    Summary of Offense

    Washington had recently been fired from a Radio Shack store. On January 16, 2005, he robbed the store and the manager, Justin Campbell, and then shot Campbell in the back of the head as the victim begged for his life. Washington later bragged of the slaying.

    Washington was sentenced to death on March 27, 2006.

    Alabama high court grants new sentencing to Brandon Washington in 2005 Birmingham robbery slaying

    BIRMINGHAM, Alabama -- The Alabama Supreme Court ruled Friday that Brandon Washington deserves a new sentencing hearing for his conviction in a fatal 2005 Birmingham robbery.

    The court said his sentencing which put him on death row had errors.

    Washington, 19, was convicted of capital murder and sentenced to death for killing store clerk Justin Campbell during the robbery of a Radio Shack electronics store in January 2005. Campbell, a married father of one, was working his way through the ranks at the store.

    Washington had been fired from the store two days prior to Campbell's slaying.

    The state's high court said improper testimony from Campbell's parents was admitted at the sentencing hearing. That included the parents describing Washington as "someone without a conscience" and saying a death sentence was appropriate. The Supreme Court also said the presentencing report prepared for the trial judge did not address Washington's troubled adolescence and mental health problems.

    The next step is for Washington to get another sentencing hearing.

    Washington, a Miles College student at the time of the killing -- was twice sentenced to death -- the latest was in 2007.

    Evidence at the trials showed Washington went into the store around closing time, pretending to look at cell phones. He pulled out a gun and demanded money from Campbell, who was working alone. Campbell offered his wallet, but Washington led him to a rear office in a search for more cash. Campbell begged for his life and to be able to see his family again. Washington shot him in the back of his head.

    When his son did not come home from work, Stephen Campbell went to the store where he discovered his son's body.
