    Tunisia approves death penalty for terrorists

    Tunisia's parliament has overwhelmingly approved legislation allowing the death penalty for those convicted on terrorism charges after Islamist militant attacks that killed dozens of foreign visitors in the past few months

    Last month, a gunman killed 38 mostly British tourists in the Tunisian seaside city of Sousse. In March, two gunmen killed 21 foreign tourists and a policeman at Tunis's Bardo Museum. Both attacks were claimed by the Islamic State jihadist group.

    MPs approved the bill by a margin of 174-0 with 10 abstentions early on Saturday after three days of debate in what parliament speaker Mohamed Ennaceur called an "extraordinary effort" to make the North African country a safer place.

    Human Rights Watch had criticized the bill, which also eases arrests of suspects, saying it "would open the way to prosecuting political dissent as terrorism, give judges overly broad powers, and curtail lawyers' ability to provide an effective defense".

    The bill, which had been debated in parliament for years but put forward after the Sousse attack, will replace a law from 2003 which then-president Zine al-Abidine Ben Ali, toppled in a popular uprising in 2011, had used to crush dissent.

    The new "law against terrorism and money laundering" permits the death penalty for terrorism-related offences such as killings of foreign visitors or someone enjoying "international protection", a reference to diplomats.

    Tunisia has undergone a largely peaceful transition to democracy since its 2011 popular uprising. But its army has been fighting a rise in Islamist militancy.

    Tunisia is especially concerned about militants entering from adjacent Libya, where Islamic State has established a toehold amid chaos caused by two rival governments battling for control, leaving a security vacuum.

    Tunisia says it has started building a wall and trench along the insecure 168 km (105 miles) of its frontier with Libya. The Sousse gunman obtained training with militants in Libya before carrying out his attack.

    On Thursday, security forces killed an Islamist militant and arrested 13 in a security operation in the northern state of Bizerte, the interior ministry said. Three more were arrested during raids on homes of suspected militants on Friday.

    Moroccan Suspect in Bardo Museum Attack Won’t Be Repatriated

    The Moroccan man suspected by Tunisian authorities to be behind the attack on the Bardo Museum in March won't be repatriated to his home country, although he entered Italy illegally, a court ruled Friday.

    Abdel Majid Touil, suspected by Tunisia of terrorism and other charges in connection with the Bardo attack, has filed for refugee status in Italy, after a court ruled against his expulsion to Morocco, his lawyer Silvia Fiorentino said Monday. A decision on his asylum request will be made in February, she added.

    The man was taken into custody in Italy in May, and was due to be extradited in Tunisia on allegations of premeditated murder, conspiracy to commit a terrorist attack, armed kidnapping and training and recruitment of terrorists on Tunisian soil. But Italian magistrates last week ruled against Mr. Touil’s extradition to Tunisia, as he faces the death penalty there.

    According to the Italian law, after the extradition decision, he should have been repatriated to Morocco because he illegally entered Italy. But on Friday judges decided that, if repatriated, the man risked to be sent to Tunisia. “This would have nulled the court’s decision against his extradition,” Ms. Fiorentino said in a written statement on Monday.

    Mr. Touil, now a free man and an asylum-seeker, has always denied any involvement in the attack. He said to judges that he arrived in Italy in February to join his family and had never left the country since then.

    Italian magistrates also started investigating into Mr. Touil’s link to terrorism but they closed the case last week, as they didn’t find evidence of his involvement with terrorist organizations.

    Italy’s interior minister Angelino Alfano said in May that there was no information linking Mr. Touil to terrorist or militant groups when he arrived at Porto Empedocle, in Sicily, on Feb. 17, on a migrant boat. He was fingerprinted and received an expulsion order, which he ignored making him an illegal migrant in Italy.

    The attack on the Bardo Museum, one of Tunis’s most popular tourist sites, shook a country that has been spared the worst of the violence that has engulfed Libya, its neighbor to the east. Those killed in the attack were mostly foreigners and included four Italians.

    A Tunisian court has handed 31 people death sentences over a 2014 attack on the home of then interior minister Lotfi Ben Jeddou, a judiciary spokesman said on Monday.

    Al-Qaeda in the Islamic Maghreb (AQIM) claimed the attack on the minister's family home in the western border region of Kasserine, which left four police officers dead.

