    Bella Vista man makes first court appearance since death penalty overturned

    BENTONVILLE -- Mauricio Alejandro Torres sat with his head bowed Friday while his lawyer, the prosecutor and judge discussed his capital murder case.

    Torres, 49, of Bella Vista made his first court appearance Friday since the Arkansas Supreme Court overturned his convictions and death sentence. Torres' second jury trial is scheduled to begin Jan. 21.

    A jury in 2016 convicted Torres of murder and first-degree battery in the death of his 6-year-old son, Maurice "Isaiah" Torres. Isaiah died March 30, 2015, at a Bella Vista medical clinic.

    Benton County Circuit Judge Brad Karren sentenced Torres to death on the jury's recommendation.

    Karren interrupted Friday's discussion to ask Torres if he felt OK.

    "I'm tired," Torres said.

    Karren told the lawyers when he saw Torres with his head down, he thought he was sleeping.

    "I'm sorry," Torres replied. "I apologize."

    A medical examiner testified in the 2016 trial Isaiah's death was caused by a bacterial infection, the result of being sodomized with a stick. The abuse with the stick occurred in Missouri, but Isaiah died in Benton County.

    The state Supreme Court overturned Torres' murder conviction April 18 in a 4-3 decision based on where elements of the crime occurred.

    Torres argued in his appeal the judge should have ruled the state failed to prove its case for the death sentence. The state Supreme Court agreed, saying prosecutors must prove an element of rape occurred in Arkansas if the rape is a required element to support the death penalty.

    The court said, because the abuse happened in Missouri, rape cannot be the aggravating factor for a death penalty.

    Nathan Smith, Benton County's prosecutor said he will amend the capital murder charges under the theory Torres knowingly killed a child. Torres also will be retried on the first-degree battery charge.

    Torres' behavior in court Friday led Karren to question whether Torres should have a mental evaluation to determine whether he is fit to stand trial.

    The judge asked Torres whether he understood what was happening in court.

    "Yes, sir," he replied.

    The judge then wanted to know whether Torres understood the roles of the judge, prosecutor and defense attorney.

    "Yes, sir," he said again.

    Karren said he was going to leave the decision on the fitness evaluation with the defense. Attoney Jeff Rosenzweig said he isn't asking for an evaluation.

    The judge ruled Torres will be held without bond in the county jail.

    An omnibus hearing is scheduled for Oct. 7.

    Mauricio Torres' wife, Cathy, pleaded guilty to capital murder in the boy's death and was given a life sentence without the possibility of parole.

    Capital murder suspect appears in court today, second trial begins January

    BENTONVILLE, Ark. (KNWA) — A man accused of raping and killing his 6-year-old son is facing a capital murder trial for the second time.

    This is this second time Mauricio Torres will face a capital murder trial.

    In 2016, Torres was found guilty of capital murder and first-degree battery after his 6-year-old son, Maurice Torres, died on a family camping trip in Missouri on March 2015.

    A forensic pathologist testified that Maurice died as a result of sexual abuse.

    Torres was convicted and sentenced to death on November 2016.

    However, his conviction was overturned in April 2019 after he argued the state did not prove its case for the death penalty.

    The state Supreme Court agreed with Torres, saying the rape had to happen in Arkansas if it supported the death penalty.

    Today is the first part of Torres’ new murder trial which is set to begin in January.

    Torres is in court today for an omnibus hearing.

    Imprisoned Bella Vista wife may testify at husband's murder trial

    BENTONVILLE -- Prosecutors may call the wife of a man accused of killing their 6-year-old son to testify at his second murder trial.

    Mauricio Alejandro Torres, 49, of Bella Vista is charged with capital murder and battery. He's accused of killing his son, Maurice "Isaiah" Torres. Prosecutors are seeking the death penalty.

    The jury trial is scheduled to begin Feb. 18. A jury convicted Torres in 2016 in the child's death, but the case was overturned on appeal.

    Cathy Torres didn't testify at the first trial. She's on the prosecution list of potential witnesses for the second trial. She pleaded guilty in March 2017 to capital murder and was sentenced to life imprisonment without parole.

    "As part of her plea agreement, Cathy Torres agreed to provide truthful testimony if needed," Benton County Prosecutor Nathan Smith said. "Pursuant to the court order, we filed a witness list including everyone we may need to call at trial so that the defendant will be on notice of all potential witnesses. The actual decision of which witnesses to call will be made closer to trial as the case unfolds."

    The witness list includes more than 100 people.

    One hundred prospective jurors are expected to be summoned for jury selection. Benton County Circuit Judge Brad Karren will conduct the initial questioning, and then lawyers will question them in groups of three.

    100 prospective jurors to get call in retrial of dad

    Death penalty sought in case

    100 prospective jurors will be called for the retrial of a man accused of torturing his son to death, a circuit judge said Friday.

