    Conoco store robbery suspect arraigned on capital murder charges, trial date set for June 2018

    A suspect in the fatal robbery of a local Conoco gas station in January was arraigned in a Smith County court on Friday.

    Dameon Jamarc Mosley, 25, of Tyler faces capital murder charges in the death of Billy Dale Stacks, 62, of Tyler.

    Mosley's trial date is set for June 4, 2018.

    Billy Dale Stacks, 62, of Tyler, was working at the Conoco gas station at 3319 NNE Loop 323 as a clerk when the store was robbed. Officials said Stacks sustained gunshot wounds to his head and shoulder and later died from his injuries.

    Two other suspects, Lamarcus Hannah, 32, and Kedarias Hayes Oliver, 23, both of Tyler, were arrested in connection to the robbery and are at the Smith County Jail on aggravated robbery charges. All three of the suspects were held on $1 million bonds.

    Hannah and Oliver await arraignment on the charges.

    Hearings rescheduled for 3 men accused of murdering Tyler gas station clerk

    Hearings for three men accused of murdering a Tyler gas station clerk in 2017 have been rescheduled.

    According to Smith County judicial records, Lamarcus Hannah, 32; Kedarias Oliver, 23; and Dameon Mosley, 25, who all face a capital murder charge in the shooting death of Billy Dale Stacks, 62, have had their hearing dates pushed back.

    The men were initially set for plea hearings on Thursday and pre-trial appearances on Friday, however, those were canceled.

    According to CBS19's newspaper partner the Tyler Morning Telegraph, Smith County District Attorney Jacob Putman says he hearings were rescheduled for July 25 because DNA evidence testing will not be completed until late June.

    On Saturday, January 28, around 3:30 a.m., officials with the Smith County Sheriff's Office and the Tyler Police Department responded to a 911 call in regards to an aggravated robbery at the Conoco gas station, located at 3319 North Northeast Loop 323 in Tyler.

    When law enforcement arrived on scene, they discovered Stacks lying on the floor with gunshot wounds.

    A Smith County deputy who was near gas station when they call came in spotted a vehicle turn onto a street that was a dead-end. When he attempted to pull the vehicle over, a chase began.

    The high-speed pursuit lasted approximately 10 minutes. One of the suspects got out of the vehicle and ran into the woods near Interstate 20 and Highway 155. The driver then escaped.

    A perimeter was established and a Texas Department of Public Safety helicopter was requested to perform an aerial search of the area. Texas Department of Criminal Justice K-9s were brought in to conduct a ground search. The Smith County SWAT team and DPS troopers also assisted.

    The manhunt was called off when a Smith County patrol sergeant was driving around the perimeter and spotted the Avenger that had been involved in the pursuit abandoned and parked next to a church on Farm-to-Market Road 2015.

    According to an arrest warrant affidavit, law enforcement officials were able to track down the owner of the abandoned vehicle involved in the incident, who said they sold it to Mosley. During a search of the vehicle, officials said they found the same type of ammunition that was used to kill Stacks.

    When Mosley was contacted over the phone and confronted with the words, “Smith County has your Dodge Avenger,” according to the affidavit, he responded with, “I loaned my car to a friend of mine named Lamarcus Hannah.”

    When contacted, Hannah agreed to an interview with the Smith County Sheriff’s Office and admitted to driving the vehicle, according to the affidavit. The document further states that Hannah said he was with Mosley and an unknown friend of his during the morning of the robbery.

    Hannah said Mosley and his friend left him at the friend’s house and Mosley’s friend later returned saying they needed to pick up Mosley in the Avenger.

    They drove to an area behind the Conoco and Hannah said Mosley got into the vehicle instructing him to “floor it,” according to the affidavit. Hannah said he didn’t stop when being pursued by law enforcement officials because he was scared, and Mosley had a gun.

    Smith County detectives and members of the Dallas Police Department took Mosley into custody in Dallas on October 29, 2017. Hannah was also arrested on October 29. Oliver was arrested the next day.

    The three remain held in the Smith County jail on bonds of $1 million.

    Mosley, Hannah and Oliver's trials are scheduled to begin this fall.

    Prosecutors initially elected to seek the death penalty for Mosley while Hannah and Oliver face life in prison.

    Two of the three suspects accused in the fatal robbery of a local Conoco gas station in January, 2017 were in the Smith County Courthouse on Friday for a pretrial hearing.

    Mosley and Hannah's cases were called separately. The two were never in the courtroom at the same time. Oliver's case was not called due to his lawyer being at a court proceeding in another county.

    Mosley was led into the 114th District Court courtroom from a side door when his case number was called. He wore an orange Smith County Jail jumpsuit, leg irons and handcuffs attached to a belly chain.

    Mosley stood in front of 114th District Court Judge Christi Kennedy with his defense attorney.

    Smith County District Attorney Jacob Putman said his office is waiting on DNA testing results to come back from the lab.

    "I expect to have the results back a week from today," Putman said. "If not it will be back early the following week."

    Mosley was escorted out of the courtroom and through the courthouse hallway prior to Hannah's case number being called and Hannah coming into the courtroom.

    Hannah also wore an orange Smith County Jail jumpsuit, leg irons and handcuffs attached to a belly chain.

    Putman repeated his prior announcement about the DNA evidence testing while Hannah and his defense attorney stood in front of Kennedy's bench.

    Kennedy said the next hearing for the three suspects will be scheduled for July 25.

    She said the July 25 hearing date puts her very close to the day she will have to order jury selection.

    "I am planning to order voir dire," Kennedy said. "Just so every one knows."

    Smith County judicial records indicate Mosley, Hannah and Oliver are scheduled to be back in court at 8:30 a.m. on July 25 for their pretrial hearings.

