Pa. parents face death penalty for toddler's fatal 13 hours in car seat

The 23-month-old girl died after investigators in western Pennsylvania said she was left in a car seat for 13 hours back in February. Now, the Fayette County District Attorney announced Thursday he would seek the death penalty against her parents.

    WPXI in Pittsburgh reports
that criminal homicide suspects Andrea Dusha and Michael Wright allegedly placed their daughter, Lydia Wright, in a car seat at 9 p.m. February 23 and did not check on her until 10:30 a.m. February 24.

Police say it was not until the girl's mother went to give her daughter a drink more than 13 hours later that she noticed the girl was foaming at the mouth and then rushed her to the hospital, where she later died, WPXI writes, adding:

Police said the toddler was severely dehydrated and weighed only 10 pounds at the time of her death, less than half the average weight for a 2-year-old girl.

The same day the toddler was found dehydrated in the car seat, Dusha posted this to Facebook at 7:40 a.m.: "If you want the dead to stop coming back to life, then you have to kill the living."

Investigators also found the couple's Uniontown home in deplorable condition, including a highchair covered in feces, a needle on the bathroom floor and open bottles of pills.

The couple has two other children, a 3-year-old and a 5-year-old, who were not malnourished but were found living in those conditions, as well.

The couple remains jailed without bail.

New Discovery Material Requested In Case Of Child’s Starvation Death

    By KDKA News

UNIONTOWN (KDKA) – The attorney of a Uniontown woman accused in the death of her young daughter is requesting new discovery material as the case prepares to go to trial.

Andrea Dusha and boyfriend Michael Lynn Wright face trial in the death of their 23-month-old daughter, Lydia Wright.

Police say Dusha brought the toddler already dead to Uniontown Hospital in February of 2016, claiming the child had developed an illness. But autopsy results showed the little girl weighed only 10 lbs., when a child of that age normally weighs as much as 20 lbs.

Dr. Cyril Wecht performed the autopsy. His findings say the child died of malnutrition and dehydration.

Dusha’s attorney, Dianne Zerega, filed briefs at Fayette County court for specific evidence from the autopsy, including autopsy tissue specimen slides, complete autopsy photos and toxicology cultures.

Zerega’s client, along with her boyfriend, are accused of willfully denying the little girl food and water as she watched her siblings, 3 and 5 years old, eat without restriction.

Dusha and Wright are accused of leaving the child in a car seat for days at a time, all of this happening in a home police described as one of unbelievable squalor and filth.

Charged with criminal homicide, Dusha and Wright face the death penalty if convicted.

Dusha remains in the Greene County Prison while Wright is lodged in the Fayette County Prison. Both are being held without bail.

Medical Information Ordered for Defense in Toddler's Death

A judge has ordered prosecutors to provide additional medical information to the attorney representing a woman charged along with a man in the death of their 23-month-old daughter

    By Associated Press

UNIONTOWN, Pa. (AP) — A judge has ordered prosecutors to provide additional medical information to the attorney representing a woman charged along with a man in the death of their 23-month-old daughter.

The (Uniontown) Herald-Standard (http://bit.ly/2hG5suq) reports that prosecutors must tell 27-year-old Andrea Dusha's attorney within 90 days whether pathology slides, blood samples, tissue slides, hematology or other autopsy materials exist in the death of Lydia Wright.

Defense attorney Dianne Zerega says she requested the information in July but received no response.

Fayette County prosecutors allege that Dusha and 43-year-old Michael Lynn Wright Jr. left Wright strapped into a car seat for more than 12 hours in February 2016. A forensic pathologist said she died of malnutrition and dehydration. Prosecutors plan to seek the death penalty if they are convicted of first-degree murder.

Woman enters no contest pleas in death of toddler daughter

A western Pennsylvania woman has pleaded no contest to third-degree murder in the malnutrition= and dehydration-related death of her toddler daughter.

The (Uniontown) Herald-Standard reports that 29-year-old Andrea Dusha has agreed to cooperate with Fayette County prosecutors and testify against the child's father.

