    3-year-old birthday girl dies after Boise stabbing, suspect charged with murder

    A 30-year-old California man accused of a vicious stabbing attack of nine refugees, including six young children, was charged with murder on Monday after one of the children died from injuries related to the attack.

    Timmy Earl Kinner was arraigned at the Ada County Courthouse on Monday afternoon.

    A 3-year-old victim, who was celebrating her birthday when the attack happened, was flown to Utah for treatment and died there, according to a Boise Police press release. She was identified by the International Rescue Committee as Ruya Kadir.

    One other child has been treated and released from a local hospital, while the seven remaining victims are still in the hospital. Many of those still in the hospital have serious or critical injuries.

    The criminal complaint lists the names of the adults who were stabbed, but a spokesman for Saint Alphonsus Medical Center said the hospital will not release conditions of crime victims. The names of the children were listed only by initials in the complaint.

    Boise Police stated in the release that "due to the nature of their injuries," police will not provide regular status updates on the conditions of the victims.

    Kinner was booked into the Ada County Jail early Sunday morning on the suspicion of nine counts of felony aggravated battery and six counts of felony injury to a child. He was charged on Monday with one count of first-degree murder, eight counts of aggravated battery and a use of deadly force enhancement.

    He is being held without bail due to extreme risk to the community, said Judge Russell Comstock.

    Ada County Deputy Prosecutor Dan Dinger said in court Monday that Kinner has exhibited aggressive behavior while in jail. He cited two incident reports: one in which Kinner was threatening staff and another in which he was endangering himself and others.

    In court, Kinner requested to represent himself, but Comstock said he would assign Kinner a public defender for now.

    “Do you understand what you’ve been charged with now, sir?” Comstock asked.

    “No, no sir,” Kinner replied.

    “What don’t you understand?” the judge asked.

    “I don’t understand none of this, sir,” Kinner said.

    The jail roster lists Kinner's city of residence as Los Angeles, but Dinger at the court hearing said Kinner was homeless with no real ties to Boise. Kinner was in southern Utah in April and California in March.

    He also has an extensive criminal record in Tennessee, according to court records. He has prior drug, weapons and assault convictions.

    Kinner is scheduled to be back in court for a preliminary hearing before Judge Michael Oaths at 8:30 a.m. July 16.

    Boise Police Chief Bill Bones said Kinner was staying with someone at the Wylie Street Station Apartments last week, but on Friday was asked to leave.

    Police responed to reports of a man attacking people at the Wylie Street Station Apartments with a knife just before 9 p.m. Saturday.

    Investigators say kinner returned to the apartment complex seeking revenge for being kicked out. He is accused of attacking children at a 3-year-old's birthday party, as well as adults and others in the vicinity. Police found stabbing victims inside and outside the apartments.

    "This is an attack against those who are most vulnerable, our children," Bones said. "It's untenable, unconscionable and is pure evil in my mind."

    All of the victims were hospitalized in Boise; one child was later flown to a Salt Lake City hospital. The extent of the victims' physical injuries varied, but some will be life-altering, Bones said at a press conference Sunday.

    The man accused of killing toddler, stabbing 8 refugees, was arrested just 2 months ago

    The man accused of brutally stabbing a toddler to death, along with non-fatally stabbing eight other people on Saturday, has a background ranging from sexual battery, assault, dealing drugs and spending time in a federal prison.

    Timmy Kinner, 30, who a prosecutor on Monday described as homeless, has known criminal records in Utah and Tennessee. Records found by the Idaho Statesman show he was arrested as recently as April in Utah, spending three days in jail but his life of crime dates back more than a decade.

    Kinner is accused of stabbing refugees gathered at a 3-year-old girl's birthday party at the Wylie Street Station Apartments. The apartment, off of State Street, is home to many refugees and the victims were from Syria, Iraq and Ethiopia.

    In his most recent arrest, Kinner's victims included the 3-year-old birthday girl who died, two 4-year-olds and children ages 6, 8 and 12, as well as three adults, police reported.

