    Wife receives plea deal to testify against Christopher Henderson in murder trial

    HUNTSVILLE, Ala. (WAFF) - The jury selection process continues on Tuesday in the Christopher Henderson trial.

    Henderson is the man accused of working together with Carlson to kill his other wife named Kristen, her mom, her nephew, and her son. He is facing the death penalty in this case.

    DEAL FOR RHONDA CARLSON

    During jury selection, prosecuting attorneys talked about a possible deal between the District Attorney’s office and Rhonda Carlson. She is the wife that’s accused of working with Henderson in the alleged crimes.

    WAFF 48 confirmed with prosecuting attorneys that Carlson has been offered a deal. Attorneys say she is cooperating with the State and will testify against Henderson. In return, the state is taking the death penalty off the table in her case and she will do life without parole.

    JURY SELECTION UPDATE

    About 130 potential jurors were called in for this case, according to attorneys. This group was broken up into different panels for questioning.

    On Monday, Judge Chris Comer told one of the panels of potential jurors they would not be sequestered if they were chosen to serve as a juror. Instead, he said it would be their responsibility to make sure they didn’t see anything on social media or in other forms of media.

    Judge Comer said he expects 12 jurors and six alternates to be selected for the trial. Judge Comer said the pool will have a high number of alternates because of COVID-19 preparedness.

    WAFF 48 caught up with attorneys on both sides of the case.

    “In capital cases, I might say there’s a heightened level of scrutiny on who gets to serve, who is qualified to serve as a juror in this case, but absolutely the burden of proof remains with the state,” said Henderson’s Defense Attorney Bruce Gardner.

    “It is serious but it’s like any other case. There’s going to be evidence. It’s going to be the burden of proof is the same. You make the same decisions based on the evidence in the case and kind of discard all the pressure and the gravity on it. It’s really the same process,” said the District Attorney’s Chief Trial Attorney Tim Gann.

    Jury selected, opening arguments scheduled Thursday for Christopher Henderson’s capital murder trial

    HUNTSVILLE, Ala. – The jury selection process in Christopher Henderson’s capital murder case took eight days, but it finally wrapped up late Wednesday afternoon. Opening arguments will begin Thursday morning for the jury trial.

    </aside>12 jurors and 6 alternates were selected. This is the most alternate jurors the prosecution and defense attorneys have ever had in a case. The state only requires two.

    This case presents a few unique challenges for jurors. First, how long this trial could potentially take, which could be several more days.

    This is a capital case. Which means if Christopher Henderson is found guilty the death penalty will be on the table.

    Then there’s also the graphic nature of this case. Henderson is accused of killing his 9-months pregnant wife, the unborn baby, two other children, and his mother-in-law at a home in New Market. After that, its alleged he and his first wife lit the house on fire.

    </aside>“It’s horrific what happened there, and some people are just not going to be able to handle it. And we’re trying our best to sift through that. And find the folks who can actually sit on this case and still be fair while viewing something worse, the worse things they will ever see in their lives,” said Time Gann, Madison County lead trial attorney.

    Wednesday afternoon, individual jurors were questioned by the prosecution and defense. Many of the questions centered around their views on the death penalty.

    </aside>This case hasn’t only created challenges for jurors. The alleged crime occurred back in 2015. Since then obstacles have come about that have prevented the case from going to trial sooner.

    “I will tell you that we were supposed to try this case in June 2020, but COVID came in and we were not allowed to have jury trials. It could’ve been a year earlier, but that still would’ve been a long time. The reason is the volume of the material. It’s just incredible how much stuff there is to get through both by the state and by us,” said Bruce Gardner, Henderson’s defense attorney.

    The juror said they failed to disclose a medical diagnosis during juror interviews last week and can’t handle the gruesome details of the case.

    First day of Henderson murder trial testimony includes video of him at crime scene, defense blames his wife

    HUNTSVILLE, Ala. — The first day of testimony in the Christopher Henderson murder trial looked squarely at the terrible toll prosecutors say he inflicted on the Smallwood family in New Market in August 2015.

    The jury heard from a deputy whose body camera video showed the family’s house on fire, a medical examiner began to outline the injuries suffered by the victims, and home security video placed Henderson, wearing black gloves, at the scene the day of the killings.

    Madison County Assistant District Attorney Shauna Barnett told jurors during her opening statement that they have substantial evidence against Henderson and that he should be found guilty on every count. Following that, she said, jurors should choose to give him the death penalty.

    Barnett also told jurors the state understands that this case – with details of child murders and more — is a hard, lonely road, but they will find their way.

    Defense attorney Bruce Gardner pushed hard in another direction, arguing Rhonda Carlson, Henderson’s first wife – who he never divorced before marrying Kristen Smallwood – was to blame for the killings.

    Gardner said prosecutors have reached a deal with Carlson which enables her to avoid a possible death sentence, but requires her to testify against Henderson.

    Gardner called that a deal with the devil.

    He told the jury Carlson was the one who planned the killlings, performed them and had the motivation to do so.

