    Death penalty sought for ex-wife accused of killing Exeter police officer

    The Tulare County District Attorney’s Office will seek the death penalty against Erika Sandoval, who allegedly shot and killed Exeter police officer Daniel Green, 31, her ex-husband and father of their 2-year-old son.

    Sandoval, 26, was arrested one day after Green’s body was found Feb. 6 in his home in Goshen. He had been shot several times, the Tulare County Sheriff’s Department said.

    Prosecutor David Alavezos said in open court Wednesday that the district attorney’s office would seek the death penalty.

    Charges against Sandoval include the special circumstance of lying in wait, which could result in the death penalty or life in prison without the possibility of parole.

    No motive for the slaying has been stated by authorities, but Sandoval and Green had been sharing custody of the child. They had a contentious relationship and engaged in heated disputes about child custody, according to court records.

    A trial is scheduled to be set Oct. 29. Sandoval is being held without bail.

    Sandoval trial expected to begin this summer

    It has been two years since the death of 31-year-old Exeter Detective Daniel Green.

    Yesterday his brothers and sisters in blue gathered to remember their fallen brother and the impact he had on the department.

    “If I could sum up what Daniel meant to the department in one word it would ‘Spark’,” Exeter Police Chief Cliff Bush said. “No matter what the mood around the department, Daniel could walk in and either with his big boyish grin or little off-hand comment light up the room and energize the people in that room.”

    “We will forever miss his wit, his wisdom and his friendship,” he said.

    Officers found Green dead in his Goshen home on Feb. 6, 2015. Green hadn’t shown up for duty after being off work for three days.

    Detectives with both the Tulare County Sheriff’s Department and the Visalia Police Department responded to the scene and began a joint investigation. Four days later, deputies arrested Green’s ex-wife, Erika Sandoval, 30 of Visalia. She was booked on suspicion of homicide.

    According to investigators, Sandoval is believed to have waited for hours for her ex-husband to get home before shooting him to death with his own gun. Green and Sandoval, who have a child together, were previously involved in a domestic violence incident in February 2011.

    Charges were never filed.

    Following Green's killing, Bush expressed the sadness felt by the entire department.

    “As you would suspect, a small department like ours is family, so this hurts deeply,” he said. “We’re all grieving right now. We’re still all in a state of shock.”

    Green had been with the department for 11 years. He was a detective and the lead investigator in the 2011 homicide of 3-year-old Sophia Acosta. The department’s investigation led to the arrest of then 20-year-old Christopher Cheary.

    Cheary was sentenced to death for the rape and killing of Sophia by Judge Joseph Kalashian on Jan. 30. Assistant District Attorney David Alavezos, who prosecuted the case, attributed the conviction to Green’s thorough police work.

    Sandoval could face a similar fate.

    In 2015, Tulare County District Attorney Tim Ward announced he would be seeking the death penalty against Sandoval. Ward appointed Alavezos as the prosecutor.

    Sandoval is charged with first-degree murder with the special allegation of lying in wait.

    The death penalty is only used for those who have committed first-degree murder under special circumstances. Special circumstances include murder for financial gain, the murder of a peace officer, murder with torture, lying in wait and several more.

    According to the DA’s office, the last death penalty conviction sought for a woman was in 2004. Delphina Jahnigen was convicted of killing 5-year-old Jamie Mayne but was sentenced to life without the possibility of parole in 2005.

    Mayne was Jahnigen’s foster child.

    Sandoval’s pretrial begins on March 1, in Department 5. Kalashian will preside over the hearing. He is one of the few Tulare County judges with experience to hear death penalty cases.

    Her trial is expected to begin in August, according to court administrators.

    Sandoval is being represented by Dan Chambers, a criminal defense attorney based in Southern California. He was unavailable for comment Tuesday.

    If convicted and sentenced to death, Sandoval will become the 16th Tulare County inmate on Death Row and the first woman sentenced to death in the county.

    Community remembers Daniel Green as trial looms

    Tuesday marked the three-year anniversary of the death of Exeter police officer Daniel Green.

    As time moves on, those who knew Green say they have not forgotten the impact his death had on the community.

    "Daniel was always a pleasure to work with and around. Even if he was having an off or particularly busy shift, he always could be counted on to have that impish grin on his face — the kind that made you wonder what he was up to," said Cliff Bush, retired Exeter police chief. "Daniel was one of those people who lit up a room when he walked in and his love for life was contagious. You could not help but be happy after just being in the same room with him."