    The knife police said Kinner used in the attack was a large, folding blade knife, according to Boise Police. It was found in the canal that runs just south of State Street when exiting the apartment complex on Wylie Lane.

    In April, the St. George, Utah, Police Department arrested Kinner for misdemeanor theft. He was sentenced to three days in jail and 18 months of supervised probation. He was ordered to pay $700 in restitution. In Utah, his probation circumstances required that he keep the court advised of his current residence and was supposed to notify the court within 48 hours if he changed addresses.

    Kinner is a convicted felon, which would have prohibited him from owning a firearm, but he has a history of illegally possessing weapons. His record also shows that he has a history of violating the terms of his supervised release.

    Criminal history in Tennessee


    In 2015: Kinner was charged in June on suspicion of two felony counts for manufacturing, delivering or selling a controlled substance, possession of marijuana, unlawful possession of a weapon and misdemeanor theft.

    In 2014: Kinner was charged with misdemeanor assault causing bodily harm in September, and one month later, he was charged with misdemeanor indecent exposure.

    In 2013: Kinner was arrested in January for two counts of misdemeanor indecent exposure, and in December, he was arrested for felony especially aggravated robbery but the charge was dismissed. In July, he was also charged with felony aggravated assault.

    In 2012: He was charged with two felony counts of aggravated assault and later with misdemeanor assault by offensive act and felony sexual battery. In October, he was charged with misdemeanor aggravated assault. In November, he was charged with assault by bodily harm and assault by offensive contact, both misdemeanors.

    In 2008:
    in February, he was charged with possession of marijuana, reckless driving, evading arrest, two counts of criminal trespassing, and two counts of false imprisonment, and unlawful possession of a weapon in a public place — all misdemeanors.

    In federal court in 2008, Kinner was indicted in Tennessee for illegal possession of a semi-automatic handgun and distributing 12 grams or more marijuana, according to court records. In that case, he pleaded guilty to the weapons charge and was sentenced in 2009 to three years and 10 months in prison and 500 hours of drug rehabilitation. After his release from prison, he was ordered to serve three years of supervised release.

    In that case, a federal judge revoked his supervised release at least twice because he committed new crimes.

    In 2007: In October, he was charged with possession of marijuana.

    In 2006: In April, he was charged with unlawful possession of a weapon in a public place. In October, Kinner was charged with misdemeanor unlawful possession of a weapon.

    Most of Kinner's charges were settled in plea agreements or ammended through prosecution.

    He also served time in a Kentucky prison, according to police. He had never been arrested in Idaho before Saturday.

    Today's case


    On top of first-degree murder, Kinner is charged with eight counts of aggravated battery, punishable by up to 15 years each if convicted, and an enhancement for use of a deadly weapon in the commission of a crime.

    If convicted, he faces up to life in prison or the death penalty.

    He awaits trial at the Ada County Jail and is being held without bond.

    In an effort to learn more about the initial reports of the stabbing, the Idaho Statesman requested copies of the 911 recorded calls made on the night of the stabbings. Ada County denied the request Monday.

    Ada County Prosecutor weighing death penalty in Boise attack

    BOISE - Ada County Prosecutor Jan Bennetts says a decision whether to seek the death penalty for a man charged in a mass stabbing in Boise last weekend will be made as soon as all evidence is reviewed.

    On Monday, July 2, the Ada County Prosecuting Attorney’s Office charged Timmy Kinner with one count of first degree murder and eight counts of aggravated battery -- in addition to a sentencing enhancement for the use of a deadly weapon -- in commission of a felony, in connection with the stabbing attack against nine people in a northwest Boise apartment complex on Saturday, June 30. A three-year-old girl died as a result of the attack.

    Kinner is being held without bond and is scheduled for a preliminary hearing on July 16, at 8:30 a.m. at the Ada County Courthouse.

    In response to media inquiries regarding the death penalty, Bennetts stated,

    “First-degree murder is an offense under Idaho law that is eligible for the death penalty. My office is working diligently to review all of the evidence in this case. The investigation is ongoing and law enforcement is working very hard to conduct a thorough investigation, compile all of the police reports and provide the completed investigation to my office.

