    ORLANDO, Fla. - The trial of a man accused of killing an Orlando police officer was postponed on Monday due to the coronavirus pandemic.

    Markeith Loyd is accused of killing Lt Debra Clayton as she tried to arrest him in January 2017. He was wanted in connection with the fatal shooting of his pregnant ex-girlfriend Sade Dixon a month earlier. Clayton’s shooting resulted in a week long manhunt for Loyd, who was eventually arrested and charged with first-degree murder.

    His trial had been scheduled for May, but was postponed because court officials in Orlando decided to limit proceedings due to the coronavirus outbreak.

    When the order is lifted, officials say they will reschedule Loyd’s trial.

    ORLANDO, Fla. – Attorneys for convicted killer Markeith Loyd have filed a motion in court asking for the removal of prosecutor Ryan Williams from his second murder trial.

    Loyd is accused of killing Orlando police Lt. Debra Clayton in 2017, while investigators were looking for him in connection with the murder of his pregnant ex-girlfriend, Sade Dixon.

    The motion was filed Monday and cites a conflict of interest between Williams and State Attorney Brad King. Williams previously worked for Orange-Osceola State Attorney Aramis Ayala when the Loyd case was removed from her by then Gov. Rick Scott.

    Loyd was convicted last year for the murder of Dixon.

    Loyd’s trial in the Clayton case was scheduled to begin in May but was postponed.

    A new trial date has not yet been scheduled.

    Orlando officers acted ‘reasonably’ when they beat accused cop killer Markeith Loyd, report says

    OPD officers cleared of wrongdoing in use of force response

    ORLANDO, Fla. – An Orlando Police Department internal review found that four officers acted “reasonably” when they delivered blow after blow while arresting accused cop killer Markeith Loyd on Jan. 17, 2017.

    The 51-page report released Thursday evening provided detailed accounts from each of the four officers as well as testimony from other law enforcement officers on scene who surrounded the home on Lescot Lane and witnessed Loyd crawling across the yard before he was taken into custody.

    All four officers who kicked, punched or otherwise struck Loyd expressed similar fear, saying they knew Loyd was accused of killing Orlando Police Sgt. Debra Clayton execution style outside a John Young Parkway Walmart nine days earlier and they didn’t want to meet a similar fate.

    Loyd was not interviewed as part of the investigation. However, as he was being escorted to jail after his 2017 arrest with his face covered in blood, he repeatedly yelled, "They beat me up" to members of the media.

    Already, the Florida Department of Law Enforcement had conducted its own review of what happened during the violent arrest. Those findings were sent to State Attorney Phil Archer who agreed the officers acted within reason, citing the state’s Stand Your Ground law.

    In OPD’s review, Sgt. James Parker, Sgt. Anthony Mongelluzzo, Officer Cedric Hinkles and Officer Jonathan Cute described Loyd’s actions that led them to believe he could be hiding a weapon under his bulletproof vest as he crawled toward the street.

    Hinkles’ and Cute’s names were redacted from OPD’s internal investigation but they were previously made public when Archer released his findings in October.

    In addition to Loyd crawling without using his legs, the officers said that the way Loyd was looking around made them believe he was plotting something. They also noted that he had the chance to surrender when he was confronted at the back of the house but instead went back inside, then tried to escape from the carport where he was confronted a second time before ultimately throwing two guns out the front door and exiting the house that way.

    The fact that Loyd was wearing a ballistic vest also led to suspicion, the officer said. That, on top of information they’d received in daily intelligence briefings that Loyd didn’t want to go back to prison and was willing to put up a fight put them on edge, records show.

    “The evening that we located him everybody was on high alert,” Parker said. “We thought for sure he was trying to go down in a blaze of glory.”

    Each of the officers was asked to justify each time they used force on Loyd.

    All in all, Parker kicked Loyd in the face, delivered two or three muzzle strikes with his rifle to Loyd’s back and punched the right side of Loyd’s face; Mongelluzzo delivered one muzzle strike to Loyd’s back and kicked Loyd once in the lower back and once in the shoulder; Hinkles kicked Loyd on the left side of his face and on the left shoulder blade, delivered one muzzle strike to the left side of his face and punched Loyd three times in the left shoulder; and Cute kicked Loyd once in the left side of his face, according to an earlier report released by Archer’s officer.

    Loyd lost his left eye as a result of the beating. His lawyer also claims he now suffers from multiple traumatic brain injuries.

    One sergeant who was not involved in the arrest but reviewed the video and statements said Loyd was at first passively resisting by not following commands to look away and by not putting his hands behind his back but then moved to resisting actively when he tensed his arms as officers were trying to handcuff him.

    One officer agreed that Loyd was at first passive, possibly as a way to trick officers and “ambush” them once they thought he was complying.

