    Judge finds Boise mass stabbing suspect Kinner is ‘dangerously mentally ill,’ not fit to stand trial

    The drawn-out hearing to determine whether a 31-year-old man accused of stabbing nine people in Boise is fit to stand trial has finally come to a conclusion.

    On Wednesday afternoon, 4th District Court Judge Nancy Baskin ordered Timmy Earl Kinner Jr. to be committed to a state facility for treatment for up to 90 days, according to online court records. But he won’t be housed a state hospital, as is typically done.

    The 31-year-old is going to the nine-bed Idaho Secure Mental Health Facility at the Idaho Maximum Security Institution because he is “dangerously mentally ill” and presents a “substantial risk of physical harm” to other people, according to Baskin’s order.

    In her ruling, Baskin said Kinner was “both unfit to proceed and unable to make informed decisions about his treatment.” She said he is a flight risk and danger to the community, including state hospital staff.

    “He presents a substantial risk of physical harm to other persons as manifested by the evidence of violent behavior alleged in the indictment, as well as his prior criminal history and conduct while in custody such that there is evidence others could be placed in reasonable fear of violent behavior and serious physical Harm,” Baskin wrote.

    The judge has given Department of Correction officials authority to provide any “involuntary necessary treatment” to help restore Kinner to mental competency. Prison officials have been ordered to submit a progress report to the court on Kinner’s mental condition — and whether he has improved enough to proceed. If the report concludes that he will not be competent in the foreseeable future, Baskin said she may order that Kinner remain at the state facility for another 180 days.

    Police investigators said Kinner went on a violent rampage at the Wylie Street Station Apartments on June 30 because he was kicked out by a woman who invited him to stay there as a guest.

    The nine stabbing victims included six children, and 3-year-old Ruya Kadir, who was celebrating her birthday, died two days after the attack. All of the victims were refugees from Syria, Iraq and Ethiopia.

    Kinner is charged with first-degree murder in the death of Ruya, and prosecutors plan to pursue the death penalty. He’s also facing numerous other charges, including eight counts of felony aggravated battery.

    A trial date has been set for Jan. 13, 2020, but Kinner's attorneys said in court last September that they did not believe he is able to assist in his own defense. A psychiatrist tasked with evaluating Kinner determined that he was not competent, a finding that prosecutors challenged at the evidentiary hearing that began on Dec. 27. It resumed Jan. 3, continued on Jan. 4 and convened again on Tuesday.

    Kinner’s mental health also came into question long before he arrived in Boise, as did signs of drug use. A judge was asked in 2009 to send him through anger management training and substance abuse treatment, and his mental competency was evaluated in 2012, Tennessee and federal court records show.

    A judge dismissed Boise mass stabbing suspect’s petition to change name to 'Eternal Love'

    BOISE — Timmy Earl Kinner Jr. failed to publish notice of his plan to change his name in the newspaper for four weeks and didn’t arrange to appear at court hearing on the matter Tuesday afternoon, so a judge dismissed his petition.

    Kinner is accused of stabbing nine people at a northwest Boise apartment complex last June, including Ruya Kadir, a 3-year-old who died a few days later.

    Kinner was granted a hearing for his proposed name change at 1:30 p.m. Tuesday before he was found unfit to stand trial on first-degree murder and other charges. He’s currently being held at secure mental health facility at the state prison.

    Judge Lynnette McHenry said Kinner was responsible for arranging transport to court for the hearing. She dismissed Kinner’s petition without prejudice, which means that he could refile.

    Attorney Fred Shoemaker, who is representing the parents of Kadir, attended the hearing. Kadir’s parents filed an objection to Kinner’s attempt to change his name.

    Judge: Boise mass stabbing suspect to continue psychiatric treatment

    A judge has ordered that mass stabbing suspect Timmy Kinner will continue to receive psychiatric treatment at the Idaho Maximum Security Prison South of Boise for another 90 days.

    Court documents state district Judge Nancy Baskin, following a mental competency hearing Thursday, has not made a definitive determination regarding Kinner's competency but the judge stated this week he continues to "lack the capacity to make informed decisions about his treatment."

    Kinner, a 31-year-old transient from California, is charged with 1st-degree murder in the death of 3-year-old Ruya Kadir in Boise last summer.

    Kinner is also facing several other charges, including 8 counts of aggravated assault.

    Prosecutors are seeking the death penalty.

    But before a jury can decide his guilt or innocence, the question of Kinner's mental competency to stand trial must be resolved. There is no insanity defense in Idaho.