    “The decision of whether to seek the death penalty cannot be made until all of the facts, circumstances and statutory factors are considered and weighed pursuant to Idaho law. A decision regarding the death penalty will be made as soon as law enforcement completes the investigation, we have an opportunity to review all of the evidence and we consult with the victims and their families.”

    Bennetts added, “On behalf of my office, our thoughts continue to be with the victims and their families as well as with the first responders and with our entire community impacted by the events of Saturday evening.”

    Judge denied, then granted psychologists access to man accused of stabbing 9, killing 1 in Boise

    A Fourth District Court magistrate judge initially denied a motion to allow doctors into the Ada County Jail to see a man accused of stabbing nine people, including one child who died.

    Timmy Earl Kinner Jr., a 30-year-old homeless man, has been charged with murder in the stabbing death of 3-year-old Ruya Kadir. Eight others were hospitalized in the stabbing at the Wylie Street Station Apartments on June 30. He is being held without bail due to extreme risk to the community, Judge Russell Comstock said at his arraignment July 2.

    Kinner was scheduled to be in court at 8:30 a.m. Monday for a preliminary hearing before Magistrate Judge Michael Oths, but that hearing was continued until Aug. 14.

    Kinner is also facing eight counts of aggravated battery in the alleged stabbing of the eight others, including five children, and a use of deadly force enhancement.

    Kinner has had five behavioral violations at the Ada County Jail, including one in which he made a verbal threat of violence toward a jail employee, according to Patrick Orr, a spokesman for the Ada County Sheriff’s Office. The other violations were for failure to follow commands from jail staff or breaking jail rules.

    “While we won’t tell you exactly where he is being housed in the jail for security issues, we can say he is being held in a cell by himself,” Orr said.

    The 30-year-old, who has a criminal record in Utah and Tennessee, has asked to represent himself, but for now he is being represented by public defender David Smethers.

    On July 3, Smethers filed a motion to allow Dr. James Davidson and Dr. Nancy Davidson into the jail to see Kinner. Oths denied the motion, “absent some further explanation of the role of proposed persons in this matter.”

    Oths said the court would reconsider the denial after the state and/or Ada County sheriff were heard on the matter.

    Smethers filed another motion with an explanation of who the Davidsons are, and their purpose for meeting with Kinner. He said they are Ph.D.-level psychologists who are part of the Davidson Forensic Group, which practices in Idaho and Texas. They are potential expert witnesses in the case.

    “Further, the defense team needs input from mental health professions in order to assess the case, prepare a defense and effectively counsel the defendant on his options,” the motion from July 9 reads.

    Kinner’s defense attorneys asked in a motion that their client be allowed “the use of at least one hand” in meetings at the Ada County Jail with the Davidsons. In his order granting access, Judge Oths struck out the stipulation on the use of one hand.

    On July 11, Oths granted access to Kinner at the jail, according to online court records.

    Mass-stabbing victims suffer more than knife wounds: 'Something is broke inside her'

    Two and a half weeks after a mass stabbing sent six children and three adults to the hospital, most of the victims have been discharged.

    But the attack by a knife-wielding transient at a 3-year-old’s princess-themed birthday party has left scars that will take a very long time to heal.

    At least five of the nine victims have been released from St. Luke’s Boise Medical Center or Saint Alphonsus Regional Medical Center, according to a family member and Boise police. Ruya Kadir, the birthday girl, died on July 2 at a Salt Lake City hospital, where she had been airlifted because her injuries were so severe.

    Timmy Earl Kinner Jr. is accused of rampaging through Ruya’s party and into residents’ units on June 30, slashing away at victims and chasing terrified children. The attack occurred at the Wylie Street Station Apartments off State Street, where Ethiopian refugees like Ruya’s family and others from Syria and Iraq have been resettled.

    Police have said that Kinner was angry and seeking revenge over having been kicked out of an apartment in the complex where he had been staying. He was not targeting refugees or motivated by hate, according to authorities.

