Alabama officials this week announced an execution time for inmate James Barber but didn't tell Barber until the following day, breaking the state's own protocol, according to the Equal Justice Initiative.
Gov. Kay Ivey sent a letter to the Alabama Department of Corrections directing the warden to execute Barber by lethal injection between midnight July 20 and 6 a.m. July 21. Officials released the execution schedule to the press Tuesday but didn't tell Barber until mid-morning Wednesday, EJI said.
Alabama's new, revised protocol states that officials must tell Barber as soon as possible and also must tell him prior to the media. The state changed the protocol in March, requiring this new addendum.
"The state’s failure to follow its own rules on notice raises new questions about its commitment and ability to carry out a lethal injection execution in accordance with its execution protocol, following the state’s torturous multi-hour execution of Joe James last July and its failed attempts to execute Alan Miller and Kenny Smith," EJI said in a statement.
Alabama announced in May that it planned to resume executions after a four-month "top to bottom" review of the state’s capital punishment system, which Gov. Kay Ivey ordered in November. Ivey announced Tuesday afternoon that the state has 30 hours from 12 a.m. on July 20 to execute Barber, a Huntsville man convicted of murder during a first-degree robbery, by lethal injection.
Until recently, the Alabama Supreme Court issued death warrants for a particular day. Now, it issues them for a timeframe, and the governor gets the final say. Other changes that resulted from the governor-mandated review include new equipment in the chamber and more personnel on hand for the execution process.
