    Youngstown murder now death penalty case


    YOUNGSTOWN, Ohio (WKBN) – A Mahoning County grand jury indicted a Youngstown man in what is now a death penalty murder case.

    Lance Hundley, 46, of Warren, was charged with aggravated murder, aggravated attempted murder, aggravated felonious assault, and aggravated arson in connection to the Nov. 6 beating death of 41-year-old Erika Huff.

    Prosecutors say Hundley beat Huff inside a Cleveland Street house and then set it on fire to cover up the crime.

    Huff’s mother was also beaten by Hundley, but survived the attack, according to police.

    Police say Hundley went to the house and beat Huff, leaving her unconscious. The victim’s mother came later after her daughter’s medic alert alarm went off and encountered Hundley and was assaulted.

    Hundley set fire to the house and tried to leave as police were arriving.

    Hundley is being held in the Mahoning County Jail on $2 million bond.

    Judge Maureen A. Sweeney has ruled Lance Hundley competent to stand trial in his capital murder case.

    The Mahoning County Common Pleas Court judge made her ruling at the end of a Friday competency hearing, at which Dr. Delaney Smith, a psychiatrist with Twin Valley Behavioral Health Care in Columbus, and Dr. Thomas Gazley, a psychologist with the

    Forensic Psychiatric Center of Northeast Ohio in Austintown, testified they found Hundley understood the legal proceedings against him and could assist in his defense.

    Hundley, 47, of Washington Street, Warren, or Cleveland Street, Youngstown, could face the death penalty if he's convicted in the Nov. 6, 2015, slaying of Erika Huff, 41, in her Cleveland Street home on Youngstown's South Side.

    Hundley is accused of beating Huff to death, beating her mother and setting the house on fire.

    Police entered the burning house to rescue Hundley and Huff's mother.

    Hundley is charged with aggravated murder with a death-penalty specification, attempted murder, felonious assault and aggravated arson.

    In January, the defense requested Hundley's competence to stand trial be evaluated and filed a plea of innocent by reason of insanity.

    "We really haven't been able to get anything accomplished on this case because we've been jammed up with the competency evaluations, and he's not been cooperative," Jennifer McLaughlin, an assistant county prosecutor, said of Hundley.

    No scheduled trial date is shown on the court docket for Hundley, but a motion hearing is set for 8:30 a.m. Jan. 11.

    In response to a question from Hundley's lawyer, John Juhasz, Dr. Smith testified Hundley refused to answer her questions during the competency evaluation about who his lawyers are and what charges he faced.

    "He was able to control his behavior when he chose to," Dr. Smith said of Hundley's behavior during his 20 days at Twin Valley.

    Although Hundley was diagnosed at Twin Valley with anti-social personality disorder and malingering of mental illness and memory deficits, Dr. Smith said Hundley showed no signs of major mental illness.

    "Anti-social personality disorder is basically a life-long character trait, where people show a chronic disregard for the rights of others," Dr. Smith explained.

    "He was cooperative in providing some general information about the allegations, but he declined to provide details about the circumstances and events in the alleged offenses," Dr. Gazley said of Hundley.

    "I don't think he was trying to look as if he was mentally ill, when he wasn't," he added.

    Dr. Gazley said he found no signs that Hundley was mentally ill.

    "Individuals who have anti-social personality disorder can certainly make choices," he said.

    "They may not have significant foresight enough to recognize the severity of any potential consequences at times. They tend to act impulsively," he observed.

    Death penalty defendant will be shackled to and from Sweeney's courtroom

    YOUNGSTOWN - Judge Maureen Sweeney has ruled that a defendant who faces death-penalty charges in Mahoning County Common Pleas Court must be shackled on his way to and from her courtroom.

    Lance Hundley, who is charged in the November 2015 slaying of a woman, can have his restraints off in the courtroom but not in the halls of the courthouse.

    The order only pertains to the Hundley case when he is wearing civilian clothes and no other case on her docket.

    The order does not mention the suicide Monday of Robert Seman, who leaped to his death after a hearing in her courtroom in his death-penalty case. He was wearing civilian clothes but not handcuffed or shackled at the time he jumped.

    In the Seman case, the judge had ordered that he be allowed to wear civilian clothing in the courtroom and “any time he was to appear in court or before the general public, he was not to appear to be in custody,” whether for pre-trial hearings or the trial, Sheriff Jerry Greene said

    The purpose of this order was to avoid tainting a jury or public opinion, and it applied in court and in the public areas of the courthouse, the sheriff explained.

    In a transcript of a pretrial hearing in Hundley’s case Wednesday, Judge Sweeney asked Hundley if he understood why the change in policy was taking place.

    “Oh, yes, under the circumstances that happened to Mr. Seman,” Hundley said, according to the transcript. “Yeah,” the transcript records Judge Sweeney answering.

    “And you understand that at no time with the jury or anything else you will be shackled in this room here, OK?”

    Hundley responded “yes,” according to the transcript.

    Greene, whose deputies provide courthouse security, applauded the judge’s order.

    “Any time that we can increase the security and are able to keep an inmate more secure when we’re transporting him, that’s a good thing,” the sheriff said.

    In high-profile cases such as death-penalty cases, defense attorneys routinely file motions asking that their defendants be allowed to wear civilian clothes and not be visibly restrained before jurors and the order is usually granted.

    A judge has denied a defense request to remove the death-penalty specification from Lance Hundley, who is charged in the Nov. 6, 2015, slaying of Erika Huff, 41, in her Cleveland Street home on the city’s South Side.

    Hundley, 47, of Washington Street, Warren, or Cleveland Street, Youngstown, is accused of beating Huff to death, beating her mother and setting the house on fire.

