    Indiana teen accused of killing two younger siblings

    RIPLEY COUNTY, Ind. – Prosecutors say a boy in Ripley County was just 13-years-old when he killed his two young siblings, Fox59 reported.

    The teen’s arrest comes over a year after police first began investigating the deaths of 23-month-old Desiree McCartney and 11-month-old Nathaniel Ritz.

    Emergency crews were first called to the children’s home in Osgood, Indiana on May 6, 2017 after the girl was found unresponsive. Her death was ruled suffocation by smothering, according to the coroner’s office.

    Emergency crews returned to their home less than three months later after the little boy was found unresponsive. The coroner’s office determined he was smothered as well.

    The toddlers were living in a home with their teen brother, their mother and their mother’s boyfriend, who is Nathaniel's father, at the time of their deaths.

    Investigators started looking into their brother more after multiple people told police he was saying some very disturbing things, including “some things (he) had done to some kittens,” according to court documents.

    On Sept. 5, 2017, police say they were contacted by the teen’s mother and informed that he had mutilated a kitten “to the point of almost killing it” at a family member’s home. The family member said the teen’s temper reminded her of the “Hulk.”

    The family member has a prosthetic leg and suffers from diabetes. At one point, she said he “said that with all of her health problems, maybe she just needed to die,” according to court documents. The teen was said to make similar statements about an old dog at the house.

    The family members he was staying with had several kittens on their front porch, and weren’t allowed inside. Court documents show they found one in the basement and it had something wrong with it.

    The teen boy was found crying, and the kitten had “blood all over it and its insides were hanging out of it.” The kitten also had a puncture-like wound to its head. When confronted, the boy said the kitten had scratched him. He got mad and squeezed really hard.

    The family members knew the cat was suffering and needed to be put down. Court documents show the teen asked if he could go and see “the kitten’s brains splattered everywhere.”

    When police interviewed the teen, they discussed how he’d been kicked out of school. He said he was tired of being bullied by another student. When they discussed Desiree and Nathaniel’s deaths, court documents show the boy said “he had a conversation with God about them, but he could not talk about it because he had promised God he wouldn’t tell anyone.”

    The officers got him to open up a little, and he started talking about dreams he had after the deaths and saving them from “hell and the chains of fire.”

    “(The boy) said he had help from an angel to free them,” court documents state.

    The teen reportedly told police he “didn’t plan on these things to happen…but had to set them free from this hell.”

    When police asked what hell meant to him, he simply replied, “chores.”

    Multiple other family members told police the boy admitted to putting blankets over the childrens’ heads until they “stopped making noise.”

    The teen boy was detained and taken to a juvenile detention center in Dearborn County on August 28, 2018.

    On September 6, the prosecutor’s office filed a petition alleging delinquency of two counts of murder. .

    His initial hearing was September 10. A judge ordered a competency evaluation. This means he will be evaluated by two doctors, and they’ll decide whether he’s competent to stand trial.

    Also, the state filed a petition to wave him to adult court.

    “In my time here, which is 19 years, I’m not sure I’ve seen anything as disturbing as this,” Prosecuting Attorney Ric Hertel said.

    Hertel was asked whether the parents will face charges, and he said, “I wouldn’t rule out the possibility.”

    UPDATE: Hertel announces juvenile to be waived to adult court in sibling deaths

    Ripley County prosecutor Ric Hertel has announced two counts of felony murder have been filed against Nickalas Kedrowitz, 13. Court documents allege Kedrowitz suffocated his 23-month old half sister Desiree McCartney. Eighty-one days later, court documents say he murdered the son of his mother’s boyfriend, Nathaniel Ritz.

    Reports indicate as of May 2017 Nickalas Kedrowitz shared a home in Osgood with his stepmother Christina McCartney, her children Desiree, Abigail and Nathaniel, and her boyfriend Stephen Ritz and his son Nickalas Kedrowitz.

    On May 1 the Indiana Department of Children’s Services and Indiana State Police began an investigation when units responded to a report of an unresponsive child. Desiree McCartney was taken to Margret Mary Health and ultimately to Cincinnati Children’s Hospital where she died five days later.

    There are unconfirmed reports that sometime between the death of Desiree and July of 2017 Kedrowitz was allowed back into the home by either DCS or a CHINS petition that was administered by the court.

