    Man arrested in woman's shooting death in Franklin County


    FRANKLINTON, N.C. - The man wanted in connection with his estranged girlfriend's shooting death in Franklin County Sunday evening has been taken into custody, according to WTVD ABC11.com.

    Garry Yarborough of Zebulon surrendered peacefully to authorities in Raleigh around 5:30 a.m. Monday after a SWAT team surrounded the Days Inn Raleigh Glenwood-Crabtree in the 6600 block of Glenwood Avenue.

    Franklinton Police Chief John Green said Yarborough was taken to WakeMed to be treated for a gunshot wound he sustained Sunday evening during an altercation with Tracy Williams of Franklinton.

    Green said Williams shot Yarborough as he attacked her around 5 p.m. in the parking lot of a Food Lion on U.S. 1 near a Cash Points ATM. He said Williams' gun then jammed and Yarborough fatally shot her.

    When officers arrived at the scene, they found Williams in front of the ATM with two guns, while the suspect's gun was missing. They believe she was trying to defend herself.

    An eyewitness said she heard arguing before the shots.

    Police said Yarborough fled the scene to Cornerstone Drive and fired into a home. They said he then forced a nurse living there to help him with his injury.

    According to an eyewitness, the nurse living there said Yarborough wanted her to bandage him.

    A short time later, police found the Yarborough's black SUV torched along Halifax Road in Franklin County.

    At the time of his surrender, Yarborough was seen in exclusive video captured by ABC11 limping as he raised his hands in the air. After he was released from WakeMed, he was taken to the Franklinton Police Department and charged with first-degree murder in Williams' death.

    Another man, Josiah Oakley - who the police chief called an accessory in the crime - was also taken into custody at the hotel.

    Meanwhile, authorities have said there are documented complaints of domestic abuse within the past year between Yarborough and Williams.

    Yarborough has a lengthy criminal record including drug charges and accessory to a murder.

    Father of slain Franklinton woman says he never trusted boyfriend

    FRANKLINTON, N.C. (WNCN) – The father of Tracy Williams, the woman police say was killed by her ex-boyfriend in Franklinton Sunday evening, told WNCN that he never trusted Garry Yarborough.

    “I met him – well I’ve seen him a couple of times with her – and I knew something wasn’t right about him because he never spoken to me,” William Steward, Tracy Williams’ father, said Monday.

    Steward said his daughter had mentioned having some issues with Yarborough in the past.

    Past problems included an incident where Yarborough kidnapped Williams, Steward said.

    “He jumped on her. He kidnapped her, carried her down to where he was living at and drew a gun on her, so she talked nice to him until she got away,” Steward said.

    After the kidnapping, Williams bought a gun.

    “She did everything she was supposed to. The system failed. That’s what that was,” Steward said.

    The father said he was frustrated “so bad I can’t even explain it” by what happened.

    He said he was aware the two had problems in the past.

    “I told her she’s got to watch that guy because something ain’t right about him,” he said.

    Yarborough was arrested early Monday morning in Raleigh, Franklinton Police said.

    Police apprehended Yarborough, 35, at a Days Inn at 6619 Glenwood Ave. in Raleigh. Yarborough asked to call his mother before leaving the hotel. Police said a second man, Josiah Michael Oakley of Raleigh, was also apprehended. Oakley was charged with accessory to murder. Police aren’t sure of the relationship between Oakley and Yarborough.

    Franklinton Police had searched for Yarborough since Sunday evening, after they say he shot and killed Williams, around 5 p.m. in a crowded shopping center parking lot.

    Green said his deputies had staked out Yarborough’s house the day before the shooting after Williams had taken out an order of protection against him. Police considered him a threat to Williams. Officers sat outside of his home for nearly four hours, but Yarborough never came home, Green said.

    Williams was in front of a Cash Points ATM when police say Yarborough approached, shot and killed her.

    Franklinton Police Chief John Green said Tracy Williams had recently gotten a conceal carry permit because she was afraid of Yarborough.

    Police said that Yarborough and Williams got into an altercation in the parking lot and that Williams tried fighting him off and shot him in the leg, but then her gun jammed.

    Williams then ran and that’s when Yarborough shot her.

    Yarborough fled the scene in a black SUV before authorities located the vehicle on Halifax Road. The vehicle had been set on fire, Green said.

    FRANKLIN COUNTY, N.C. (WTVD) -- The man police say killed his ex-girlfriend in Franklin County was indicted for first-degree murder Wednesday.

    Garry Yarborough, of Zebulon, is accused of shooting Tracy Williams on July 26 at an ATM in a grocery store parking lot.

    Yarborough was also indicted for burning personal property, first-degree kidnapping, felony breaking and entering, and assault with a deadly weapon with intent to kill.

    Capital trial for Yarborough

    LOUISBURG — Garry A. Yarborough will face the death penalty following a hearing Aug. 27 in which Franklin County District Attorney Michael Waters told Judge Robert H. Hobgood his office would pursue a capital case.

    Yarborough, 35, is being charged with the first degree murder of 44 year old, Tracy Williams.

    Franklinton murder suspect linked to other murder cases


    RALEIGH, NC (WNCN) — The man facing murder charges in the death of his ex-girlfriend in Franklinton has been linked to other murder cases in the triangle, according to his attorneys.

    In court last week, Garry Yarborough’s attorneys said Yarborough wrote a letter to investigators in Johnston County providing information to murder cases in Johnston and Wake Counties. The attorney’s did not specify which cases.

    Yarborough’s first defense team tells WNCN they dropped him because he refused to take their advice. Yarborough is now being represented by a public defender.

    Police arrested him in July, charging him with murdering Tracy Williams.

    FRANKLINTON, N.C. — Closing arguments were held Wednesday in the murder trial of Garry Yarborough, who is accused of ambushing an ex-girlfriend at an ATM in Franklinton, chasing her and killing her three years ago.

    Both sides agree that Yarborough killed Tracy Williams, but they disagree that it was premeditated murder.

    Witnesses to the July 2015 crime said Williams, who had sought a protective order against Yarborough, shot him once before her gun jammed, and he then chased her down and shot her in the head. "Shoots her in the back of the head and throws her out into the parking lot," prosecutor Allison Capps said.

    Yarborough's attorney said the meeting at the ATM was to discuss their relationship, and that he pulled a gun only when she frightened him.

    They say Yarborough suffers from post-traumatic stress disorder after a violent childhood, which makes him in capable of premeditation. Mental health aside, they say surveillance video that was captured shows manslaughter at worst.

    "If you ignore the mental health section and don't buy anything else, what you see on that video is not murder," said Christine Malumphy, Yarborough's attorney.

    The state disagrees. They say Yarborough planned her killing and even sent threatening text messages the night before. They say he knew what he was doing to Williams.

    "Her choices are not what brought us here today. Those are the defendants choices – calculated, conscious, deliberate choices," Capps said.

    Williams' mother said it was her daughter who had reason to be afraid. Before her death, she sought that protective order against Yarborough, changed her vehicle, purchased a gun and took conceal-carry permit classes.

    Williams' mother testified to a history of violence, noting a time when she was in the car with her daughter and they were followed by Yarborough. When they stopped, she said, Yarborough yelled at Williams, and Williams fired her gun.

    After Williams died, Yarborough went to the home of a nurse he knew to seek treatment for the gunshot wound she left in his leg. Capps said he held that woman at gunpoint to demand first aid.

    A jury will continue deliberations on Thursday morning.
