Joshua Lee Burgess - North Carolina Death Row

Trial set for man accused of strangling, murdering daughter in Union County

    WSOCTV.com

UNION COUNTY, N.C. — The trial for a Union County father accused of murdering his daughter has been set for May. The state is pursuing the death penalty against him.

Channel 9 had followed the tragedy since 2019.

Zaria Burgess was just 15 when she died, and authorities haven’t released a motive in the murder yet.

On Monday in court, Joshua Burgess looked very similar to his August 2019 mugshot.

Joshua Burgess faces a list of charges in the case, including first degree murder as well as statutory rape and kidnapping. He’s been in the Union County jail since Zaria Burgess’s death.

The details of the case are disturbing. Investigators say Zaria Burgess was visiting her dad for the weekend at his Wesley Chapel home. They said Joshua Burgess strangled his daughter, then slit her throat inside the house.

Deputies said he later walked to the sheriff’s office, turned himself in, and told them where to find her body.

On Monday, his defense attorneys asked for his admission to be scrubbed from the record, claiming a right to a fair trial.

The state, in addition to pursuing the death penalty, also asked that Burgess be chained during the trial on behalf of the Union County Sheriff’s Office. A deputy expressed safety concerns over the nature of the crime, fearing Burgess could act out. The judge said he will rule at a later date.

Zaria Burgess was a rising sophomore at Monroe High School. She was a member of the marching band and dance team. At the time, her family told Channel 9 she was a kind girl who loved her family. She was a cheerleader whose friends remembered her as “bubbly and bright.” She was someone who kept her teammates laughing.

The next step in the case is the selection of the jury. More details are expected to come to light once the trial begins.

Union County man given death penalty for brutal murder of his daughter

A jury sentenced Joshua Lee Burgess to death after murdering his 15-year-old daughter

    By WBTV Web News Staff

MONROE, N.C. (WBTV) - A Union County jury sentenced a man to death for the brutal murder of his daughter on Friday.

Joshua Lee Burgess, 35, murdered his 15-year-old daughter, Zaria, on Aug. 18, 2019, after torturing her for 22 hours at his home near Airport Road in Monroe.

Burgess slit her throat after psychologically and sexually abusing her, according to the Union County District Attorney’s Office.

He was convicted of one count of first-degree murder, one count of statutory rape, three counts of statutory sex offense, and one count of first-degree sexual exploitation of a minor.

“The details of this murder are indescribable,” Union County Sheriff Eddie Cathey said in a 2019 WBTV story. “Every officer and detective involved in this case is feeling the effects of what happened to this child. There is no logical answer to explain why this man did what he is accused of doing. Our hearts and prayers are with [the victim’s] mom and her family.”

WBTV also reported in 2019 that Burgess turned himself into the sheriff’s office and admitted to killing his daughter.

The case was investigated by the Union County Sheriff’s Office and prosecuted by District Attorney Trey Robison and Assistant District Attorney Mary Beth Usher, with the significant assistance of ADA Cristin Dunne and DA Office Investigator Ronnie Watkins.