    Sandoval faces the death penalty, if convicted.

    The death penalty can only be sought by prosecutors if a special circumstance accompanies a murder charge. Special circumstances include murder for financial gain, the murder of a peace officer, murder with torture, lying in wait and several others.

    Assistant District Attorney David Alavezos has been assigned as the prosecutor. Alavezos declined to comment on the case because he doesn't want to jeopardize a conviction.

    Cases involving the death penalty typically take years to come to a conclusion.

    Prosecutors expect Sandoval's jury trial to begin this spring.

    According to the DA’s office, the last death penalty conviction sought for a woman was in 2004. Delphina Jahnigen, Visalia, killed 5-year-old Jamie Mayne. The murder conviction included a special circumstance that the crime included torture.

    She was later sentenced to life without the possibility of parole in 2005.

    She will soon stand trial for the crimes she's been accused of — shooting her ex-husband, Exeter Detective Daniel Green, to death.

    The judge will address the jury on Tuesday. Opening arguments will begin in October, according to the district attorney's office.

    Sandoval, 26, is charged with first-degree murder with the special allegation of lying in wait. She faces death, but could land in prison forever based on state laws.

    Retired Judge Joseph Kalashian will preside. Kalashian has overseen several death penalty cases, more than any other judge in Tulare County.

    Green, 31, was found dead in his home on Feb. 6, 2015. He hadn’t shown up for duty after being off for three days. Green had been with the Exeter Police Department for 11 years.

    Detectives with the Tulare County Sheriff’s Department and the Visalia Police Department responded to the scene and began a joint investigation.

    VISALIA, Calif. (KFSN) -- The trial continued on Wednesday for the woman accused of murdering an Exeter Police officer more than four years ago.

    Prosecutors say Erika Sandoval killed Daniel Green, her ex-husband, because she was jealous of a new woman he was seeing.

    Sandoval's phone used a cell tower in Goshen for two calls on the day she allegedly killed her ex-husband - one just after 11 a.m.

    And that's around the same time surveillance video shows Sandoval walking towards his Goshen home.

    Two detectives spoke with Erika Sandoval at the Government Plaza building on the night of February 6, 2015, hours after her ex-husband and Exeter Police Officer Daniel Green was found shot to death inside his home.

    During the taped interview, Sandoval told them about their rocky relationship, including some instances of domestic violence.

    But she maintained that they didn't have any major problems recently, and that Green was a good father to their son.

    "We gotta know - is there anything that you're missing, anything that we need to know about? This guy's one of our own. We want to catch the people who did this. We need to know - is there anything you're forgetting about right now that you could tell us about?" they said/

    "She provided us no substantive leads as to who would have committed the homicide," recalled Visalia Police Sgt. Daniel Ford in court on Wednesday.

    During the interview, Sandoval also expressed confusion about a text she received from Green's phone number that night.

    But by the end of the night, the detectives decided to drive her home.

    She was later arrested and charged with her husband's murder.

    Prosecutors say she shot and killed Green while he was on the toilet.

    On Wednesday, attorneys brought up alleged abusive behavior by Green and Sandoval.

    The trial continues on Thursday, and then resumes next Tuesday.

    Sandoval faces the death penalty or life in prison if convicted.

    The trial for the South Valley woman accused of killing her ex-husband, Exeter Police Officer Daniel Green is moving forward.

    The case against Erika Sandoval started more than three weeks ago.

    On thursday, the defense called a few former members of the Exeter Police Department.

    One of them was former Exeter Police Sergeant Jeffrey Detwiler, who in 2015, was convicted of having sex with a minor in the police explorers program.

    Before he was let go from the department, Detwiler worked with Daniel Green.

    On Thursday, Detwiler testified that he didn't dislike Green.

    Rather, he took issue with Green's conduct as a police officer, saying he was present for numerous discussions about complaints against Green.

    "There were complaints from the citizens and there was a complaint from one of the police officers," Detwiler said.

    Sandoval's defense attorney has called other witnesses who have called Green's professional conduct as a police officer into question.

    Last week, a woman told jurors that Green, in uniform, aggressively confronted her and her boyfriend at an Exeter bar, sat on the hood of her parked car, and threatened her boyfriend with violence.

    On Thursday, Sandoval's former co-worker said she witnessed a domestic violence incident between Sandoval and Green in the parking lot outside their Fresno office.

