Sheriff: South Carolina man charged with murder, kidnapping

    By Associated Press

BENNETTSVILLE, S.C. – A South Carolina man has been arrested and charged in the stabbing death of a Bennettsville woman and the disappearance of her 8-year-old daughter, who remains missing, authorities said Saturday.

The Marlboro County Sheriff's Office said in a statement that Jejuancey Fernando Harrington, 32, of Bennettsville, has been charged with murder in the death of Ella Lowery. The woman's body was found May 5 in the home she shared with her daughter, Iyana.

Harrington also has been charged with kidnapping in connection with the child's disappearance and with possession of a weapon during a violent crime, Sheriff Charles Lemon said.

The girl hasn't been seen since, despite a massive search by state police and the FBI. Lemon said the search is continuing and that finding the child remains the priority.

"We are keeping our focus on finding Iyana Lowery and bringing her home to her family," Lemon said in the statement released via the South Carolina Law Enforcement Division, the state's top crime-fighting agency.

Lemon said a $10,000 reward was being offered for information leading to the recovery of the child.

It wasn't immediately known if Harrington had an attorney. He was being held at the Marlboro County Detention Center.

Lemon said the arrest constituted a "major break in the case" and added the investigation is continuing and "there is still much work to do." His statement didn't elaborate on whether the arrest led to any information about the whereabouts of the missing girl.

Child’s body has been identified as that of missing Marlboro County girl

    By Cynthia Roldan
    The State

A coroner announced Tuesday that the body found in a remote area of Marlboro County is that of an 8-year-old girl who had been missing for more than a week.

Through DNA records, Marlboro County Coroner Tim Brown said the body was that of Iyana Lowery, who had been missing since her mother was found dead on May 5, said Marlboro County Sheriff Charles Lemon.

Brown ruled Iyana’s manner of death as a homicide but did not disclose her cause of death.

Lemon said additional charges of murder and armed robbery have been filed against Jejauncey Fernando Harrington, 32, of Bennettsvile, who was already facing charges of murder and possession of a weapon during a violent crime in connection with the stabbing death of Iyana’s mother, Ella Lowery.

Harrington also had been previously charged with kidnapping and possession of a weapon during a violent crime in connection with Iyana’s disappearance. She was last seen on May 4 at her 36-year-old mother’s home.

Before Harrington’s arrest, Lemon had announced that the reward for information that brought Iyana home had been bumped to $10,000. That same day, Lemon also announced murder charges had been dropped against a different man who the agency initially arrested in connection with Lowery’s slaying.

State seeking death penalty against Bennettsville man accused of killing woman, child

    By Tonya Brown
    ABC 15 News

MARLBORO COUNTY, S.C. (WPDE) — The state of South Carolina wants to seek the death penalty against Jejuancey Fernando Harrington, 33, in connection to the murders of 36-year-old Ella Lowery and her 8-year-old daughter, Iyana Lowery, according to S.C. Public Index online records.

The index shows the notice was filed on April 23.

Ella Lowery was found murdered in her Bennettsville home on May 5, 2017.

Her daughter was found dead 12 days later in Gum Swamp Creek on New Bridge Road in the McColl area of Marlboro County.

Deputies charged Harrington with two counts of murder.

Arrest warrants said Harrington stashed the personal belongings of Ella Lowery inside an abandoned home on New Bridge Road near the creek where Iyana was found dead, according to arrest warrants.

The warrants add that video footage from New Bridge Road places Harrington near the abandoned home where Lowery's personal belongings were found after the murder.

The warrants say Harrington killed Lowery on May 5 at a home on Craig Circle in Bennettsville.

Deputies said Harrington kidnapped Iyana and killed her.

Arrest warrants say Iyana's DNA was found in the trunk of a 1998 Mitsubishi Eclipse that Harrington was driving.

Deputies have yet to say how Iyana was killed or what personal belongings of her mother's were found at the abandoned house.

