    Florence man found guilty of Capital Murder given death penalty plus 20 years

    FLORENCE, Ala. – Benjamin Young has been given the death penalty. A Lauderdale County Judge agreed with a recommendation by a jury back in February.

    Young was found guilty of capital murder, first-degree assault, and shooting into an occupied vehicle for his part in a 2016 fatal shooting. In addition to the death penalty, Judge Hal Hughston also sentenced Young to 20 years for the assault charge.

    Young is one of five people arrested in relation to the shooting death of 19-year-old Ki-Jana Freeman on March 1, 2016. A second teen was also injured.

    TUSCUMBIA — Officials say charges have been upgraded against a man originally charged with murder in connection with the 2016 shooting death of a Tuscumbia man outside an apartment complex.

    A Colbert County grand jury has indicted Riley Earl (Trey) Hamm III, 30, for capital murder, first-degree hindering prosecution, felony murder and first-degree assault.

    The indictment was issued during the March term of the grand jury.

    Tuscumbia police arrested Hamm in January. He was charged with murder and hindering prosecution in connection with the shooting that killed Ki-Jana Freeman, 19, and injured Tyler Blythe, who was 17 at the time.

    Detective Capt. Stuart Setliff said once the case against Hamm was completed, it was turned over to the Colbert County District Attorney’s Office and presented to the grand jury.

    “The grand jury upgraded the charges and added a couple,” Setliff said.

    Police Chief Tony Logan said the shooting took place March 1, 2016, outside Spring Creek Apartments on Avenue A in Tuscumbia. Police said the shooting was captured on security video at the apartment complex.

    Freeman died at Helen Keller Hospital in Sheffield. Blythe was treated for numerous gunshot wounds.

    Benjamin Young, 30, 502 Staunton Ave., Florence; Thomas Hubbard, 33, 1100 Midland Ave., Muscle Shoals; and Peter Capote, 24, same address, have all been indicted on charges of capital murder, first-degree assault, and shooting into an occupied vehicle.

    Young was found guilty Feb. 7 of capital murder and last week was sentenced to death.

    In October, De’Vonta Bates, 21, 106 Market Ave., Muscle Shoals, pleaded guilty to conspiracy to commit murder. He is scheduled to be sentenced in March. The district attorney’s office recommended a 20-year sentence.

    Police said Hamm’s name came up early in the investigation. New information and evidence put him at the scene, and he is reported to have been in an active role at the time of the shooting.

    The indictment also points out that Hamm is accused of “burning clothing” worn by others who were involved in the shooting.

    Testimony during Young’s trial indicate that Hubbard is the person who orchestrated the shooting.

    During testimony in Young's trial, witnesses said the shooting was a gang-related retaliation after a member's house in Muscle Shoals was broken into and several items taken.

    Witnesses identified Hubbard, Capote, Young, and Hamm as high-ranking members in the gang.

    Hamm is being held in the county jail on bail of $100,000.

    He is scheduled to be arraigned April 12 by Colbert County Circuit Judge Jackie Hatcher.

    Freeman was "lured" to complex

    TUSCUMBIA — De’Vonate Bates said he was with other members of the Almighty Imperial Gang when plans were made to kill the person Thomas Hubbard thought broke into his house and stole items, including an Xbox.

    Bates said members of the gang were at Hubbard’s house in Muscle Shoals on March 1, 2016, when the discussion was held. Bates said Hubbard, who goes by “Silent,” is head of the gang.

    He said Hubbard told the members he wanted to find out who broke into his house, and then he was “going to kill them.”

    Bates said a plan was developed, and Benjamin “B.K.” Young, Peter “Goofy” Capote, Hubbard and Riley “Trey” Hamm III left Hubbard’s house to meet and “kill” the person they thought was responsible.

    Bates’ testimony came Wednesday during the second day of Capote's capital murder trial.

    Capote is one of four people charged in the 2016 shooting that killed Freeman, 19, and injured Tyler Blythe, who was 17 at the time.

    Capote, Hubbard, Young and Hamm have all been charged with capital murder.

    Bates was arrested and charged with conspiracy to commit murder. He has pleaded guilty to the charge and is awaiting sentencing.