    "I saw him grabbing her ponytail and pushing her to the dashboard two times... She was holding her baby," she said.

    The woman said she saw Sandoval in the office later that day.

    "I saw like a red mark kind of like a bump on her forehead on the left side," she said.

    Sandoval's defense attorney says she was the victim of Green's physical and verbal abuse - even after their divorce and birth of their son.

    But on February 6, 2015, prosecutors say Sandoval murdered her ex-husband in cold blood, motivated by a new woman he was starting to see.

    Erika Sandoval, the woman on trial for allegedly murdering her ex-husband, Exeter Police officer Daniel Green, testified in court on Wednesday.

    Sandoval said Green grabbed her by the neck and held her up against a wall once.

    Another time, she said Green dragged her by her hair down the hallway.

    She also claimed Green an Exeter Police Officer, pointed a gun at her on several occasions.

    While pointing a gun at her once, she said Green said, "I could (expletive) kill you and make it look like an accident."

    Sandoval also testified that Green would threaten to call the police on her and take their son, who was born after their divorce, away.

    "Did you believe that Mr. Green could or would do those things?" Dan Chambers, Sandoval's defense attorney asked her. "Absolutely," Sandoval responded.

    "Why did you believe that?" Chambers asked. "I knew he had a lot of power, a lot of pull," Sandoval said.

    On February 6, 2015, Sandoval said she climbed through an unlocked window to get inside Green's Goshen home.

    He wasn't there, and Sandoval admitted she went to snoop around, having concerns about her son's living conditions while staying there.

    Sandoval eventually looked inside Green's safe in the spare bedroom.

    She said she found two explicit photos of underage girls engaged in sex acts with men.

    "I thought, is he watching this kind of stuff around my son?" Sandoval said. "Is he doing anything to my son? So yeah I did think about my son."

    Sandoval heard Green come home, so she hid in a closet.

    She then grabbed one of his guns and confronted him as he sat on the toilet.

    Sandoval said her ex-husband looked at her, said he was going to kill her, and started to get up.

    That's when she opened fire.

    "I regretted it instantly," she said. "Because that was the father of my child."

    During the beginning of cross-examination, Tulare County Assistant District Attorney David Alavezos asked Sandoval why no reports described the photos she said she found.

    "You didn't tell anybody that you thought he may have been abused sexually by Daniel, did you?" Alavezos asked Sandoval. "At CPS, you didn't tell anybody so that he could get counseling you were worried he needed, did you?"

    "I wasn't sure if he had gotten abused," Sandoval said.

    Sandoval will be back on the witness stand on Friday.

    She faces the death penalty if convicted.

    VISALIA, Calif. (KFSN) -- Earlier this week, Erika Sandoval claimed she shot and killed her ex-husband, Exeter Police Officer Daniel Green, after finding two printed pictures of child pornography in his safe.

    On Friday, Tulare County Assistant District Attorney David Alavezos told Sandoval the pictures were never found.

    During cross-examination, Alavezos also asked Sandoval why she unloaded Green's service weapon after killing him, taking the ammunition from it as well as two other guns and dumping it all under some sagebrush in Traver.

    Sandoval said all she remembers is taking two guns from the house.

    "I remember telling the detective that I did unload the guns," Sandoval said. "I don't know where I told them I unloaded them but I do remember saying I unloaded guns."

    "Well you unloaded one into Daniel," Alavezos said.

    Later, Sandoval became emotional as Alavezos asked her about each of the four shots she fired at Green as he was on the toilet, including the one that killed him.

    "One of your shots...went through his forehead," Alavezos said. "Didn't it?"

    "Yes," Sandoval said through tears.
    Sandoval said she regretted killing Green instantly.

    Prosecutors have argued she was upset that he was seeing a new woman and that Sandoval called Green 120 times in the few days leading up to his death.

    "Detective Klaussen at the bottom of the page says, 'Well I was asking you when, when did you make the decision, how long ago was it that you made that decision?'" Alavezos said. "And what did you say?"

    "That same day," Sandoval said. "Like I was already thinking about it. I was all like you know...cause he...I was just...I knew he was talking to somebody else. And I was like man, if he's talking to somebody else, he's gonna definitely not pay attention to (our son) and like be less careless with him and I just started worrying a lot and I wasn't eating for a few days."

    Sandoval said she was confused at the time, thinking Detective Klaussen was asking when she decided to go to Green's home, not when she decided to kill him.

    The trial will continue on Tuesday.