Harrington has been transferred to three different detention centers since his arrest. Officials haven't said why he's been moved around so much and they aren't saying where he's being held at this time.

A gag order was issued on May 18, 2017, by Fourth Circuit Chief Administrative Judge Roger M. Henderson in the case against Harrington.

The order says said the investigation is ongoing and there have been “numerous, aggressive inquiries regarding this case by non-trial participants.”

It also says, “The State believes it has a duty to protect the pending investigation of this case as well as the right of the defendant to a fair trial.”

The order doesn’t restrict the activity of any person or entity not included as a “Covered Person.”

It defines a “Covered Person” as the 4th Circuit Solicitor’s Offices, Solicitor, Deputy Solicitor, Assistant Solicitors, employees and staff of Solicitor’s Offices, all law enforcement, defendant, all counsel for defendant, victim, parents of victim, family members of victim, witnesses and or potential witnesses, all counsel for victim, victim’s family and victim’s representative.

The Fourth Circuit Solicitor’s Office can’t comment on the death penalty notice because of the gag order.

A trial date for Harrington hasn’t been set at this time.

MARLBORO COUNTY, S.C. — Jejuancey Harrington has filed several motions ahead of his trial on charges of two counts of murder, kidnapping, armed robbery, possession of a weapon during the commission of a violent crime and use of a vehicle without permission in the deaths of a Bennettsville woman and her eight-year-old daughter, according to public online court records.

The state is seeking the death penalty against Harrington.

Ella Lowery was found stabbed to death on May 5, 2017 at her home on Craig Circle in Bennettsville.

Her daughter Iyana was discovered missing after Lowery was found dead.

Deputies searched for nine days until they found Iyana's remains in a creek in the McColl community of Marlboro County.

The search gained national attention with many distraught and hurt over the child's death.

Harrington has filed several motions this year, including a motion to have solicitor provide written notice of evidence, a motion to prevent the state from seeking the death penalty against him, a motion to preclude public shackling, motion for complete recordation and transcript of all proceedings, motion prohibiting defendant from being in jail clothing, motion to incorporate all federal and state constitutional bases, motion specially setting hearings on all pre-trial motions, motion to require constitutional grand jury proceedings, motion for an order compelling heightened scrutiny and motion for non-waiver of rights.

A gag order remains in effect in the case due to aggressive inquiries.

It is not yet known if the specifics of the motions filed by Harrington have been addressed.

A trial date hasn't been set.

Death penalty trial date set for man accused of killing Bennettsville mother, child

    By Kevin Accettulla
    WBTW News

BENNETTSVILLE, S.C. (WBTW) — The date has been set for the death penalty trial for a man accused of killing a Bennettsville 8-year-old and her mother in 2017, according to 4th Circuit Deputy Solicitor Kernard Redmond.

The trial for Jejuancey Harrington, of Bennettsville, is scheduled to begin immediately after jury selection, which is scheduled for July 5, 2022, according to Redmond.

Harrington was charged in connection with the deaths of Ella Lowery, of Bennettsville, and her 8-year-old daughter, Iyana Lowery.

According to the arrest warrant, Harrington robbed his murder victim, Ella Lowery, after stabbing her multiple times. Law enforcement agents obtained video footage from New Bridge Road in McColl that places Harrington near an abandoned home where “personal belongings of Ella Lowery were found after the murder.”

The warrant also details how Harrington killed the young girl after kidnapping her from her home. Harrington placed Iyana Lowery’s body in a remote pool of water off New Bridge Road in McColl, where she was discovered. Harrington “transported [Iyana] in a 1998 Mitsubishi Eclipse,” where Iyana’s DNA was found in the trunk of the car, the warrant reports.

Arrest warrants show Harrington’s DNA was found on a cigarette located at the home on Craig Circle in Bennettsville where Ella Lowery’s body was located. Forensic testing also shows Iyana Lowery’s DNA was found inside Harrington’s vehicle.

The trial will be held at the Marlboro County Courthouse.

