    Defense plans to claim Murabella double-murder suspect was on Ambien

    The St. Johns County man who reportedly killed his wife and her best friend in her Murabella home in 2015 plans to claim he was under the influence of Ambien — and other drugs — during the killings.

    James Colley and his wife Amanda were separated at the time of the murders, which occurred on Aug. 15, 2015. Colley is accused of shooting his wife and her best friend, Lindy Dobbins, before going on the run.

    On Thursday, a judge granted two motions filed by the state. One was in reference to Lamar Douberly, who court documents show was in a relationship with Amanda Colley.

    Douberly was at the home at the time of the shootings and survived the attack.

    The motion states in questioning about alleged extramarital affairs. Douberly can only be questioned about his relationship with Amanda Colley. The other motion the judge granted regarded both victims' toxicology reports, which are to be omitted.

    The defense plans to use involuntary intoxication as their defense in this case, stating Colley was under the influence of Ambien -- and other drugs -- at the time of the murders.

    On the same day his wife was shot and killed, Colley was in a St. Johns County court, fighting an injunction order in his divorce case and claims that he was violent and burned his wife’s clothes in the yard. The state wants Colley's attorney that day to explain his observation of Colley’s condition that morning

    Colley was captured hours after the killings in Virginia. He is facing the death penalty if convicted of the first-degree murder charge.

    Colley’s trial is expected to begin on July 9 and should last around three weeks.

    Jury selection begins Tuesday in the death penalty trial of the man accused of killing his estranged wife and her friend in a MuraBella home nearly three years ago.

    James Terry Colley Jr. is facing two counts of first-degree murder in the August 2015 shooting deaths of 36-year-old Amanda Cloaninger Colley and 39-year-old Lindy Mosler Dobbins.

    He is also facing two counts of attempted first-degree murder with a firearm, burglary with assault or battery, armed burglary and aggravated stalking after injunction.

    A grand jury indicted Colley, 38, in September 2015.

    ST. AUGUSTINE, Fla. - Nearly three years after authorities said James Colley Jr. shot his estranged wife and her friend in a rampage at the couple's St. Johns County home, jury selection in the 38-year-old's double murder trial is taking some time.

    Of 60 prospective jurors were brought in Monday, all but 11 were dismissed. At the judge's request, 30 more were added to the pool Tuesday and jury selection was to expected to continue into Wednesday.

    Colley is charged with two counts of first-degree murder, two counts of attempted first-degree murder, two burglary counts and a count of aggravated stalking in the August 2015 shooting of Amanda Colley, 36, and Lindy Dobbins, 39.

    Before Amanda Colley was killed, she had taken out a restraining order against James Colley, but authorities said Colley ignored the order and burned his wife's clothes in the yard, among other violations.

    At a court hearing Aug. 27, 2015, a judge told Colley to stay away from his wife and handed down a 60-day suspended sentence on the restraining order violation charge.

    But immediately following the hearing, Colley went to his father's home to get a gun and then drove to the couple’s home, opening fire on Amanda Colley and her friends, according to prosecutors.

    Dobbins was fatally shot as she and another friend, Rachel Hendricks, hid in a closet. Amanda Colley was slain as she took cover inside a bathroom.

    Authorities said Colley was looking for Lamar Douberly, who he suspected of having a relationship with his wife, when he walked up through the backyard and opened fire into the residence.

    Douberly and another person escaped the home without harm.

    The sudden violence at the upscale home near World Golf Village spawned a massive manhunt that included a nationwide alert to be on the lookout for him.

    He was arrested following a traffic stop in Norton, Virginia, after another driver reported nearly being run off the road. He was later extradited to Florida.

    Prosecutors plan to seek the death penalty if Colley is convicted.

    ST. AUGUSTINE, Fla. - A woman who survived a deadly rampage in 2015 recounted the harrowing details Thursday as she testified in the trial for the man accused of gunning down her two friends.

    Rachel Hendricks had to take a steadying breath when she was asked to point out James Colley Jr. in a St. Johns County courtroom.

    Colley, 38, is charged with killing Hendricks' friends -- Colley's estranged wife, Amanda Colley, and her best friend, Lindy Dobbins -- at the Colleys' Murabella home in August 2015.

    Hendricks testified that on Aug. 27, 2015, Colley showed up uninvited at the home, looking for a man he believed was in a relationship with Amanda Colley, 36.

    Hendricks said she was in the home when James Colley, who had been ordered by a judge earlier that morning not to have contact with his wife, appeared in the backyard of the home carrying a gun and opened fire.

    She described running and hiding with Dobbins, 39, in a walk-in closet in the bathroom and bracing the door to keep James Colley out.

    Hendricks said she could hear him screaming at Amanda Colley, who was in the bathroom, asking, “Where is he? Where is he?” and cursing at her.

