Affidavit: Texas Tech student told police he 'f----d up' and 'shot their friend' following arrest

    By Caleb Downs
    mySA

The Texas Tech student accused of fatally shooting a university police officer told police "he was the one that shot their friend" and later said he "f----d up" and did "something illogical," according to an arrest warrant obtained by mySA.com.

The officer shot and killed has been identified as Officer Floyd East Jr.

The warrant details what allegedly happened leading up to and after the shooting.

Hollis Daniels, 19, of Seguin, was first arrested Monday evening on a drug possession charge when campus police responded to his room for a welfare check and reportedly found drugs and drug paraphernalia inside.

According to his arrest warrant affidavit, officers took him to the campus police station, where an officer began working on the booking paperwork at one of the station's computers. His back was to Hollis, who was not handcuffed at the time.

There was one other police officer in the room, a corporal, but he left the room as the officer worked on the booking paperwork, police said.

A short time later the corporal "heard a bang from the briefing room," the affidavit says.

When the corporal walked back in, he saw the officer suffering from a gunshot wound. Hollis was nowhere to be found, according to the affidavit. The corporal later told police the officer's body camera was missing, but that his pistol remained in its holster. A single .45 caliber shell casing was found near the officer's body, according to the affidavit.

Authorities located Hollis a short time later in the 2700 block of Drive of Champions at the City Bank Coliseum, where he was arrested, officials said. A .45 caliber pistol and police body camera were found near the location of his arrest, officials said.

During his arrest, Daniels allegedly said "he was the one that shot their friend." Later, in interviews with police, Daniels said he "f----d up" and did "something illogical."

He was charged with capital murder and booked into the Lubbock County Jail.

A judge set his bail at $5 million.

Search warrants provide new details on the night Seguin teen allegedly killed Texas Tech officer

    By Fares Sabawi
    mysanantonio.com

The night Hollis Daniels allegedly shot and killed a Texas Tech officer, police were reportedly called to his dorm room on reports a gun had been fired.

The officers found Xanax and other unknown tablets and were told Daniels had been dealing drugs out of the room, according to newly released documents in the case.

The 19-year-old from Seguin is accused of shooting Officer Floyd East on Oct. 19 with a stolen .45 caliber pistol in the campus police station. Police arrested Daniels later that night near the Lubbock Municipal Coliseum. He was charged with capital murder and possessing a stolen firearm.

Recently released search warrants provided more details Thursday on what happened that night.

In a search warrant, Lubbock police indicated the welfare check that sent officers to Daniels' room stemmed from reports a gun was fired in the room in Talkington Hall. Police were also told drugs were being sold out of the room, according to the warrant.

Daniels' roommates allegedly told police after the shooting that Daniels was constantly smoking marijuana, using Xanax and that he dealt drugs to others.

Three officers, including East, responded and made contact with Daniels. Officers handcuffed him after they discover suspected Xanax and "another quantity of unknown tablets," the warrant says.

Police took him to the police station, where he was searched and placed unhandcuffed in the same room where East was filling out paperwork, officials said. Daniels somehow gained access to the gun and shot East before fleeing, authorities said.

    He was arrested soon after.

A search of Daniels' room after the shooting turned up two laptops, a ledger, a diary, a pipe, white pills in a baggie and a digital scale, as well as a shell casing. Police also searched his car and discovered a prescription bottle and bag of small drug baggies, according to the warrant.

If Daniels is convicted of capital murder, he faces life in prison or the death penalty.

Capital Murder Indictment, Man Accused of Texas Tech Campus Cop Killing

    By Staff
    EverythingLubbock.com

LUBBOCK, TX - Hollis Alvin Daniels, 19, was indicted by a grand jury in Lubbock for capital murder on Wednesday. Daniels was arrested on October 9 less than two hours after Texas Tech police officer Floyd East, Jr. was shot and killed on campus.

East and other officers arrested Daniels for drug possession, and Daniels was inside the Texas Tech police station. Although he was searched for a weapon, court records said somehow Daniels was able to conceal a stolen gun. Court records said Daniels was alone in a room with East when he pulled a gun and shot East.

The indictment itself does not say if prosecutors will seek the death penalty. A call was placed to the office of Lubbock County Criminal District Attorney to ask for more information.

Family of fallen Texas Tech Officer Floyd East releases statement

    By Lucinda Holt
    Lubbock Avalanche-Journal

The family of Texas Tech Police Department Officer Floyd East Jr. released a statement on Monday after he was killed in the line of duty on Oct. 9.

East, 48, was a native of El Paso who began his career with the department on Dec. 2, 2014 as a guard at Texas Tech’s University Health Sciences Center while attending El Paso Community College Law Enforcement Academy to obtain his basic peace officer license.

He is survived by his wife and two teenage daughters.

A Texas Tech news release speaks of the family’s gratitude toward the support shown by Lubbock and El Paso Communities.