    On July 20, 2017 first responders were called to the home again for an unresponsive child. On that occasion, Nathaniel Ritz, 11 months, was found unconscious at 11:12 p.m. and was taken to Margaret Mary Health in Batesville. He was pronounced dead due to Asystole at 12:12 a.m., a dire form of cardiac arrest.

    At this point the of timeline the role DCS is not certain. Indiana State Police now had two detectives- one working the death of Desiree McCartney and another looking into the death of Nathaniel Ritz.

    In September of 2017 Christina McCartney told investigators Kedrowitz killed at a kitten while in the care of his aunt and uncle. Kedrowitz told his relatives he took the kitten to the basement and he got mad, squeezing cat very hard.

    Kedrowitz was found with the cat in his grasp on the front porch crying. Kedrowitz’s aunt found another kitten in the litter that had suffered a minor puncture wound.

    As the investigation continued police learned Kedrowitz confided about the killings to family members. On two occasions in the month of December Kedrowitz allegedly told family members he killed both Desiree and Nathaniel by placing a heavy blanket on their faces and pressing hard where the nose and mouth would be.

    Kedrowitz told detectives in December of 2017 he has a conversation with God about Desiree and Nathaniel but couldn’t talk about the content. When pressed the probable cause affidavit says Nickalas told police he was freeing the two from hell and chains of fire and had help from an angel to free them.

    The State of Indiana has filed a waiver to move Kedrowitz to adult court. The waiver is filed because Indiana Code allows for a “presumptive waiver” if a murder has been committed by juvenile 12-years-old and there is probable cause.

    Next, prosecutors must prove his competency to complete the wavier to adult court.

    No other charges have been filed in the case.

    Kedrowitz is being held in Dearborn County.

    Former Rockcreek student accused of killing young kids

    A former Rockcreek Elementary student, whose family had lived in Elizabethtown, has been charged in Ripley County with two counts of murder.

    Police say Nickalas Kedrowitz, now 14 and a seventh-grader, is responsible for the deaths of his 23-month-old sister and the 11-month-old son of his mother’s fiance, who lived in the same household.

    Nickalas, who lived in Osgood immediately prior to his arrest, has been accused in Ripley Circuit Court with two Level 1 felony counts of murder in the deaths of Desiree McCartney, 23 months, and Nathaniel Ritz, 11 months, court documents state. He is currently incarcerated at a Dearborn County juvenile facility.

    Nickalas attended Rockcreek Elementary southeast of Columbus until about 2014. That’s when the boy and his family moved from Elizabethtown to Richmond, and later to Osgood in Ripley County, said the teen’s mother, Christina McCartney.

    Nickalas had nearly completed sixth grade when the family left Bartholomew County, less than an hour away from his most recent home in Osgood, she said.

    The teen is now undergoing mental health evaluations to determine if he is competent to stand trial in the homicides, with the next hearing in his case set for Dec. 18 in Ripley County, his mother said. Now living in Indianapolis, McCartney said she visits her son at the juvenile detention center once a week on Sundays.

    Desiree’s death

    Court documents state Desiree McCartney died after first responders were called to a home in the 200 block of South Maple Street in Osgood on May 1, 2017 about an unresponsive child.

    McCartney was living at the home with her fiance, Stephen Ritz, and four children, including Nickalas, Desiree, Nathaniel and Abigail, who was 1 year old, according to court affidavits filed in the case. Nickalas, Desiree and Abigail are McCartney’s children.

    She was not Nathaniel’s mother, but had been caring for him since shortly after his birth, she said. Nathaniel was Ritz’s child who had full custody of him, she said.

    When questioned by police investigators about Desiree’s death, McCartney said she returned home and Nickalas told her that he did not think Desiree was feeling good because she was not talking to him.

    Ritz told police that Abby and Nathaniel were crying in the living room and he had asked Nickalas to get Desiree’s diaper and pajamas, as she was taking a bath. After taking care of the other two children, Ritz told police that he returned to the bathroom to check on Desiree and that Nickalas was in tears and told him Desiree had quit breathing.

    Ritz initially told police that he performed CPR for five minutes before McCartney returned home, but admitted in a later interview that he had not performed CPR, the affidavit states. McCartney told police she tried to wake the girl up and began performing CPR and called 911, saying Ritz began “freaking out.”

