    More DNA tests requested in Timothy Madden case

    Timothy Madden's defense attorney has requested forensic testing on additional items. The court document lists 5 DNA tests.

    The Commonwealth's reply to this request is due on October 21, 2016.

    Madden is accused of raping and killing 7-year-old Gabbi Doolin on the campus of Allen County-Scottsville High School on November 14, 2015. He is facing the death penalty.

    Madden will be back in court on November 9, 2016 at 1:30 pm.

    Madden hearing in Doolin death moved to December

    A court hearing for a Scottsville man suspected in the slaying of 7-year-old Gabriella "Gabbi" Doolin that had been set for Wednesday was rescheduled for next month.

    Timothy Madden, 39, was scheduled to appear in Allen Circuit Court for a pretrial conference on Wednesday in his case.

    Madden is charged with murder, kidnapping, first-degree rape and first-degree sodomy in connection with the death of Gabbi Doolin, of Scottsville, whose body was found Nov. 14 in a wooded area near Allen County-Scottsville High School.

    Represented by attorney Travis Lock, Madden has pleaded not guilty to all counts. Allen County Commonwealth's Attorney Clint Willis is seeking the death penalty.

    Allen Circuit Judge Janet Crocker issued an order Wednesday rescheduling the pretrial conference for Dec. 2.

    Crocker also set a Nov. 23 deadline for Lock and Willis to file any motions to be heard next month.

    The Kentucky State Police investigated Gabbi's death.

    Her older brother was involved in a youth league football game at the high school on the day of her death.

    Gabbi's mother reported her missing, and the girl's body was found 25 minutes afterward, according to police.

    Manual strangulation and drowning were listed as the causes of her death, according to court records.

    Police arrested Madden on Nov. 20 after forensic analysis found that a DNA sample collected from Madden matched DNA that police recovered from Gabbi, according to an arrest citation.

    No trial date has been set in the case.

    Upon his arrest, Madden was initially placed in Barren County Corrections Center, where he was held in isolation.

    In August, Madden was moved to Christian County Detention Center in Hopkinsville to make space for more inmates in Barren County.

    Attorney Wants Timothy Madden Trial Moved Out of Allen County

    The attorney for a man charged in the death of a young Allen County girl wants the trial moved out of the region.

    Attorney Travis Lock filed a change of venue request Friday afternoon in Allen Circuit Court on behalf of Timothy Madden. Lock previously told WKU Public Radio that his client couldn't get a fair trial in Allen County due to publicity surrounding the case.

    "I think it's going to be tough to impanel a jury in any contiguous county," stated Lock. "I'm sure that's something the court will address in due time."

    Lock cited results of a telephone survey conducted in February by WKU’s Social Science Research Center. The poll questioned 256 Allen County residents. Seventy-five percent of them believed Madden was guilty of murdering Gabbi Doolin. The seven-year-old’s body was found behind Allen County-Scottsville High School in November 2015.

    Madden is charged with murder, kidnapping, rape, and sodomy. He could get the death penalty if convicted. His trial is likely to begin in early 2018.

    The man accused of killing a 7-year-old girl in 2015 appeared in Allen County Circuit Court Thursday morning.

    Timothy Madden’s trial has been set for February 26, 2018, but it won’t be in Allen County. A survey will be conducted for surrounding counties to determine venue.

    Madden is charged with murder, rape, sodomy, and kidnapping in the death of 7-year-old Gabbi Doolin.

    Doolin was killed on November 14, 2015 on the campus of Allen County-Scottsville High School during a youth football game.

    In a December 2016 interview Madden’s attorney Travis Lock said it would be tough for his client to get a fair trial in Allen County or any of the surrounding counties.

    Lock filed the change of venue request on March 31, 2017.

    Timothy Madden faces the death penalty if convicted.

    ALLEN COUNTY, Ky. (WZTV) — A change of venue has been granted for the Kentucky man accused of raping and murdering a 7-year-old girl at a football game.

    Timothy Madden's trial venue has not yet been determined.

    Madden is accused of killing Gabbi Doolin in November 2015 while the girl and her family were attending an Allen County youth football game. Madden is officially charged with kidnapping, rape, sodomy, and murder.

    Madden has previously pleaded 'not guilty' to the charges.

    Madden is from Allen County and went to Scottsville High School, where Gabbi's father attended.

    SCOTTSVILLE – Timothy Madden’s trial on murder and three other charges will not take place in Allen County, but a venue hasn’t been determined ahead of the scheduled Feb. 26 trial date.

    Madden, 40, of Scottsville, could face the death penalty if he is convicted on charges of murder, first-degree rape, first-degree sodomy and kidnapping in the death of 7-year-old Gabriella “Gabbi” Doolin on Nov. 14, 2015.

    Gabbi’s body was found in a wooded area near Allen County-Scottsville High School, where her brother was taking part in a youth football game.