    Mosley's jury trial is scheduled to start on Oct. 17, according to judicial records

    Judicial records show Hannah's jury trial is scheduled to start on Nov. 4.

    Oliver's jury trial has not been scheduled, according to judicial records.

    Capital murder trial gets underway for suspect in fatal Tyler gas station robbery

    TYLER, Texas (KLTV) - Thursday marked the start of the capital murder trial for one of three suspects in a fatal gas station robbery that occurred in January of 2017.

    Dameon Jamarc Mosley was indicted in April 2017 on charges of capital murder by terror threat and aggravated robbery in connection to the alleged incident.

    Mosley, LaMarcus Hannah, and Kedaris Oliver were all arrested in connection with the murder of Billy Dale Stacks. Stacks was working as a clerk at a Conoco gas station in Tyler on Jan. 28, 2017, when he was shot several times during an armed robbery.

    Mosely was indicted in April 2017 on charges of capital murder by terror threat and aggravated robbery in connection to the robbery. Hannah and Oliver were indicted in 2017 on one count of capital murder each.

    Mosley pleaded “not guilty” to the charges. After the prosecuting and defense attorneys gave their opening statements, the jury watched dashcam video from the deputy who responded to the call that night as he chased a vehicle he thought had been involved.

    One of the witnesses, a Tyler police officer, was the first law enforcement officer to arrive on the scene. He told the jury that Stacks was mostly unresponsive at that point and could only give his name.

    The jurors also heard the 911 call from the morning of Jan. 28, 2017.

    TYLER, Texas — A jury found in the Dameon Jamarc Mosley guilty of capital murder just before 1 p.m. on Wednesday.

    Mosley, 28, who faced a capital murder charge and could be sentenced to death if convicted in the shooting death of Billy Stacks, 62, of Tyler.

    He pleaded not guilty last Thursday and jury deliberated just over an hour before coming out with the guilty verdict.

    TYLER, Texas (KLTV) - The prosecution and the defense rested Tuesday afternoon in the sentencing phase of a Tyler man’s capital murder trial.

    Dameon Jamarc Mosley, 28, was convicted of capital murder last week for killing gas station clerk Billy Dale Stacks during a 2017 robbery at a Conoco station in Tyler.

    The sentencing phase will resume at 9:30 a.m. Wednesday. The jury will hear closing arguments and the judge’s instructions before starting deliberations.

    Mosley could be sentenced to death or life in prison. Two other suspects, LaMarcus Hannah and Kedaris Oliver, were also indicted on one count of capital murder each.

    Jury begins deliberations on whether Tyler man will be executed for murder of gas station clerk

    TYLER, Texas (KETK) – A jury has begun deliberations on whether a Tyler man will be executed for the murder of a gas station clerk back in January 2017.

    Dameon Mosley, 28, was convicted for the murder of 62-year-old Billy Stacks while robbing a then-Conoco gas station. The jury of seven men and five women took just over an hour to convict Mosley for the crime.

    Prosecutors have been seeking the death penalty since the case entered the courtroom while the defense has been arguing for life in prison. Over the course of the trial, Mosley has shown little emotion and has rarely spoken.

    Under Texas law for capital murder, a jury may only give the punishments of life in prison without parole or the death penalty. If sentenced to death, Mosley would be the first from Tyler to receive the sentence since 2015.

    In his closing argument, First District Attorney Chris Gatewood said: ” If I had it my way, Billi Stacks would still be working at the Conoco and Dameon Mosley would be on probation.”

    Smith County District Attorney Jacob Putman told the jury “Your job is to make sure justice is done.”

    Putman also reminded the jury that there is no further legal punishment for Mosley if he gets life without parole, unless he committs another murder.

    “His only job is to not kill anybody,” Putman exclaimed to the jury.

    The defense argued how Mosley’s privileges in prison would be limited and that he would be under constant supervision.

    “How can this particular individual that is sitting with life without parole be a continuing threat to society,” said one defense attorney.

    He continued: “They don’t roam around the prison like students on college campuses.”

    His chief lawyer Robbie McClung talked about the structure in prison Mosley would have: “Maybe guidance in prison for the rest of his life is exactly what he needs.”

    For the past five days, witnesses for the prosecution and defense have testified about his character and his past. On Monday, Mosley’s mother testified about her battle with alcoholism during his childhood and how she would beat him at times.

    Psychologists testified that Mosley had borderline intellectual disabilities, which is an IQ between 70-80. Less than a year before his trial, Mosley scored an 80 on a state IQ test.

    Mosley sentenced to death for murder of gas station clerk, jury deliberated less than 1 hour

    UPDATE #1 (1:30 PM) – Dameon Mosley has been sentenced to death for the murder of Billy Stacks after the jury deliberated less than one hour following closing arguments.

    The jury found that Mosley had a high probability of committing more violent crimes behind bars and that he was not intellectually disabled. The jury was composed of seven men and five women, all of whom are white.

    Judge Kennedy thanked them for their service as they had been on the panel for over a month.

    Mosley is the first man from Tyler to receive the death penalty since 2015.

    TYLER, Texas (KETK) – Three months after Dameon Mosley was sentenced to death for the murder of Billy Stacks during a gas station robbery in 2017, the last of his two accomplices to be tried pleaded guilty to murder in a Tyler courtroom and was sentenced to 35 years.

    Kedarius Oliver, 26, is the last remaining man involved in the robbery to be sentenced for Stacks’ murder at the then-Conoco gas station on Loop 323 in January 2017.

    He was originally charged with capital murder, which carries with it the death penalty, but pleaded to the lesser charge. As part of his plea agreement, he waived his right to a jury trial.

    He delivered his plea in front of 114th District Court Judge Christi Kennedy.