Prosecutors allege that she and 34-year-old Michael Wright Jr. left Wright strapped into a car seat for more than 12 hours in February 2016. A forensic pathologist said she died of malnutrition and dehydration.

In exchange for Dusha's no contest plea to the murder charge as well as child endangerment and reckless endangerment, prosecutors have agreed to recommend a prison sentence of 9½ to 19 years.

Prosecutors are seeking the death penalty against Wright. A judge in May agreed to a competency evaluation for him.

Uniontown Father Convicted Of Third-Degree Murder In Child’s Starvation Death

    By CBS Pittsburgh News

UNIONTOWN (KDKA) — The Fayette County man on trial in the starvation death of his young daughter has been convicted of third-degree murder.

Michael Wright Jr., of Uniontown, could face up to 20-40 years in prison for the February 2016 death of 23-month-old Lydia Wright.

As he walked out of the court room Thursday, Wright said, “I’m innocent.”

According to testimony at the trial, the girl was found living in deplorable conditions. She was strapped to a car seat and unable to move.

Investigators said Wright and his partner, Andrea Dusha, would allegedly eat meals in front of the little girl, who was malnourished and dehydrated.

“When you see, especially your own children, you put their needs ahead of your own, and that certainly didn’t happen in this case. The record was replete with one of the chief concerns of the defendant was where he could get his methadone on the very morning of [the child’s] death,” Assistant District Attorney Melinda Dellarose said.

Dusha testified against Wright during the trial.

Police say Dusha brought the toddler already dead to Uniontown Hospital in 2016, claiming the child had developed an illness. But autopsy results showed the little girl weighed only 10 pounds, when a child of that age normally weighs as much as 20 pounds.

Prosecutors asked for a first-degree murder conviction, which could have meant life behind bars for Wright, but prosecutors say they’re pleased with the verdict.

“To know that both people who are responsible for putting [the child] there are going to spend time in prison for that is very gratifying,” Dellarose said. “Unfortunately, no matter what the outcome is in the court room, [it] can’t ever bring her back.”

Dusha has pleaded guilty in the case and is waiting to be sentenced.

Wright will be sentenced on May 24.

Uniontown mother sentenced in daughter's malnutrition death

    By Mark Hoffman
    Uniontown Herald Standard

The Uniontown mother who pleaded guilty to third-degree murder in the malnutrition and dehydration-related death of her 23-month-old daughter was sentenced to up to 19 years in prison on Monday.

Andrea Dusha, 29, pleaded no contest in the death of her daughter, Lydia Wright, in August.

“I realize this is a difficult situation and has been very traumatic for me and everyone involved,” Dusha told Fayette County Senior Judge Gerald R. Solomon before he imposed a 9 ½ to 19-year sentence. “I wish to move forward from this and try to put this behind me the best I can.”

Dusha and the child’s father, Michael Wright Jr., 34, of Uniontown left Lydia strapped in a car seat at their Uniontown home for more than 12 hours on Feb. 24, 2016. The child was determined to have died hours before Dusha brought her to Uniontown Hospital.

Dusha told police the girl was a healthy baby, but had been sick for several days before she died. Forensic pathologist Dr. Cyril Wecht determined Lydia died from malnutrition and dehydration, and testified during Wright’s trial last week that at nearly 2 years old, the child weighed 10 pounds when she died.

Part of Dusha’s plea included her cooperation with prosecutors and testifying against Wright at his trial.

“She fulfilled her end of the plea bargain,” Assistant District Attorney Melinda Dellarose told Solomon.

A jury convicted Wright of third-degree murder, endangering the welfare of children and reckless endangerment last week. He will be sentenced on May 24 and faces a maximum sentence of 20 to 40 years in prison on the murder charge.

Dusha’s attorney, Wendy Williams, said there hasn’t been a day where Dusha and her family haven’t expressed regret about what Lydia’s death, and wish they could go back and change things.

As part of Dusha’s sentence, Solomon gave her credit for time she’s already served since her arrest on March 17, 2016 to the time of her sentencing.

Dusha was transported back to Greene County Prison, where she’d been housed, and will be sent to the State Correctional Institution at Muncy for compliance with her sentence.
