    Bella Vista couple arrested in connection with boy's death

    BELLA VISTA -- Police arrested a couple Monday on charges they raped and killed their 6-year-old son.

    Cathy Lynn Torres, 43, called police at 11:33 p.m. March 29 and said she found her son, Maurice, unconscious and not breathing, adding he had brown liquid coming from his nose, according to police dispatch logs. Other than complaining of a stomach ache earlier in the evening, Torres said the boy had been asleep and snoring before she found him, the log shows.

    The boy was taken by ambulance to Mercy Medical Clinic in Bella Vista, where he was pronounced dead. An autopsy at the Arkansas Medical Examiner's Office ruled the death a homicide, according to a news release Monday from Police Chief Ken Farmer.

    Bella Vista police said the boy died from internal injuries caused by rape, according to court documents filed Friday in connection with Cathy Torres' petition for an order of protection from her husband.

    Mauricio Alejandro Torres, 45, and Cathy Torres were arrested Monday on charges of capital murder, a Class Y felony; rape, a Class Y felony; and first-degree battery, a Class B felony, according to the Bella Vista Police Department.

    They also have two daughters. The girls, ages 6 and 7, are in custody of the Arkansas Department of Human Services.

    In her petition for the order, Cathy Torres claims their son died due to abuse from her husband.

    Cathy Torres believes her husband "is the only man who had access to their son for an extended period of time on the days leading up to his death," according to a summary prepared for the petition. The children are homeschooled, and the family went camping the weekend before Maurice's death, according to the summary.

    Cathy Torres claims in the documents she was scared to talk with police and answer questions because her husband has threatened to kill her, and he once told her he would bury her in the backyard. He also had put his finger to her head like a gun, according to the court documents seeking the protection order.

    She was granted a temporary order of protection until April 23.

    The Torreses live at 9 Cresswell Circle in the last of five houses on the street. A swing set and bench sat in the front yard Monday, and statues of baby angels adorned the walkway to the front door.

    The Torreses are set to appear in Circuit Judge Brad Karren's courtroom this morning for a probable cause and bond hearing.

    Karren is scheduled to preside next month over another murder case involving a 6 year old. Zachary Holly, 30, is accused of the Nov. 20, 2012, murder of 6-year-old Jersey Bridgeman in Bentonville. Holly is charged with capital murder, rape, kidnapping and residential burglary.

    He previously pleaded not guilty to the charges and is being held without bond in the Benton County Jail. Prosecutors will seek the death penalty.

    Jury selection for Holly is set to begin May 8.

    Prosecutor Seeks Death Penalty Against Couple In Son’s Death

    The Benton County prosecutor is seeking the death penalty against Cathy and Mauricio Torres, who pleaded not guilty to capital murder and first-degree battery charges Monday (May 4) in the death of their six-year-old son, Isaiah.

    The Bella Vista couple was arraigned in Benton County Circuit Court on Monday morning (May 4). They are being held without bond in the Benton County Jail with their next court appearance June 1. Both are charged with capital murder and 1st degree battery.

    Mauricio Torres’ jury trial is set to begin Jan. 12, 2016. The jury trial for Cathy Torres is to begin Jan. 26, 2016. Both are due in court for a pre-trial hearing on June 1.

    JONESBORO, AR (KNWA) - New information has been uncovered involving a Bella Vista man accused in the rape and murder of his 6-year-old son.

    According to documents from Jonesboro Police, Mauricio Alejandro Torres, 45, was investigated twice back in 2004 in the alleged rape and assault of a child.

    The Arkansas Department of Human Services (DHS) was involved with those Jonesboro investigations.The state agency also launched two investigations last year into abuse claims against Torres. DHS was involved with four total investigations concerning Torres, who is facing capital murder and rape charges for the death of Isaiah Torres. His wife, Cathy Lynn Torres, 43, faces the same charges.

    The documents from Jonesboro Police reveal investigations surrounding Torres, dating back to over a decade ago. In March 2004, a woman reported her 4-year-old niece said Torres hurt her and touched her.

    Jonesboro officers did several interviews with the girl, and say she did not say anything about Torres harming her. Police say because there was not any physical evidence, the case was closed.

    Four months later, in July 2004, Jonesboro Police opened another investigation involving Torres. Again, Torres was accused of raping and assaulting a 4-year-old girl.

    According to Family Protection Unit Investigator, Ashley Reid, the 4-year-old said Torres put his hands down her pants and told her not to tell anyone about it. The girl told investigator Reid it happened all the time.

    In October of 2004, the case was sent to the Prosecutor's office for review. No charges were ever filed against Torres.

    As we continue our coverage of this story, we have asked DHS why no action was taken against Torres, after four investigations were conducted.