    She said she heard a gunshot, then never heard Amanda Colley's voice again.

    Hendricks said a shot fired through the closet door grazed her arm and felt “like a rug burn.”

    Prosecutors showed an image of a bullet hole in the closet door.

    Hendricks said after the shot, she fell back and James Colley forced his way inside, heading past her and straight to Dobbins, who was crouching behind a dresser.

    She said Colley put the handgun he was carrying up to Dobbins' head, and that's when Hendricks ran out of the closet and through the front door, looking for help. She heard a shot as she fled.

    Hendricks broke down crying on the stand as prosecutors played the 911 call she made from a neighbor's house after running from the shooting. In the call she repeatedly said she was scared for her life.

    Assistant State Attorney Jennifer Lynne Dunton said Colley was looking for Lamar Douberly at the home that day after leaving threatening messages for his estranged wife.

    "Call me or I'm going to come find you," Dunton quoted, along with several expletive laced rants.

    Douberly also testified Thursday about his relationship with Amanda Colley, the shooting rampage and the events that led up to the shooting.

    Douberly said when the shootig started and he heard James Colley yelling, "Where is he?" he realized he might be the target and fled. He said he ran into the garage, rolled under the garage door and ran from the home.

    He wasn't hurt and found someone a few streets away to call 911.

    Dunton said Amanda Colley heard Dobbins being shot in the closet before James Colley found her, wounded on the bathroom floor, and shot her multiple times as she begged for her life.

    The state told the jury that the murders were premeditated because Colley broke in around 4 a.m. that morning and ransacked the home, then returned hours later and killed Amanda Colley and Dobbins.

    Colley's attorney, Terry Shoemaker, said it’s not a question of whether or not Colley is guilty, but what would lead him to do this. Shoemaker said that Colley was heavily medicated for depression, anxiety and other medical issues, and because of that, he wasn’t himself.

    “The question isn’t who did that. The question is why did it happen? How could this happen? How could a person who loved his family more than anything in his life do that?" Shoemaker said.

    COLLEY, DAY 2: Death penalty case sees testimony from medical examiner, others

    Amanda Cloaninger Colley was shot nine times and her friend, Lindy Mosler Dobbins, three times, the day they were killed in a shooting spree in Colley’s MuraBella home nearly three years ago.

    That was the testimony of chief medical examiner Dr. Predrag Bulic on the second day of the death penalty trial of James Terry Colley Jr.

    And it was testimony — more than an hour’s worth — that James Colley sat through with his head down, keeping his eyes from the autopsy photos of the two women he is accused of killing.

    He is facing two counts of first-degree murder in the shooting death of Dobbins and his estranged wife as well as two counts of attempted first-degree murder and various burglary charges stemming from the shooting.

    Bulic’s afternoon testimony came during a full day of state’s witnesses who were called to walk jurors through the case. It all followed the first day of testimony in which the two survivors of the rampage — Amanda Colley’s boyfriend, Lamar Douberly, and her friend Rachel Hendricks — told jurors what they experienced the morning of Aug. 27, 2015, at 260 South Bellagio Drive.

    During questioning from Assistant State Attorney Mark Johnson, Bulic told jurors that although Amanda Colley had been shot by nine separate bullets, her body had been wounded several more times. The number of wounds, he explained, were the result of various entrance, exit and re-entrance wounds resulting from single bullets, some of which passed through her arms and legs before re-entering her body elsewhere.

    Bulic described the wounds to her limbs as “defensive wounds,” some of which were likely sustained while she was sitting or lying on the floor trying to shield her vital organs from the gunshots.

    Though several of the wounds she sustained could have killed her, Bulic said, one bullet that passed through a hand and entered her neck, severed her carotid artery and spinal cord and would have been “immediately lethal.”

    That was also the case for two of three wounds sustained by Dobbins, who was shot in the right temple and right shoulder as well as a foot as she tried to hide in a closet of her friend’s home.

    Other witnesses on Friday included Det. David Causey with the St. Johns County Sheriff’s Office who performed forensic examinations of both James Colley’s and Amanda Colley’s phones.

    During questioning by Assistant State Attorney Jennifer Dunton, Causey testified that James Colley had called his estranged wife 22 times the morning she was killed, left at least four voicemail messages and sent several text messages, many of which suggested that Colley was upset over learning that his wife was having an affair.

    In one voicemail Colley can be heard telling the mother of two that “You are lucky I don’t tell our children about this,” and in others he asked her to “Please talk to me, please.”

    The trial resumes Monday morning.

    Prosecutors are expected to rest their case later that day, with Colley’s defense team, Garry Wood and Terry Shoemaker, calling their first witnesses on Tuesday.

    Prosecution to continue presenting evidence against James Colley Jr.

