    Markeith Loyd taken into custody in slain officer's handcuffs

    ORLANDO, Fla. - The man accused of killing his pregnant ex-girlfriend and an Orlando police officer is in custody after a massive nine-day manhunt, according to the Orlando Police Department.

    News of Markeith Loyd's arrest was announced on Twitter Tuesday night by Orlando police. A search for Loyd, 41, has been underway in Central Florida since Lt. Debra Clayton was fatally shot while trying to approach Loyd outside an Orlando Walmart the morning of Jan. 9.

    Law enforcement sources told News 6 that authorities surrounded a house at 1156 Lescot Lane in Metro West and ordered Loyd to surrender Tuesday just before 7 p.m. Loyd crawled out of the house covered in body armor and armed with two guns, Orlando Police Chief John Mina said during a news conference Tuesday night.

    Mina said Loyd initially tried to escape out the back through a sliding glass door, but then came out through the front door and dropped the two guns on the ground.

    One of those guns had a 100-round capacity, Mina said.

    Loyd resisted arrest but no law enforcement officers were injured during Loyd's capture. Mina said Loyd is being treated for facial injuries, which he described as "minor."

    No one else was inside the home when Loyd was taken into custody. The house was abandoned and Mina does not know how long Loyd had been hiding inside.

    Markeith Loyd could face death penalty, legal experts say

    The search for an accused police killed ended after nine long days but the road to justice is far from finished, legal experts say.

    Orlando, Orange County, state and federal law enforcement officers captured Markeith Loyd, 41, Tuesday evening at an abandoned house five-minutes from where police said the suspect gunned down Orlando police Lt. Debra Clayton at Walmart on Jan. 9.

    Clayton was attempting to contact Loyd at the John Young Parkway store because he was wanted on a warrant for the Dec. 13 shooting death of his former pregnant girlfriend.

    Loyd will likely have a first appearance in Orange County on Wednesday where his bail will definitely be denied, News 6 legal expert Steven Kramer said.

    "He will be kept in isolation in jail," Kramer said. "He has nothing to lose."

    Loyd was held up in an abandoned Orlando house with two firearms, one with a 100-round drum attached, and was wearing body armor, according to Orlando police.

    The man Crimeline offered a $100,000 reward for faces a slew of charges which could result in a death sentence, Kramer said.

    Orange County Sheriff Jerry Demings said deputies will serve warrants Tuesday night to charge Loyd with two first-degree murder charges and two counts of aggravated assault with a firearm for the shooting death of his former girlfriend, 24-year-old Sade Dixon and her unborn child.

    Loyd is also charged with one count of attempted homicide for allegedly shooting Dixon's brother, Demings said.

    Orlando police have not yet announced the charges related to Clayton's death.

    First-degree murder of a law enforcement officer is punishable by death or life in prison without parole.

    Kramer said it is unclear whether Loyd will also be charged with felony murder for Deputy First Class Norman Lewis, who was fatally struck while on his motorcycle attempting to aid in the search for Loyd.

    Orlando police Chief John Mina said after Loyd's capture that more arrests are coming for people who aided and abetted Loyd on his run from the law.

    Loyd's former boss, his niece and an ex-girlfriend were arrested this week and charged with helping Loyd avoid capture.

    The property where Loyd was captured is tied to some of his known associates, Mina said.

    As for a trial, it won't happen anytime soon, Kramer said. It could be months before all the evidence and witnesses are processed.

    The prosecutor who is assigned to the case will be "a skilled pro who knows what they are doing with death cases," Kramer said.

    Unless Loyd hires another defense lawyer, he will receive a public defender.

    Loyd will be tried at the downtown Orange County Courthouse. Both Orlando and Orange County are in the Ninth Judicial Circuit Court.

    9:13 p.m., Dec. 13: Sade Dixon, a 24-year-old pregnant mother of two, opened the door to her parents' Pine Hills home to find Loyd, her ex-boyfriend, standing outside, police said. He opened fire, police said. Dixon is fatally shot and her 26-year-old brother, Ronald Steward, is wounded in the gunfire trying to protect his sister. Dixon's children, ages 2 and 8, were home at the time of the shooting. They were unharmed.