    We also want to know if any of the agency's policies or procedures are being re-evaluated or changed, following Isaiah Torres' death.

    Pending attorney approval, DHS will not comment.

    Police inquiry substantiates boy, 6, abused

    Record says child suffered extreme, repeated cruelty

    Arkansas State Police child abuse investigators substantiated 10 different allegations of abuse or neglect of a 6-year-old Bella Vista boy whose parents are accused in his death, a document released Wednesday shows.

    The state police Crimes Against Children Division found that the boy, Maurice Isaiah Torres, was subjected to sexual abuse, "abuse with a deadly weapon," "extreme or repeated cruelty" and "internal injuries" that led to his death on March 30.

    The findings were included in a summary released by the Arkansas Department of Human Services under the public disclosure provisions of the state Child Maltreatment Act. The summary doesn't name the offender or offenders, noting that such information can't be disclosed because "due process has not been satisfied."

    The release of the information comes as the boy's parents, Mauricio Alejandro Torres, 45, and Cathy Lynn Torres, 43, face capital-murder and first-degree battery charges in Benton County Circuit Court. Prosecutors have said they will seek the death penalty in the case. Both parents, who remain jailed pending trial, have pleaded innocent.

    The state medical examiner's office determined that the boy, who went by the name Isaiah, died as the result of internal injuries he suffered from being raped within 24 hours of his death.

    An autopsy also revealed multiple "healed, healing and acute" blunt force trauma injuries to Isaiah's head, trunk and extremities that indicated the boy had suffered from a pattern of repeated physical abuse.

    Both Torreses have been accused of repeatedly beating Isaiah "over an extended period of time" and being involved in the injuries that resulted in his death.

    Neither have been charged with rape in Arkansas because prosecutors have said they believe the purported rape occurred in Missouri. As of Wednesday afternoon, no charges had been filed in Missouri courts against either Torres, according to the state's computerized court records system.

    According to Benton County court documents, Cathy Torres has said she saw Mauricio Torres beat Isaiah with an electrical cord, a belt and at times his knuckles. She said some of Mauricio Torres' blows drew blood. Cathy Torres has denied knowing anything about Isaiah's injuries that indicate he was raped.

    The latest document released by the Human Services Department shows that civilian investigators with the state police found substantiating evidence of Isaiah being subjected to sexual penetration and sexual contact.

    The investigation, closed June 4, also found that the boy was subjected to burns or scalding and physical abuse, including cuts, bruises, welts, internal injuries and blows to his face or head. Investigators substantiated additional allegations that the boy had been subjected to "extreme or repeated cruelty" and that at least one caretaker had failed to protect him, the document shows.

    Reached by phone Wednesday, public defender Gina Reynolds, who is part of a team of attorneys representing Mauricio Torres, said she couldn't comment on the maltreatment finding.

    Tony Pirani, who is part of a team of attorneys representing Cathy Torres in her criminal case, referred questions to attorney Dee Scritchfield. A message left for Scritchfield wasn't returned by Wednesday evening.

    Under Arkansas Code Annotated 12-18-1102, the Human Services Department is required to release to the public upon request certain information about child maltreatment investigations involving fatalities or near fatalities.

    The document released Wednesday to the Arkansas Democrat-Gazette contained information required to be made available once a fatality investigation is determined to be "true."

    The civil finding -- based on a lower threshold of evidence than a criminal case -- usually results in offenders' names being placed in the Child Maltreatment Central Registry unless they successfully appeal. Placement in the registry can bar a person from holding certain jobs and have an impact on child custody decisions.

    On Wednesday, Human Services Department spokesman Amy Webb said she couldn't confirm whether an appeal had been filed.

    The latest child maltreatment investigation was at least the third involving Isaiah in the past two years.

    Allegations of inadequate supervision made on Jan. 22, 2014, were found to be unsubstantiated. An allegation made about two months later that the boy had signs of cuts, bruises or welts was also ruled unsubstantiated, Human Services Department documents show.

    The previous maltreatment investigations involving Isaiah and a past termination of the Torreses' parental rights involving other children were first reported by the Arkansas Times in April.

    As a result of Isaiah's death, Human Services Department documents show that the boy's siblings have been placed in foster care.

    BENTONVILLE -- It is expected to take 45 to 60 days before prosecutors can begin to receive information from evidence that was sent to the state Crime Laboratory in the investigation into the death of a 6-year-old boy.

    The boy's parents, Mauricio Alejandro Torres, 45, and Cathy Torres, 44, of Bella Vista, are charged with capital murder and first-degree battery. They previously pleaded innocent to the charges and are being held without bail in the Benton County jail.