    One of the stabbing victims, Teba Jalil, age 6, is “doing OK,” said Anmar Lafta, an Iraqi immigrant in Boise who is related to the little girl and four other victims. But “OK” only goes so far. Teba has lost a lot of weight, he said, and is a far different child from the smiling soon-to-be-first grader she was before the attack.

    “She’s not back at how she was before,” Lafta said in an interview Tuesday. “Inside her, something is just broke. All of them, not just her. … The way how she talk. The way how she walk. Something is broke inside of her.”

    Teba’s 8-year-old brother, Zine, was released from St. Luke’s the day after the attack. Their mother, Miada Jasim, 37, remains in Saint Alphonsus. She had been stabbed in the neck and remains paralyzed on her left side.

    Ordeals of a mother and her toddler

    Ekhlas Al Khudhur, an Iraqi refugee who was stabbed more than a dozen times, has been released from Saint Alphonsus, Lafta said, but she will return to the hospital at a future date for further surgery. “They just let her out to make her feel better,” he said.

    And Al Khudhur’s daughter, 2½-year-old Miral Ghaleb? She’s “OK” too, he said. She’s been discharged from St. Lukes. “She’s kind of stable. She keeps crying, scared.”

    Lafta said that the Jalils are staying with him until the International Rescue Committee can arrange for the family to move out of the Wylie Street Station Apartments.

    In addition to Lafta’s relatives and Ruya, Kinner is accused of attacking a family of Syrian refugees, Ahmad Manla and two sons, ages 6 and 12. According to Boise police, one of the boys was discharged from St. Luke’s.

    The family has requested that additional information not be released.

    Kinner is a 30-year-old transient with a long criminal record. He has been charged with one count of first degree murder and eight counts of aggravated battery with a use of deadly force enhancement. He is being held without bail and is scheduled to return to court on Aug. 14.

    Police said that Kinner’s attack left more victims than any crime in Boise history.

    Offers of help keep coming

    Julianne Donnelly Tzul, executive director of the International Rescue Committee in Boise, told the Idaho Statesman that three of the families Kinner is accused of attacking have been moved from the Wylie Street Station Apartments and are living in temporary housing.

    “There’s another cluster of folks that have requested relocation,” Donnelly Tzul said Tuesday. “We’re working on getting it for them.”

    Donnelly Tzul estimates that 30 organizations in the area have offered to help the families of Wylie Street Station. Every family in the complex – U.S. citizens and refugees alike – has been contacted “to find out what they need and want,” she said.

    “The Red Cross is gathering resources from each organization,” she said. “Each of us is navigating with specific families. If this family needs furniture, clothes, food, we’re that interface. All of the victims’ families have been offered counseling. A couple have said they are not ready. A couple were in counseling before” and are continuing.

    Donnelly Tzul said several local restaurants have donated proceeds from Thursday’s sales to the victims. Two concerts are being planned by people associated with Treefort Music Fest. Micron employees have launched a campaign. Transitional housing for the victims has been paid for through a grant from Airbnb.

    “Last I saw we were looking at either having received or expecting to receive $300,000,” she said. “The medical bills [for the victims] could also be substantial. … $300,000 pales when you look at long-term care for someone who is uninsured.”

    And at least one of the hospitalized victims, Donnelly Tzul said,“will not be released anytime soon.”

    How IRC says it’s using donations


    She said she wants donors to be aware of lengths the IRC is going to to ensure that all donations for the Wylie Street Station victims go to the victims.

    Every donation that comes in as part of the campaign on their behalf is carefully coded, she said. None of the money has been used to support the staff member the IRC sent to Boise to help the 22-person local staff
    assist the stabbing victims.

    “None of the money raised from the community is going to IRC,” Donnelly Tzul said. “Not before. Not now. We’re trying to conserve that money for areas of deepest need for the families: medical bills, getting folks moved, first month’s rent and deposit, lost wages.”

    Those who still want to donate can go to the IRC website, rescue.org/boise, and give eitherthrough the Boise office’s main portal or a special campaign link that has been created for the stabbing victims.

