    More than 3½ years have passed since the body of Jacqueline "Jackie" Hartman was found in the desert.

    After a recent court hearing, the trial for the Gilbert woman's accused killer is set to begin Oct. 7. On Tuesday, Judge Karen L. O'Connor ordered a document in the case to be sealed

    Jury selection in the trial of Jonathan Ian Burns, 29, is scheduled to begin in Maricopa County Superior Court on Oct. 7, court documents state. The Mesa man faces felony charges of first-degree murder, sexual assault, kidnapping and weapons misconduct in Hartman's death and disappearance in January 2007.

    Hartman's disappearance sparked national interest and a large-scale search. Her body was found in a remote part of the desert northeast of Fountain Hills.

    Background

    Hartman, 19, was last seen after her first date with Burns on Jan. 28, according to Gilbert police. Investigators arrested Burns the next day, after police found her bullet-ridden, torn clothing in a dumpster near Burns' home in Mesa.

    Burns later admitted to having sex with Hartman, but said he dropped her off afterward so she could meet up with her family. Police, strangers and Hartman's family and friends searched for three weeks but found no signs of the woman.

    Investigators ultimately tracked Burns' movement throughout the Valley by following his cellphone signal as it bounced from cell tower to cell tower toward Shea Boulevard and Highway 87, according to Gilbert police. While detectives were in the area, an ATV rider discovered Hartman's body on Feb. 19, 2007.

    What's next?

    Burns faces the death penalty if convicted. His next court hearing is scheduled for Sept. 9.

    Woman gets 2½ years for gun role in Hartman killing

    A woman who police say supplied the gun used in the murder of a Gilbert woman was sentenced Wednesday to 2 ½ years in prison, despite pleas from friends that she receive probation.

    Maricopa County Superior Court Judge David Udall said "there needs to be a strong message to the community" that guns shouldn't be handed over to convicted felons who have no right to possess them.

    Friends of Mandi Smith, 25, of Mesa, testified that she had no prior felony convictions and that she had no idea that Jonathan Ian Burns, who is charged with Jackie Hartman's murder, would use the gun in a slaying.

    "I have no evidence that Miss Smith knew Mr. Burns would commit a crime with this gun, but she enabled him," prosecutor Vince Imbordino said. "She went into it with eyes wide open. She knew he was just released from prison, she knew he wasn't supposed to have a gun."

    Hartman, 19, disappeared Jan. 28 and Burns was arrested the next day after police found her bullet-ridden, torn clothing in a dumpster near the home he shared with Smith.

    Hartman's body was found on Feb. 9 in Sycamore Creek after an extensive search by police and family members.

    Burns is charged with first-degree murder, sexual assault, kidnapping and misconduct involving weapons. Smith pled guilty to misconduct involving weapons.

    Gilbert police Sgt. Sy Ray testified that police never recovered the gun, but ballistics examinations showed that the bullet found near Hartman's body in Sycamore Creek was consistent with being fired by the same gun Smith purchased for Burns at a pawnshop, a .9 mm Springfield Arms pistol.

    "She referred to the gun multiple times as Jonathan's gun. She purchased it for Jonathan because she was aware he was a prohibited possessor and could not purchase it himself," Ray testified.

    But Gina Meyer, a friend of Smith's who is planning to marry her brother, called Smith's sentence "harsh" and said Smith "was stupid" to allow Burns to manipulate her.

    "They were engaged to be married. She had no idea he'd do something like that," Meyer said.

    She testified in court that Smith mistakenly believed that Burns had been rehabilitated by his stay in prison.

    "It's been publicly implied that she (Smith) was involved in these heinous acts. She was not involved. She was a victim, too," Meyer said.

    A single mother, Smith mistakenly believed that Burns would help support her and her daughter after the death of Smith's father, Meyer said.

    Burns was released from prison in August 2006 after serving more than five years for burglary, during which he racked up 35 disciplinary infractions, according to the state Department of Corrections Web site.

    David Hartman, Jackie's father, said he considers Smith partially responsible for his daughter's death. "I think it was fair," he said about the sentence. "The way I look at it, we're not getting Jackie back."

    Angela Hollie, Smith's probation officer, recommended one year in jail and three years of supervised probation.

    The East Valley Tribune reports 29-year-old Jonathan Burns of Mesa is charged with first-degree murder, sexual assault, kidnapping and weapons misconduct in the high-profile case involving Jackie Hartman.

    The medical examiner says Hartman died from multiple gunshot wounds to her head.

    PHOENIX -- Opening statements are expected to get under way today in the trial of a man accused of killing a 19-year-old Gilbert woman in 2007.

    Prosecutors say Jonathan Burns shot Jackie Hartman on their first date together on Jan. 28, 2007.

    It was a nearly month before police found the 19-year-old's body buried in the desert near Fountain Hills.