    Desiree was taken by ambulance to Margaret Mary Community Hospital in Batesville, and then to Children’s Hospital in Cincinnati prior to her being declared dead, according to court affidavits.

    Nickalas told police that Desiree undressed herself and got into the bath by herself, with water up to her chest if she was sitting, or up to her knees if standing, according to the affidavit. Desiree threw up twice while in the bathtub and Nickalas told police he went to get some wipes. When Nickalas returned about five minutes later, he found Desiree floating in the water on her belly, the affidavit states. So he took her out, but she was not responding, the court affidavit states.

    An autopsy conducted May 7, 2017 concluded Desiree’s cause and manner of death were undetermined, but the exam revealed a prolonged period of anoxia — lack of oxygen — to the brain, court documents state.

    Nathaniel’s death

    Less than three months later, McCartney called 911, seeking emergency support when Nathaniel was unresponsive in their Osgood home. Her call was placed at 11:12 p.m. July 20, 2017.

    Less than an hour later, Nathaniel was pronounced dead at 12:12 a.m. July 21 at the Batesville hospital. Physicians said the child’s heart had stopped about a half hour before emergency medical technicians arrived, court affidavits states.

    When family members were questioned, McCartney said the family had eaten supper and then watched television. The affidavit states that at about 11 p.m., she asked Nickalas to take Nathaniel to bed, in a bedroom Nickalas shared with the baby.

    McCartney told police she went into her bedroom to change clothes.

    Within a few minutes, Nickalas told his mother, “Something is not right with Nathaniel, he is not acting right,” the affidavit states.

    McCartney picked up the child and took him into her room to change him, then called for Ritz. They decided to call 911 and began performing CPR.

    Nickalas said he had helped get supper ready, then was cleaning up the table and the kids after supper, the affidavit states. He put Nathaniel and Abby in their rocker swings and later put Nathaniel in his bed and went to do laundry, the affidavit states.

    After a while, Nickalas said he noticed Nathaniel wasn’t moving so he picked him up and then took him to his mother.

    An autopsy was conducted but a cause of death for Nathaniel could not be determined, the affidavit states. The autopsy did not reveal evidence of acute injury, congenital abnormalities or other causes.

    Family separated

    After Nathaniel’s death, the family was split up and Nickalas was placed with his uncle, Jeff Barker, who also lived in Osgood, by Indiana Department of Child Services, McCartney said in an interview with The Republic.

    Court affidavits state that while Nickalas was at the Barker residence, he was accused in September 2017 of mutilating a kitten, to the point of almost killing it. The Barker family reported that Nickalas had told them one of the kittens was in the basement, and Nickalas was told to get it out of the house. Later, they found Nickalas crying on the front porch with the kitten covered in blood, the affidavit states.

    Nickalas told them the kitten had scratched him and he was mad and squeezed it really hard, the affidavit states.

    When police learned about the incident, they asked the Barkers for permission to speak with Nickalas, which was arranged for Dec. 13, 2017, the affidavit states.

    Promise to God

    During the conversation with detectives, Nickalas said he had a conversation with God about Desiree and Nathaniel, but he could not talk about it because he had promised God he wouldn’t tell anyone, the affidavit states. He told the detectives that he had dreams about the two children after they died and began talking about saving Desiree and Nathaniel from Hell and the chains of fire, the affidavits states. Nickalas said he had help from an angel to free them, the affidavit states.

    When Nickalas was asked to talk about what happened to Desiree, he began crying and initially said he couldn’t remember, the affidavit states. When asked about Nathaniel, Nickalas told police that he had placed the boy in the bottom bunk of bunk beds and placed a blanket on Nathaniel’s head, the affidavit states. When asked about Desiree again, Nickalas told detectives that he helped her out of the bath and then put a towel over her head, to set her free for heaven, the affidavit states.

    The detectives wrote that Nickalas was crying and kept saying he had to do it, according to the affidavit.

    Nickalas repeatedly told the detectives that he didn’t want Desiree or Nathaniel to live in the Hell that he had to live in. When asked what that Hell was, Nickalas replied “chores,” the affidavit stated. Nickalas asked the detectives if they had seen the chore list he had to complete every day, and they said they had.

