    BROOKHAVEN, Miss. (AP) — Two police officers were shot and killed following an early Saturday morning confrontation in Mississippi, authorities said.

    Warren Strain of the Mississippi Department of Public Safety said at a news conference that the officers were called to a house in the city of Brookhaven at about 5 a.m. for a report of shots fired.

    Amid an exchange of gunfire, both officers were "mortally wounded" and then pronounced dead at a local hospital, Strain said. He identified the weapon used as a handgun but would not elaborate.

    Authorities identified the deceased officers as Patrolman James White, 35; and Cpl. Zack Moak, 31. Both were wearing bulletproof vests at the time and were equipped with body and dashboard cameras. White arrived on the scene first, and Moak arrived next.

    A suspect was wounded in the exchange and taken for treatment to a hospital in Jackson. Police identified him as Marquis Flowers, 25, of Brookhaven. Strain said charges have not been filed yet but that Flowers is "in custody."

    Brookhaven Police Chief Kenneth Collins said the city is a "safe community ... but like any place, we have crime." He called White and Moak, both residents of Lincoln County, "heroes."

    "These are two awesome people who lost their lives this morning in the line of duty. Two heroes lost their lives this morning," Collins said.

    Strain said the investigation is in its initial stages. A number of people have been questioned in the case.

    The Mississippi Bureau of Investigation is working the case, in addition to other agencies.

    Gov. Phil Bryant issued a statement via Twitter asking for prayers "for the family and loved ones of these fallen heroes."

    Capital murder charges pending for suspect in police killings

    Two counts of capital murder are pending for the only suspect in the murder of two Brookhaven police officers, a state agency spokesperson said Tuesday.

    Mississippi Department of Corrections Communications Director Grace Fisher said 25-year-old Marquis Aaron Flowers, of 426 Independence St. in Brookhaven, had his parole revoked Oct. 2 after the state parole board determined he had violated the conditions of his 2017 parole due to “pending charges of two counts of capital murder” and possession of a firearm by a convicted felon. The department’s announcement marks the first time any agency has confirmed pending charges for Flowers, who was arrested Sept. 29 at the scene of the shooting deaths of BPD patrolman James White and Cpl. Zach Moak.

    “Flowers remains hospitalized. Once he is released, he will return to prison to complete the sentence he received for multiple counts of vehicle burglary in Pike (eight counts) and Lincoln (two counts) counties, and one count of conspiracy in Lincoln County,” Fisher said. “With the crimes running concurrently, he received a total of six years to serve, followed by probation, when sentenced on Jan. 12, 2015, for the crimes committed in 2010.”

    Capital murder charges carry the possibility of the death penalty in Mississippi.

    The Mississippi Bureau of Investigation, which is handling the investigation of the officers’ murders, has yet to announce charges on Flowers or update his condition. He was shot and wounded before being taken into custody, and remains under guard at a Jackson hospital.

    It is unclear who shot Flowers. White reported finding a shot-up vehicle with blood in the driver’s seat when he arrived at the scene on North Sixth Street before 5 a.m., and Brookhaven Police Chief Kenneth Collins said Moak exchanged fire with Flowers at the scene before he was killed.

    Investigators have not said whether Flowers was already shot before police arrived, or who may have shot him. Police say Flowers remains the only suspect in the killings.

    The deaths of Moak and White were followed by a week of mourning in Brookhaven. Both officers were laid to rest in large, separate events that drew law enforcement officers from across the nation and dignitaries from around Mississippi.

    Flowers was out on parole at the time of the shootings after the state parole board released him a year ago.

    Court records show he was released from the Adams County Jail on May 3 after posting a $50,000 bond set by judge Al Johnson on charges of taking away a motor vehicle and four counts of burglary of automobiles stemming from separate thefts in Natchez in February 2017. Deputies say Flowers initially escaped capture in a high-speed chase, but later surrendered himself at the Adams County Sheriff’s Office.

    The court filed a bench warrant for Flowers’ rearrest on Aug. 6 after he failed to show up at a court appearance.

    Court records also show Flowers had been indicted Jan. 8 in Adams County on the charges from February 2017. At the time of his arrest then, he was reportedly wearing an ankle monitor after being released on probation in January 2015 from his sentence for the 2010 burglaries.

    Marquis Aaron Flowers, 26, appeared Tuesday in Brookhaven City Court and was charged in the killings of Brookhaven officers Zach Moak and James White, The Daily Leader reported.

    A judge appointed an attorney for Flowers and set a Jan. 8 preliminary hearing.

    The officers were killed Sept. 29 at a Brookhaven home.

    Investigators said Flowers was wounded in a gunfire exchange with Moak. Flowers was taken into custody the day of the killings and was hospitalized. He was discharged Oct. 17 and sent to a state prison. Records show he had previous burglary convictions.

    Flowers' attorney couldn't immediately be reached after business hours Tuesday.

    BROOKHAVEN, Miss. — A judge denied bond Tuesday for a man accused of shooting and killing two Brookhaven police officers.