    The Benton County circuit clerk's office will begin Wednesday calling prospective jurors for Mauricio Torres' 2nd capital murder trial. Torres, 50, of Bella Vista is charged with capital murder and battery in connection with the death of his 6-year-old son Maurice Isaiah Torres.

    Prosecutors are seeking the death penalty.

    Jury selection is scheduled to begin Feb. 18. The 100 individuals will be told to report at noon Feb. 18 to Bentonville District Court for initial questioning by Benton County Circuit Judge Brad Karren, Karren said Friday. His courtroom is too small to hold that many people.

    Prospective jurors will be questioned in groups of 3 by the attorneys. There will be 4 groups interviewed each day. 12 jurors and 3 alternates will be selected.

    Jury selection is expected to take a few days, and the trial may last one to two weeks.

    "We believe it's important he's allowed to do it each day," Rosenzweig said.

    Karren granted the request.

    Lt. Shannon Jenkins, the spokeswoman for the Benton County sheriff's office, said inmates are allowed to shower daily.

    The same witnesses are expected to testify during the trial who were called in his first trial with the exception of Cathy Torres. She's the boy's mother.

    Doctor testifies dead boy suffered from ongoing abuse

    BENTONVILLE -- The emergency room doctor who tried to save a 6-year-old boy's life described the bruises and wounds on the child's body.

    Dr. Franklin Mayhue, who worked at Mercy Bella Vista Medical Center, treated Maurice Isaiah Torres on March 29, 2015, in the emergency room. He pronounced the boy dead after attempts to save him failed.

    Mayhue testified Friday morning at Mauricio Alejandro Torres' capital murder trial.

    Mayhue testified that Isaiah arrived at the emergency room in cardiac arrest. Mayhue described the situation as bizarre because Isaiah appeared to be suffering from ongoing abuse. "He had wounds all over his body," Mayhue said. "This was an extreme picture of a child who was not only dead, but dead from a bizarre situation."

    Torres, 50, is charged with capital murder and battery in connection with the death of his son. Prosecutors are seeking the death penalty. It is Torres' second trial. The Arkansas Supreme Court last year overturned his convictions on the same charges.

    Mayhue pointed out other wounds on the boy's face and said they suggested neglect and physical abuse. Mayhue said there were wounds all over Isaiah's body.

    Cearley questioned Mayhue about telling Mauricio Torres and his wife, Cathy, that their son was dead. Mayhue said it's never easy to tell a person that a loved one is dead, but he had never observed a couple respond to the news as they did.

    Mayhue said there was no reaction from the couple.

    "There was an absence of a normal grieving response from parents that lost a child," he said.

    The trial continues this afternoon.

    BENTONVILLE -- Mauricio Alejandro Torres described his 6-year-old son's beatings as a family affair when police interviewed him in 2015 after the boy died.

    Torres, 50, of Bella Vista described the punishments in a April 6, 2015, interview with Bella Vista Police Capt. Tim Cook.

    Torres is charged with capital murder and battery in connection with the death of his son. Prosecutors are seeking the death penalty.

    It's Torres' second trial. He was previously convicted of the same charges, but last year the Arkansas Supreme Court overturned the convictions and ordered a new trial.

    Torres downplayed his role in his son's abuse and placed the blame on his wife, Cathy Torres. He was only guilty by association, he told Cook. He claimed his wife never connected emotionally to their son.

    Cathy Torres didn't testify at her husband's first trial, but is on the prosecution list of potential witnesses for the second trial. She pleaded guilty in March 2017 to capital murder and was sentenced to life imprisonment without parole.

    Torres said he spanked Isaiah and once hit him with an extension cord, but his wife also hit the boy with a belt, he said. His wife would have one of their daughters hit Isaiah, he said.

    Cook told Torres his son's death was the result of being raped with an object.

    "Who raped Isaiah?" Cook asked.

    "Not me," Torres said.

    He said his son had a horrible death, but he didn't kill him.

    "Who did it then?" Cook asked.

    Torres said he didn't rape his son and didn't believe his wife committed the act.

    Isaiah's death was the result of an accident, Torres claimed in the second interview with Cook.

    "How was it an accident, Maurice?" Cook asked in the April 7, 2015, interview at the Benton County Sheriff's Office.

    "It was an accident," Torres said. "I can't betray her."

    Torres said he was worried he would be treated harsher than his wife.

    He told Cook the incident happened near the door of their camper in Missouri.

    "Please, Maurice," Cook said as he asked Torres to tell him what object was used to rape Isaiah.

    Torres said he couldn't betray his wife. He repeated his claim Isaiah's death was the result of an accident. He and his wife were both guilty of the mistake, he said.