    Needed: vacation lodging and gift certificates

    And the IRC has a request on behalf of a particular set of victims. The group would like to help this traumatized family of five take “a break from this whole experience” in McCall or Sun Valley, some place with mountains and lots of peace. They’re looking for a cabin or other lodging and some gift certificates to cover meals and other expenses.

    “The families are taking different paths in terms of how connected to their community they want to be as they go through healing,” Donnelly Tzul said. “This one family does not want to do large group things with neighbors and friends. They don’t want to have their children relive the experience.”

    After all the pain the family has endured, she said, the IRC staff wants their trip “to feel like a vacation.”

    Boise mass stabbing suspect’s attorneys say his rights were violated in police jail visit

    Timmy Earl Kinner Jr. sent a note to Ada County Jail staff, addressed “To whom it may concern!” The July 20 note read:

    “This is from Timmy Kinner 01119786. I have info pertaining to my case & I need to speak w/ an investigator. Possibly & preferably 1 already assigned to investigate my charges.”

    The 30-year-old is charged with murder in connection with the June 30 stabbing of nine people, including 3-year-old Ruya Kadir, who later died. He’s also facing eight counts of aggravated battery and a use of deadly force enhancement.

    The contents of that note, which is called a “kite” in the context of written jail communication, was not available when the Statesman first reported July 27 that Kinner had summoned police to the jail. A Boise police spokeswoman told the Statesman no conversation between police and Kinner took place that day.

    Kinner’s three attorneys with the Ada County Public Defender’s Office, who declined to comment July 27, said in court documents filed a few days later that their client was not summoning a police detective when he asked to speak to an “investigator” that day but rather a defense investigator whom they had assigned to Kinner’s case.

    They also said a Boise police detective’s comment to Kinner that day was an “unconscionable” violation of his Sixth Amendment rights, and they filed a motion seeking to limit police and other agents of the state access to Kinner unless his counsel is present. They also requested to be notified by the sheriff’s office of all future kites sent by Kinner.

    “The state knew the defendant was represented by counsel, that the defendant’s mental conditions would be a significant factor, and possibly knew (or should have known), that the defendant had requested to meet with an investigator versus a detective in the kite,” Kinner’s attorneys said in a July 30 memorandum to support their motion to limit access to their client.

    Ada County Prosecutor Jan Bennetts declined to comment, other than to say: “My office will respond to the defense filings through the court process.” A Boise Police spokeswoman also declined to comment.

    Kinner’s attorneys said in court documents that they became aware that police were planning to meet with Kinner when they received a call from the Ada County Prosecutor’s Office at 5 p.m. July 20. They said they twice asked for the meeting to be canceled but prosecutors declined to call it off.

    “The kite in no way asks to speak with a detective or a member of law enforcement,” the memorandum says. “Law enforcement and the state are precluded from seeking clarification from the defendant due to the fact that he is represented by counsel, which if not abundantly clear from the record in this case, was acknowledged by the prosecutor before the attempted interrogation.”

    The public defenders further assert that within 30 seconds after Kinner had “unequivocally invoked his Fifth and Sixth Amendment rights,” one of the detectives told Kinner that “Your attorney does not write reports, we write reports, so if you want to tell your side of the story, let us know.”

    That statement was “designed to evoke an incriminating response at that time or in the future,” Kinner’s attorneys said in the motion, calling it an unconscionable violation of the defendant’s Sixth Amendment rights.

    Kinner has asked to represent himself, but he has three public defenders: David Smethers, Brian Marx and Daniel Lorello.

    On July 24, Marx filed a motion with the court, providing notice that Kinner “heretofore asserted his Fifth Amendment right to silence and Sixth Amendment right to counsel, reiterates these rights herein, and places all persons on notice of the aforementioned rights have not been waived, and cannot be waived without counsel present.”

    At Kinner’s last court hearing, when his attorneys tried to bar cameras from the courtroom, he told the judge that he thought it was "sabotage" that they would continue to be permitted to cover the proceedings.

    His next court appearance is scheduled for Aug. 14.