    Burns, who had spent time in prison on unrelated charges before ever meeting Hartman, has maintained his innocence since police arrested him the day after his date with Hartman. He did admit having sex with Hartman but claims he dropped her off to meet her family.

    Police say Hartman did call her sister to pick her up at a gas station, but the nursing student never made it. Hartman's clothing, torn and riddled with bullet holes, was found in a trash bin near Burns' Mesa home.

    A grand jury indicted Burns, now 29, in connection with Hartman's disappearance before her body was found.

    After several delays, jury selection in the case finally started on Oct. 26. Burns is charged with first-degree murder, sexual assault, kidnapping and weapons misconduct.

    If the jury convicts him, Burns could face the death penalty.

    Closing Arguments Heard in Hartman Murder Case

    Prosecutors argued Jonathan Burns is a cold blooded killer who took advantage of an innocent girl to indulge his sexual appetites. Then, after he sexually assaulted Jackie Hartman on their first date, he decided to kill her.

    "Jackie is dead because of him and not because of what anyone else did or did not do," said prosecutor Vince Imbordino.

    Prosecutors say Burns threw Jackie's clothes into a dumpster in Mesa, then dumped her body in the desert near Fountain Hills.

    "Ultimately, the responsibility lies only with this defendant..today, we begin the final step," said Imbordino.

    But the defense attorney said Jonathan Burns had nothing to do with the death of Jackie Hartman, the real murderer was Burns' girlfriend, Mandy Smith.

    The defense: a jealous girlfriend is the killer.

    "All the evidence shows Mandy is the one who killed Jackie, not Jon, he was not a cohort or an accomplice in this," said the defense attorney.

    Prosecutors counter the evidence is overwhelming that Jonathan Burns did it.

    Now the jury must decide.

    This is a capital murder trial. If the jurors find Burns guilty, the 29-year-old could face the death penalty.

    Jurors continued Wednesday to deliberate the fate of a Mesa man accused of raping and murdering Gilbert coed Jacquelan "Jackie" Hartman.

    On Monday, jurors began their deliberations to determine whether Johnathan Ian Burns, 29, killed Hartman, 19, following their first date Jan. 28, 2007.

    Burns faces the death penalty if convicted of first-degree murder. He also faces charges of sexual assault, kidnapping and misconduct involving a weapon, according to court records.

    Hartman's family testified during the trial, which began Nov. 9 in Maricopa County Superior Court, that the 2006 Higley High School grad and aspiring nursing student met Burns at a Diamond Shamrock gas station near Williams Field Road and the San Tan Loop 202.

    Weeks later, on Jan. 28, 2007, Hartman's sister dropped her off to meet Burns for their first date, according to court testimony.

    The sister testified Jackie asked her to pick her up at the Diamond Shamrock after the date, but she never showed.

    In interviews with police, Burns admitted to having sex with Hartman, but stated he dropped her off afterward so she could meet up with her family.

    Hartman's disappearance spurred nearly a three-week manhunt, which involved members of her family, local volunteers and authorities.

    Police arrested Burns the day after the disappearance, when police found Hartman's bullet-ridden, torn clothing in a dumpster near his Mesa home, court documents show.

    Hartman's body, however, wouldn't be found until Feb. 19, 2007. An all-terrain vehicle rider found her body near Highway 87, northwest of Saguaro Lake.

    Investigators stated in court documents and police reports that cell phone records placed Burns' phone near where Hartman's body was found.

    The man who killed a 19-year old Valley woman on their first date will be eligible for the death penalty, a jury decided on Monday.

    Last week a jury convicted Jonathan Burns, 29, in the murder of Jackie Hartman. The jury agreed today that the crime was cruel and was committed as part of a kidnapping.

    Both factors make Burns eligible for the death penalty.

    The jury will take a Christmas break and return to sentence Burns on Jan. 10.

    Burns was found guilty on charges of first-degree murder, sexual assault, kidnapping and weapons misconduct. Prosecutors said he raped and fatally shot Jackie Hartman on their first date on Jan. 28, 2007.

    It was nearly a month before police found Hartman's body buried in the desert near Fountain Hills; her torn clothing was found in a trash bin near Burns' home.

    Court paperwork showed Hartman was last seen by her sister, Randi, around 2 a.m. the morning she was killed. Randi said her sister was with Burns, and that they were supposed to meet up again in Gilbert at 4:45 a.m. Randi said her sister was never dropped off.

    According to court paperwork, Burns told police he had sex with Hartman and dropped her off at home around 5 a.m.

    But police said they tracked Burns' cell phone north on Highway 87, and he couldn’t account for his whereabouts for about five hours.

    Authorities said earlier this year that Burns made plans to escape from jail while awaiting his trial.

    The Maricopa County Sheriff's Office said Burns admitted to chiseling the plastic toothbrush into a tool he could use to open his handcuffs. Burns planned to unlock the cuffs and escape from a transport van, deputies said.

    Burns previously had spent seven years in prison in Arizona for burglary, arson and other offenses, court documents revealed.
