Attorneys appointed in Muscle Shoals capital murder case

A man charged with capital murder, who police said drove his brother to a residence and then helped him get away after the homeowner was shot, was in court Friday to get appointed attorneys.

Colbert County Circuit Judge Hal Hughston Jr. postponed an arraignment for Jeremy Michael Credille until legal representation was appointed.

Credille, 32, 425 W. Lee Ave., Florence, was arrested in January after he was indicted by a Colbert County grand jury.

Credille is the brother of Ronnie Lee Credille, 39, of Florence, who along with Erica Fox, 36, of Muscle Shoals, was arrested Aug. 26, 2016, and charged in connection with the shooting death of Jason Fox.

Erica Fox was married to Jason Fox at the time of the shooting. Police said Ronnie Lee Credille is Erica Fox’s boyfriend.

Hughston said Credille had originally indicated he had an attorney but it was now his understanding that he needed one appointed. Hughston then appointed Tuscumbia attorneys B.T. Gardner and John Kennemer to represent Credille.

“I’m going to postpone the arraignment at this time. I’m sure your attorneys will be wanting to file some motions and the state will want a chance to answer those,” Hughston said Friday. “We’ll set the arraignment for later.”

Credille, Ronnie Credille and Erica Fox were all indicted for capital murder during the January grand jury session.

Ronnie Credille’s arraignment was scheduled for Monday, but was postponed and has not been reset. Erica Fox will be arraigned April 6 by Circuit Judge Jackie Hatcher.

Police said Jeremy Credille is accused of driving Ronnie Credille to Fox’s residence on Grand Avenue in Muscle Shoals and then picking him up after Ronnie Credille shot and killed Jason Fox.

Fox, 40, was found inside the door of his house on Aug. 12. Reports indicate he was shot once in the head with what is believed to be a 9 mm pistol. Police said Fox owned a 9 mm pistol and a .22-caliber pistol. Neither were found in the house.

According to the arrest affidavit, Fox and Ronnie Credille talked to each other several times about killing her husband for insurance money so they could be together.

All three are being held in jail without bail.

Suspect pleads guilty to capital murder

TUSCUMBIA -- One of three people accused of capital murder in the 2016 shooting death of a Muscle Shoals man pleaded guilty to the charge Tuesday.

Ronnie Credille issued the plea in front of Colbert County Circuit Judge Hal Hughston Jr. As part of the agreement, Credille, 40, received a sentence of life in prison without parole. He is expected to testify against co-defendant Erica Fox.

The punishment for capital murder is either life without parole, or the death penalty.

The charges stem from the slaying of Fox's husband, Jason Fox, 40, who was found inside the doorway of his house on Aug. 12, 2016. Reports indicate he was shot once in the head with what is believed to be a 9 mm pistol.

During Tuesday's hearing, Ronnie Credille stood before a packed courtroom and apologized.

"I'm sorry for what I've done," he said. "I know I can never take back what I've done."

After the hearing, Colbert County Chief Assistant District Attorney Kyle Brown said he had talked with Jason Fox's family about the plea.

"We've been in touch with the Fox family quite frequently through all this," Brown said. "The plea agreement assures he will never get out of jail and his life will end in prison."

Assistant District Attorney Angela Hulsey said investigators had an excellent case against Credille.

"I commend the Muscle Shoals Police Department for their very hard work and dedication to this case," Hulsey said.

Defense attorneys Robert Graham and Nathan Johnson issued a statement after the hearing explaining that they believe the plea was the best scenario for both sides.

"Mr. Credille admitted to it," the statement added. "He's remorseful and he did the right thing today. He did not want to put either family through any more agony. Our hearts go out to the Fox and Credille families. Our investigator, Junior Witt, did an excellent job working on the defense team."

They went on to thank the Muscle Shoals police investigators for their openness throughout the case.

Erica Fox's capital murder trial was scheduled to begin earlier this month, but was postponed when Colbert County Circuit Judge Jackie Hatcher agreed to a request from her attorneys to have a mental evaluation done on their client.

Credille and his brother, Jeremy Credille, 32, of Florence, were indicted in January on capital murder charges.

According to the arrest affidavit, Erica Fox and Ronnie Credille talked to each other several times about killing her husband for insurance money so they could be together.

Police said Jeremy Credille is accused of driving Ronnie Credille to Fox's residence on Grand Avenue in Muscle Shoals, and picking up his brother after Ronnie Credille shot and killed Jason Fox.

All three suspects are being held in jail without bail.

    Fox trial rescheduled

    By Tom Smith
    The Times-Daily

TUSCUMBIA — The trial of a Muscle Shoals woman accused of instigating the 2016 shooting death of her husband has been rescheduled for October.

Colbert County Chief Assistant District Attorney Kyle Brown said Thursday the capital murder trial of Erica Fox has been placed on the Oct. 22 circuit court docket.

Fox, 38, is charged in the shooting death of her husband, Jason Fox.

The trial was set to begin Monday with jury selection.

“We are still waiting on the results of her mental evaluation,” Brown said. “The judge issued the order Wednesday evening resetting the trial.”

He said the prosecution was ready to try the case.

The district attorney’s office is not seeking the death penalty if Fox is convicted.

According to police, Fox, who was married at the time, is accused of working with boyfriend Ronnie Credille, 41, of Florence, to kill her husband for insurance money.

Ronnie Credille and his brother, Jeremy Credille, 34, Florence, have also been charged with capital murder.

In August 2017, Ronnie Credille pleaded guilty and was sentenced to life in prison without parole. He is expected to testify in Erica Fox’s trial.

    Jeremy Credille’s case is pending.

Jason Fox, 40, was found inside the doorway of his house on Aug. 12, 2016. Reports indicate he was shot once in the head with what is believed to be a 9 mm pistol.

Police said Fox owned a 9 mm pistol and a .22-caliber pistol. Neither were found in the house.

According to the indictment, Fox is accused of enlisting Ronnie Credille to commit the shooting. She is accused of arranging to meet her husband at their house for lunch, and is accused of telling Ronnie Credille where the weapons would be.

In the arrest affidavit, police said Fox and Ronnie Credille talked to each other several times about killing her husband.

Police said Jeremy Credille is accused of driving Ronnie Credille to Fox’s residence on Grand Avenue in Muscle Shoals, and picking him up after Ronnie Credille shot and killed Jason Fox.

Woman who orchestrated husband’s shooting death sentenced

    By The Associated Press

A woman convicted of orchestrating her husband’s killing in Alabama has been sentenced to life in prison without the possibility of parole.

News outlets report 38-year-old Erica Fox was sentenced Wednesday morning by a Colbert County Circuit Court judge. She was found guilty of capital murder last month in the shooting of Jason Fox. He was discovered dead inside his home in 2016.

Prosecutors say Fox conspired with her boyfriend, Ronnie Credille, to kill her husband and collect on a $300,000 life insurance policy.

Prosecutors were not seeking the death penalty, as Assistant County District Attorney Angela Hulsey says the sentencing was basically a procedural matter since life without parole was the only sentence.

Credille pleaded guilty to capital murder last year and received the same sentence.