    And Judge Baskin's order this week states the Idaho Department of Correction will continue to provide the "prescribed involuntarily necessary treatment to restore the defendant's competency."

    Kinner was first determined mentally incompetent to stand trial in January, a decision that was reaffirmed at a competency hearing in April.

    And according to court documents, Kinner's competency will be reviewed at another closed hearing on August 1.

    The judge has also issued a gag order in this high profile case so nobody involved with the case can talk about it publicly.

    Suspect in Boise mass stabbing that killed 3-year-old is found competent to stand trial

    The man accused of fatally stabbing a 3-year-old girl and wounding eight other people at or near the child’s birthday party on June 30, 2018, is back in the Ada County Jail after a judge on Saturday declared that he is competent to stand trial.

    In an order on Saturday, though, Baskin wrote that Kinner “has sufficient present ability to consult with his lawyer with a reasonable degree of rational understanding — and (that) he has a rational as well as factual understanding of the proceedings against him.” Hearings had been held again in September to determine whether or not he was competent to assist in his own defense.

    Kinner’s jury trial is tentatively set for Jan. 13, 2020.

    Death penalty trial postponed until 2021 for Boise mass stabbing suspect Kinner

    After at least 9 months of working to restore a 31-year-old suspect’s mental competency, attorneys have requested more time to prepare for his trial in the mass stabbing of 9 people last year that left a 3-year-old Boise girl dead.

    Timmy Earl Kinner Jr., who appeared in court Wednesday, is charged with fatally stabbing Ruya Kadir and wounding eight other people at or near the child’s birthday party on June 30, 2018, at a Boise apartment complex.

    Ada County prosecutors have said they plan to pursue the death penalty against Kinner, who is charged with first-degree murder and 12 other felonies connected to the attacks. His trial was initially set for January 2020, but he was declared competent just this month, and attorneys need more time to ready their cases.

    The defense argued that they have 21,000 pages of discovery to review and didn’t have the opportunity to work with Kinner when he was being restored to competency. Because of that, the defense argued that they couldn’t be prepared by January and asked for a trial date sometime in late 2021.

    Prosecutors asked for a trial date in September.

    Fourth District Judge Nancy Baskin landed in the middle and said she would chose a date in “early 2021.” Kinner has waived his right to a speedy trial, and a final date will not be set until after Judge Baskin reviews other motions in November.

    Kinner was escorted into court Wednesday by four sheriff’s deputies, and walked into the fifth-floor courtroom with a broad smile as he greeted his three public defenders.

    Baskin is the judge who determined Kinner to be fit for trial. In January, he was found to be “dangerously mentally ill” and needed to be restored to competency, which took most of the year. To be determined competent, a defendant must be able to assist in his own defense, understand proceedings and communicate with his attorneys.

    Baskin rearraigned Kinner in court Wednesday, reading his charges out loud, and again informed him of his rights. She also notified him again that the state is pursuing the death penalty.

    Kinner responded softly with “yes, ma’am” and “no, ma’am” when the judge asked questions about the charges and his rights. Baskin also questioned Kinner to make sure he understood what the maximum punishment for his charges could be, and Kinner said he understood.

    The hearing was the 1st public court appearance Kinner has made in months, as all of his competency hearings were sealed from the public. Wearing a yellow Ada County Jail uniform, Kinner appeared heavier than he was at the time of his arrest in 2018, his previously long hair had been cut short and he’d grown a full beard.

    Attorney David Smethers told the court that he and his colleagues were prepared to provide Kinner with a defense, but that they still did not agree with Baskin’s decision on competency.

    “We are not agreeing that he is competent at this time,” Smethers said in court.

    Part of Wednesday’s hearing was closed to the public. When the judge reopened the courtroom, she heard the defense and prosecution make further statements about how long the case should be postponed. The defense said that it believes jury selection alone could take at least three months, and the death penalty trial is expected to take at least 8 weeks.

    Kinner remains in custody at the Ada County Jail without bail.

    Timmy Kinner, a suspect accused of killing a little girl, 3, at her birthday party, and wounding eight others during a stabbing rampage in Boise, Idaho, nearly three years ago, has pleaded guilty to several crimes, including first-degree murder.

    Kinner pleaded guilty Tuesday to one count of first-degree murder, eight counts of aggravated battery, two counts of aggravated assault, and one count of use of a deadly weapon, according to the Ada County Prosecutor’s Office. The pleas were entered as part of a stipulated plea agreement, court records showed.