    “I had it pictured, he’s going to roll because everyone... now you’ve got three to four guys within hand’s reach of this guy and obviously the only thing he could conceal in his pants would be a handgun at he time,” an officer whose name was redacted said. “It’s going to be fast, even if he gets hit by us he’s going to at least take one more person with him and that’s my God’s honest thought that I had in that time frame.”

    The sergeant said each blow was justified based on the totality of the circumstances.

    All four officers interviewed stood by their actions. All four were also asked if they used force as a form of retaliation since they knew Loyd was accused of killing Clayton and his pregnant ex-girlfriend, Sade Dixon. All four replied no.

    Of everyone interviewed, the only person to raise an alarm was a sergeant from the Orange County Sheriff’s Office who said the officers’ behavior when they stood over Loyd as a group while Loyd was on the ground was “inappropriate.”

    The sergeant said he told the officers, “Hey, enough, enough. Back up, back up” in order to diffuse the situation. He also said he saw an unknown officer spit in Loyd’s direction.

    The review included an investigation into claims that Loyd was beaten after he was handcuffed as he was positioned behind patrol cars outside the Lescot Lane home and allegations that Loyd was sexually assaulted after his arrest

    One deputy admitted that Loyd was “jostled around a bit” as law enforcement officers tried to remove his bulletproof vest but “it wasn’t in a malicious or you know, a bad manner of any way.”

    The report ultimately concluded there was no evidence of either of those two claims.

    The lengthy document ends with a summary of the allegations against Loyd, the intelligence they had gathered on him which included his propensity toward firearms and other factors that led officers to believe he could have been planning to open fire.

    “Given the totality of the circumstances, (the officers) used force which they reasonably believed necessary to prevent imminent death or great bodily harm to themselves, fellow officers of nearby civilians,” the report read.

    “None of the officers involved in the apprehension of Loyd were equipped with a Taser, chemical agent of ASP baton. All four utilized intensified techniques in a low-light environment to overcome the actions of a known violent fugitive.”

    Loyd was sentenced to life in prison in October for fatally shooting Dixon and injuring her brother as he tried to protect her. He has yet to stand trial in connection with Clayton’s death.

    Accused cop killer Markeith Loyd tells News 6 he ‘meets violence with violence’

    The man accused of shooting and killing Orlando Police Lt. Debra Clayton claims he was “in fear for his life and ready to fight fire with fire” while being sought by authorities for a previous murder, according to a letter he recently sent to News 6.

    Markeith Loyd does not explicitly confess to killing Clayton in the six-page letter mailed from the Orange County Jail, where he is being held while awaiting trial.

    But Loyd never denies shooting the police officer and offers possible justifications for his actions in the letter, potentially providing a glimpse into Loyd’s courtroom defense strategy.

    “This never had to happen, but the investigator and police had a hidden agenda, and that blowed up in they face and now they want to place blame on me cause I was fighting for my life from a system that was hell bent on killing me,” Loyd wrote.

    Last year, a jury convicted Loyd of murdering his ex-girlfriend, Sade Dixon, and their unborn child during a shooting outside Dixon’s home in December 2016. Dixon’s brother, Ronald Steward, was injured in the altercation.

    Loyd is currently serving a life prison sentence for that crime.

    While on the run from authorities after killing Dixon, investigators said Loyd gunned down the police officer in the parking lot of an Orlando Walmart.

    If a jury convicts Loyd of murdering Clayton, prosecutors intend to seek the death penalty.

    “This evil [expletive] system created the Walmart incident with Clayton,” Loyd wrote in his letter to News 6. “I never wanted that to happen, as I didn’t want the incident to happen with Sade, my child and Ron.”

    Following Dixon’s death, Loyd claims police and the media portrayed him as a “monster” and “mad man” while spreading what he described as “lies” about the shooting, which Loyd unsuccessfully tried to convince jurors was done in self-defense.

    “I knew I was being set up to be killed,” Loyd wrote.

    While Loyd was shopping at Walmart in January 2017, investigators said a customer recognized him as being the wanted man and alerted Clayton, who was also in the store while dressed in her Orlando Police Department uniform.

    Walmart security camera footage, which has never been released publicly, reportedly showed what happened next.

    According to investigators, Clayton can be seen running after Loyd in the parking lot.

    Loyd then loops back and pulls a handgun from his waist, according to investigators.

    Authorities said the video captured Loyd firing three shots at the police officer, striking her once in the hip and causing her to fall.

    “The suspect advances towards her with his right arm outstretched and repeatedly firing his gun at [then-]Sgt. Clayton while she is on her back,” an arrest affidavit stated.

    After Clayton fired her weapon seven times, investigators said Loyd stood over her and shot at her several more times.

    One of the bullets fatally struck Clayton in the neck, the medical examiner concluded.

    Loyd then drove away from the Walmart, investigators said.