    Birc Morledge, one of the attorneys for Torres, asked Mayhue if his client could have already been aware that his son was dead since he attempted CPR and it took a while to get him to the hospital.

    Mayhue said he didn't know, but maintained the couple's reaction to the death was unusual.

    The trial will resume Monday morning in Judge Brad Karren's courtroom.

    At murder trial, girl testifies of brother's abuse by parents

    BENTONVILLE -- A jury on Monday heard a 12-year-old girl describe the abuse her younger brother endured at the hands of their parents.

    The seventh grader testified Monday afternoon at her father's murder trial.

    Mauricio Alejandro Torres, 50, of Bella Vista is charged with capital murder and battery. Prosecutors are seeking the death penalty.

    It's Torres' second trial. He was previously convicted of the same charges, but last year the Arkansas Supreme Court overturned the convictions and ordered a new trial.

    Six-year-old Maurice Isaiah Torres died March 30, 2015, at a Bella Vista medical clinic. A medical examiner testified in the 2016 trial that the boy's death was caused by a bacterial infection resulting from sodomy.

    Torres started crying when his daughter walked into the courtroom, but he remained silent as she testified.

    Stuart Cearley, chief deputy prosecutor, asked the girl how she wanted to refer to her parents, Mauricio and Cathy Torres.

    She wanted to refer to them as "bio dad" and "bio mom."

    The girl said her biological parents treated Isaiah differently from her and Isaiah's twin sister.

    She, her sister and her parents would eat cooked meals or restaurant food while Isaiah had to eat rice and beans, the girl said. They sometimes gave him peanut butter, she said.

    She testified that Isaiah had to sleep in a dog cage, and for one month he had to stay in a large trash can.

    The girl said she sometimes had to act as a guard to keep her brother from escaping to get food.

    She testified that her parents beat Isaiah with cables, shoes and sticks. Her parents also made her beat Isaiah with a stick, the girl said. "I did it because I was afraid because I might get beat if I didn't do it," she said.

    The girl told jurors that she witnessed her father putting a stick between her brother's legs. She also said her father would punish the boy by pulling out his teeth with pliers.

    She told jurors that she remembers her mother pouring bleach on Isaiah while Mauricio Torres was scrubbing him, adding that the boy had to go to the hospital.

    "[Isaiah] was happy because he got to eat real food, watch TV and sleep in a real bed," the girl said.

    Bill James, one of Mauricio Torres' attorneys, asked the girl if she testified at the last trial that Cathy Torres was the one who poured bleach on Isaiah and if she didn't mention her father in the bleach story.

    The girl said she remembers her father scrubbing Isaiah.

    "I know it's true because I remember seeing it," she said.

    She testified that even though Isaiah and her sister are twins, they did not celebrate Isaiah's birthday.

    "He wasn't given any present or birthday cake?" Cearley asked. "No," she answered.

    She testified that she and her sister got Christmas gifts and stockings with gifts, but Isaiah's stocking had coal in it.

    James questioned the girl about other things that she did not mention in earlier interviews and testimony.

    The girl said her parents were crying when the doctor told them that Isaiah had died. She told James that she thought Isaiah had died of a stomachache.

    The jury also spent time Monday watching video of Mauricio Torres' confession to sodomizing his son with a stick to punish him.

    Torres told Bella Vista police Capt. Tim Cook in an April 7, 2015, interview that he twice placed a stick in his son's rectum and made him stand in the corner and do squats.

    Torres said he punished his son for eating cake while the family was on a camping trip in Missouri. Torres said in the interview that his son was doing the squats and that his wife forced the boy down on the stick, which resulted in the injuries that led to Isaiah's death.

    Dr. Stephen Erickson, assistant medical examiner, testified that the boy's death was the result of an infection as a result of sodomy. He said child abuse was a contributing factor to the child's death.

    "This child died as result of chronic child abuse," Erickson said.

    The jury viewed photographs of Isaiah's body as Erickson pointed out the injuries.

    Erickson said Isaiah's nose had been broken and that several of his teeth had either been knocked or pulled out.

    Erickson said he could not tell how many wounds were on Isaiah's head because of the numerous new and old injuries.

    Prosecutors rested their case after Erickson's testimony.

    The defense will begin to make its case this morning.

    BENTONVILLE -- Seven men and five women are deliberating whether Mauricio Alejandro Torres is guilty of beating and murdering his 6-year-old son.

    The jury began deliberations Wednesday morning after hearing closing statements from the attorneys.

    BENTON COUNTY, ARKANSAS, Ark. — Mauricio Torres, a Bella Vista man, previously convicted for the rape and murder of his 6-year-old son in 2015, has been found guilty of Capital Murder and First Degree Battery during a retrial. He could face the death penalty.

    The judge dismissed the jury and Torres will be sentenced Thursday (March 5) morning at 8:30 a.m.