    Afternoon, Dec. 14: Stephanie Dixon-Daniels and Ron Dixon held a press conference outside their Pine Hills home to beg the community for help in finding their daughter's killer. “We would like the killer, you know who you are – turn yourself in. Don't make them come get you,” Dixon-Daniels said. Orlando City Commissioner Regina Hill also attended the press conference.

    5:15 p.m., Dec. 14: The Orange County Sheriff's Office named Loyd as a suspect in Dixon's murder and her brother's shooting. A news release listed Loyd as armed and dangerous.

    5 p.m., Dec. 15: Loyd's criminal history starts to come to light. He was arrested on a murder charge in 1995, but that charge was later dropped because a witness lied about key information. In 1998, he's accused of battery on a law enforcement officer, for which he spends four years in jail.

    7:17 a.m., Jan. 9: A civilian at Walmart at Princeton Street and John Young Parkway approached Orlando police Master Sgt. Debra Clayton, 42, and told her that Loyd is at the store. Clayton radioed in for backup and approached Loyd. A witness told News 6 that Loyd started shooting when Clayton yelled for him to stop running. Orlando Police Chief John Mina said additional officers arrived within 28 seconds, but by that time Clayton was already down and Loyd had left the scene. Shortly after, a deputy spots Loyd at North Lane and Pine Hills Drive. Loyd pulls into a nearby apartment complex and shoots the unmarked OCSO SUV twice, officials said. The deputy was not injured. Loyd then carjacked a vehicle and left before abandoning the vehicle near the intersection of Rosemont and Cinderlane Parkway.

    7:19 a.m., Jan. 9: Officers at Walmart radioed in to say an officer was down and broadcasted a call for help. First responders perform CPR on Clayton and transport her to a local hospital.

    7:40 a.m., Jan. 9: Clayton, 42, is pronounced dead at Orlando Regional Medical Center. Clayton was a 17-year veteran of the Orlando Police Department as well as a wife, mother and University of Central Florida alumna with a bachelor's degree in public administration and a master's degree in criminal justice.

    9 a.m., Jan. 9: Seventeen Orange County schools are placed on lockdown.

    9:36 a.m., Jan. 9: The Orlando Police Department names Loyd as the suspect in Clayton's death.

    12 p.m., Jan. 10: Lake County Sheriff's Office helps OCSO and OPD search a home in Clermont, acting on a lead that Loyd could be inside. The homeowner consents to the search. Loyd was not found.

    1:48 p.m., Jan. 10: The FBI Most Wanted Twitter account tweeted a photo of Loyd.

    1:50 p.m., Jan. 10: Officials announce that Clayton's funeral will be held Saturday at 2 p.m.

    2:30 p.m., Jan. 10: Demings announces that the Crimeline reward has been raised to $100K, the biggest reward Crimeline has ever received. Officials said they are working to get arrest warrants signed for the people they believe have been helping Loyd evade arrest for several weeks.

    9:21 p.m., Jan. 10: Zarghee Mayan is booked into the Orange County Jail on a charge of accessory after the fact to first-degree murder. Officials said Mayan helped Loyd avoid arrest after Dixon's murder in December. He also told authorities that Loyd has been wearing a bulletproof vest.

    12:39 p.m., Jan. 11: OCSO tweets a link to a GoFundMe page to benefit Lewis' family.

    3 p.m., Jan. 11: Lakensha Smith-Loyd, Markeith Loyd's niece, is arrested on an accessory after the fact to first-degree murder charge for transporting $200 to her uncle after Dixon's murder, police said.

    8:15 p.m., Jan. 11: A third person is arrested in connection with the search for Loyd. Officials identified the woman as Jameis Slaughter, one of Loyd's ex-girlfriends.

    9:30 a.m., Jan. 12: Smith-Loyd and Slaughter appear before an Orange County judge. Slaughter's bond is set at $505,000 and Smith-Loyd's bond is set at $750,000. The prosecutor said in court that Smith-Loyd knows where her uncle Markeith Loyd is. "I think it's reasonable to assert that as she stands here today, she knows where he is and has not furnished that information," the prosecutor said.