    Kinner was arrested in 2018, accused of attacking nine people during the birthday party of Ruya Kadir at a Boise apartment complex. Ruya died from her injuries and eight other people, including five children, were wounded during the attack.

    On Tuesday, Anmar Lafta, who is related to some of the stabbing victims, said he wants Kinner sentenced to death, according to the Idaho Statesman. However, it was unclear if his plea agreement will keep that option open.

    "What he did to children, to the family, he broke family hearts and he killed children. Those people should go to death without even thinking about it," Lafta said. "… They’re not adults, they hadn’t seen life yet. They ran away from war to come here, and look what happened to them."

    Kinner was ruled incompetent to stand trial for several months after his arrest. Attorneys for Kinner argued that he suffered from "mental conditions" which impaired his decision-making skills and the ability for them to defend him, Boise's KTVB-TV reported. Despite those arguments, he was declared mentally fit to stand trial in October 2019.

    He was slated to appear for a jury trial in September this year. His next court appearance will be for his sentencing scheduled for June 10.

    Kinner, originally from Memphis, Tennessee, arrived in Boise several weeks before the June 2018 stabbing, according to the Statesman. He had been living at the apartment complex where the rampage occurred and was reportedly asked to leave by the resident he was staying with a week before the incident. Police have said Kinner didn't know any of the victims, many of whom were refugees who escaped violence in their home countries before coming to Idaho.

    The brother of Mustafa Mutlak, whose wife and two children were injured in the attack, said his family was "relieved" after Kinner pleaded guilty.

    "We just want everybody to be safe, because the crimes he did against kids are horrible," Alex Mutlak told the paper. "That was terrifying to see a grown man attacking kids at a birthday party. We just wish that justice will take place and we pray for his soul to be forgiven by God … We thank the city and the police department and the justice system because they made us feel more safe at home after the accidents."

    Kinner's plea deal will prevent a potentially lengthy and difficult trial for the victims, according to Julianne Donnelly Tzul, executive director of the International Rescue Committee in Boise.

    "Our heartfelt care goes out to the families who were impacted, and our gratitude goes to the Boise community who wrapped services and support around our Wylie neighbors in an extraordinarily difficult time," Tzul said. "We, at the IRC in Boise, are grateful that the families who survived the Wylie mass stabbing attack will be spared the experience of reliving the incident with a lengthy trial. We once again thank the community for respecting the privacy of the impacted families."

    Prosecutors withdraw intent to seek death penalty in exchange for Kinner's guilty plea

    BOISE — Timmy Kinner Jr., 32, will not face the death penalty after in March accepting a stipulated plea agreement in his first-degree murder case in Ada County.

    Kinner, who in June 2018 was charged with stabbing 3-year-old Ruya Kadir to death during a birthday party, and injuring eight others, all of whom were refugees, pleaded guilty March 30 to first-degree murder and a dozen other charges.

    In exchange for Kinner’s guilty plea, Ada County agreed to withdraw its notice of intent to seek the death penalty filed on Oct. 18, 2018. A potential death sentence remains on the table and the state reserves the right to re-file the notice of intent, according to a copy of the plea agreement.

    Kinner will be sentenced to life in prison for first-degree murder and aggravated battery, the agreement stated. The sentences will run consecutively so that Kinner will be sentenced to two consecutive fixed-life terms on those counts.

    One of Kinner’s aggravated battery charges will be enhanced by Kinner’s guilty plea entered for use of a deadly weapon during the commission of a crime, according to the agreement. That charge will result in a 30-year fixed sentence, which will run consecutively to Kinner’s two life sentences.

    On Kinner’s remaining counts, the sentences will be open for argument in court. According to the plea agreement, this will include whether the sentences for those counts will run consecutive or concurrent, the latter of which would reduce Kinner’s time served.

    Kinner also is required as part of his guilty pleas to admit to a prior federal conviction for being a felon in possession of a firearm in May 2009 and two convictions out of Tennessee, one for aggravated assault in November 2013 another for possession of a controlled substance with intent to sell in May 2016.

    Should any of the victims of Kinner’s crimes request a no-contact order, the court will issue an order barring Kinner from making contact with any of the victims or immediate family members of any victims who were minors at the time of the commission of the crimes, to which Kinner is pleading guilty, the agreement stated.

    Kinner will have the opportunity to make a statement apologizing to the victims in his own words at sentencing, and the parties stipulated in the plea deal that this statement will not be in violation of any of the no-contact orders.

