    Do You Think Texas Will Ever Get Back On The Appropriate Path With Their U.S. Death Penalty Process?

    I was just wondering because lately Texas have been lacking in their U.S. Death Penalty Process by giving multiple of U.S. Death Row Inmates stays.

    I remember when Texas use to have at least 10 Executions per month.


    Texas I hope that you get back on the appropriate path very soon in your U.S. Death Penalty Process.

    The death penalty is a very thought out process. In each active death penalty state has its own issues with obtaining drugs or a Moratorium issued by the Governor per state. There are variable reasons as to why Texas hasn't executed anyone since April 2016. Hurst V Florida is another issue in Florida and affecting Alabama as a result considering that Midazolam is the main drug to put death row inmates to death. Oklahoma is under scrutiny for the botched execution of Clayton Lockett and Charles Warner was executed with the wrong kind of drug not within its own state protocol. Oklahoma is awaiting a decision whether to adopt the priority of Nitrogen Gas to execute inmates should drugs for Lethal Injection is unavailable.

    Well we're going to find out in a few days if Texas is finally back on track. Barney Fuller is scheduled for execution in 12 days. Since he's volunteering, there's no reason other than possible lack of drugs for him to not be executed.

    Its possible Texas was simply reluctant to proceed with executions while the 5th circuit was deciding the drug testing lawsuit. When they were almost out of drugs last year they were transparent about it;there's no reason to doubt the statement that they stand ready to execute. This is similar to the lull in 2014.

    So to answer your question, I think Fuller, Edwards, and Gonzales will be executed. Its hard to say about Battaglia since he hasn't had a competency hearing yet.

    On another note concerning Texas where Wood, Ruiz, Jennings, Gonzales and Edwards filed a lawsuit on drug testing. That lawsuit was dismissed by the 5th Circuit last week, hence awaiting new execution dates for Wood, Ruiz and Jennings. Texas is paying a secret source to compound Pentobarbital at $350 per dose. Aaron is right, there is no reason to halt the execution on October 5. John Battaglia is awaiting, while Tilon Carter has a February date.
