    David Howard Wiggins - Alabama Death Row




    Facts of the Crime:

    Convicted and sentenced to death for murder during a robbery and first-degree robbery. Russell County Circuit Court Judge George Greene ordered a directed verdict of acquittal on a charge of first-degree burglary. Jurors took less than three hours to find Wiggins guilty of the death of Kyle Cavins, 58. Cavins was shot in the early hours of October 29, 2005 at his Fort Mitchell wrecker business.

    Wiggins was sentenced to death on April 30, 2009.

    County Circuit Court of the 2005 capital murder of Kyle Cavins, was sentenced to death by lethal injection this morning.

    "I think he got what he deserved," said Cavins' widow, Connie Cavins, after Judge George Greene read his decision. "And he didn't show a bit of remorse. During the whole trial or anything, no remorse whatsoever. He got what he deserved."

    Wiggins sat quietly as the judge recounted the details of a case that occurred more than three years ago.

    Greene spoke of Wiggins' abusive childhood, his known crack cocaine habit and his long-time struggle with alcoholism. He also described how many blasts from a rifle it took to kill the 58-year-old Cavins that night at B&E Repair, 756 Alabama Highway 165 in Fort Mitchell.

    The judge also mentioned the jury's recent decision to impose the death penalty in the shooting death.

    When the sentence was read, one of Wiggins' family members, a woman, silently cried. Wiggins, wrists bound and wearing a white tunic and pants, did not appear to react.

    Alabama appeals court upholds 8 death penalty cases

    A state appeals court is refusing to overturn the convictions of eight inmates on Alabama’s death row.

    In cases from Jefferson County, the Alabama Court of Criminal Appeals upheld the convictions and death sentences of Justin White; William Bruce Marshal; Demetrius Avery Jackson; and Anthony Lane.

    The judges also refused to overturn the cases of Calvin Stallworth from Baldwin County and David H. Wiggins from Russell County.

    From Mobile County, the court upheld the convictions and death sentences of William John Zeigler and Michael Bragg Woolf.

    Woolf was convicted of killing his wife and their 2-year-old son. While the court upheld his case, the court did tell a judge to clarify a sentencing order.

    The eight cases represent 4 percent of all the 197 inmates on death row in Alabama.

    In today's orders, the United States Supreme Court DENIED Wiggins' certiorari petition.