    In both cases, Nickalas told detectives he did this to protect them from Ritz, according to the affidavit.

    Amended autopsies

    On Jan. 22, the Hamilton County, Ohio, Coroner’s Office amended the autopsy report on Desiree, ruling asphyxia due to smothering and declaring it a homicide. Nathaniel’s death cause was amended to asphyxia due to smothering on Jan. 18, with his death also ruled as a homicide.

    In the interview with The Republic, McCartney described Nickalas as a spontaneous child who was known for helping others during his time at Rockcreek Elementary. He participated in Cub Scouts and Boy Scouts and would help one of the handicapped children on and off a bus at Rockcreek, his mother said. He was also involved in church activities, she said.

    McCartney said Nickalas’ interview with detectives, when he made religious references, was not done with her permission or knowledge, and that Nickalas had been watching a witchcraft movie and was parroting information from it with the information taken out of context by the investigators.

    She also said that Nickalas expressed to her several times that he wanted to kill himself.

    McCartney theorized that Desiree could have had a seizure in the bathtub that resulted in her death, and that Nathaniel might have succumbed to breathing problems caused by his exposure to methamphetamine prior to his birth, she said.

    McCartney said she was worried about Nickalas being kept at a detention center rather than at a mental health center, as he was not receiving needed medication and therapy.

    “I would not think my son could do these things,” she said of the allegations contained in the court documents.

    Ripley Co. Mom Goes On TV To Defend Teenage Son Accused Of Killing Siblings

    Ripley County, Ind. – Does a 14-year-old Ripley County teen accused of killing his younger siblings belong in jail? His mother took to national television this week to give her answer.

    Nickalas Kedrowitz is accused of smothering 23-month-old Desiree McCartney in May of 2017 and 11-month-old Nathaniel Ritz in July of 2017.

    Kedrowitz was arrested approximately three months ago. His mother, Christina, believes her son does not belong in jail, but would instead benefit from being in a mental health facility.

    On Wednesday, Christina was featured on Dr. Phil, where she stated her son is “every mother’s dream child” and not a “serial killer.”

    “Prior to all of this, my son was the picture-perfect kid,” Christina said. “He did know right from wrong and he did not need a mental hospital or any of that. I think that after all this has happened and the trauma he has had to face, something has definitely switched in him. He’s not the same child as he was before.”

    Christina, who has a master’s degree in psychology, was questioned about any indications that her son might have some mental and emotional problems.

    “I think she’s really confused,” said Dr. Phil. “On the one hand, she says my son Nickalas is a dream child, a child that anyone would want. But, on the other hand, she says he need to be in a mental institution.”

    Christina stated that she was aware her son had a mild intellectual disability, but that he didn’t have any behavioral problems or red flags.

    However, court documents say Kedrowitz mutilated a kitten prior to the second child’s death. He also allegedly told a relative that they might be better off if someone murdered them due to the fact they were missing a leg and had a heart condition.

    “I think he is in need of serious help and I don’t think he should be tried as an adult,” said Dr. Phil. “I think he should be tried as an adolescent and I think he should be sent to a psychiatric facility for whatever time is necessary to get him help.”

    Ripley County Prosecutor Ric Hertel is on record saying he will ask a judge to waive the murder cases against the 14-year-old to adult court. A decision has yet to be made.

    In related news, Christina hopes to be reunited with her daughter that was put into foster care shortly after the alleged murders. Dr. Phil told her that will never happen unless she takes some ownership of the situation and admits some wrongdoing.

    Boy Accused Of Smothering Siblings Waived To Adult Court

    (Ripley County, Ind.) - A Ripley County teenager accused of smothering to death two of his siblings will be tried as an adult.

    Fifteen-year-old Nickalas Kedrowitz is charged with two counts of murder for killing his 23-month-old sister Desiree McCartney in May of 2017. Just 13 at the time, he was removed from the family’s Osgood home by the Indiana Department of Child Services, which prevented law enforcement from interviewing him.

    DCS later placed Kedrowitz back into the home. Then the following July, he allegedly smothered his 11-month-old brother Nathaniel Ritz.

    Indiana State Police detectives say Kedrowitz used a towel or blanket to cover the noses and mouths of the young children to stop their breathing. Ripley County Prosecutor Ric Hertel said last year that the teen remarked how killing the children freed them from “some sort of hell.”