“On Oct. 9, we lost Floyd East Jr.,” the statement reads, “a beloved father, husband, brother and son. The past few weeks have been difficult for our family as we come to terms with his passing. The weeks, months and years ahead will be difficult as well. As anyone who has lost a loved one knows, grief is crushing. It swallows you into darkness and despair. It robs you of hope. But the outpouring of love for our family during this time has lifted us up and delivered the hope we need as we cope with our loss.”

East was reportedly killed by 19-year-old Hollis Alvin Daniels III following a check welfare call to Daniels’ dorm room.During a search of Daniels’ room evidence of drugs along with drug paraphernalia were located.

Daniels was then taken to the TTU Police Department where East was in the process of completing paperwork for Daniels’ arrest when Daniels allegedly shot and killed the officer, taking East’s body-worn camera in the process.

Daniels was located and arrested after a search, which left the campus on lockdown for several hours.

According to reports, Daniels was accused of stealing a .45 caliber pistol earlier that day.The pistol was taken from a home in the 3400 block of 28th Street. A pat down was completed, however, police have not disclosed how the gun was obtained.

On Nov.1, Daniels was indicted on a capital murder charge — an offense that carries a punishment of the death penalty or life in prison without parole. He remains jailed on $5 million dollar bond.

On Oct. 17, East was laid to rest in a private service in El Paso, which followed a public service held at the Abraham Chavez Theater.Officers from numerous agencies attended the service to pay their respects to their brother in blue, for which the family is grateful, according to the statement:

“We are eternally thankful for the kindness and support we’ve received from the Lubbock and El Paso communities. It warmed our hearts to see the hundreds of people who turned out for the processions and memorials in both cities. And we truly appreciate the kind words, cards, flowers, prayers and other beautiful gestures we’ve received from friends and strangers alike.

“We also want to express our gratitude to the Texas Tech Police Departments in Lubbock and El Paso; the students, faculty and staff of Texas Tech University in Lubbock and Texas Tech University Health Sciences Center El Paso; and the community of law enforcement and first responders who came from across Texas and across the country to show their support to Floyd and our family.

“Floyd was a dedicated police officer who truly cared for the communities he worked in. He chose law enforcement as a career because he wanted to be part of the effort to keep cities safe — to make them great places to live and raise a family.

“The overwhelming show of support in both Lubbock and El Paso tells us Floyd did the right thing. We are comforted by your love and kindness, and proud to be part of the communities that Floyd served.”

State seeks death penalty against accused Texas Tech police officer shooter

    By Amber Stegall
    KCBD-TV

LUBBOCK, TX (KCBD) - According to court documents, the State of Texas is seeking the death penalty against 19-year-old Hollis "Reid" Daniels III.

Daniels has been charged with capital murder of a peace officer after Officer Floyd East Jr., a Texas Tech University police officer, was shot and killed in the campus police department on Oct. 9.

The documents show the court has determined Daniels is indigent (poor) and a regional public defender has been appointed to represent him.

On Wednesday, November 1, 2017, Daniels was indicted by a Lubbock Grand Jury, charged with capital murder of a peace officer. Prior to his indictment, court documents say counsel for Daniels filed a motion suggesting incompetence and requested a formal examination.

The report has not been released, however, the court documents say informal conversations with the examiner indicate Daniels is likely to be found incompetent. If he were found incompetent and ordered to a competency restoration program, that inpatient program would be lengthy and located at North Texas State Hospital, Vernon Campus.

"The restoration program is potentially lengthy; during this time, Mr. Daniels would be unable to sign authorizations for those records that could be obtained with a direct letter request."

Because of the media coverage on this case, the 137th District Court issued a news media gag order on November 2, 2017, meaning people directly involved in the case are to refrain from further communication with the media.

Conviction on a capital murder charge carries a penalty of execution or life in prison without the opportunity for parole.

Daniels remains in the Lubbock County Detention Center, held on $5 million bond.

Daniels is also facing federal weapons charges. A federal court in Lubbock issued that indictment on Wednesday, Oct. 11, stating that Daniels "did knowingly possess, conceal, store and dispose of a stolen firearm, a Springfield Model XD45 .45 caliber semi-automatic pistol."

Wife of slain Texas Tech officer sues for $1 million or more

    By bigcountryhomegpage.com New Staff

LUBBOCK, Texas – The wife of Texas Tech police officer Floyd East, Jr. filed a lawsuit on Friday for $1 million or more.

Carmen East of El Paso sued Hollis Alvin Daniels, III, for wrongful death. The lawsuit accused Daniels of shooting and killing East.

“The cold and calculated act took place while Officer Floyd East, Jr. was in the course and scope of his employment as a peace officer and investigating other criminal activity of … Daniels,” the lawsuit said.

“Daniels … shot and killed Officer Floyd East, Jr. with a .45 caliber handgun at the Texas Tech Police Department,” the lawsuit said.

Daniels was charged with capital murder on the night of the shooting – October 9, 2017. Court records in the criminal case said East took Daniels into custody and brought him to the Texas Tech Police Department.