    Kristen Smallwood was 9 months pregnant with his child at the time of the killings. Her unborn daughter, her mother Jean Smallwood, her 8-year-old son, Clayton Chambers, her 1-year-old nephew Eli Sokolowski, were also killed that day.

    Keith Smallwood, Kristen’s brother testified that Kristen, Henderson, and Clayton had returned to Alabama from Michigan and moved into the Smallwood’s parents’ home on St. Clair Lane. They lived there for several months, but had relationship issues, Keith Smallwood said.

    Henderson was asked to leave the home in June 2015 and the family changed the locks.

    Christopher Henderson filed for divorce in July 2015, court records show. Kristen Henderson filed for a protection order against him on July 29 and on July 31, she filed a notice to the court that a divorce wasn’t necessary. The filing argues she had learned Henderson was still married to Carlson.

    Keith Smallwood testified that about a week before the killings he’d purchased a video security system for the home on St. Clair and Kristen helped him figure out where to point the cameras. The images from near the front door and garage would be sent out via notifications, for phone and email, when it recorded people on the property.

    Some of the security video — showing Kristen Smallwood and her son — who were both killed — was played in court Thursday.

    The video played in court Thursday shows a person prosecutors say is Rhonda Carlson, who’s also charged in the case. She appears to be trying to enter a door near the home’s garage. The woman then gets in a small SUV and drives away.

    Kristen Smallwood is then seen returning home after picking up her 8-year-old son from school. He can be seen exiting a van and carrying his backpack into the house. Later, a visibly pregnant Kristen enters the house.

    Carlson returns to the home apparently with a gas can and the video later shows what appears to be Christopher Henderson running out of the home.

    The first prosecution witness — Madison County Sheriff’s Deputy Drew Lane – testified to receiving a domestic disturbance call and said when he got near the home, he saw a plume of smoke.

    As he got closer, Kristen’s sister, 1-year-old Eli’s mother was frantically trying to get his attention, saying there were people inside the home.

    Deputy Lane testified to grabbing a gas mask and he another deputy tried to break windows and yelled to see if anyone was inside who needed help. There was no response.

    Keith Smallwood testified he had been the first family member on the scene, saw the house on fire and used a sledgehammer to open the front door. He testified he was blown back by draft from the fire and couldn’t get closer because of the flame and smoke.

    A representative with the Alabama Department of Forensic Sciences, who assisted in the autopsies back in 2015 – the doctor who performed them has since died – testified about the victims’ injuries. The prosecution also entered pictures of the bodies – which appeared to be charred beyond recognition – into evidence, without going through them with the jury.

    Before the trial began Friday, one juror pushed to be excused, citing concerns about their inability to handle the disturbing material. After a lengthy discussion, Madison County Circuit Judge Chris Comer excused the juror. The jury pool is now 12 jurors and five alternates.

    The case is due to resume Friday morning.

    Prosecutors began the second day of testimony by calling Dr. Steven Dunton with the Alabama Department of Forensic Services. Dunton described autopsy reports in grim detail saying there were more than 100 photographs taken for each of the five reports.


    Kristen Smallwood was 9 months pregnant with Henderson’s child at the time of the killings. Her unborn daughter, her mother Jean Smallwood, her 8-year-old son, Clayton Chambers, her 1-year-old nephew Eli Sokolowski, were also killed that day.


    Dunton reviewed the cause of death of each person and confirmed that some of the victims were still alive when the home was set on fire, though their injuries would have been fatal. The autopsy of Henderson’s pregnant wife Kristen Henderson showed that she had been stabbed numerous times and shot in the neck. The unborn child was cut from her body and the autopsy showed multiple sharp force injuries.


    Kristen’s mother, Jean Smallwood was shot to death before the fire. Eight-year-old Clayton was stabbed and unable to breathe, but still conscious when the fire started. One-year-old Eli was stabbed several times, but his cause of death was carbon monoxide poisoning.


    The prosecution also called a witness from the Madison County Sheriff’s Office who was a crime scene investigator in 2015. Investigator Monroe said they were at the crime scene for around a week. Teams worked together to gather evidence and sift through the debris. The investigator testified that they took around 5,000 photographs at the scene.

    Comer previously excused a main juror and called an alternate prior to testimony Thursday morning; the alternate juror pool is down to four people.

    After a break for lunch, forensic investigator Jason McMinn took the stand to discuss data collected from two of the three phones obtained in a search warrant from the residence, including call logs, contact lists, text messages, videos, and a Gmail account identified as Henderson’s.

    McMinn stated a report was generated from the recently-purchased device based on web history, video and photos, and search history. According to the report, the online search records at the time of the killings were related to break-ins, breaking windows, pistol rounds, and what happens when a person is shot.

    Next to take the stand, a witness appearing to work in the domestic violence protection office within the court system identified a protection order obtained on July 29 after Christopher Henderson moved out of the home. Records indicate Henderson was served with the order.