    Those convicted were found guilty of "wilful homicide and membership of a terrorist group" and were also sentenced to 36 years in prison.

    A total of 46 people were prosecuted over the attack, said the spokesman for Tunis district court, Sofiene Sliti.

    Among the 15 remaining defendants, eight were sentenced to between three and 10 years in jail for "membership of a terrorist group" and "involvement in terrorism-related matters".

    The court, which issued the rulings on Friday, dismissed cases against the remaining seven, Sliti told AFP.

    Among the 31 sentenced to death were Seifallah Ben Hassine, an associate of late Al-Qaeda leader Osama bin Laden and founder of the jihadist group Ansar al-Sharia.

    The New York Times has reported that Ben Hassine, also known by the nom de guerre Abou Iyadh, was killed in an air strike in Libya in mid-June last year.

    The list also included Lokmane Abu Sakhr, an Algerian jihadist killed by Tunisian security forces at the end of March last year, also in Kasserine.

    Since its independence from France in 1956, Tunisia has carried out 135 executions, but has observed a moratorium on the practice since 1991.

    A new anti-terror law adopted in July upheld the death penalty, despite condemnation by local and international rights groups.

    Since Tunisia's 2011 revolution, jihadist attacks have cost dozens of lives among security forces as well as civilians.

    Attacks claimed by the Islamic State group on the National Bardo Museum in Tunis and a beach resort also killed 59 foreign tourists in 2015.

    A Tunisian court has convicted dozens of jihadists over the 2015 murder of a teenage shepherd, but the vast majority remain on the run, a prosecution spokesman said Wednesday.

    Mabrouk Soltani, 17, was beheaded as his sheep grazed on Mount Mghilla in central west Tunisia.

    The details of the murder sparked outrage, with the victim's cousin forced to watch and carry his head to the family home.

    A total of 49 people were convicted on Tuesday over the murder, including 45 in absentia, the prosecutor's spokesman Sofiene Sliti said.

    Four were sentenced to death, one of whom is in custody, while the others were sentenced to between 15 and 36 years in prison.

    Tunisian courts continue to issue death sentences despite no executions being carried out since 1991.

    Those convicted over Soltani's killing were prosecuted under Tunisia's 2015 anti-terror legislation.

    The murder was claimed by the Tunisian branch of the Islamic State group, Jund al-Khilafa, in a video which showed the killing.

    Two years later, Soltani's brother Khalifa was abducted and killed in the same area, in an attack also claimed by IS.

    The mountainous area near the Algerian border is also a stronghold of the Al-Qaeda-linked Okba Ibn Nafaa Battalion.

    Since its 2011 revolution, Tunisia has experienced an increase in jihadist attacks that have killed dozens of members of the security forces and at least 59 foreign tourists.

    The country has been under a state of emergency since November 2015, when an IS-claimed suicide bombing in Tunis killed 12 presidential guards.

    Tunis/Tunisia — The Criminal Division of the judicial counter-terrorism division sentenced to death the murderer of Riadh Barrouta, police major in an attack in Bardo, spokesperson for the Court of First Instance of Tunis 1, Mohsen Daly said Tuesday.

    The so-called Zied Ben Salem Gharbi, on November 1, 2017, attacked with a knife, a traffic police patrol in Bardo. He stabbed Major Riadh Barrouta in the neck and wounded Captain Mohamed Aidi in the forehead.

    Riadh Barrouta had succumbed to his injuries a day after the attack.

    The same source said the perpetrator of the attack was also sentenced to life imprisonment for the attempted murder of Captain Mohamed Aidi and 10 years imprisonment for membership in a terrorist group.

    The Criminal Chamber specialising in terrorist cases also fined the assailant 150 thousand dinars to be paid to the heirs of Riadh Barrouta, Daly added in a statement to TAP.

    TUNIS: A Tunisian court has sentenced to death nine jihadists accused of having beheaded a soldier in 2016, a murder claimed by the Islamic State group, media reported on Saturday.

    Tunisia hands death sentences to convicts mainly in trials related to national security under a 2015 terror law, despite a moratorium on capital punishment in place since 1991.

    Friday’s verdict concerns the murder of army corporal Said Ghozlani in November 2016, in the Mount Mghila area near the border with Algeria. He was found beheaded in his home in that region, which is considered a hideout for jihadists.