    ST. AUGUSTINE, Fla. - After two days of damning testimony in the trial over the 2015 deaths of two women in a St. Johns County home, the prosecution of James Colley Jr. is expected to call more witnesses Monday.

    Colley, 38, is accused of killing his estranged wife, Amanda, and her friend, Lindy Dobbins, in their home hours after a court hearing about his violation of a restraining order requiring him to stay away from his wife.

    Much of the prosecution's evidence Friday centered around police and the medical examiner. At times as gruesome autopsy photos of his dead wife and her friend were shown, Colley lowered his head and covered his ears.

    "We see the head and upper portion of the torso covered in newspaper to preserve the evidence," Chief Medical Examiner Predrag Bulic testified.

    At other times, Colley listened, including discussion of evidence found in the home, like sex toys that might have incited jealousy and possible a motive for the killings.

    The jury was also presented with a series erratic texts and voicemails he sent to his estranged wife in the hours before the murder.

    "Don’t do nothing to me, I won’t do nothing to you."

    Prosecutors told the judge they should finish calling witnesses Monday. The defense has told the judge that they would need probably a couple of days to interview witnesses.

    In his opening statement last week, Colley's attorney, Terry Shoemaker, said it’s not a question of whether or not Colley is guilty, but what would lead him to do this. Shoemaker said Colley was heavily medicated for depression, anxiety and other medical issues, and because of that, he wasn’t himself.

    “The question isn’t who did that. The question is why did it happen? How could this happen? How could a person who loved his family more than anything in his life do that?" Shoemaker said.

    Prosecution rests case against St. Johns County man; defense begins Tuesday

    ST. AUGUSTINE, Fla. - After three days of damning testimony last week in the trial of James Colley in the 2015 shooting deaths of his estranged wife and her friend, prosecutors rested their case early Monday afternoon.

    Colley, 38, is accused of killing Amanda Colley and her friend Lindy Dobbins in a St. Johns County home hours after a court hearing about his violation of a restraining order requiring him to stay away from his wife.

    Testimony Monday morning included a Norton, Virginia, police officer who helped take Colley into custody only hours after the bodies of his wife and friend were found. Evidence photos from that arrest scene showed two guns (a handgun and an AR-15 style rifle), bullets and an empty beer bottle lying in the front seat of Colley's car.

    "He had some visible blood on his face and scratches and stains under his fingernails," Wise County, Virginia, Sheriff's Office Capt. Timothy Wagner said.

    Other testimony matched the bullets found in Colley's car to those found in the bodies of the two women. An expert testified that Colley's DNA was found on the murder weapon.

    There was also an interview with a woman who developed a relationship with Colley after his marriage began to fall apart. Amy Mason testified that they were planning on eventually introducing their children to one another once Colley’s divorce was final.

    She said they also had scheduled plans for the weekend after the murders.

    "We had plans to go and get a tie for him. My sister was getting married that weekend and he was going to join me at the wedding. We had plans the whole weekend, to spend the whole weekend together," Mason said.

    Prosecutors rested their case just before 2 p.m. The defense has told the judge that it should need one day to call five or six witnesses, so the jury could begin deliberations by Wednesday.

    ST. AUGUSTINE, Fla. - After three days of damning testimony in the trial of James Colley in the 2015 shooting deaths of his estranged wife and her friend, the defense presented a handful of witnesses Tuesday morning, then rested.

    Colley, 38, is accused of killing Amanda Colley and her friend Lindy Dobbins in a St. John's County home hours after a court hearing about his violation of a restraining order requiring him to stay away from his wife.

    In its closing argument, the prosecution recounted evidence in the case -- witnesses, Colley's DNA found on guns, ballistics, crime scene photos and 911 calls.

    "He had time to reflect that morning. He had time to change his mind. He didn’t do that. (He had) intent to kill," Assistant State Attorney Jennifer Dunton told the jury.

    Defense attorney Terry Shoemaker then talked about Colley's contentious marriage, saying Amanda Colley had been stringing her husband along.

    “She kept bringing him back in and not allowing him to move on. Just a constant, over and over and over," he said. "Is it reasonable to think that something happened that led him into that house? I believe it is and I wish I knew what it was.”

    Guilty verdict delivered in murder of Kenmore native

    ST. JOHN'S COUNTY, FL (WKBW) - A first-degree murder conviction has been delivered against the Florida man accused of killing his estranged wife, and her friend, Lindy Dobbins, a Kenmore native and mother of three.

    According to local news station News 4 Jax, a jury in St. John's County took less that two hours to convict James Colley Junior of the 2015 double-murder.

    In addition to murder, 38-year-old Colley was also convicted of attempted first-degree murder, burglary and aggravated stalking.

    The penalty phase of the trial will begin on Monday. Colley Jr. could face the death penalty.