    Marquis Flowers, 26, is charged in connection with a September shooting that killed two Brookhaven police officers -- Patrolman James White, 35, and Cpl. Zach Moak, 31.

    An investigator with the Mississippi Bureau of Investigation testified during Tuesday's court hearing that the officers' body cameras captured the suspect shooting at them.

    MBI agent Luke Harrington said Flowers told him in an interview that "the cops were caught in my cross-fire." Harrington said Flowers was already wounded from gunshots when White and Moak responded to a call of gunfire before dawn on Sept. 29.

    Flowers spent two weeks in a hospital and then was sent to the Mississippi State Penitentiary at Parchman because his parole on previous auto burglary convictions was revoked.

    Flowers is charged with two counts of capital murder in the officers' deaths. The case against will be sent to a grand jury.

    2012 — Sentenced in Lincoln County to five years in prison with three years suspended for eight counts of auto burglary and conspiracy.

    2015 — Judge revokes Flowers' parole and sentences him to serve the three years in prison that were previously suspended.

    August 2016 — Flowers is paroled and required to wear a GPS monitor.

    March 2017 — Flowers is returned to prison after his parole is revoked when the Natchez Police Department charges him with vehicle theft and felony fleeing.

    October 2017 — Flowers is paroled again and released to Adams County.

    Man indicted on capital murder charges in officers’ deaths; pleads not guilty

    Marquis Flowers, who was arrested following the shooting deaths of two Brookhaven police officers in 2018, was indicted by a grand jury on two counts of capital murder and possession of a firearm by a convicted felon. He pleaded not guilty to the charges.

    The indictment documents were released Tuesday morning. Flowers was formally arraigned Tuesday.

    According to the indictment, Flowers did “kill and murder a peace officer, James Kevin White” when White was acting in his official capacity. The indictment reads the same for the murder of Walter Zachery Marshall Moak when he was serving in his official capacity as a peace officer.

    The third count is for possession of a firearm — a Diamondback model DB9 9mm semi-automatic pistol — by a convicted felon.

    The indictment includes an enhancement to all counts because Flowers had been convicted at least twice of prior felonies.

    “The Office of the District Attorney has been and will continue to work closely with all law enforcement agencies involved during the prosecution of this case. We ask that the public continue to respect the privacy of the families of the victims and all of the individuals impacted by this incident,” District Attorney Dee Bates said in a written statement after court.

    Bates said after Tuesday’s hearing that he will pursue the death penalty. A trial could be at least several months away. Bates said prosecutors are awaiting results of ballistics tests from the state crime lab. He also said a judge will decide later whether the case will be tried in Lincoln County.

    Flowers was the only suspect in the shooting, according to officials. He was arrested at a residence on North Sixth Street in Brookhaven early on Sept. 29 following the shooting deaths of Moak and White. The officers responded to the home on a report of “shots fired” and found a bullet-pocked Cadillac Escalade with blood in the driver’s seat.

    Brookhaven Police Chief Kenneth Collins said Moak exchanged shots with a suspect before his death, though it remains unclear who opened fire on the vehicle before police arrived.

    Flowers was out on parole at the time of the shootings after the state parole board released him. He remains in state prison after his parole was revoked following the shootings. Bond has not been set for the new charges.

    Mississippi Bureau of Investigations Special Agent Luke Harrington said in court in January that camera footage shows 26-year-old Flowers killed both officers. Harrington told the court during Flowers’ preliminary hearing the suspect allegedly killed White, the first to arrive on the scene, then killed Moak.

    Harrington also testified Flowers confessed to shooting both officers accidentally while exchanging gunfire with unknown suspects who may have shot Flowers numerous times to generate the “shots fired” call before officers arrived.

    An MDOC employee who was disciplined after Flowers went unmonitored by a parole officer and allegedly murdered two Brookhaven police officers was found to be “least responsible” and his reprimand was reversed by the state Employee Appeals Board.

    MDOC alleged that the employee should have issued a warrant for Flowers’ arrest when he could not be located — prior to the fatal shootings in September. But the appeals board found the employee was not to blame, rather it was a “systemic failure” that allowed Flowers to remain free.

    Suspect in 2018 Brookhaven police killings is back in Adams County Jail

    NATCHEZ — The man charged with killing two Brookhaven police officers in 2018 is being held in the Adams County Jail on a contempt of court charge for failure to appear in Adams County Court for an incident prior to the police officers’ slayings in September 2018.

    Marquis Aaron Flowers, 27, was booked into the Adams County Jail on Friday, Adams County Sheriff Travis Patten said.

    Flowers, who has not yet been to court on the September 2018 killings of Brookhaven police officers Zach Moak, 31, and Kevin James White, 35, was on parole for a Lincoln County vehicle burglary conviction at the time of those killings.

    After his arrest for the officers’ killings, Flowers was sent to the Mississippi Department of Corrections to finish serving his term for the vehicle burglary charge in Lincoln County and therefore, has not yet been to court on the officer killing charges, Patten said.

