    Summary of Offense:

    All of the crimes for which Mitchell has been charged or convicted occurred over a seven-day period in November 2005. Mitchell was sentenced to death in 2007 for a Thanksgiving Day 2005 triple homicide at the Airport Inn in Birmingham. A co-defendant, Roderick Byrd, also was sentenced to death in that case.

    Evidence showed he shot to death Kim Olney, the 28-year-old desk clerk and Dorothy Smith, 58, who was about to check in to catch a flight home after visiting her son and granddaughter. A co-defendant, Roderick Byrd, killed John Aylesworth, a 42-year-old Texas truck driver staying at the motel because his rig had broken down.

    Mitchell also separately pleaded guilty to capital murder and was sentenced to life without parole for killing Corey Brazzle during a robbery three days after the Airport Inn slayings.

    MONTGOMERY, Alabama -- The Alabama Supreme Court quashed an appeal today in the capital murder conviction and death sentence of Brandon Deon Mitchell in the Thanksgiving 2005 triple slaying at the Airport Inn in Birmingham.

    The court had granted an appeal on the issue of whether Circuit Judge Bill Cole properly considered the jury's recommendation of life without parole before the judge overrode the advisory verdict and imposed the death penalty in 2007.

    But after examining the record, the justices found that Cole had provided a written explanation of his sentencing decision, including how he weighed the sentencing verdict.

    Mitchell shot to death motel employee Kim Olney, 28; and traveler Dorothy Smith, 58; during a motel robbery. A co-defendant, Roderick Byrd, killed Texas truck driver John Aylesworth, 42, during the robbery near Birmingham's airport.

    Mitchell was sentenced to death in all three murders, even though his jury voted 10-2 for the alternative capital sentence of life without parole. Byrd also was sentenced to death in a separate trial.

    Mitchell pleaded guilty separately to capital murder for killing Corey Brazzle, 32, two days after the motel robbery. He was sentenced to life without parole in that case.

    In today's United States Supreme Court orders, Mitchell's petition for writ of certiorari was DENIED.

    Alabama appeals court upholds death sentences for 2 Birmingham men with 9 killings between them

    Death sentences for two Birmingham multiple murderers Brandon Deon Mitchell and Kenneth Eugene Billups, who are responsible for nine murders between them, were upheld today by the Alabama Court of Criminal Appeals.

    Mitchell, 28, killed three people and aided in a fourth capital murder over Thanksgiving weekend in 2005.

    Billups, 36, killed four men on one day in 2003 and committed another capital murder -- all within days of his 30th birthday.

    The appeals court ruled also today that Mitchell got a fair trial in 2006 in a triple slaying during a robbery at the former Airport Inn.

    In the Billups case, the criminal appeals court ruled his 2006 trial and death sentence were fair in the capital murders of Rafael Salcedo, 15; Enrique Marquez, 16; Wilbur Gomez, 20; and Manuel Perez Nunez, 27.

    On Dec. 16, 2003, Billups lured the four victims to a Center Point apartment under the guise of a drug deal. Billups shot all four when they arrived.

    In a separate trial, Billups was convicted of capital murder and sentenced to death for killing Stephon Lockett the day after Billups' 30th birthday.

    The Alabama Court of Criminal Appeals has reversed the judgment granting Mitchell a new sentencing and remanded to the trial court to reinstate his death sentence.

    The victims' families were promised justice. It would have been profoundly unjust to screw them over and pull the rug out from under them with retroactive legislation.

    No state should ever do more than the bare minimum mandated by SCOTUS.

    Mitchell killed 3 people. Those 2 jurors got it right. If judges can override unanimous recommendations for death, they should be allowed to override split recommendations of life.
    Don't ask questions, just consume product and then get excited for next products.

    On October 4, 2023, Mitchell filed his habeas appeal to the U.S. District Court for the Northern District of Alabama.
