    Accused Fresno rampage killer is competent to stand trial, judge rules

    Accused Fresno rampage killer Kori Ali Muhammad, who has a documented history of schizophrenia and believes he is 66 trillion years old, can control the weather, and that UFOs are real, is competent to stand trial in connection with a crime spree that left four people dead last April, a Superior Court judge ruled on Monday.

    In making his ruling, Judge Jonathan Conklin found that Muhammad, 39, of Fresno, understands the criminal proceedings in Fresno County Superior Court and is able to assist his attorney, Richard Beshwate Jr., in building a defense to the charges.

    The ruling came as a surprise to Beshwate, who argued Monday that two court-appointed doctors had found Muhammad legally incompetent to stand trial because he is schizophrenic and suffers from delusions or psychosis. A doctor hired by the prosecution found Muhammad competent to stand trial.

    Conklin didn’t say what swayed him to find Muhammad competent, but prosecutor Brian Hutchins argued that Muhammad was able to control or manage his mental illness, and that his delusional views are part of his religious beliefs associated with the Nation of Islam.

    Hutchins said correctional officers testified during Muhammad’s two-week competency hearing that he was calm and polite in Fresno County Jail, didn’t talk to himself or make up words, and was able to take care of his personal hygiene.

    In addition, Hutchins played recordings of Muhammad’s telephone calls from jail to family and friends. In the recordings, Hutchins said Muhammad was able to carry on conversations.

    Hutchins argued that Muhammad was “playing up his symptoms” in order “to manipulate the system.”

    In talking with the three doctors, Muhammad was alert, made eye contact, and was able to give them a history of his mental illness, Hutchins told Conklin.

    Muhammad didn’t get to hear all of Hutchin’s argument; Conklin kicked him out of the courtroom when he made an outburst, one of several he made during his competency hearing. Conklin allowed Muhammad to return to the courtroom for Beshwate’s arguments after he promised to keep quiet.

    After announcing the ruling, Conklin reinstated criminal charges that had been suspended since Muhammad’s arrest last April. Conklin accepted Muhammad’s not-guilty plea to murder and attempted murder charges and scheduled a status hearing on Friday to determine whether both sides can proceed with a preliminary hearing on Feb. 1. The preliminary hearing will determine whether there’s enough evidence to order Muhammad to stand trial.

    Before leaving court, Muhammad, who is being held in the Fresno County Jail without bail, shouted his typical mantra that black people need reparations. He also said to watch out for natural disasters.

    Outside court, Beshwate said he probably won’t appeal the judge’s ruling.

    Down the road lies a bigger question: will the District Attorney’ Office seek the death penalty? Hutchins declined to comment, other than to say he was pleased with Conklin’s ruling.

    Typically, the prosecution announces whether it will seek the death penalty after the preliminary hearing, and after the defense, in an informal setting, gives its pitch to District Attorney Lisa Smittcamp as to why Muhammad’s life should be spared.

    Still be mulled over is whether Muhammad will enter a plea of not guilty by reason of insanity.

    A criminal complaint charges Muhammad with murdering three men – Mark Gassett, David Jackson and Zackary Randalls – April 18 near downtown Fresno. He also faces attempted murder charges for allegedly shooting at Stephen Walter, Michael Flores and Mark Greer during the spree. In addition, he is charged with the murder of Motel 6 security guard Carl Allen Williams III, who was shot while working April 13.

    At the time, Fresno police Chief Jerry Dyer said Muhammad confessed to the shooting rampage and to Williams’ murder. Dyer said Muhammad told police he decided to “kill as many people as he could” once he learned authorities were seeking him for Williams’ murder. Dyer also said Muhammad told detectives that he targeted the victims because they were white.

    In a telephone interview from jail after his arrest, Muhammad told The Bee that went on his deadly rampage to draw attention to the plight of black women and children who have been kidnapped, raped, and killed by white people.

    In the rambling, hour-long interview, Muhammad talked about voodoo, his mental illness, world destruction and the election of President Donald Trump. He showed no remorse for the victims and no fear of a possible death penalty. “They tell black people all the time to get over it. So I say get over it. There will be no pity party.”