    In his letter to News 6, Loyd claimed police were trying to hunt him down and kill him.

    “Never been a rabbit and always been a lion,” Loyd wrote. “I meet peace with peace and violence with violence.”

    Loyd disputed allegations that he ambushed Clayton outside the store.

    “If anyone was ambushed, it was me coming out of Walmart,” he wrote.

    Loyd’s attorney, Terence Lenamon, stated in a recent court filing that the Orlando Police Department failed to investigate Clayton’s actions.

    “They did not attempt to determine whether she fired her firearm first at the defendant or whether the defendant was responding to her action when he initially fired his weapon,” Lenamon wrote in a motion.

    The defense attorney then raised the possibility that the police officer may have broken the law before she was killed.

    “(The) Orlando Police Department completely ignored a possible strike mark and a projectile recovered at the scene, evidence which would support the theory that Clayton fired first before the defendant drew his weapon, possibly in violation of OPD policy and Florida law,” Lenamon wrote in the court filing.

    In a bold accusation, Loyd’s letter to News 6 alleges that police “doctored” a portion of the Walmart security video.

    Loyd claims a copy of the video law enforcement shared with his attorney “[leaves] out the image where I’m running with my back turned to Clayton as she has her gun arm extended pointed at my back”.

    Loyd’s attorney filed a motion in April demanding that a defense expert be allowed to examine the original security video due to alleged discrepancies involving the number of frames per second that were captured by the cameras.

    Prosecutors deny that the surveillance video was altered.

    “We are aware of no evidence that has been tampered with or changed,” said Chief Assistant State Attorney Ric Ridgway. “The defense has an ‘expert’ who will testify about some ‘variance in the frame rate’ of the Walmart video. Apparently, if that does exist, it is a result of the equipment used to record the video, not due to tampering.”

    Lenamon did not respond to specific questions emailed to him by News 6 inquiring whether he agreed with Loyd’s characterization that the video was “doctored.”

    “As I always maintain, the story of the events leading up to and after the shooting of Debra Clayton will be told in the courtroom; either during pretrial litigation or during the trial,” Lenamon replied in an email.

    The police officer’s widower said he assumed Loyd would attempt to portray himself as a victim during his trial for Clayton’s murder, just as he did when he was on trial for killing his ex-girlfriend.

    “I’m not surprised by this,” Seth Clayton told News 6 when informed about Loyd’s correspondence.

    In his letter, Loyd claims Orlando police “tortured me and took my eye” when he was taken into custody for Clayton’s murder.

    Although Loyd lost the use of his eye due to blows he received from officers while being arrested outside an abandoned house, an outside state attorney who reviewed the officers’ actions concluded their use of force was justified.

    An internal Orlando Police Department investigation recently determined its officers acted reasonably while arresting Loyd.

    “If black lives matter, where they at?” Loyd wrote as he concluded his letter to News 6. “‘Cause it don’t get no blacker (than) me. I’m the side that survived. I guess that don’t count.”

    ORLANDO, Fla. — The attorney representing Markeith Loyd has filed a motion to dismiss the convicted murder’s upcoming second murder trial for the death of Orlando Police Lt. Debra Clayton.

    His attorney, Terence Lenamon, argued that the upcoming trial goes against the doctrine of “collateral estoppel,” which prevents someone from being tried for the same crime twice.

    Loyd was scheduled to go to trial in May for the shooting death of Clayton, but the trial has been delayed due to COVID-19. Investigators say he killed her in a Walmart parking lot in 2017 while on the run for killing his pregnant ex-girlfriend Sade Dixon.

    In a motion filed Aug. 13, his attorneys said the evidence related to the Clayton case was used to convict him for Dixon’s murder.

    “The State is getting two bites at the very same apple, which is precisely what is intended to be barred by the doctrine of collateral estoppel,” Loyd’s attorneys wrote in the motion.

    The attorneys argued that the jury in the Dixon trial “indisputably used, relied on, and made ultimate determinations concerning that evidence to support its verdict in the initial trial.”

    Loyd was sentenced to life in prison after being convicted of first-degree murder in Dixon’s trial.

    ORANGE COUNTY, Fla. — Convicted killer Markeith Loyd’s attorney is asking an Orange County judge find that a supreme court order is a violation of his rights.

    Loyd was convicted of killing his ex-girlfriend, Sade Dixon, and her unborn child, but he still has to go to trial for the death of Orlando Police Lt. Deborah Clayton. That trial has been put on hold due to COVID-19.

    Before they can move forward, Loyd’s attorney says he’s not ready to pick a jury until he is sure that he gets a diverse jury pool.

    His attorney takes issue over the Florida supreme court’s ruling that in order to limit contact during COVID-19, each chief judge should tell the clerks of court to create a process that will enable the automatic excusal of someone who can’t meet the courts phase 2 or 3 screening requirements, is high risk or is taking care of kids because of COVID-19 disruptions.