    In February, Young was convicted in of capital murder and was sentenced to death.

    Bates said the stolen Xbox belonged to gang member Dewayne Austin Hammonds, who had left it at Hubbard’s house on Midland Avenue in Muscle Shoals. The house was broken into Feb. 28, 2016, while Hubbard and others were at his grandmother’s funeral.

    He said Hammonds saw on Facebook that Ki-Jana Freeman had a Xbox for sale, and they thought it might be the one that was stolen.

    “Austin was supposed to check it out, but he had to go to work. I knew (Freeman) through Austin, so it was my job to text (Freeman) and get him to meet somewhere,” Bates said. “It was my idea to lure him to meet at Spring Creek Apartments to sell drugs.”

    A short time after Freeman arrived at the apartment complex, he was shot and killed.

    Bates said when the four men left the Muscle Shoals residence, they were in a white Dodge four-door truck and Young was driving, Capote was in the passenger front seat. Hubbard was in the back behind the driver, and Hamm was behind the passenger.

    Tuscumbia police detective Sgt. Wes Holland said Capote was identified as one of the shooters after viewing a surveillance video taken in the parking lot of Spring Creek Apartments.

    He said Bates and Hammonds said the shooters were "B.K." (Young) and "Goofy" (Capote).

    Holland testified that after Bates was developed as a possible suspect, he gave law enforcement a couple of false statements.

    With Bates on the witness said, Captoe’s defense team of Robert Graham and Bill Marthaler tried to discredit Bates’ testimony.

    “Would you lie to keep from being charged with murder and a life sentence?” Graham asked Bates.

    “No,” he said.

    “You lied to the police over, over and over,” Graham said.

    “Yes,” Bates admitted.

    “But as the investigation went on, you were able to collaborate the last statement that Bates gave you?” Chief Assistant District Attorney Kyle Brown asked Holland.

    “Yes,” he said.

    The trial continues today.

    TUSCUMBIA — Colbert County Assistant District Attorney Angela Husley said there is no question the state has met its burden of proof that Pete Capote was involved in the shooting death of Ki-Jana Freeman.

    “In a handwritten note, Capote says he killed K.J. (Freeman),” Hulsey told jurors in closing arguments today. “Witnesses, who were in a meeting when the plan was devised to set up (Freeman) told you Benjamin Young got into the driver’s seat of a truck and Capote was the passenger. A witness at the apartment complex said she saw two people get out of the truck — one from the driver’s side and another from the passenger side — and then she heard gunshots.

    “There were 12 bullet holes in the driver’s side of K.J.’s car, where he sat and died. Tyler Blythe was a passenger and was shot and luckily survived.”

    Capote is charged with capital murder. The shooting took place on March 1, 2016, in the parking lot of Spring Creek Apartments in Tuscumbia.

    The jury was charged by Colbert County Circuit Hal Hughston Jr. at 1 p.m. before beginning deliberations.

    The jury deliberated for 55 minutes.

    A jury today recommended the death penalty for Peter Capote, one of five people accused in the 2016 slaying of Shoals teenager Ki-Jana Freeman.

    The Colbert County jury voted 10-2 to impose the death penalty after convicting Capote, a 24-year-old Muscle Shoals man, of capital murder. He also was convicted of first-degree assault and shooting into an occupied vehicle.

    Circuit Judge Hal Hughston Jr. will issue a formal sentence May 24.

    Freeman was fatally shot March 1, 2016 as he sat in a Mustang with his friend Tyler Blythe outside Spring Creek Apartments in Tuscumbia. Blythe, 17, was injured in the shooting.

    Colbert County Assistant District Attorneys Kyle Brown and Angela Hulsey prosecuted the case. After today's verdict, Brown said he's thankful to get justice for Freeman's family.

    "They've been through so much," Brown said. "Their patience and strength have been so impressive to me."

    Capote is the third man convicted in the case. Prosecutors said Capote and Benjamin Young, who was sentenced to death last month, were the trigger men. De'Vontae Bates pleaded guilty last year to criminal conspiracy and agreed to testify about the plan to kill Freeman. His sentencing is scheduled later this year.