    BOISE -- A grand jury in Ada County has returned an indictment for a California man accused of stabbing a toddler to death at her own birthday party during a violent spree that sent eight other people to the hospital.

    Timmy Kinner Jr. has been indicted on one count of first-degree murder, eight counts of aggravated battery, one count of burglary, two counts of aggravated assault and a deadly weapons sentencing enhancement. The charges in the indictment are identical to the ones already levied by the Ada County Prosecutor's office, with the addition of the assault and burglary counts.

    Kinner is accused of killing 3-year-old Ruya Kadir and stabbing five other children attending her party, along with three adults who tried to shield the children from the attack. All of the victims were refugees from Syria, Iraq and Ethiopia.

    "Five weeks ago, our community was shaken by the events of June 30, 2018," Prosecutor Jan Bennetts said in a statement. "On behalf of my entire Office, I extend my deepest condolences to Ruya's family for their unimaginable loss. Our thoughts continue to be with Ruya's family and all of the victims who are injured and their families."

    Bennetts also thanked the Boise Police detectives who have "worked tirelessly" on the case and vowed to continue working towards justice.

    "We know the community wants answers and those answers will come through the court proceedings in this case," she continued. "It is important that we preserve the integrity of the case and let the criminal justice process take its course to ensure Mr. Kinner receives a fair trial."

    Investigators say Kinner did not know the victims, and targeted the birthday party at the Wylie Street Station apartments at random. The suspect had briefly stayed with other residents at the apartment complex, and was angry when they kicked him out, according to police.

    Police say he returned to the complex with a knife to exact revenge on those people, but when he discovered they were not home, turned his attention to the children's party underway a few doors down.

    Kinner was taken into custody at the scene, and officers were able to recover the large folding knife used in the attack from a nearby canal. He has been held without bond since his arrest.

    If convicted of murder, Kinner will face either the death penalty or life in prison.

    "A decision regarding the death penalty will be forthcoming as soon as all the statutory factors under Idaho law are fully considered," Bennetts said. "My office will continue to focus on the work ahead in our pursuit of justice in this case."

    No plea entered by man accused of Boise's mass stabbing; hearings scheduled

    About 45 minutes before a victim’s mother shouted at him while escorted from the courtroom, the man accused of Boise’s June mass stabbing made his first in-person appearance Wednesday morning in Ada County Court.

    It was his first of two appearances for Timmy Kinner, 30, this week - he has another set for 1:30 p.m. Thursday.

    Flanked by jail deputies and defense attorneys, the Los Angeles man took a seat at the defense table in a bright yellow jumpsuit. Fourth District Court Judge Nancy Baskin entered the full courtroom not long after that, and prepared to arraign Kinner on the 13 charges he faces, including first-degree murder.

    Those charges stem from the night of June 30, when police and prosecutors say he stabbed nine people — all refugees — including six children at an apartment complex near the intersection of Wylie Lane and State Street in Boise. One of those children, Ruya Kadir, 3, later died of her injuries. Many of the children stabbed that night attended a birthday party for Ruya at the time.

    For the next 45 minutes, Kinner answered Baskin’s questions with “yes ma’am” in a low monotone. From time to time he asked his attorney, David Smethers, to clarify the proceedings for him, which he did in inaudible, whispered conversation.

    The proceedings were largely a formality — Baskin read Kinner all 13 of the charges he faces, including first-degree murder, eight counts of aggravated battery, two counts of aggravated assault, and one count of burglary. The indictment also includes an enhancement for use of a deadly weapon, which means if prosecutors can prove Kinner used a deadly weapon during the attack, he could face a heavier jail sentence.

    As it is, he faces life in prison, as well as the possibility of the death penalty, Baskin told him Wednesday.

    After she finished reading the charges against him, Smethers asked for two weeks before Kinner entered a plea. Baskin did not grant the full two weeks, but instead set the case over for a hearing 9:30 a.m. Aug. 28.

    She also scheduled a motions hearing for 1:30 p.m. Thursday at which attorneys will discuss motions they filed in the case, but had not yet resolved in open court. If attorneys reach an agreement before then, she said, that hearing will be canceled.

