    Justin Matthew White - Alabama Death Row




    Summary of Offense:

    Justin White, already serving life without parole for the rape and murder of a college student in 2006, was sentenced to death on February 4, 2010 for the rape and strangulation of a teenager that occurred four months before the other crime. White, 22, was convicted of capital murder in December 2009 for the July 11, 2006, death of Jasmine Parker, 17, whose mother found her nearly nude body with a pair of jeans wrapped around her neck inside their north Birmingham apartment.

    The other victim, 20-year-old Sirrea Black, was killed in a similar way on October 31, 2006. The Bessemer judge in that case upheld that jury's recommendation of life without parole instead of death in the murder of Black, a student at the University of Alabama at Birmingham. The jury in the Birmingham trial also recommended life without parole in a 9-3 vote after hearing testimony about White's longtime struggles with and treatment for mental and impulse-control problems. But after hearing arguments from lawyers, Circuit Judge Clyde Jones ruled that White should die by lethal injection for the crime.

    Black's murder was cited as an aggravating factor by the prosecution, along with burglary and rape in Parker's death. Jones said he gave great consideration to the jury's sentencing recommendation, but decided to overrule the advisory verdict because of Parker's age and the way she was killed. A Jefferson County coroner testified in December that strangulation with soft ligatures such as clothing results in a slow death. Parker also had a non-lethal cut to her throat.

    Alabama appeals court upholds 8 death penalty cases

    A state appeals court is refusing to overturn the convictions of eight inmates on Alabama’s death row.

    In cases from Jefferson County, the Alabama Court of Criminal Appeals upheld the convictions and death sentences of Justin White; William Bruce Marshal; Demetrius Avery Jackson; and Anthony Lane.

    The judges also refused to overturn the cases of Calvin Stallworth from Baldwin County and David H. Wiggins from Russell County.

    From Mobile County, the court upheld the convictions and death sentences of William John Zeigler and Michael Bragg Woolf.

    Woolf was convicted of killing his wife and their 2-year-old son. While the court upheld his case, the court did tell a judge to clarify a sentencing order.

    The eight cases represent 4 percent of all the 197 inmates on death row in Alabama.

    Court rejects appeal by Alabama death row inmate from Jefferson County

    MONTGOMERY, Ala. (AP) — An Alabama appeals court is rejecting the claims of a death row inmate who’s trying to overturn his capital murder conviction.

    The Court of Criminal Appeals on Friday upheld the conviction and death sentence of Justin White, who was convicted in the murder of Jasmine Parker during a burglary and sexual assault in Jefferson County in 2009.

    Jurors recommended a sentence of life without parole, but a judge sentenced White to die.

    White appealed, claiming a judge improperly used the words of a prosecutor in an order rejecting one of his claims. He also challenged a decision against providing him money to hire an expert to challenge evidence used in court against him.

    The court rejected those claims, plus White’s arguments that his attorney didn’t represent him adequately.