    The court also said anyone who has just gotten back to work or is financially struggling because of the pandemic can have a pass from jury summons for six months.

    Loyd’s attorney wants the circuit court to rule that unconstitutional.

    “The order will create a process that systematically and disproportionately excludes African Americans and other minorities, which would violate the defendant’s constitutional rights to a jury selected from a body reasonably representative of the community,” his attorney wrote.

    Loyd has a hearing scheduled for later this month.

    ORLANDO, Fla. — On Tuesday, an Orange County judge heard the first motions since the start of the pandemic in the second Markeith Loyd murder trial. Judge Leticia Marques says Loyd will not face a jury until 2021.

    Loyd is accused of shooting and killing Orlando Police Lt. Debra Clayton in January 2017.

    Judge Marques is making it clear to both sides that the jury will eventually determine whether the shooting death of Clayton was first-degree murder, and if it was, if Loyd will get a life sentence or a death sentence.

    Everyone in the courtroom was wearing masks, and at times, they had trouble hearing each other.

    The defense and the state filed multiple motions this year, including whether a jury needs to be unanimous in a death penalty case.

    "This case is not going to be tried this year. I did my best to try and get it done, so it's not going to be done this year. So, I'm going to give this some time, to see if anything the Supreme Court does with standard jury instructions. There's also several death penalty cases up before the Supreme Court right now, whose rulings may or may not effect my position on this," Judge Marques said.

    The judge said as they get closer to trial, there will be a day devoted to jury instructions in this case.

    The defense continues to push that Loyd pulled out his gun after Clayton shot at him.

    Loyd is already convicted in the shooting death of his pregnant ex-girlfriend Sade Dixon, where a jury recommended life in prison.

    ORLANDO, Fla. — Wednesday marks the second day of hearings for the trial of the man accused of killing an Orlando Police lieutenant in 2017.

    Markeith Loyd was already a wanted man when deputies say he shot Lt. Debra Clayton while she was trying to question him.

    The judge set aside two days so both the defense and prosecution could present a host of motions.

    One motion from the defense attorney was a request to have the court reporter identify potential jurors by their race.

    The judge, astounded, asked how that would work.

    Loyd's attorney also filed a motion to stop all law enforcement, except those testifying, to appear in court in uniform because it might intimidate the defendant's family and show support for it and Clayton's family.

    The judge agreed and added she didn't want to see visible weapons, badges on plain clothes, or anything depicting Clayton's face, such as buttons or shirts.

    Loyd's attorney also asked the judge to ban camera's from the courtroom.

    The judge told him first, by law, he would have to notify every television station and the newspaper.

    He would then have to file a proper motion before she would consider it.

    Judge granted Loyd’s motion to act as his own attorney at trial

    ORANGE COUNTY, Fla. – Convicted killer Markeith Loyd will now act as his own attorney in his upcoming trial for the death of Orlando Police Lt. Debra Clayton.

    A judge granted Loyd’s handwritten motion on Monday, according to the Orange County Clerk of Courts website. It is not clear exactly when the motion was filed but the postmark on the document shows a date of July 27, 2021.

    In the motion, Loyd cites section 1 of the 14th Amendment, ”Nor shall any state deprive any person of the life, liberty, or property without due process of law; nor deny any person within it’s (sic) jurisdiction the equal protection of the law,” as well as the 6th amendment, ”expressing the peoples (sic) right of self representation (sic).

    The judge also ordered that attorneys Teodoro Marrero and Terrance Lenamon remain on as standby counsel to Loyd.

    As of this writing, Loyd's trial for the shooting death of Clayton is set for Oct. 8.

    Markeith Loyd won’t represent himself in second murder trial; lawyer reinstated

    Trial starts Oct. 8

    ORLANDO, Fla. – Convicted murderer Markeith Loyd will no longer be representing himself in his second upcoming murder trial, according to court records.

    Loyd is accused of shooting and killing Orlando police Lt. Debra Clayton outside a Walmart in 2017 while he was on the run for killing his pregnant ex-girlfriend, Sade Dixon, outside her home. He was previously convicted of Dixon’s slaying and is set to stand trial for Clayton’s death in October.

    A judge granted Loyd’s handwritten request to represent himself in his second trial on Aug. 2 but Loyd later filed another motion asking for legal help in the form of co-counsel.

    On Friday, Loyd’s former attorney Terry Lenamon was reappointed as his counsel. Lenamon specializes in first-degree murder defense and death penalty cases.

    If convicted of killing Clayton, Loyd could face the death penalty.

    Loyd was convicted in October 2019 of killing Dixon. He’s also already serving a life sentence for that conviction.

    The trial is still scheduled to begin on Oct. 8 and is projected to last six to eight weeks.
