    Man Charged With Rape, Capital Murder In Death Of Missing Clarke County Woman

    D.J. Harris has been charged with two counts of capital murder, one count during rape and one count during the course of a burglary in the death of Monique Presnall-Kidd, a Clarke County woman who went missing last week.

    Presnall-Kidd’s body was found in the trunk of a stolen vehicle on Sunday in Jackson, three days after she was reported missing.

    When police arrived to the victim’s home, the door had been kicked down and her home had been robbed.

    Clarke County Sheriff Ray Norris told News 5 that Presnall-Kidd was killed during the rape. Norris said the official cause of death was strangulation.

    He added that there was no previous relationship between Presnall-Kidd and Harris and called the crime “pre-meditated.”

    An accomplice has also been charged in the case. Cedric Hunt is charged with hindering prosecution and moving the body.

    Harris has quite the arrest record — he has been arrested 38 times and served time in prison twice.

    Both men are currently in jail.

    There has been an outpouring of support for Presnall-Kidd on social media.

    “Rest in peace sweet angel! She went out of her way to make my special needs brother smile. Thank you for being a friend,” Heather Marie said on WKRG’s Facebook page.

    “She was such a precious person and classmate,” said Alicia Moore.

    The Clarke County grand Jury two weeks ago indicted Dennis James “D. J.” Harris with two counts of capital murder in the death of Monique Presnall Kidd in March.

    Harris went to Presnall- Kidd’s home on the Pineywoods Road where he raped her and strangled her to death. He placed the 33-year-old’s body in the trunk of her car. It was then driven to Walker Springs and parked behind a closed store.

    Cedric Hunt was also indicted for hindering prosecution and moving a body for assisting Harris.

    The woman had been working in Mobile and when she wasn’t seen within a few days the family alerted lawmen. They went to her home and found that the door had been kicked in and the place burglarized.

    A search began. Acting on a tip, lawmen went to Walker Springs to search along the railroad and that’s when they found her car.

    Capital murder case up for trial; jurors to decide

    Potential jurors were being polled to hear a capital murder case in Clarke County Circuit Court Tuesday and Wednesday.

    The process may be longer than other jury selections because of the nature of the case.

    There are only two options in a capital case if the defendant is found guilty — life imprisonment or the death penalty.

    Dennis James “D.J.” Harris faces three counts of capital murder in the death of Monica Presnall-Kidd in 2016. The capital charges relate to her death during a burglary, during a rape and of other sexual abuse. There are three other charges of murder, attempted murder and intimidating a witness.

    The cause of death, per the indictment, is “choking or strangulation or smothering.”

    Presnall-Kidd was determined to be missing and apparently the victim of foul play in March. Her body was found a few days afterwards in the trunk of her car hidden behind a closed store in Walker Springs.

    An investigation led to Harris’ arrest.

    Prosecuting the case are attorneys from the Alabama Attorney General’s office. Representing Harris are Daryl Drinkard, Matthew Drinkard and Perry Newton.

    D. J. Harris gets life but for burglary, not capital murder

    Three counts of capital murder turned into second degree burglary when Dennis James “D. J.” Harris pleaded to the latter in Clarke County Circuit Court Wednesday, June 15.

    The change from capital murder allowed him to escape a possible death sentence had the case gone to trial and a guilty verdict been returned. Even so, his plea imposed a life sentence for the burglary charge because of three prior felony convictions.

    Harris was charged with the 2016 murder of Monique Presnall-Kidd.

    Presnall-Kidd disappeared in mid-March 2016. Investigating lawmen found the door to her Pineywoods Road home kicked in and the home burglarized.

    Harris was accused of raping her and killing her by “choking or strangulation or smothering” according to the indictment.

    Her body was found in the trunk of her car hidden behind a closed store in Walker Springs a few days after her disappearance.

    Three capital charges were issued, one related to her death during a robbery, the others related to her death during a rape or other sexual abuse. There were also three other charges of murder, attempted murder and of intimidating a witness, the latter in relation to the case.

    All were dismissed and replaced by the burglary charge as presented by Assistant Alabama Attorneys General who were prosecuting the case.

    Matthew Drinkard, one of the defense attorneys in questioning jurors in preparation to select a jury asked if they thought it should be reasonable that the state should have to prove a time of death and a method of death.

    Others defending Harris were Daryl Drinkard and Perry Newton.

    Several plea offerings were said to be put on the table before the one detailed here was accepted.

    The plea came Wednesday afternoon, June 15 as a jury was being prepared to be selected to hear the case. Potential jurors had been questioned Monday, Tuesday and Wednesday morning.

    The plea agreement was “made with the wishes of Presnall-Kidd’s mother,” according to Assistant Alabama Attorney General Damon Lewis. Her mother is Kartika Womack.

    Judge Gaines McCorquodale explained Harris’ rights to him and asked if he understood the plea agreement before signing it. Harris acknowledged that he did.

    Harris’ three prior felony convictions triggered the life sentence.

    Because Harris has three prior felony convictions on his record, he was sentenced to life in prison, with the possibility of parole.

    Had he been tried and found guilty of capital murder the only sentencing options would have been life imprisonment without parole or the death penalty. The jury would have decided the sentence in a second deliberation.

    The actual time spent going through and accepting the plea agreement lasted less than 10 minutes.

    Harris has a long list of run-ins with the law. He had been arrested at least 38 times and has already served two prison sentences as a convicted felon. He was arrested on a domestic violence and strangulation charge and for making terrorist threats not long before Presnall- Kidd’s death.

    Harris was given credit for the six years and three months he has spent in jail since 2016.

    He was ordered to pay $50 to the crime victims fund. A restitution amount will be set at a later date.

    Harris was reportedly removed from the Clarke County Jail to a state prison late last week to begin his sentence.