    Two others -- Riley Hamm Jr. and Thomas Hubbard -- are awaiting trial. Hubbard is set for trial in June. Hamm's case likely will go to trial next year.

    Authorities have said the suspects arranged to either buy or sell an Xbox to Freeman, but the transaction was a setup. The suspects believed Freeman and another man had stolen an XBox and TV two days earlier in a burglary.

    TUSCUMBIA — Jury selection and opening statements are expected to begin Thursday in the capital murder case of a man police said was the “mastermind” in the shooting death of Ki-Jana Freeman.

    The trial of Thomas Hubbard, 33, 1100 Midland Ave., Muscle Shoals, will begin in Colbert County Circuit Judge Jackie Hatcher’s courtroom.

    Hubbard is charged with capital murder and first-degree assault.

    Detectives said Hubbard is the person who orchestrated the March 1, 2016, shooting that killed Freeman and seriously injured a teenager in the parking lot of a Tuscumbia apartment complex.

    Police said Peter Capote, 24, 1100 Midland Ave., Muscle Shoals., Benjamin Owen Young, 30, 502 Staunton Ave., Florence; Riley Hamm III, 30, 2220 W. 17th St., Sheffield; and De’Vontae Bernard Bates, 21, 106 Markate Ave., Muscle Shoals, are all charged along with Hubbard in connection with the shooting death of Freeman, 19, of Tuscumbia.

    The shooting took place outside Spring Creek Apartments on Avenue A in Tuscumbia. Freeman died at Helen Keller Hospital in Sheffield.

    Tyler Blythe, 19, of Tuscumbia, who was 17 at the time, was flown to Huntsville Hospital, where he was treated for numerous gunshot wounds. He still is recovering from his injuries, police said.

    Capote, Hubbard, Young and Hamm have all been indicted for capital murder, first-degree assault and shooting into an occupied vehicle.

    Bates was indicted for criminal conspiracy and pleaded guilty to the charge.

    Young and Capote have both been found guilty of capital murder and both have been sentenced to death by Colbert County Circuit Judge Hal Hughston Jr.

    Hamm is scheduled to be arraigned on his charges Aug. 8.

    Chief Assistant Colbert County District Attorney Kyle Brown said prosecutors are seeking the death penalty against Hubbard.

    According to testimony at Young’s trial, Hubbard, Capote, Hamm and Young were high-ranking members of a gang. Witnesses said the shooting was a gang-related retaliation after Hubbard’s residence was broken into.

    The testimony indicated that someone broke into Hubbard’s residence and stole a computer gaming system while he, family and friends were at his grandmother’s funeral.

    Police said witnesses said Hubbard became enraged and wanted revenge. Reports indicate a member of the gang said it could have been Freeman and a plan was put into place to lure (Freeman) to the apartments and kill him.

    Motion to remove death penalty denied; trial set to start Thursday

    TUSCUMBIA — Colbert County Circuit Judge Jackie Hatcher denied a request this morning to bar the death penalty from the upcoming capital murder case of Thomas Hubbard.

    Defense David Bradley, who along with Jamy Poss are representing Hubbard, based his motion on a 2002 U.S. Supreme Court ruling on a Virginia case.

    Bradley said the Supreme Court ruled that it is cruel and unusual punishment to execute an "intellectually disabled" individual, which is prohibited by the Eighth Amendment.

    Expert witnesses Dr. Allen Shealy, a clinical psychologist from Birmingham, said that talking to Hubbard, and talking to people who knew him, led him to believe Hubbard should be tested. He had an IQ of 63.

    Shealy said Hubbard should be considered intellectually disabled "which years ago would have be considered mild retardation."

    Chief Assistant District Attorney Kyle Brown argued that Hubbard knew what he was doing when he gave law enforcement a statement about the incident. Also, he said that Hubbard was the head of a gang, and that he ran a business through the gang receiving and selling marijuana.

    "Which are signs of his ability to plan and to adapt," Brown said.

    Hubbard’s capital murder case is scheduled to begin Thursday afternoon following the selection of a jury.

    Hubbard is the person police orchestrated the 2016 shooting death of Ki-Jana Freeman, which took place in the parking lot of a Tuscumbia apartment complex.

    If found guilty, the district attorney’s office is seeking the death penalty.
