    Death penalty lifted in 1990 murder conviction

    MOBILE, Ala. -- Herbert Williams, Jr., who was sentenced to die for the slaying of a local businessman nearly 20 years ago, had his punishment changed to life in prison without parole today.

    Williams, 40, was serving time on death row after a jury convicted him in 1990 of shooting to death Timothy Hasser in 1988.

    The Mobile County jury had recommended that Williams receive life in prison, but then-Circuit Judge Ferrill McRae sentenced Williams to death.

    Williams appealed his case, and the three-judge panel of the 11th U.S. Circuit Court of Appeals last year accepted his claim that he did not receive adequate legal representation during the penalty phase of his trial.

    A federal judge then ordered a new sentencing hearing in Mobile County circuit court.

    This morning, Circuit Judge Robert Smith ordered Williams to life in prison without the possibility of parole.

    Prosecutors said Williams' attorneys have agreed to drop any further appeals of his conviction.

    Williams, who wore glasses and a brown prison uniform, declined to speak during the brief hearing.

    His attorney George Kendall later declined to comment on the case.