    Hertel announced Wednesday night, September 4, that a judge deemed Kedrowitz competent to stand trial.

    “A judge determined Kedrowitz competent after several days of testimony from multiple psychologists who evaluated Kedrowitz. Based on this testimony, the judge ruled that Kedrowitz clearly understood the proceedings and was assisting in his defense, based on his statements and behavior during the evaluations,” said Hertel.

    After a series of lengthy court hearings, the judge also determined that Kedrowitz should be waived from juvenile court and tried as an adult for both murders. Hertel said Indiana law allows defendants as young as age 12 to be tried as adults in murder cases.

    The teen’s defense attorneys were unsuccessful in attempts to persuade the judge that it would be in the best interest of Kedrowitz and the public if he were to remain in the juvenile justice system.

    “Prosecutors responded by admitting evidence that Kedrowitz has allegedly also mutilated small animals, and made threats to a classmate and teacher even after Kedrowitz was alleged to commit the murders,” said Hertel. “Prosecutors argued that those additional facts demonstrated Kedrowitz’s continued danger to the community.”

    Now in adult court, Kedrowitz made his initial appearance on the murder charges Wednesday. Mark Jones and Lynn Fledderman have been appointed as his attorneys. He remains held at the Dearborn County Juvenile Detention Center, according to court records.

    A jury trial is scheduled for February 18, 2020.

    If convicted, Kedrowitz faces an advisory sentence of 55 years on each murder count. He is not eligible for a life sentence or the death penalty due to his age.

    Trial date set for teen accused of double murder

    Versailles, IN — A trial date is set for Nickalas Kedrowitz, who has been charged with two counts of murder of his 2-year-old sister and 11-month-old brother, that occurred on separate occasions in 2017.

    The current date for the trial is set for February 8, 2021, in the Ripley County Court.

    Back in September of 2019, Kedowitz was found to be competent to stand trial and to do such as an adult, though he is currently 16.

    Osgood teen accused of killing toddlers finally goes to court

    An Osgood teenager is set for a murder trial next week in Ripley County Circuit Court after Judge Ryan King would not approve any more continuances. In June the Judge told defense attorney Mark Jones that he made his decisions based on the law and the case was going forward. This court date finally comes after four years of waiting – it dates back to May 1, 2017, when Nickalas James Kedrowitz, 17, was accused of killing two toddler siblings who lived in the home with him in Osgood. This was waved into adult court and Kedrowitz has been incarcerated at the Juvenile Detention Center in Lawrenceburg.

    Jury selection is set to begin next Wednesday, August 11 with the trial to begin on Monday, August 16.

    Of concern to the defense attorney was whether or not Kedrowitz was competent to stand trial. That was determined earlier and even at the June hearing where the Judge said plenty of people were on medication (for mental illnesses, etc.)

    Prosecutor Ric Hertel said at the June hearing that the State was ready to go forward. He noted that after four years it’s time for a jury to weigh in.

    Ripley County teen sentenced to 100 years in prison in slayings of 2 young siblings

    RIPLEY COUNTY, Ind. — A Ripley County teenager convicted of two counts of murder in the slaying of his two young siblings was sentenced in court Tuesday.

    Nickalas Kedrowitz was sentenced to 50 years in prison on both counts of murder. Those terms must be served consecutively, a judge ruled, meaning Kedrowitz will serve a total of 100 years.

    Nickalas Kedrowitz was 13 when he suffocated two of his siblings between 2017 and 2018.

    Kedrowitz was arrested in August 2018 in the May 2017 killing of his 23-month-old half-sister, Desiree McCartney, and the July 2017 killing of his 11-month-old stepbrother, Nathaniel Ritz.

    Officials said the children died less than 90 days apart.

    Ripley County Prosecuting Attorney Ric Hertel said the teen admitted suffocating Desiree with a towel after she got out of the bathtub. He told investigators he suffocated Nathaniel with a blanket.

    Hertel said the teen made remarks to detectives during the investigation that he was "freeing his siblings from hell."

    Both were killed at the family's home in Osgood, about 60 miles southeast of Indianapolis.

    Hertel says the case went through several stages to get to this point, including hearings to determine Kedrowitz's competency and waiver to adult court.