    Prosecutors will seek the death penalty against the two.

    Cathy Torres appeared in court Monday morning for a hearing that was reset to 1:30 p.m. Oct. 5.

    Nathan Smith, Benton County prosecuting attorney, said evidence had been collected and sent to the crime laboratory in Little Rock.

    "We basically sent the entire house to the crime lab," Smith said.

    It could take up to 60 days before prosecutors get information back from the crime laboratory, Smith said.

    Smith does not believe that there will be any issues from that evidence to file any motions.

    Tony Pirani, one of the attorneys for Cathy Torres, said one issue will be possible evidence that prosecutors may attempt to use against her. Pirani said a separate hearing will be needed to hear any of those issues, which would include any evidence of prior or similar bad acts.

    One pending motion concerned a gag order to prevent the Benton County prosecuting attorney's office and the Arkansas Department of Human Services from releasing any information on the case.

    Prosecutors and a DHS attorney filed responses objecting to a judge issuing the gag order.

    Attorneys for Mauricio Torres also have filed a motion seeking the gag order. A hearing is set for 2 p.m. July 31.

    The Torreses also were arrested on rape charges, but prosecutors didn't include that offense in their charging documents. The rape occurred in Missouri, not in Benton County, Smith said previously.

    The couple will be tried separately.

    Karren asked Chambers to file a written motion for the court. He then set the next hearing for 1:30 p.m. Nov. 16.

    Cathy Torres' jury trial is scheduled to begin Jan. 26.

    They each could be sentenced to life imprisonment without parole or the death penalty if convicted of capital murder. The battery charge is punishable with a prison sentence ranging from five to 20 years.

    Death penalty remains on table in mother's trial

    BENTONVILLE -- A local circuit judge denied several motions in the case of a Bella Vista woman accused of killing her 6-year-old son.

    Judge Brad Karren presided over a hearing Monday concerning motions that had been filed in Cathy Torres' case.

    Cathy Torres, 43, and Mauricio Alejandro Torres, 45, are charged with capital murder and first-degree battery, a Class B felony. They have pleaded innocent to the charges. The Torreses are being held without bail in the Benton County jail.

    Their son, Maurice Isaiah Torres, 6, was taken to a hospital where he was pronounced dead March 29. A medical examiner later determined the boy suffered from chronic child abuse, and his death was from internal injuries caused by being raped, according to court documents.

    Prosecutors will seek the death penalty for Mauricio Torres and Cathy Torres.

    Many of the motions dealt with Monday involved seeking to have the death penalty declared unconstitutional. Such motions routinely are filed in death-penalty cases. Karren denied each one.

    Karren did grant a defense motion to prohibit displays of emotion at trial.

    Tony Pirani, one of the attorneys for Cathy Torres, described the case as emotional. Pirani said there may be spectators who could cause an outburst. An outburst in front of a jury could be detrimental to his client and affect whether she would receive a fair trial, Pirani said.

    "If it happens, the court will act quickly," Karren said of any potential outbursts.

    Karren scheduled another hearing on more motions for 2:30 p.m. Oct. 28.

    Prosecutors will try Mauricio Torres first. His jury trial is set to begin Jan. 12. A pretrial hearing will be Jan. 11. Cathy Torres' jury trial is scheduled to begin Jan. 26. A pretrial hearing is set for Jan. 25.

    BENTONVILLE -- A conflict led to new attorneys being appointed for a Bella Vista man accused of killing his 6-year-old son.

    Three attorneys from the Arkansas Public Defender Commission were appointed to represent him after his arrest. Teri Chambers, one of the attorneys, told Circuit Judge Brad Karren that there is a conflict that prevents them from continuing to represent Torres.

    Chambers did not feel comfortable disclosing the reason in open court. Chambers did say if they remained on the case it would cause irreparable harm to Torres.

    Nathan Smith, Benton County prosecuting attorney, did not object to the change.

    Karren was reluctant to let the three off the case, saying the switch would cause a delay in the trial.

    Smith intends to try Mauricio Torres first. His jury trial is set to begin Jan. 12. A pre-trial hearing will be Jan. 11.

    Bill James and Jeff Rosenzweig now represent Mauricio Torres. They were not in court Wednesday. Karren asked Torres if he objected to the attorney change and Torres said no.

    BENTONVILLE — A January jury trial will not take place for the Bella Vista man accused of killing his 6-year-old son.

    Mauricio Alejandro Torres’ jury trial was scheduled to begin Jan. 12. The trial was rescheduled due to the appointment of two new attorneys to represent Mauricio Torres. Jeff Rosenzweig and Bill James replaced attorneys for the Arkansas Public Defenders Commission who had represented Mauricio Torres.
