    AL CCA Tosses Conviction for Jodey Waldrop AL DR in 2005 Murder of Infant Son

    The Alabama Attorney's General Office will ask the state Court of Criminal Appeals to reconsider its decision to reverse the capital murder conviction of Jodey Wayne Waldrop, of Red Bay.

    Jodey Waldrop Waldrop, 31, was convicted Aug. 17, 2007, in Franklin County Circuit Court and sentenced to death for the 2005 homicide of his 3-week-old son.

    Prosecutors contended Waldrop shook the child violently. Waldrop testified he dropped the baby while trying to light a cigarette.

    On Friday, the Court of Criminal Appeals issued an order overturning Waldrop's conviction, citing comments about Waldrop's assault conviction in Mississippi that were made during the trial as grounds for the reversal. The justices wrote that Franklin Circuit Court Judge Terry Dempsey should have instructed jurors the comments could not be used as evidence for convicting Waldrop.

    Appeals Court Justices Alisa Kelli Wise, Samuel Henry Welch, J. Elizabeth Kellum and James Allen Main concurred with the opinion. Justice Mary Becker Windom dissented.

    Franklin District Attorney Joey Rushing was upset when he learned the conviction had been overturned.

    "His attorneys are the ones that brought up his prior record during their direct questioning of the defendant," Rushing said. "We only asked the defendant about his assault conviction as a follow-up to what his own attorneys had asked.

    "We believe the judge's failure to instruct jurors to not consider Waldrop's prior conviction as evidence in this trial is what the legal community defines as harmless error. We do not see it as grounds to overturn his conviction."

    Officials with the Equal Justice Initiative Center in Montgomery, who represented Waldrop in the appeal, could not be reached for comment Friday.

    Assistant Attorney General Clay Crenshaw said he will ask the appeals court justices to rehear Waldrop's appeal.

    If the appeals court refuses to reinstate the conviction, he will ask the Alabama Supreme Court to overturn the appeals court decision.

    "We can carry it all the way to U.S. Supreme Court if we need to," he said.

    Rushing said he is confident the state Supreme Court will overturn the appeals court ruling.

    If the Appeals Court's decision to overturn the conviction stands, Waldrop will receive another trial.

    While awaiting a final decision on his appeal, Waldrop will remain on death row at Holman Prison in Atmore.

    Waldrop is now doing life in prison WITH parole. If anyone has got any more information of what happened, then please share because I don't think anyone saw Alabama giving a baby murderer a chance of freedom..

    Man Sentenced for Child's Death

    RUSSELLVILLE - On Tuesday, after Jodey Wayne Waldrop stood in a Franklin County courtroom and learned he is to spend the rest of his life in prison for the death of his son, he turned around and apologized to his wife.

    “I'm sorry for what I did,” he told Tiffany Ellis.

    Waldrop, with hands and feet shackled and dressed in a white jail uniform, was then escorted out of the courtroom.

    Waldrop, 32, of Red Bay, was charged with capital murder in connection with the 2005 shaking death of his 3-week-old son, Jodey Jo “Chance” Waldrop.

    Waldrop's sentence was part of a plea agreement between his attorney, Steve Aldridge, of Sheffield, and Franklin County District Attorney Joey Rushing.

    Aldridge said by entering the plea, it was agreed the infant's death was a reckless act, not an intentional act of murder.

    Rushing said the agreement was reached after he discussed the plea with the child's mother.

    “Her goal was that he get a life sentence,” Rushing said. “We acknowledged that it was a shaken baby case and that it was possible that he could have been convicted of anywhere from manslaughter to capital murder. She agreed to make the offer for a life sentence.

    “We believe it is a good sentence, based on the facts of the case.”

    Waldrop has been in jail since he was arrested in 2006. He was found guilty of capital murder and sentenced to death in 2007. The Alabama Court of Criminal Appeals overturned the conviction in March. Appeals court justices wrote in their opinion that Franklin Circuit Court Judge Terry Dempsey should have instructed jurors to not consider testimony they heard about Waldrop having been convicted of assault in Mississippi.

    Rushing said by pleading guilty, Waldrop gave up his right to appeal.

    Courthouse officials said Waldrop admitted he got angry and shook the child to get him to quiet down.

    Rushing said Waldrop was taken to Holman Prison after Tuesday's hearing.

    The Alabama Department of Corrections has him listed as a lifer with a chance of freedom but taking a guess after reading the article, I'd imagine that Waldrop would have to serve an impossible amount of time before becoming eligible.

    Convicted killer of infant son stabbed to death with shank in Alabama prison

    ST. CLAIR COUNTY, Alabama -A north Alabama man convicted of capital murder in the 2005 shaking death of his infant son was stabbed to death in state prison early today.

    Jodey Wayne Waldrop, 36, was stabbed with a prison shank. The incident happened about 1:57 a.m. inside the cell he shared with another man at St. Clair Correctional Facility, said St. Clair County Coroner Dennis Russell.

    Waldrop was taken to St. Vincent's St. Clair where he was pronounced dead at 2:56 a.m., Russell said. Prison officials said an investigation is ongoing.

    Waldrop was arrested in 2006 for the death of his 3-week-old son, Jodey Chance Waldrop, who was killed the previous year. The baby suffered fatal brain injuries from being violently shaken.

    Waldrop was found guilty in 2007, but in 2010 the Alabama Court of Criminal Appeals overturned his case and ruled he should receive a new trial. According to an Associated Press story, jurors heard testimony during the trial about a previous conviction Waldrop had for assault in Mississippi, but the judge in the first trial failed to instruct them on how to consider that evidence.

    Alabama court records show that in 2011, Waldrop pleaded guilty and was sentenced to life in prison. According to an article in the Florence Times Daily, Waldrop's sentence was part of a plea agreement that the infant's death was a reckless act, not an intentional act of murder.

    Authorities said Waldrop admitted he got angry and shook the child, the Florence publication wrote, and he also apologized to his wife in court.

    One reason LWOP is cheaper than Death (which is ultimately a very deceptive fallacy but that's beside the point) is that the inmate is housed in the general prison population and this is an example of why that's not exactly the best idea ever. Believe it or not, there is Honour amongst Thieves and giving a baby killer the Dahmer Treatment isn't out of the question.
    I am vehemently against Murder. That's why I support the Death Penalty.