    Madden’s attorney, Travis Lock, successfully sought this year to have the trial moved out of Allen County, arguing that pretrial publicity prejudiced potential jurors against Madden and would prevent him from receiving a fair trial.

    Simpson County, a neighboring county that is in the same judicial circuit as Allen County, would take precedence as a trial venue, but Lock has filed to have the trial moved out of any county bordering Allen County.

    On Friday, Lock made his case for preventing the trial from taking place in any adjoining county, calling Joel Turner, director of the Western Kentucky University Social Science Research Center to testify.

    Lock commissioned the research center to conduct a random telephone survey of 725 residents in Simpson, Warren, Barren, Monroe and Christian counties to learn what they knew about the case and assess their opinions of Madden’s guilt or innocence.

    The survey, conducted between Sept. 25 and Oct. 8, found that 56 percent of Warren County residents believe Madden is guilty of murder.

    A total of 48 percent of respondents in Barren and Simpson counties believed Madden is guilty, while 43 percent of respondents in Monroe County voiced the same opinion.

    Of the people in those four counties who believed Madden is guilty, a large majority stated that he was “definitely guilty.”

    On the witness stand Friday, Turner said the random sampling of residents would most accurately reflect the sentiments of residents in those counties who would be part of the jury selection process.

    “If an unbiased jury is selected, it would really be just by luck,” Turner said.

    Christian County, which does not border Allen County, was selected for the phone survey because Madden is being jailed there and the county’s relatively new justice center could accommodate a trial of this nature, Turner testified.

    The survey showed a low public awareness of the case in Christian County, where only 18 percent of respondents polled knew that Madden had been charged with Gabbi’s death, and 11 percent believing Madden is guilty.

    A total of 85 percent of Christian County respondents said they did not know whether Madden is guilty.

    “Most people in Christian County had not made up their mind or were largely unaware of the case,” Turner said.

    Allen County Commonwealth’s Attorney Clint Willis’ questioning of Turner focused on census figures of the adjoining counties that had been compiled in a response to Lock’s motion.

    Willis argued that, given a pool of a few hundred jurors for a death penalty case, it would be reasonable to expect to find several dozen potential jurors from which a panel of 12 unbiased jurors could be selected in any of the adjoining counties.

    The jury pool in Allen County would be reduced merely by virtue of the amount of people who know Madden, are related to him or have worked with him, Willis said.

    “By going to another county, contiguous or not, we get back all the potential jurors we would normally lose,” Willis said.

    Allen Circuit Judge Janet Crocker did not give a ruling from the bench, saying she would take Lock’s supplemental motion under advisement.

    “I want to give some additional consideration to the surveys and the analysis the commonwealth has done with the census figures,” Crocker said.

    After the hearing, Lock said he was encouraged by the court’s decision to review the arguments from both sides before making a ruling.

    “We look forward to the time when the court makes a decision on the venue issue,” Lock said. “Once we know the venue, then that will put us in a better position to start preparing this case for trial.”

    Timothy Madden's trial for murder and three other counts in the death of 7-year-old Gabriella "Gabbi" Doolin is set for next month, but Madden's attorney is seeking to have the Feb. 26 trial date vacated, arguing in a court filing that he needs more time to prepare Madden's defense.

    Madden, 40, is charged with murder, kidnapping, first-degree rape and first-degree sodomy in connection with Gabbi's death, and faces the death penalty if convicted as charged.

    Gabbi's body was found Nov. 14, 2015 in some woods near Allen County-Scottsville High School, where her brother was taking part in a youth league football game that day. Madden was arrested six days later by Kentucky State Police.

    A pretrial conference in the case is scheduled for Friday in Allen Circuit Court, where Madden's attorney, Travis Lock, plans to present his motion to vacate the trial date.

    In a 36-page motion filed Dec. 26, Lock argues that he would be incapable of effectively representing Madden if the trial were to go forward as scheduled, stating that he requires more time to independently review evidence provided him by Allen County Commonwealth's Attorney Clint Willis.

    Allen Circuit Judge Janet Crocker set the Feb. 26 trial date at the end of a pretrial conference in September.

    Lock objected at the time and, in the months since, he has maintained that it would not be possible to complete his trial preparation ahead of that date.

    "The time needed to prepare the case for trial is currently unknown and the defense respectfully requests the trial court vacate the trial date," Lock said in his motion.

    The trial will not take place in Allen County, and Crocker has not yet ruled on a motion from Lock requesting the trial be held in a county that does not border Allen County.

    Lock's motion specifies that the analysis of forensic evidence provided by Willis has not been completed by his independent investigators.

    After earlier formal requests to compel Willis' office to turn over certain items of evidence, the materials were provided to the defense on Oct. 4, Lock said in his motion, and consulting experts hired by Lock "are still engaged in the process of reviewing and analyzing the materials to determine the completeness of these requested items and their initial independent conclusions."