    South Valley woman who shot and killed ex-husband officer continues testimony

    VISALIA, Calif. (KFSN) -- Erika Sandoval said she wasn't bothered by an Instagram photo of her ex-husband with another woman-she had seen pictures of him with other girls before.

    She said she looked up the new woman, named Brenda, on Facebook because she wanted to know who could potentially be around the son she shared with Daniel Green.

    On Tuesday, Tulare County Assistant District Attorney David Alavezos asked Sandoval about some texts between her and a friend on February 5th, 2015.

    Sandoval told the friend she didn't have time for Green anymore, saying she thought he might be seeing someone new.

    "I don't know if I meant Brenda on there or maybe some other girl because like I said, there's been various girls," Sandoval said.

    "How many girls did you look up that week on the internet?" Alavezos asked Sandoval.

    "That week, just Brenda, I think," Sandoval replied.

    "And we saw that her photograph with Daniel was accessed on February 5th by your phone," Alavezos continued.

    "Yes, but I wasn't sure who I was referring to at that moment with that text with my friend as to who I was referring to," Sandoval said. "I knew he was talking to somebody or a few girls and I don't know if I was referring to Brenda particular(ly) on that text."

    Prosecutors have argued that Brenda was the reason Sandoval shot and killed Green at his Goshen home the following day.

    Detectives later found a note with the name in Sandoval's purse.

    After she shot Green, Sandoval texted Green's phone while at her tax appointment, telling him that their son wanted to talk to him.

    Sandoval texted him again that afternoon, and a couple of times that night.

    "Then at 6:03 you sent him a text, 'Why are you not answering my calls?' Correct?"

    "Correct," Sandoval said.

    "And then at 6:03, immediately following that, you send him a text, 'What's going on?' Correct?"

    "Correct."

    When asked, Sandoval said she wasn't trying to throw detectives off by offering to show them the texts, because she knew they would eventually come for her.

    Testimony will continue tomorrow.

    The judge told jurors he expects them to have the case by the first part of next week.

    Sandoval faces the death penalty if convicted.

    VISALIA, Calif. (KFSN) -- At first, she denied it, but Erika Sandoval eventually confessed to shooting and killing her ex-husband, Exeter Police Officer Daniel Green inside his Goshen home.

    She told sheriff's detectives that when she heard Green in the bathroom, she confronted him and started shooting.

    "Detective Klaussen said to you, 'Ok was (Green) saying anything to you?' Tulare County Assistant District Attorney David Alavezos said. "And what did you respond?"

    "No," Erika Sandoval said, reading from a transcript. "He didn't get a chance to say anything. He knew. He knew I was upset. He knew that, you know, he's done a lot to me."

    Last week, Sandoval said she shot him after he said he saw her, said he was going to kill her, and started to stand up.

    She said she originally lied to detectives, and when asked why, she said she was scared to talk to Detective Klaussen.

    Later on Wednesday, Sandoval said she didn't trust the detectives, because every time she reached out to law enforcement about Green's domestic abuse before, they let her down.

    And she said Green always told her that cops looked out for each other.

    "And what happened to your trust level when you found out that the lead investigator on this case was friends with Mr. Green?" Dan Chambers, Sandoval's defense attorney, asked her. "It didn't surprise me, but it definitely scared me even more, so I definitely didn't trust him," Sandoval responded.

    Sandoval said distrust of law enforcement was also the reason she didn't bring up the photos she says she found in Green's safe moments before she killed him-showing underage girls engaged in sex acts.

    "Does it surprise you we haven't seen those pictures?" Chambers asked Sandoval.

    "No it doesn't," she said.

    Tulare County Assistant District Attorney David Alavezos has continued to argue that Sandoval killed her ex-husband because he had started to see a new woman--looking her up on Facebook, writing her name on a note, and looking at an Instagram photo of them the day before she killed him.

    "The reality is in this particular case, you couldn't handle the fact that you and Daniel weren't going to be together, that he had a new girlfriend," Alavezos said. "That made him happy. That meant you were going to be sharing (your son). So you decided you were going to kill him. You left your work and you went to his house. You hid, you waited for him to get in the most vulnerable position he could get in, then you walked in and you shot him."

    "No," Sandoval responded.

    "No further questions," Alavezos said.

    Sandoval finished her testimony later on Wednesday afternoon-her fourth day on the witness stand.

    The trial will continue on Thursday, and the jury is expected to begin deliberating sometime next week.