    In January 2019, Kinner was declared dangerously mentally ill by Fourth Judicial District Judge Nancy Baskin and ordered to undergo treatment at the Idaho State Maximum Security Institution.

    After Baskin declared Kinner fit for trial in October 2019, his trial was rescheduled for September of this year. Kinner is scheduled to be sentenced June 10. According to his plea agreement, Kinner is requesting that he serve his sentence out of state.

    Man Behind 2018 Boise Mass Stabbing Sentenced To 2 Lifetimes In Prison

    Timmy Earl Kinner, the man who pleaded guilty to slashing his way through a child's birthday party in 2018 and killing a 3-year-old girl in the process, will serve two life sentences without the possibility of parole.

    Kinner will also serve another 120 years in prison consecutively. A hearing to settle a proposed $328,000 in restitution will be held in August.

    He pleaded guilty to 11 total charges, including first-degree murder, aggravated battery and aggravated assault in March.

    Five children and three adults also suffered injuries, including some that were life-threatening at the time, during the attack that swept through a northwest Boise apartment complex.

    Ada County Prosecutor Jan Bennett’s office originally sought the death penalty in the case, but dropped its push due to Kinner’s plea agreement.

    He had originally been found mentally unfit to stand trial until the fall of 2019.

    Bifituu Kadir, the mother of 3-year-old Ruya Kadir who was killed during the attack, broke down crying as she gave testimony.

    Dressed in a black jacket and a pink, orange and white head wrap, Kadir had seen Kinner sitting outside on that warm June evening in 2018.

    “I had no idea that this individual was planning to kill my daughter,” she said through an interpreter. “I passed by him hugging my daughter at the time. I wish he had killed me instead.”

    Since her daughter’s death, Kadir said she used to visit her grave every day at 5 a.m. to tell Ruya good morning and returned at 8 p.m. to tell her good night.

    “Half my heart is there,” she said.

    Kinner, dressed in a white polo shirt, glasses and wearing a rosary around his neck, looked at Kadir through most of her testimony while writing on a piece of paper with his hands restrained.

    “You have taken my life from me. I cannot sleep. You are always in my life. You are everywhere,” Kadir told him. “I really hate myself because I let you harm my daughter and I really hate my color because I look like you.”

    Kinner is Black and Kadir is Ethiopian.

    After several victims gave their statements, prosecutors began outlining the “stabbing rampage.”

    Shortly after they described Kinner picking up Ruya, stabbing her in the heart and throwing her down, Kadir threw what appeared to be a metal water bottle across the room at him. Guards quickly ushered Kinner through a side door while others restrained

    Kadir — who repeatedly screamed her daughter’s name — and ushered her out of the courtroom.

    She and Ruya’s father Recep Seran were then required by Judge Nancy Baskin to watch proceedings remotely. Other victims and their families joined them.

    When asked if he was hurt during the outburst, Kinner said, “Thankfully, no.”

    He later gave a lengthy statement apologizing to the victims.

    “I didn’t have any plans to throw my life away and I definitely didn’t have any plans to hurt these people,” Kinner said. “I hate that I took their baby away from them.”

    Previously during the hearing, an investigator for the defense outlined Kinner’s significant mental health issues. He had been diagnosed with bipolar disorder and schizophrenia throughout his life

    He told his victims he hopes they understand he was having a mental breakdown and that he did not intend to attack anyone that night.

    “That’s the only way they’re going to be able to grow up and enjoy their lives,” Kinner said.

    Earlier in the hearing, parents of several victims said their children live in fear after the attack. They said the kids refuse to play outside anymore, with one child opening cabinets and closet doors in rooms to ensure no one is hiding in them.

    The grisly mass stabbing on June 30, 2018 carved lasting memories of one of Boise’s most gruesome crime scenes into the minds of those who were touched by it.

    “People were scattered across the apartment complex, both within apartments themselves, lying in the street and in the walkways,” said former Boise Police Chief Bill Bones at a news conference the day following the attack.

    Firefighters sprayed off bloodstains from the parking lot the morning after the attack as well-wishers – dropped off flowers, posters and cards at a makeshift vigil on the bridge over the canal where police said Kinner had thrown the knife used in the attack.

    A civil lawsuit filed by Kadir’s parents against Kinner, as well as her neighbors and companies affiliated with the apartment complex where the attack happened is still ongoing. It had been on hold pending the end of Kinner’s criminal case.