    Also, Lock argues that he requires more time to consulting expert witnesses who would provide testimony of mitigating circumstances that would weigh against imposing a death sentence should Madden be convicted.

    Madden's constitutional rights would be violated and a conviction could potentially be overturned on appeal if his mitigation defense were inadequate, according to Lock.

    "It has long been recognized that a competent mitigation investigation must include the family history going back at least three generations, and must document genetic history, patterns and effects of familial medical conditions," Lock's motion stated. "Because it is well established that many major psychotic illnesses have strong genetic components, the existence of mental illnesses or related conditions in the family tree is important to a competent mental health assessment of the client ... . The mitigation investigation in Timothy W. Madden's case is far from completion and thus a continuance is not only warranted for good cause, but it is constitutionally mandated."

    Lock supplemented his motion with a timeline that lists the dates of court appearances, filings, communications with Willis and other events related to trial preparation.

    SCOTTSVILLE, Ky. -- The man accused of killing 7-year-old Gabbi Doolin in November, 2015 will have both a change of venue and a new trial date.

    Timothy Madden's murder trial will be moved to Hardin County.

    The Feb. 26 trial date will also be changed.

    A scheduling conference for trial will be held at noon on Feb. 13.

    All proceedings will be held in Allen County until trial.

    Judge Janet Crocker said this is the most important case she will ever preside over, suggesting it will be most important case anyone involved on either side will preside over. She hopes nothing like what happened two years ago ever happens again.

    Judge Crocker said, "I appreciate both families' desire for closure," but that in a death penalty case, "everybody needs to be prepared."

    Doolin family spokesperson, Lori Wilson, said they're happy to see a step forward in the case, although disappointed the trial will be moved back. She said the family will look to Jesus Christ to see to it that the trial is completed and justice is brought.

    Commonwealth Attorney Clint Willis said he and his team would have been ready for trial in February, and having to explain to the Doolin family why the trial won't happen is hard, although he understands the legal process behind it.

    Timothy Madden is facing charges of murder, rape first degree (victim less than 12 years of age), sodomy first degree (victim less than 12 years of age), and kidnapping (victim death).

    Timothy Madden's Death Penalty Trial Set for Summer

    A new trial date has been set for the Allen County man charged in the brutal death of a young girl more than two years ago. Timothy Madden returned to court on Wednesday for a pre-trial hearing.

    The capital murder case against the 40-year-old Madden will now go to trial on July 23. Madden's Attorney Travis Lock questioned whether he could be ready to present his case by then. The defense attorney said he’s still working to collect mitigation evidence in the event that Madden is found guilty.

    "Should there be a penalty phase in any capital case, the purpose of mitigation is to give the jury, whose task is to sentence the defendant, a detailed look at the defendant's entire life," Lock told WKU Public Radio.

    Allen Circuit Court Judge Janet Crocker said she didn’t want either family to go through another anniversary without a resolution. The trial was originally set for February 26 before the judge granted a defense motion to delay the trial.

    "The commonwealth and this victim's family cannot simply continue to be held hostage while you get your case ready to try," Crocker stated in court.

    Allen County Commonwealth’s Attorney Clint Willis said the prosecution is ready and thinks the judge made the right decision to set a trial date.

    "I think, emotionally, you have to take into account the feelings and emotions of the victims' family in every case, and this one, there's obviously it's very intense feelings," commented Willis.

    Madden is charged in the November 2015 kidnapping and murder of Gabbi Doolin whose body was found behind Allen County-Scottsville High School. The seven-year-old had been raped, strangled, and drowned.

    The death penalty case will be tried in Hardin County due to pre-trial publicity in Allen and surrounding counties.

    Defense team files motion in Timothy Madden murder case

    Timothy Madden's defense team filed a motion for the Commonwealth to provide the defendant with funds for special services.

    Madden is accused of kidnapping, raping, and murdering seven year old Gabbi Doolin in Scottsville in November of 2015.

    Madden has been incarcerated since his arrest of November 20, 2015.

    "We are asking the court to find Mr. Madden indigent and to award him funds for obtaining necessary expert assistance in preparing his defense for trial," says Madden's attorney Travis Lock.

    When Lock says that the court should see Madden as indigent, it means he can't financially support his court fees any longer.

    If Madden is identified as indigent, the state must provide him with special services that Lock says is his client is entitled to.

    "The defendant has a constitutional right to funds for necessary services in preparing his defense and also a constitutional right to have an attorney he or she chooses," Lock adds.

    The money to fund Madden's services would come from the state's tax dollars, but the defense team believes it is an essential part to holding a fair trial.

    "We are simply asking for resources available which we believe and indigent defendant is constitutionally entitled to, resources to prepare and present his defense,"

    Commonwealth Attorney Clint Willis says his team will have until Friday to file an official response to the motion. He says he doesn't want this to move the trial back because he wants to bring the Doolin family closure as soon as possible. Willis mentions that he will file sooner if time permits.