Other information couldn’t be provided due to a gag order on the case.

State withdraws death penalty for Marlboro Co. man charged in murder of woman, child

    By Tonya Brown
    ABC 15 News

MARLBORO COUNTY, S.C. (WPDE) — The State has withdrawn its Notice of Intent to Seek the Death Penalty in the upcoming trial of Jejuancey Harrington, according to a news release from the Fourth Circuit Solicitor’s Office.

Officials said Harrington’s attorneys “initiated an agreement with the State to waive his right to a jury trial, conditioned upon the State withdrawing the Notice of Intent to Seek the Death Penalty for the 2017 murders of 36-year-old Ella Lowery and her 8-year-old daughter, Iyana."

The State agreed after talking with the victims’ family.

The agreement was formally accepted by the Honorable S.C. Circuit Court Judge Michael G. Nettles this week during a hearing in Marion.

Harrington is charged with two counts of murder, kidnapping, armed robbery, possession of a weapon during the commission of a violent crime and use of a vehicle without permission.

Ella Lowery was found stabbed to death on May 5, 2017, at her home on Craig Circle in Bennettsville.

Her daughter Iyana was discovered missing after Lowery was found dead.

Deputies searched for nine days until they found Iyana's body in a creek in the McColl community of Marlboro County.

The search gained national attention with many distraught and hurt over the child's death.

Harrington has filed several motions since his arrest, including a motion to have a solicitor provide written notice of evidence, a motion to prevent the state from seeking the death penalty against him, a motion to preclude public shackling, a motion for complete redecoration and transcript of all proceedings, motion prohibiting defendant from being in jail clothing, motion to incorporate all federal and state constitutional bases, motion specially setting hearings on all pre-trial motions, motion to require constitutional grand jury proceedings, motion for an order compelling heightened scrutiny and motion for non-waiver of rights.

Harrington’s trial was set to take place on February 6.

However, officials said he will now have a bench trial, scheduled to take place on February 13 at the Marlboro County Courthouse in Bennettsville.

Initial testimony will be taken on February 9 in Bennettsville because one of the State’s witnesses will be unavailable during the week of February 13.

The trial is expected to last more than a week.

Man found guilty of killing Marlboro County woman, 8-year-old daughter in 2017

    By Kevin Accettulla
    WBTW

MARLBORO COUNTY, S.C. (WBTW) — A man was found guilty Friday of killing a Marlboro County woman and her 8-year-old daughter in 2017, according to the 4th Circuit Solicitor’s Office.

Jejauncey Harrington was found guilty on all counts by Judge Michael Nettles in a bench trial, meaning there was no jury.

Nettles sentenced Harrington to life in prison for the murder charges, and 30 years on the kidnapping and armed robbery charges. All sentences will run concurrent.

Harrington’s attorney and prosecutors reached a deal in early February to remove the death penalty as an option in return for Harrington waiving his right to a jury trial.

Harrington killed Ella Lowery and kidnapped and killed her 8-year-old daughter Iyana Lowery in 2017.

According to an arrest warrant, law enforcement agents obtained video footage from New Bridge Road in McColl that places Harrington near an abandoned home where “personal belongings of Ella Lowery were found after the murder.”

The warrant also details how Harrington killed the young girl after kidnapping her from her home. Harrington placed Iyana Lowery’s body in a remote pool of water off New Bridge Road in McColl, where she was discovered. Harrington “transported [Iyana] in a 1998 Mitsubishi Eclipse,” where Iyana’s DNA was found in the trunk of the car, the warrant indicated.

Arrest warrants also show that authorities found Harrington’s DNA on a cigarette at the home on Craig Circle in Bennettsville where Ella Lowery’s body was found. Forensic testing also showed that Iyana Lowery’s DNA was inside Harrington’s vehicle.

Ella Lowery’s cause of death was determined to be two stab wounds to the neck. The daughter’s cause of death was undetermined because of the state of decomposition.
