Charges upgraded for suspect in Renee Eldridge's murder

Stacey Demar Gray, who was arrested in connection to Renee Eldridge's death, now faces capital murder charges for kidnapping and rape connected to the case.

Gray only was charged with murder on July 14, but authorities upgraded the charges Wednesday. Valley Police Chief Tommy Weldon said he couldn't release many details concerning the upgraded charges.

"We haven't received all of our forensic reports yet," Gray said. "But based on the evidence we already had, we feel those were the appropriate charges."

Weldon said Gray is now eligible for the death penalty, but the Chamber County District Attorney's Office declined to comment on whether or not they plan to push for it in this particular case.

"Everybody is innocent until they're proven guilty, but similar type cases are the ones we have normally tried to seek the death penalty on in the past," Chief Assistant District Attorney Damon Lewis said.

Police confirmed that the kidnapping charge was issued because they believe Gray abducted the 25-year-old woman from Columbus.

Renee Eldridge's family reported her missing from her 46th Street home on the weekend of July 4. Ricky Eldridge, the victim's father, said the last time he saw his daughter alive was when her friends dropped her off at her residence around 3 a.m. July 4.

The father said that it was around 10:30 a.m. the following morning when Renee's mother Nancy Gray discovered she was gone and that her room was in disarray.

The victim's body was found in Osanippa Creek off of Hopewell Road on July 7. She was pronounced dead of blunt force trauma to the head, according to authorities.

Valley Police Maj. Mike Reynolds said two separate witnesses came forward on the morning of July 7, and told police that at two different times during the weekend of July 4 they saw a black male in a dark SUV parked at the bridge where Eldridge was found. One witness said the man was leaning over the bridge looking at the water, Reynolds added.

Authorities said they learned that Gray owned a dark SUV with the same partial tag number given by witnesses. Investigators said they also discovered evidence "in plain view within the vehicle," though they have not said what that evidence is.

Police said they interviewed Gray and were able to disprove much of his alibi, allowing them to execute search warrants for his vehicle and Russell County address. Evidence found at his address led to the warrant for his arrest, according to the release.

When police received a tip that Gray and his brother were in a vehicle in the Notasulga area, they attempted to stop the vehicle on July 13, according to the report.

Police said Gray, a passenger in the vehicle, fled into the woods. His brother, whose name has not been released, stayed in the vehicle and was arrested for possession of a firearm by a felon after 10 weapons were found in the vehicle, according to the release.

Gray was found by local residents in a yard on Lily Lane in Notasulga and held at gunpoint until police took him into custody July 14 at 12:45 a.m. ET.

Questions arise if accused killer attacked victim months before murder

COLUMBUS, GA (WTVM) - More charges face the man accused of killing Columbus woman, Renee Eldridge, in July.

Columbus officials say they have served new warrants this week on Stacey Gray for a separate case of false imprisonment and rape.

Gray's charges in Alabama have been upgraded to include capitol rape, however his victim Renee Eldridge was also a victim of another attack last December in Columbus.

At the moment Columbus Police won't confirm if Gray's DNA was linked to that heinous assault on Eldridge months before her murder. However, some people are questioning if it turns out it was Gray's DNA, could he have been arrested sooner, and Eldridge still be alive?

"I think that there should be an investigation into whether or not Columbus Police Department submitted the unknown profile, DNA profile that they had on March 5 to the FBI," said attorney Kyle Fischer.

Fischer has questions for investigators who were initially focused on another man, his client, a Fort Benning Soldier, as the suspect in the 2014 attack on Eldridge.

Fischer claims his client was falsely imprisoned for 10 weeks before DNA evidence cleared him, although he was still officially listed as a suspect up until this week.

The soldier is now planning on suing the city of Columbus for his ordeal that was magnified by community concerns when Eldridge went missing July 4th.

"I truly believe his life was in danger," said Fischer, "He was called in to make a statement when she disappeared, there were a lot of people on social media who were putting about his name, private messaging his name, saying that he was a rapist, saying what kind of car that he drove."

Fischer explains that DNA from convicted felons are listed in national databases. Stacey Gray is a convicted felon after serving time in Ohio for assaulting two police officers.

Again there is a fresh warrant for Stacey Gray in Columbus for false imprisonment and rape however police will not, at this time, disclose the name of the alleged victim of that rape.

Our sources in law enforcement tell us that the results of DNA testing from that 2014 attack can only be revealed in the course of a trial. Police remind us that they do not release the name of rape victims, and neither does News Leader 9 as a matter of policy.

However, in a case where the victim is deceased and a previous rape could play a major role in the prosecution of the capitol murder case, those kinds of details would come to light at a later time.

UPDATE: Eldridge murder suspect convicted of shooting two Ohio Police Officers in 1994

COLUMBUS, GA (WTVM) - We have new information on what appears to be an extensive criminal history for murder suspect Stacey Gray, who has been charged with the murder of 25-year-old Renee Eldridge.

According to the Mahoning County Clerk's office in Ohio, Gray was charged with felonious assault of two Youngstown Police Officers, David Vukovich and John Payne.

