    Alabama appeals court upholds death sentence for Kenneth Billups in 2003 Birmingham slaying

    MONTGOMERY (AP) -- The Alabama Court of Criminal Appeals has upheld the death sentence for Kenneth Eugene Billups in the drug-related fatal shooting of Stevon Lockett in Birmingham.

    Billups also faces the death penalty for the slayings of four men killed three days after Lockett's killing on Dec. 13, 2003.

    The appeals court also upheld Friday the capital murder conviction of Jimmy Lamar Killingsworth Jr. He was sentenced to death for the Dec. 10, 2004 shooting death of 36-year-old Steven C. Spears of Randolph.

    Spears was killed when a shotgun was fired into his car from another vehicle as he and his wife were driving home from a family gathering in Bibb County.

    In the Billups case, the criminal appeals court ruled his 2006 trial and death sentence were fair in the capital murders of Rafael Salcedo, 15; Enrique Marquez, 16; Wilbur Gomez, 20; and Manuel Perez Nunez, 27.

    On Dec. 16, 2003, Billups lured the four victims to a Center Point apartment under the guise of a drug deal. Billups shot all four when they arrived.

    In a separate trial, Billips was convicted of capital murder and sentenced to death for killing Stephon Lockett the day after Billips' 30th birthday.

    ALABAMA SUPREME COURT GRANTS NEW TRIAL TO EJI DEATH ROW CLIENT KENNETH BILLUPS


    Mr. Billups was convicted of capital murder after his jury improperly was allowed to consider the State's detailed account of his alleged involvement in a separate crime, photographs of the victims in that case, and testimony from seven witnesses about it.

    EJI argued on appeal that several errors undermined the reliability of Mr. Billups's conviction and death sentence, including that evidence about a separate offense should not have been admitted at all.

    Because evidence of a defendant's potential involvement in another crime may persuade jurors to convict based on the perception that the defendant is a bad person or a criminal rather than on the evidence in the case, the law bars the use of evidence about a separate crime except for very limited purposes. EJI argued that Mr. Billups's trial judge failed to identify the specific, limited purposes for which the jury could lawfully consider this evidence.

    The Alabama Supreme Court agreed, ruling that the trial court committed plain error when it gave the jury a "laundry list" of purposes, including ones that did not apply to Mr. Billups. The court found that the error "obvious[ly]" confused the jury and prejudiced Mr. Billups, and requires a new trial.

    What is the status of Billups case? I don't find a recent trial took place and he is still on Death Row.

    Alabama appeals court upholds death sentences for 2 Birmingham men with 9 killings between them

    Death sentences for two Birmingham multiple murderers Brandon Deon Mitchell and Kenneth Eugene Billups, who are responsible for nine murders between them, were upheld today by the Alabama Court of Criminal Appeals.

    Mitchell, 28, killed three people and aided in a fourth capital murder over Thanksgiving weekend in 2005.

    Billups, 36, killed four men on one day in 2003 and committed another capital murder -- all within days of his 30th birthday.

    The appeals court ruled also today that Mitchell got a fair trial in 2006 in a triple slaying during a robbery at the former Airport Inn.

    Evidence showed he shot to death Kim Olney, the 28-year-old desk clerk and Dorothy Smith, 58, who was about to check in to catch a flight home after visiting her son and granddaughter. A co-defendant, Roderick Byrd killed John Aylesworth, a 42-year-old Texas truck driver staying at the motel because his rig had broken down.

    Mitchell, 28, also separately pleaded guilty to capital murder and was sentenced to life without parole for killing Corey Brazzle during a robbery three days after the Airport Inn slayings.