    Rhonda Carlson, who has been charged with capital murder, took the stand as a prosecution witness with defense identifying her as the person who orchestrated the killings. Carlson was still married to Henderson when he married Kristen. She has been in custody since 2015.

    Carlson stated her marriage to Henderson ended in 2014, but never filed paperwork for a formal divorce. She said they reconnected in June 2015, the same year as the killings.

    Carlson said she and Henderson lived in an apartment a few weeks before the killings, where Henderson told her that he and Kristen were not getting along. She said Henderson began discussing going into Kristen’s home at night and shooting her father and anybody else who came down the stairs. Carlson was instructed to watch the stairs. Henderson also researched a plan to ambush Kristen’s father at a rental home, but Carlson said she did not believe him.

    A few weeks before the killings, Henderson inquired about the viability of a baby if the mother was killed. The pair also researched guns and ammunition with Carlson receiving a 9mm pistol on her birthday, July 26, while Henderson got a .22 to carry out the plan.

    The plan was initially to break into the home and shoot every member of the family, Carlson said. She stated after failing to pick the lock one evening, the pair “chickened out” a few days before the killings occurred. The pair eventually planned to carry out the plan during the day when the men were not home in an attempt to make Kristen’s father suffer.

    Carlson stated both of them decided to burn the home down instead on the day of the killings. When asked if she knew who would be in the home, she stated, “Kristen, her mother, child home from school, Kristen’s son, and Eli.”

    The pair went to Walmart, carried a daughter to school, and took a nap before going to the home on St. Clair Lane. Carlson was supposed to drop off Henderson and he would call when the murders were done, but he forgot his cell phone.

    Carlson said she entered the home’s garage after realizing Henderson had left his phone, and drove around. She then retrieved the gas can, went inside the front door, and found Henderson standing near a body with blood all over him, the carpet, and the kitchen. No one was still alive, said Carlson.

    Henderson began pouring gasoline and then use a lighter, according to Carlson’s testimony. The pair drove off while the house was on fire and went to Ditto Landing, where they burned their clothing. The pair originally discussed keeping the baby, but Carlson stated she did not want to be a mother again. Henderson said a “baby would just end up whining like her mom,” and decided he did not want it, per Carlson.

    Carlson said she bought new clothes at Walmart and received a phone call from her daughter who said SWAT and police were at the home. The pair was arrested shortly after.

    Prosecutor Tim Gann showed Carlson photos and videos of the vehicle used to get to the murder scene, as well as security camera footage, a photo of them at Walmart, and footage of Henderson practicing a lock-picking technique.

    The judge stated the defense is planning a long cross-examination of the witness on Monday, after the state wraps up their proceedings.

    Christopher Henderson is accused of killed five people, including two children and a pregnant woman, at a New Market home before setting it on fire in 2015.

    Victim Kristen Smallwood was 9 months pregnant with Henderson’s child at the time of the killings. Her unborn daughter, her mother Jean Smallwood, her 8-year-old son, Clayton Chambers, her 1-year-old nephew Eli Sokolowski, were also killed that day.

    Last week, during the first two days of testimony, extremely disturbing autopsy photos were presented along with extensive details about those crimes.

    The prosecution continued questioning Christopher Henderson’s first wife and alleged accomplice, Rhonda Carlson, Monday morning. Carlson is also facing capital murder charges that are still moving through the court system.

    Gardner asked Carlson, “Do you agree that the truth does not come easy for you in this case,” and stated, “You’ve lied and lied all about your involvement in this case.” Carlson answered both with “Yes.”

    After the video of Carlson’s interview with an investigator was played for the court, Gardner accused Carlson of smiling several times while “they were talking about five people being dead and you’re smiling.”

    The defense made accusations that Carlson wanted Smallwood’s child and hated the fact that she was pregnant with Henderson’s baby. Gardner said Carlson wanted revenge and had every motive in the world to kill her. Carlson said, “Yes sir.” to every statement Gardener made.

    The prosecution called also called forensic scientist to the stand and a retired investigator for the Madison County Sheriff’s Office, Eugene Nash. Nash was the lead investigator at the scene on the day of the murders.

    The prosecution rested their case on Monday. The defense will begin to present its case on Tuesday.

    HUNTSVILLE, Ala. – The defense rested Tuesday morning, electing not to call any witnesses in the Christopher Henderson murder trial.

    Closing arguments concluded just after 1 p.m., and Judge Chris Comer gave the jury a break until 2:15 p.m.

    When jurors returned, Comer began charging the jury, stating issues in the case, clarifying unclear legal terms, and instructing jurors on the standard of proof they will be giving a verdict on. The process took almost 2 hours.

    The jury met for deliberations for a short time before deciding to begin deliberations at 9 a.m. Wednesday.

    Henderson is charged with killing five people, including two children and his pregnant wife in August 2015, before setting the family’s New Market house on fire.

    After three full days of testimony from a forensic scientist, a retired Madison County Sheriff’s Office investigator, and Rhonda Carlson, Christopher Henderson’s first wife, the prosecution rested Monday afternoon.