    Accused rampage killer told detectives that racism made him want to kill whites

    Kori Ali Muhammad was ordered Thursday to stand trial on murder and attempted murder charges after 10 police officers and detectives testified in chilling detail his confession to the killing of four people last April, his fascination with voodoo, and the racism he experienced as a child growing up in Fresno that led to his resentment of white people.

    But a key piece of evidence was revealed during the hearing in Fresno County Superior Court that could save the 39-year-old Muhammad from the death penalty, should the District Attorney’s Office decide to seek it.

    Muhammad has a long documented history of schizophrenia, delusions and hearing voices, said Fresno attorney Richard Beshwate Jr., who is defending Muhammad.

    In court Thursday, Fresno police detective Miguel Alvarez said he spoke with Muhammad about his mental illness during his confession to the shootings. Alvarez testified that Muhammad told him he tried for six months to get Seroquel, anti-psychotic medication used to treat schizophrenia and bipolar disorder to decrease hallucinations, from the Fresno County Department of Behavior Science Health, but couldn’t obtain it.

    After Judge Jonathan Conklin made his ruling for Muhammad to stand trial, Beshwate said Alvarez’s testimony might convince prosecutors not to seek the death penalty since Muhammad was unable to get medicine to control his mental illness symptoms.

    Prosecutor Brian Hutchins said the decision whether to seek the death penalty has not been made. But he said Beshwate will have the opportunity to state his case to the District Attorney’s Office as to why Muhammad’s life should be spared before then.

    A judge has postponed for two weeks a hearing that could determine whether accused rampage killer Kori Ali Muhammad face the death penalty on murder and attempted murder charges in the deaths of four white men last April.

    Fresno Superior Court Judge Jonathan Conklin approved the postponement at a court appearance Wednesday morning.

    DA decides to seek death penalty for accused Fresno rampage killer

    The District Attorney's Office will seek the death penalty against Kori Ali Muhammad, who confessed to killing four people in central Fresno, fueled by his hatred for white people.

    Fresno defense lawyer Richard Beshwate Jr., who is defending Muhammad, was told of the prosecution's decision in a letter on Tuesday. He said he had met with the office's top administrators a couple of weeks ago in hopes of sparing Muhammad from a possible death sentence.

    Beshwate declined to identify who he met with. He said he told the group about Muhammad's documented history of mental illness, but "they felt compelled to seek death."

    Assistant District Attorney Steve Wright said it was District Attorney Lisa Smittcamp's decision to seek the death penalty. He said Smittcamp made the decision after listening carefully to the concerns of Beshwate and co-counsel Antonio Alvarez.

    "It's not a decision we took lightly," Wright said.

    Muhammad, who grew up in Fresno and Sacramento, is accused in Fresno Superior Court of murdering Mark Gassett, David Jackson and Zackary Randalls on April 18 near downtown Fresno.

    He also faces attempted murder charges for allegedly shooting at Stephen Walter, Michael Flores and Mark Greer during the spree. In addition, he is charged with the murder of Motel 6 security guard Carl Allen Williams III, who was shot while working on April 13, and the attempted murder of security guard Oscar Menjivar, who witnessed Williams' killing.

    Wright said the prosecution can seek the death penalty because Muhammad faces two special circumstance allegations – that he committed a multiple murder and that the killings were based on race.

    Muhammad, 39, will be arraigned on the charges on Wednesday.

    According to Beshwate, Muhammad has a long documented history of schizophrenia, delusions and hearing voices. Two court-appointed doctors have already found him incompetent to stand trial. A third doctor, hired by the prosecution, said he is competent to stand trial.

    In a ruling in January, Judge Jonathan Conklin ruled that Muhammad is competent to stand trial. A month later, Conklin ordered Muhammad to stand trial after hearing testimony from police detectives about his confession to the deadly rampage.

    But a key piece of evidence also was revealed during the hearing – Fresno police Detective Miguel Alvarez testified that he spoke with Muhammad about his mental illness during his confession. The last Fresno County defendant to receive the death penalty was Eddie Ricky Nealy, who was convicted of the 1985 rape and killing of Fresno teen Jody Lynn Wolf and sentenced to death in December 2015.

    Wesson, 71, and Nealy, 61, remain on death row at San Quentin Prison.