    Also, prior to the officers’ killings, in March 2017 while he was out on parole for the Lincoln County vehicle burglary charge, Flowers — while wearing an electronic ankle monitor — was charged by Natchez Police with fleeing or eluding a law enforcement officer of the Adams County Sheriff’s Office, and stealing a vehicle in connection with a high-speed chase the previous month.

    Judge Al Johnson set Flowers’ bond at $50,000 for those charges, and Flowers posted the bond and was released on May 3, court records indicate.

    Flowers, however, failed to appear for the court date on that charge and the Adams County Circuit Clerk’s office filed a bench warrant for Flowers’ arrest Aug. 6, 2018, after he failed to appear in court for trial.

    Flowers was at large in Brookhaven on Sept. 29, 2018, the night the two Brookhaven officers were killed.

    Flowers was shot in that incident as well.

    Patten said Flowers is currently being held in the Adams County Jail until he can face the Adams County charges before he will be sent to Lincoln County to face the two police officer murder charges in Lincoln County court.

    Judge: No bond for man charged with killing 2 officers

    A Mississippi judge on Wednesday denied defense attorneys' request to set bond for a man awaiting trial in the 2018 shooting deaths of 2 police officers.

    Marquis A. Flowers, 27, sat silently between his attorneys during a status hearing in Lincoln County Circuit Court, the Daily Leader reported.

    Circuit Judge Michael Taylor said in his ruling that based on exhibits, relevant law and the Constitution, bail can be denied and should be in this case, especially considering Flowers's history of failing to appear in Adams County Circuit Court while released on bond in a different case. Taylor said the charges of capital murder also weighed heavily in the decision.

    Flowers was indicted Oct. 28 on 2 counts of capital murder in the deaths of Brookhaven police Cpl. Zach Moak, 31, and patrol officer James White, 35, and possession of a firearm by a convicted felon. Flowers pleaded not guilty Nov. 12 to all 3 counts.

    The officers were killed Sept. 29, 2018, while responding to a call about shots being fired at a home in Brookhaven.

    Flowers was previously convicted of auto burglary charges in south Mississippi’s Lincoln and Pike counties. He was charged in Natchez with taking a motor vehicle and 4 counts of auto burglary, fleeing from authorities in a high-speed chase in February 2017. He later turned himself in. Released on bail, Flowers was a fugitive at the time of the Brookhaven shootings after failing to appear for a court date in Adams County.

    Flowers’ parole was revoked after the Brookhaven officers were killed, and he has remained in custody. He is being held in the Adams County jail. Another status hearing in the capital murder case is set for June 9. The district attorney has said he will pursue the death penalty once the case goes to trial.

    Special Judge appointed to preside over trial of accused cop killer

    LINCOLN CO., Miss. (WLBT) - The Mississippi Supreme Court has appointed a retired judge to preside over the murder trial of Marquis Flowers who is charged with killing two Brookhaven Police officers.

    Richard McKenzie of Hattiesburg has been appointed as a Special Judge in the case.

    This follows the recusal of two judges on July 24th.

    Flowers is charged with two counts of capital murder. He is accused of killing Brookhaven Police Officers James White and Zach Moak in September 2018.

    He is also charged with being a felon in possession of a firearm.

    Flowers was denied bond in May based on his previous criminal activity and his failure to appear for a court date in Adams County just before the officers were killed.

    Jury selection set for double capital murder trial

    Jury selection has been scheduled for the upcoming trial of the man accused of killing Brookhaven police officers Zach Moak and James White in 2018.

    Special Judge Richard W. “Dickey” McKenzie, appointed to the case by the Mississippi Supreme Court in July 2020, told those present at Tuesday morning’s hearing that a jury will be selected from Lafayette County beginning Nov. 8 for the capital murder trial of Marquis A. Flowers.

    Flowers was charged in December 2018 with two counts of capital murder in the shooting deaths of Moak and White, who were killed at a residence on North Sixth Street, Brookhaven, in the early morning hours of Sept. 29, 2018.

    Flowers was also charged with a felony count of possession of a firearm by a convicted felon.

    Flowers, dressed in a bright yellow Rankin County Jail jump suit, was escorted into the Lincoln County Jail and 14th Circuit Court courtroom by jailers and Lincoln County deputies. The only observers present in the courtroom galley were members of the victims’ families.

    McKenzie stated for the record that he had met with both the defense and prosecution teams — defense attorney Kelsey Rushing and his assistant, and District Attorney Dee Bates and Assistant District Attorney Brendon Adams — in chambers and discussed possible venues and dates for jury selection. With the results of that meeting announced, the judge informed the court that the location of the trial would be within the 14th Circuit Court district beginning in November, either at the Pike County Courthouse in Magnolia or the Lincoln County courtroom in Brookhaven, depending upon COVID restrictions and space needed. The final determination will be made closer to the trial date.

    After a mere four minutes in open court, with nothing to add from either legal team, Flowers was escorted out and court was dismissed.