    Judge Maureen A. Sweeney of Mahoning County Common Pleas Court rejected a defense claim that Ohio’s direct appeal from the trial court to the state supreme court in capital murder cases, which bypasses the 7th District Court of Appeals, violates Hundley’s right to due process of law.

    “There are countless further appeals, collateral proceedings and other actions brought in both state and federal courts,” after the Ohio Supreme Court rules on an appeal in a capital case, Judge Sweeney wrote in a judgment entry filed Friday.

    Judge Sweeney also rejected a defense claim that Ohio law improperly fails to narrow the class of offenders eligible for the death penalty to include only the worst offenders, saying the state’s top court has previously considered and rejected the defense argument.

    The judge also ruled that individual questioning of prospective jurors for Hundley’s trial out of earshot of other potential jurors would be limited to matters pertaining to their exposure to, and reactions to, pretrial publicity and their views concerning the death penalty.

    The judge said, however, she’d consider any other sensitive issues that may arise before Hundley’s trial.

    “Unlike other death penalty cases, this matter has received minimal pretrial publicity,” the judge wrote.

    Hundley’s next pre-trial hearing is set for 8:30 a.m. July 12; and his jury trial is set to begin Sept. 8.

    YOUNGSTOWN — It didn’t take long today for Lance Hundley to have his feet held to the fire in his death-penalty case, and afterward he decided maybe he shouldn’t be his own lawyer after all.

    Just minutes after Judge Maureen Sweeney granted his request to represent himself in his capital murder trial in Mahoning County Common Pleas Court, Hundley had to question the detective on his case. A hearing was happening where the defense was asking to suppress a brief statement Hundley made to police the day he was arrested because he claimed his Miranda rights were violated.

    But after the hearing was over Hundley changed his mind and asked that his court-appointed attorneys, John Juhasz and Doug Taylor, be reinstated. Judge Sweeney agreed.

    Man decides to be his own attorney in death penalty case

    YOUNGSTOWN — After firing his attorneys today and getting Judge Maureen Sweeney to agree to appoint him out of town counsel in his death penalty case, Lance Hundley decided to represent himself.

    Hundley’s trial, with orientation for jurors set for Friday in Mahoning County Common Pleas Court, is still on schedule after two hearings which clearly exsparated the judge.

    Hundley, 47, of Washington Street, Warren, or Cleveland Street, Youngstown, is accused of beating Erika Huff, 41, to death, beating her mother and setting her house on fire.

    He could face the death penalty if convicted.

    Hundley back in court bickering with judge in death penalty case

    YOUNGSTOWN — A man who wants the right to represent himself in his death penalty case bickered Wednesday with a judge in Mahoning County Common Pleas Court.

    Lance Hundley, 47, accused of the November 2015 beating death of Erika Huff and the attempted murder of her mother, complained to Judge Maureen Sweeney in a pretrial hearing that his former attorneys, who are now on stand by, have failed to perform several duties for him, such as sending letters or acquiring documents.

    Judge Sweeney curtly told Hundley that now that he is own attorney, those are his responsibilities.

    Hundley is set to go on trial in January for Huff's death.

    Jury to be seated soon in Youngstown death penalty case

    YOUNGSTOWN, Ohio (WKBN) - A jury could be in place next week to hear the case against Lance Hundley of Youngstown.

    Lawyers for both the defense and prosecution continued Wednesday working through their list of prospective jurors.

    They started with a pool of about 145 and hope to have that whittled down to around 50 by the end of the week.

    Hundley is charged with beating Erika Huff to death in 2015 as well as attacking the victim’s mother. He faces a possible death sentence if he’s convicted.

    YOUNGSTOWN — Opening statements have begun in Mahoning County Common Pleas Court in the Lance Hundley capital murder trial before Judge Maureen Sweeney.

    Hundley, 48, of Warren, is accused of the Nov. 6, 2015, beating death of Erika Huff and the attempted murder of her mother in Huff's Cleveland Street home.

    Murder suspect takes stand at trial, says he did not kill woman

    YOUNGSTOWN, Ohio (WKBN) - Accused killer Lance Hundley insists he never killed the disabled woman he's been staying with, and repeatedly hit the victim's elderly mother with a hammer in self-defense.

    That was the story Hundley told Friday morning as he took the witness stand in his own capital murder trial.

    He's charged in the beating death of Erika Huff back in late 2015.

    But, Friday he claimed the woman's mother and step father, along with a third unidentified man, committed the crime and nearly killed him as well.

    Hundley told the jury he came to the area in August 2015 and had been staying at Erika Huff's house on the southside, paying her $200 a month.

    He said on the night of November 5, he'd gone to a couple bars, came back and smoked some marijuana with Erika and fell asleep watching TV.

    "I'm on the couch. I couldn't see the face.. Okay.. and they was chokin' me out.. From behind," Hundley said.

    Hundley said the attacker used chloroform on him and he blacked out, coming to in the kitchen. He said he then started walking toward the back when he saw a man come out of Erika's room with a gas can.

    "No I did not kill Erika Huff," Hundley said.

    "But you were in an altercation with Denise Johnson?" Attorney Doug Taylor asked.

    "Yes, I was. She and her husband and that man, whoever that man was, is responsible for Erika Huff," Hundley said.

    Hundley insisted the others set fire to the house and at one point he started fighting with Denise Johnson, hitting her repeatedly with a hammer.

    Although Hundley was rescued from the burning house, he says he never told anyone but his lawyers this story for nearly three years, insisting he never killed Erika Huff. Closing arguments are expected this Monday.

    The charges against him could bring the death penalty if he's convicted.