    Strategies in Fresno racist killing spree case could create complications

    FRESNO, Calif. (KFSN) -- A day after prosecutors said they'll pursue the death penalty for murders motivated by race, the defense announced Kori Muhammad will plead insanity.

    He's accused of killing four people and specifically targeting white men for his last three shootings in April 2017.

    The wheels of justice grind very slowly in death penalty cases and the insanity plea adds another layer of complications. Carl Williams, Zackary Randalls, Mark Gassett, and David Jackson are the victims, and we talked to a couple family members who say they're happy with the district attorney's decision.

    Almost a year after the Fresno killing spree prosecutors say was motivated by race, both sides have laid their cards on the table.

    The DA is pursuing the death penalty, and the defense?

    "We're going to enter a not guilty plea to all counts," said Richard Beshwate Wednesday morning. "We're going to enter a not guilty by reason of insanity plea on all matters as well."

    Legal analysts tell Action News death penalty cases typically take five years or longer to resolve, especially when the defense claims insanity. Both sides will line up experts and dig deep into the defendant's past.

    "You have to get records from an inmate or defendant that may have been hidden or lost for years - school records, medical records, any type of criminal records, discipline records," said Ralph Torres.

    Torres defended one of the last people sent to death row from Fresno County, but he never expects his former client to be executed.

    "I think Marcus Wesson's going to die in prison," he said.

    A jury convicted Wesson for the murders of nine people -- all branches on his twisted and incestuous family tree. 13 years later, his appeals process hasn't progressed very far.

    California hasn't executed anyone since Fresno County killer Clarence Ray Allen got a lethal injection in 2006. There are 746 people are on death row, including 15 from Fresno County, with Eddie Nealy being the last three years ago.

    For now, they're all a lot more likely to die of natural causes than execution, but Torres says sometimes pursuing the death penalty may still be the right thing to do.

    "You have to weigh the pain and the morality of the family losing a loved one," he said. "And in most cases it's going to be a husband or wife or son or daughter and you can see why the death penalty still exists in California."

    A lot of people on an Action News reporter's Facebook page asked how the defendant could plead insanity when a judge found him competent to stand trial last month.

    The simplest answer is that they're different questions. Competence is a question of mental status right now. Sanity is a question of mental status at the time of the crime.

    Accused Fresno rampage killer Kori Ali Muhammad, who has a documented history of schizophrenia, delusions and hearing voices, pleaded not guilty by reason of insanity on Wednesday to murder and attempted murder charges for his role in a crime spree a year ago.

    Muhammad's plea in Fresno Superior Court was unusual because in past proceedings defense attorney Richard Beshwate Jr. had entered not guilty pleas on Muhammad's behalf.

    But in cases dealing with insanity pleas, Judge Jonathan Conklin said the law required the defendant to personally enter the plea. When Conklin asked Muhammad if he wanted to enter an insanity plea, Muhammad clearly replied: "Yes, sir."

    Conklin accepted the plea and ordered Visalia psychiatrist Luis Velosa to examine Muhammad. Because the prosecution is seeking the death penalty, Conklin ordered Fresno attorney Antonio Alvarez to assist Beshwate in defending Muhammad.

    Part of Wednesday's proceeding was closed to the public because it dealt with Muhammad's confidential juvenile records.

    Under California law, a not-guilty-by-reason-of-insanity plea applies when a defendant is unable to know right from wrong at the time the crime is committed. If found innocent by reason of insanity, Muhammad would not go back on the streets; he would be locked up in a state hospital for the criminally insane, Beshwate has said. There he would be treated with the goal for him to return to sanity so trial proceedings can resume.

    Both sides were ordered to return to court on June 11 is discuss Velosa's findings.

    Because of the quirk in the law, getting a mentally ill defendant to enter a plea of not guilty by reason can be difficult.

    Years ago, in another high-profile Fresno murder case, defense lawyers wanted Marcus Wesson to enter a plea of not guilty by reason of insanity , but Wesson declined. Wesson was later sentenced to death in 2005 after being convicted in Fresno Superior Court of the orchestrating the killings of nine of his children.

    Police say Muhammad, 40, has confessed to the shootings, saying they were fueled by his hatred for white people.

