    Summary of Offense:

    All of the crimes for which Mitchell has been charged or convicted occurred over a seven-day period in November 2005. Mitchell was sentenced to death in 2007 for a Thanksgiving Day 2005 triple homicide at the Airport Inn in Birmingham. A co-defendant, Roderick Byrd, also was sentenced to death in that case.

    Evidence showed he shot to death Kim Olney, the 28-year-old desk clerk and Dorothy Smith, 58, who was about to check in to catch a flight home after visiting her son and granddaughter. A co-defendant, Roderick Byrd, killed John Aylesworth, a 42-year-old Texas truck driver staying at the motel because his rig had broken down.

    Mitchell also separately pleaded guilty to capital murder and was sentenced to life without parole for killing Corey Brazzle during a robbery three days after the Airport Inn slayings.

    MONTGOMERY, Alabama -- The Alabama Supreme Court quashed an appeal today in the capital murder conviction and death sentence of Brandon Deon Mitchell in the Thanksgiving 2005 triple slaying at the Airport Inn in Birmingham.

    The court had granted an appeal on the issue of whether Circuit Judge Bill Cole properly considered the jury's recommendation of life without parole before the judge overrode the advisory verdict and imposed the death penalty in 2007.

    But after examining the record, the justices found that Cole had provided a written explanation of his sentencing decision, including how he weighed the sentencing verdict.

    Mitchell shot to death motel employee Kim Olney, 28; and traveler Dorothy Smith, 58; during a motel robbery. A co-defendant, Roderick Byrd, killed Texas truck driver John Aylesworth, 42, during the robbery near Birmingham's airport.

    Mitchell was sentenced to death in all three murders, even though his jury voted 10-2 for the alternative capital sentence of life without parole. Byrd also was sentenced to death in a separate trial.

    Mitchell pleaded guilty separately to capital murder for killing Corey Brazzle, 32, two days after the motel robbery. He was sentenced to life without parole in that case.