    3:30 p.m., Jan. 12: More than 100 places have been searched in the manhunt for Loyd, Orlando Police Chief John Mina said. Loyd's clothing was found near the crime scene were he allegedly shot and killed Sgt. Clayton. Police said Loyd was wearing a bulletproof vest when he shot Clayton and she returned fire. The vest may have saved his life, Mina said. Crimeline Executive Director says more than 800 tipsters have called in.

    12:55 a.m., Jan. 13: The Orange County Sheriff's Office announces that the funeral for Lewis has been postponed until Sunday because of a family emergency.

    8:10 a.m., Jan. 13: The search for Loyd expanded into Polk County, as authorities in Haines City issued an alert about the suspected cop killer. Haines City police said Loyd has family in the area and may be hiding in the city. Lakeland police and the Polk County Sheriff's Office also tweeted information about the search for Loyd, urging residents to call 911 and vowing to find Loyd if he's in the area.

    2:45 p.m., Jan. 14: Orlando Police Chief John Mina posthumously promoted fallen Master Sgt. Debra Clayton to the rank of lieutenant during her funeral.

    I do hope that once Jeff Sessions becomes Attorney General he'll immediately launch a Justice Department investigation into what may well be an egregious violation of Loyd's civil rights.

    Markeith Loyd might escape death penalty without fix in law

    TALLAHASSEE - Markeith Loyd, accused of killing his ex-girlfriend and an Orlando police officer, could escape facing capital punishment if the Legislature doesn't fix Florida's death penalty law.

    Rulings from the U.S. Supreme Court and Florida Supreme Court last year nullified the state's capital punishment statutes. Lawmakers would have to change the law to comply with the rulings before Loyd's possible conviction in order for prosecutors to seek the death penalty against him, some Central Florida defense lawyers say.

    "The Legislature will have to do something ... before anybody gets sentenced to death," said J. Edwin Mills, an Orlando attorney who has defended murder suspects.

    Loyd was captured by Orlando police on Tuesday night after a weeklong manhunt. He is accused of gunning down Orlando Police Lt. Debra Clayton on Jan. 9 and his pregnant ex-girlfriend Sade Dixon on Dec. 13.

    Steven Laurence, an Altamonte Springs attorney and death penalty expert, predicted that the absence of a new law won't stop prosecutors from seeking capital punishment. A judge could instruct the jury that all 12 of them would have to agree for Loyd to be sentenced to death, he said.

    A defense attorney would be sure to appeal, he added, but the sentence might survive the challenge.

    Yet the law still needs to be fixed to remove the cloud of confusion surrounding potential death penalty cases.

    "The question is when will the Florida Legislature re-enact a constitutional death penalty statute?" said Belvin Perry Jr., former chief judge in Orange and Osceola counties.

    Rep. Chris Sprowls, R-Palm Harbor, is leading House efforts to rewrite the law. He said the Loyd case has brought home the need to move swiftly to get a valid law in place.

    "This situation makes it more of a reality for people, but we knew it was a reality before," Sprowls said. "There is still a sense of urgency."

    Sprowls said he is confident the Legislature will be able to fix the law in time for it to apply to Loyd.

    "The fact of the matter is we'll have a death penalty in place before his trial starts," Sprowls said.

    Sprowls hasn't submitted a bill yet, but Sen. Randolph Bracy, D-Orlando, has filed SB 280, which would require unanimous votes from juries to sentence a defendant to death.

    The U.S. Supreme Court ruled in January 2016 that Florida's law allowing split juries, even by a 7-5 vote, to recommend a death sentence to a judge, who would then make the final sentence, was unconstitutional.

    Florida lawmakers responded by changing the law to require a 10-2 jury vote, but the Florida Supreme Court ruled in November that a unanimous jury is required.

    The Legislature can't pass any laws until its session begins March 7. In theory, a defense attorney for Loyd could demand a speedy trial, which would have to begin within 60 days of the request.

    Sprowls, a former Hillsborough County prosecutor who has tried capital cases, says that's not nearly enough time for any defense lawyer to conduct a full inquiry into the case, including interviewing witnesses and getting depositions.

    Orange-Osceola State Attorney Aramis Ayala declined to comment on whether she would seek the death penalty in the case. A spokeswoman wrote it was "premature to comment on the Loyd cases as it is an open and active investigation."

    A spokeswoman for the Public Defender's office that covers Orange and Osceola counties also declined to comment.