    At Wednesday's hearing, Muhammad did not have any outburst. In past proceedings, he would yell that black people need reparations for slavery or natural disasters will plague America. He was temporarily removed from the courtroom.

    Pre-hearing to determine if serial shooter is mentally fit for trial

    FRESNO, Calif. (KFSN) -- A judge will hear arguments later today to help determine if Kori Muhammad, the man charged in last year's deadly Fresno shooting spree, will be mentally fit to stand trial.

    Muhammad is scheduled to be back in court later Monday afternoon. The pre-hearing will center on discussions about Muhammad's insanity related claims.

    He has been questioned and analyzed by three doctors, two are court-appointed psychiatrists.

    In June a hearing to review the most recent doctor's report was scheduled, but the report was not yet available.

    Muhammad has admitted to killing three men in front of Catholic Charities in April of 2017 and a security guard at a motel a few days earlier.

    Two attorneys will represent him. A second one was appointed because the district attorney's office will seek the death penalty.

    Despite defense move, judge says death penalty trial will stay in Fresno

    A Fresno County judge on Thursday denied a request to move the death penalty trial of Kori Ali Muhammad, who is accused of killing three people in a crime spree two years ago as well as another homicide.

    Judge Jonathan Conklin said defense attorneys who filed the change of venue motion did not present enough valid reasons to move the trial.

    For instance, a survey of 100 people showed only one or two recognized the defendant’s name, so with a county the size of Fresno there shouldn’t be a problem finding an impartial jury, the judge said.

    But the attorneys are free to bring up the issue again during jury selection, Conklin said.

    Muhammad’s trial starts May 13.

    He faces the death penalty because the Fresno County District Attorney filed two special circumstance allegations of multiple murder and that the homicides were based on race.

    Muhammad, 41, has pleaded not guilty by reason of insanity. He has a documented history of schizophrenia, delusions and hearing voices.

    Death penalty trial starts for suspect in racist killing spree through Fresno

    A death penalty trial officially started Wednesday for Kori Muhammad, the man accused of killing four men -- including three during a racist killing spree through downtown Fresno.

    We won't see any evidence for more than a month, though.

    Carl Williams died on April 13, 2017.

    Zack Randalls, Mark Gassett, and David Jackson died in a shooting spree on April 18.

    A jury could decide the fate of the suspect right around the two-year anniversary of the killings.

    With a trial expected to last up to two months, finding 12 jurors and some alternates will be a challenge.

    "Will it just be retired people?" said legal analyst Tony Capozzi. "Is it gonna be government people who are allowed off and paid during this period of time? Self-employed business people, it'll be almost impossible for them to sit on this jury."

    The Fresno County courts sent out more than 1000 summons for jury selection starting February 3.

    Attorneys discussed pretrial motions with the judge Wednesday, getting an outline for which evidence will be admitted.

    The trial will be broken up into three phases: guilt, sanity, and punishment.

    Capozzi says the guilt phase should be relatively quick because the shooting isn't a whodunit.

    "(It) is pretty much open and shut," he said. "I really wonder is the defense is going to put any evidence on at all."

    Police caught the gunman after he shot his way down Fulton Street and they say he admitted his crime immediately and said he specifically targeted white men.

    "That's a cutting edge issue in this case because the DA is going to use that to say why he should get the death penalty and the defense is going to use it to say he wasn't sane," Capozzi said.

    During a 2018 trial to determine whether the defendant is mentally competent, an expert on radical belief systems said killing four "white devils" would make him a hero in his religion -- the Nation of Islam, which is an American black supremacy religion, and a belief system vehemently and consistently rejected by mainstream Muslims.

    The Southern Poverty Law Center has labeled Nation of Islam a hate group.

    One psychiatrist said the suspect suffers from delusions, but some of them are just fundamental beliefs of his faith -- like his claim that he's 67 trillion years old and he can control the weather.

    Three psychiatrists agreed the defendant has schizophrenia and possibly other mental disorders, but that won't clinch an insanity verdict.

    "The fact that someone had a mental defect at the time of the crime doesn't mean he was insane," Capozzi said. "Doesn't mean he couldn't form that criminal intent - the intent to kill."

    Attorneys expect to seat a jury in time to start presenting evidence on March 2.
