    Prosecutor: Ala. dad may face death penalty in toddler death

    DOTHAN, Ala. (AP) - A prosecutor says a Dothan man charged with domestic assault in the death of his 2-year-old son may end up facing stiffer charges and a possible death sentence.

    The Dothan Eagle reports 25-year-old Jose Luis Rosales Sr. had his first court appearance Monday. He was charged with first degree domestic violence-assault following the death of his son, Jose Jr., at a hospital Saturday.

    Houston County District Attorney Doug Valeska said he's still awaiting autopsy results on the child. Depending on the autopsy findings, he said, Rosales could "potentially" be charged with capital murder.

    Authorities have released few details about the case. A warrant charging Rosales says he committed domestic violence-assault by shaking his son.

    The judge Monday appointed an attorney for Rosales and set a Sept. 4 preliminary hearing.

    Death Penalty Trial set for January 2018 for man charged with killing 2-year-old son

    A Houston County man will go on trial early next year for capital murder in the death of his two-year-old son in 2014.

    Judge Larry Anderson set the trial of Jose Luis Rosales, Sr. for January. Rosales was arrested in August 2014 after the death of his son, Jose Rosales Jr. According to police reports, the child was shaken violently, causing head and brain injuries.

    On Monday, Anderson also ruled on several motions related to the case filed by Rosales’ attorneys, Eric Davis and Matt Lamere.

    Anderson denied a motion that would have required the local court to conduct a proportionality review to determine if a charge of capital murder against Rosales was appropriate when compared to other cases with similar circumstances. Anderson said these reviews are typically done at the appellate court level.

    Anderson also denied a motion that the death penalty could only be imposed if the jury verdict was unanimous in favor of execution. Davis argued that Alabama is the only state left that allows executions on a non-unanimous jury verdict.

    Anderson said a non-unanimous verdict was allowable.

    “We’re here to follow Alabama law,” he said. “I’m not here to make the law.”

    Anderson denied a motion that would prohibit him from overriding a jury’s verdict. A recent law prohibits judicial override, but is not applicable to Rosales’ case, as the case was pending when the law was passed.

    Anderson said courts rarely override juries. He’s only done it once, and it was to change a verdict from death to life without parole.

    Anderson did grant a few of the defense’s motions regarding instructions to the jury and the opportunity for the defense to review the court’s charges to the jury before its deliberations.

    New witness comes forth in toddler murder case, trial rescheduled

    A Houston County man’s capital murder case was scheduled to begin Monday, Sept. 24. However, a new witness in the case has caused the trial to be rescheduled.

    Judge Larry Anderson was scheduled to hear the trial of Jose Luis Rosales, Sr. next week. Rosales was arrested in August 2014 after the death of his son, Jose Rosales Jr.

    According to Defense Attorney Christina Lamere, a new witness living out-of-state has surfaced, and both the prosecutors and defense attorneys will need to travel out of state to interview the witness.

    The defense recently filed a motion to bar the use of the aggravating circumstance of “especially heinous, atrocious, or cruel,” requesting that the death penalty be taken off the table if Rosales Sr. is found guilty of capital murder.

    Anderson issued an order stating the motion would be addressed before prior to trial.

    “We are hoping Judge Anderson addresses this motion as soon as possible,” Lamere said.

    According to police reports, the child was shaken violently, causing head and brain injuries.

    Investigators with the Houston County Sheriff’s Office originally arrested Rosales on Aug. 22, 2015, and charged him with felony first-degree domestic violence assault. Court records show the domestic violence assault warrant obtained by sheriff’s investigators charged Rosales with shaking his son by force.

    Houston County Coroner Robert Byrd previously told the Dothan Eagle the toddler was found unresponsive by his father in the family’s Fortner Street home, located just outside the city limits, on the afternoon of Saturday, Aug. 22.

    Lamere believes the trial will be rescheduled for November or December. Attorneys Matt Lamere and Eric Davis also represent Rosales.

    The continuance was due to a new witness resurfacing that lived out of state, and both the prosecutors and defense attorneys were required to travel out of state, said defense attorney Christina Lamere.

    Judge Larry Anderson who is presiding over the case could sentence Rosales, Sr. to LWOP or death row. An aggravating factor could net a sentence of death in this case. A similar case was that of Heather Leavell Keaton in 2015.