A jury found Gray guilty of causing both police officers physical harm with a deadly weapon, a gun. Both officers were not seriously hurt and survived the assault.

Gray was convicted by a jury and entered the Ohio prison system in January 1994. He spent nine years in prison before he was paroled in February 2003. He was released from his parole restrictions in 2004.

We have reached out to the Youngstown Police Chief to see if he can remember any more details about the case.

In Muscogee County, Gray has plead guilty to misdemeanor cruelty to children, simple battery and driving with a suspended license. He was also cited for driving without a license and ordered to pay child support.

The Valley Police Department says Gray was named a suspect early in their investigation. Police say Gray was a friend of Renee's mother and knew Renee as well.

On the morning of July 7, when Renee Eldridge's body was found, two separate witnesses came forward and gave information.

The witnesses stated that at two different times during the Fourth of July weekend, they saw a black male in a dark SUV parked at the bridge where Eldridge was found.

Chilling new details in the murder of Eldridge were revealed in the arrest warrant and deposition:

"On July 7, 2015 officers of the Valley Police department found the body of a white female, later identified as Nancy Renee Eldridge, in the Osanippa creek at the 1300 block of Hopewell Road Valley, Chambers County, AL.

Eldridge had been reported missing on July 4, 2015 from her residence in Columbus, Ga. An autopsy performed by the department of forensic science medical examiner's office ruled her death a homicide caused by blunt force trauma."

Court records list some evidence police used to link Gray to the murder:

During the course of the investigation Stacey Demar Gray, alias was developed as a suspect based on the following evidence:

A vehicle matching Gray's was seen at the scene of the crime by a resident of Valley, AL. on July 4, 2015.

A search of his vehicle revealed blood evidence inside.

Surveillance video obtained near 46th Street Columbus, Ga. showed the suspect's vehicle near the victim's residence after she was last seen by friends.

A search of Gray's cellular phone records contradict his statement of his whereabouts during the time in question.

A search of Gray's residence revealed a burn barrel that was used to burn the victim's clothes. A piece of the victim's purse was discovered unburnt and was identified by family members as belonging to the victim. Brown hair, which was the hair color of the victim was discovered at the residence.

Police tell News Leader 9 that one of the witnesses stated the male was leaning over the bridge looking at the water below and was able to give police a partial tag number of the SUV. When investigators began talking to Renee's family and friends in Columbus, they found Gray owned a dark SUV that had the same partial tag number given by witnesses. Investigators also discovered evidence in plain view within the vehicle. Gray was interviewed at that time and he denied any involvement in Eldridge's disappearance or murder.

Based on his statements, investigators were able to disprove much of his story and executed search warrants for his vehicle and for a residence that he had in Russell County.

Evidence found at the Russell County residence led investigators to issue a warrant for the arrest of Gray for murder on Friday, July 10.

That same day, a request for assistance from the U.S. Marshall's Fugitive Recovery Unit was made in order to track and arrest Gray. On July 13, information was received that Gray and his brother were in a vehicle in the Notasulga, Ala. area.

Notasulga's police chief attempted to arrest him at a traffic stop on County Road 52 in Macon County near Notasulga on Monday, July 13.

Gray ran into the woods while his brother, Willie, who was driving the car, was arrested for felon in possession of a firearm after law enforcement officials say 10 weapons were found in the SUV he was driving.

A massive manhunt ensued, with dozens of law enforcement agencies, a helicopter and tracking K9 units flooding the Notasulga community to assist.

Gray was captured late Monday night on July 13 in Macon County following a 10-hour manhunt. The search ended when Macon County residents held the man at gunpoint until police arrived.

Police say a 9 millimeter Beretta was tucked into Gray's waistband when he was arrested by police.

During the detainment of Gray, he was asked by News Leader 9's Elizabeth White if he killed Eldridge.

"No," Gray said. "No ma'am, I did not." When asked if he had anything to say to the Eldridge family, Gray said, "I didn't kill her."

Police have not recovered a weapon and suggest Gray may have allegedly used his hands to beat Eldridge to death. Gray is currently being detained in the Chambers County Detention Facility on no bond.

So far investigators have not revealed a motive in the murder, and they can't say if Eldridge was sexually assaulted prior to her death by blunt force trauma to the head.

If investigators do find evidence she was allegedly sexually assaulted during her murder, the murder charge could be upgraded to capital murder.

This is a developing story. Stay tuned for more details.

To bad this lowlife wasn't jailed for life for shooting two cops, then he wouldn't have been able to rape and murder Renee Eldridge.

DNA evidence ties Renee Eldridge's murder suspect to her 2014 rape, police say

Evidence shows the man accused of killing Renee Eldridge of Columbus, Ga. in July also raped her in December 2014, according to court testimony.

DNA collected from murder suspect Stacey Gray matches that collected from Eldridge following her rape, the Ledger-Enquirer reported. Eldridge had accused another man of sexually assaulting her; the charges against that man were dropped.