    As deputies led Kinner from the courtroom, Bifitiw Kadir, Ruya’s mother, shouted at him from the front row of the gallery; court employees led her from the courtroom.

    BOISE -- As court adjourned Wednesday morning, the mother of a dead toddler began to scream.

    "Why you kill my baby?" she shouted at 30-year-old Timmy Kinner. "Why? Why? Why? Why? Why?"

    With members of the court and supporters around her, Ruya Kadir's mother was hustled from the courtroom. Her wailing echoed down the hallway.

    Kinner could face the death penalty if convicted in the June 30 stabbing rampage at a Boise apartment complex that left 3-year-old Ruya dead and eight other people - including five children age 12 or younger - with ghastly injuries.

    As she read through the indictment, Judge Nancy Baskin outlined some of the carnage.

    A 2-year-old girl with a lacerated liver, stomach, and pancreas.

    A 7-year-old boy with a slash across his face and knocked-out teeth.

    One woman with a broken jaw and punctured lung. Another with a stab wound to her spinal cord.

    And little Ruya, who was stabbed in the face at her own birthday party, and lived only long enough to be airlifted to a hospital in Salt Lake City.

    n all, Kinner faces one count of first-degree murder, eight counts of aggravated battery, two counts of aggravated assault, one count of burglary and a use of a deadly weapon in the commission of a felony.

    The suspect's defense attorney David Smethers requested more time before Kinner enters a plea, and that plea hearing was ultimately delayed until Aug. 28. But whatever answer Kinner enters then - guilty, not guilty, or no answer at all - will do little to unravel the agonizing question that has gripped Boise and punctured the quiet hubbub of the courtroom Wednesday.

    Why?

    Investigators have provided little motive explaining why Kinner, a California resident and recent arrival to Boise, would have targeted a little girl's princess-themed party with such bloody results.

    None of the victims had ever met the suspect. Although all nine were refugees from Ethiopia, Iraq and Syria - prompting speculation the rampage was a hate crime - police have found no evidence the stabbings were motivated by the victims' refugee status.

    Police have said Kinner had briefly stayed with another resident at the apartment complex, but was asked by that person to leave after she became alarmed by his bizarre behavior. Consumed by anger, he came back to the Wylie Street Station with a large knife to get revenge, investigators allege.

    But that person wasn't home, and inexplicably, prosecutors say, Kinner zeroed in on the birthday party a few doors down instead.

    The attack prompted a flood of 911 calls, some from children who locked themselves in a closet to escape. Kinner was taken into custody at the scene, and officers later fished the knife from a nearby canal.

    Prosecutors have not yet announced publicly whether they will seek the death penalty. As the hearing ended, Baskin agreed to take up a motion filed by the defense concerning Kinner's bond at his next hearing. He is currently not eligible to be bailed out of jail.

    As Ruya's mother was led anguished from the room, Kinner glanced back once towards her. Then he slipped, shackled, through the side door to await the transport back to his cell.

    Prosecutors say Kinner randomly targeted the birthday party of 3-year-old Ruya Kadir June 30 after getting angry at someone else who lived in the Wylie Street Station apartments. Ruya died from her wounds day after the attack. Five other children under the age of 12 were also stabbed, along with three adults at the party who tried to save them.

    After the attack, Kinner tossed the murder weapon into a nearby canal, police say. He was taken into custody at the scene, and officers later fished the knife out of the water.

    Tuesday's hearing was subdued in comparison to previous court appearances, several of which have been marked by outbursts from the suspect and the victim's mother. Kinner sat at the defense table with his head down for most of the hearing, occasionally leaning over to confer with his attorneys.

    Baskin set Kinner's trial to begin after the new year, with jury selection slated for Jan. 3. The group of 300 potential jurors will be sent a questionnaire before that date to hopefully narrow down the pool, the judge said.

    Kinner's plea hearing also starts the clock on the prosecution's 60-day window to decide whether to seek the death penalty for Ruya's murder. Prosecutors have not yet indicated whether they will ask for him to be executed if he is convicted.