Court records said Daniels had a stolen gun with him that was not discovered while he was under arrest. The criminal court records said Daniels shot East and then ran out of the police department. He was found and re-arrested a short time later.

The lawsuit said Daniels acted with “disregard towards human life.”

Daniels was a Texas Tech student at the time of the shooting.

The capital murder charge was still pending as of Monday and Daniels remained in the Lubbock County Detention Center. Prosecutors filed documents stating their intention to seek the death penalty.

Daniels has not yet filed his side of the story in court records.

Court wrangles with scheduling issues in the death penalty case against Daniels in Lubbock

    By Everything Lubbock News staff

LUBBOCK, Texas — Hollis Alvin Daniels, charged with capital murder for the fatal shooting of Texas Tech Police Officer Floyd East, made an appearance in court Friday. The hearing was procedural, but it explained why the case is not likely to go to trial anytime soon.

The defense attorney for Daniels, Chip Lewis, has a trial in California that is anticipated to take five or six months. A jury was already chosen for the California trial, but Lewis indicated that because of COVID, the jury is likely to be released. A new jury will then be chosen in the spring of 2021.

By the way, information on the internet indicated the other case is the murder trial of Robert Durst. Durst is accused of killing Susan Burman who disappeared in 2000. Durst made national news because he has been accused of killing three people over the years.

Lewis anticipated not being available for a trial in the Daniels case until the fall of 2021.

Court records said on October 9, 2017, Daniels was arrested by East on the campus of Texas Tech.

Daniels, age 19 at the time, had a stolen handgun with him, court records previously said. Inside the Texas Tech Police Department, East uncuffed Daniels just long enough to sign paperwork. Court records said it was at that time Daniels pulled out a gun and fatally shot East.

Daniels was located and arrested that same evening. He has been held in the Lubbock County Detention Center since that time.

In the Daniels case, State District Judge John “Trey” McClendon said he wanted to talk privately with Lewis and Lubbock County Criminal District Attorney Sunshine Stanek. The judge would then try to nail down a more specific timeline for trial.

The hearing on Friday was then adjourned. Prosecutors are seeking the death penalty against Daniels.

Hollis Daniels appears in court for scheduling conference in Texas Tech capital murder case

    By Gabriel Monte
    Lubbock Avalanche-Journal

Hollis Daniels, the former Texas Tech University freshman accused in the shooting death of a campus police officer five years ago, appeared in court Friday for a scheduling conference in his capital murder case.

Daniels, 23, has been held at the Lubbock County Detention Center since his Oct. 10, 2017, arrest and is charged in the shooting death of Floyd East Jr. If convicted, Daniels faces the death penalty or life in prison without parole.

The Lubbock County District Attorneys Office has said in previous hearings that it is seeking the death penalty in the case.

The scheduling conference on Friday was to determine future court dates leading up to a potential trial.

Daniels' attorney, Chip Lewis, told the court in a November 2020 hearing that he would have to hold off on engaging in another trial without the permission of the Los Angeles County Judge presiding over the trial his other client, billionaire Robert Durst.

Durst was arrested in 2015 in connection with the 2000 death of his friend, Susan Berman. He was convicted in September 2021 of shooting Berman at point-blank range in 2000 at her Los Angeles home.

He was sentenced to life Oct. 14. Two days later, he was hospitalized with COVID-19, according to USA Today reporting. Following his conviction, Durst was indicted in New York on a murder charge for his wife's 1982 death. Durst, 78, died in January of natural causes.

Police investigators in Lubbock believe Daniels, who is from Seguin, shot East on Oct. 9, 2017 as the police officer was filling out paperwork at the Tech PD headquarters for Daniels' arrest on an unrelated offense.

The two were the only ones in the room when a shot rang out, according to an arrest warrant. An officer who was in another room rushed in to find East on the floor suffering from a gunshot wound and Daniels was gone.

It is unclear how Daniels managed to possess a firearm at the police station.

Daniels was arrested on campus after a two-hour manhunt. A .45 caliber pistol was found near him.

"Hollis Daniels stated to officers that he was the one that shot their friend," the warrant states.

A media gag order was issued shortly after his indictment, barring anyone involved in the case to speak to the media.

Meanwhile, East's wife, Carmen filed a wrongful death lawsuit against Daniels in 2019. However, Hollis never filed a response despite records showing that he was served with the lawsuit at the jail and attorney James Frost sought a 30-day extension to file one.

In May 2020 Lubbock judge Ruben Reyes issued a default judgement in East's favor, finding that Hollis owed her $120 million in damages, according to court records.

The Easts lived in El Paso with their two daughters, but Floyd, who had recently taken the position in Lubbock with the Texas Tech Police Department, chose to travel each week instead of uprooting the entire family. He had hoped, eventually, to move back to El Paso to work as a police officer on the Texas Tech HSC campus there, according to Avalanche-Journal archives.