Gray is charged with capital murder, kidnapping and capital murder rape in Eldridge's death. He is now charged with binding her hands and feet and raping her last year.

Eldridge's body was found on July 7 in Osanippa Creek in Valley near the Alabama-Georgia border two days after her family reported her missing. Her hands and ankles were bound with green rope and tied to a cement block.

Authorities believe Eldridge died from blunt force trauma to the head.

According to the report, Gray was known to Eldridge. He had an on-and-off again sexual relationship with her mother.

Soldier accused in previous attack of murdered Columbus woman fights to clear name

    By Emilie Arroyo
    WTVM News

COLUMBUS, GA (WTVM) - Last July, a young Columbus woman went missing. Nancy Eldridge, known to many as Renee, was found murdered less than a week after her troubling disappearance.

WTVM investigations found Eldridge had been assaulted months before, and police had arrested an Army soldier for the attack.

Turns out they had the wrong man.

For most, July 4th celebrates life and liberty; for Renee Eldridge's family, the day is stained with sorrow and loss. It was the last day they saw Renee Eldridge alive.

"There was clearly a struggle in her room, her keys, her cell phone, everything was left here, she's the only thing missing," said family members when Eldridge went missing.

Her mysterious disappearance sent loved ones and investigators into an urgent search for answers. Fear prompted some to zero in on a Fort Benning Sergeant First Class, who we are calling Joe to protect his identity.

"They were after me," said Joe.

Joe had been charged with raping Eldrige in December 2014, months before her disappearance.

"I didn't think I'd be the one going to jail for something I didn't do," said Joe.

Eldridge's body was found on July 7, 2015 in Valley's Osanippa Cree. She was naked and bound, tied to a cement block.

After a massive manhunt Stacey Gray, a close friend of Eldridge and her mom, was arrested on July 14 for the gruesome crime.

Gray denied killing the young woman but investigators say blood evidence, witness testimony, and a piece of Eldridge's purse found inside a burn barrel on his property were incriminating. Gray was charged with murder.

Later in July, Alabama prosecutors upgraded that to capital murder and rape, around the same time Georgia officials issued a warrant for Gray, and just as Joe was cleared as a suspect in the December rape of Eldridge.

"I feel like the person that raped her back in December was the same person that came back, and to me I thought that if that person came back a second time, I think this time she probably realized and probably put up a fight and that's what cost her her life," said Joe.

Months before the murder, Eldridge would file a rape report and investigators would collect DNA evidence. So how was it Joe, a distinguished, combat veteran with more than a decade of service to the Army end up blamed?

"I think for the first time in Columbus I actually met a really cool person, I just wanted to hang out again," said Joe.

Joe and Eldridge dated before the December assault. Eager to see her again, Joe says these are the text messages the two exchanged the night of the rape.

"Hey, well I still wanted to see you, can I come over?" said Joe.

"I might be a little bit drunk and my room's a mess," Joe said when describing Eldidge's response.

"I texted her I could be over there in 10 minutes if you want me to, and she never responded to me. I tried calling her a few times and after that I was like she probably went to bed."

The late night exchange was enough for investigators, and Joe was arrested.

"We have enough probable cause, I was like what kind of probable cause? She was like well according to the victim and the text message, that's more than enough probable cause," said Joe when describing the night investigators took him into custody.

Attorney Kyle Fischer says he asked officials to pull his client's cell phone records to pin his location, as well as camera footage of his client's neighborhood. All were allegedly dismissed.

"Her room had black out curtains, meaning that the room was pitch black, there was no light, she couldn't see who was actually doing this to her," said Fischer, "There are so many parts of this case where the investigation fell apart and allowed a rapist to walk the streets of Columbus, and that ought to concern the citizens of Columbus."

Joe sat in jail for 10 weeks, two of which were after this DNA result from the Georgia Bureau of investigations came back stating "The DNA obtained could not have been contributed by" Joe.

Joe was finally released after the DNA results made their way to the District Attorney's office where officials worked to release Joe immediately.

"Finance wise, I pretty much exhausted my entire bank account keeping my mortgage and car and everything afloat while I was not getting paid. Career wise, I actually had the plans to try and go to flight school," said Joe.

We have worked diligently to find out on the record whose DNA matched Eldridge's rape kit, if it was indeed Stacey Gray who is in custody for her murder.

Gray has previous felony charges, which means his DNA should be logged in an FBI database and should have been available to investigators before Eldridge's murder if a search was conducted during the time of her rape.

Columbus Police will not confirm on the record if they believe Gray raped Eldridge in December, saying it's an open investigation they won't discuss.

"To say that they system failed my client in this case is an understatement. and here's the troubling part, it failed Renee. It failed her," said Fischer.

We reached out the the open records department with the District Attorney for probable cause information on Stacey Gray's arrest warrant. They had no information for us, and directed us back to Columbus Police.

Officials from the Georgia Bureau of Investigation said they had no shareable information and also directed us back to Columbus Police. Regional and national officials with the Federal Bureau Investigation said the same story.

Perhaps more information will be forcibly revealed to the public when Gray stands trial.
