    30-year-old charged with capital murder in Rockdale child's death

    A 30-year-old from Albuquerque, New Mexico, has been arrested in Rockdale and charged with capital murder in the death of a 1-year-old girl.

    According to Rockdale police, around 5:45 p.m. Monday, first responders were called to a home on San Gabriel Street. The 911 caller said a child was not breathing. Authorities said the 1-year-old lived at the residence with her grandfather, who is her primary caregiver, but was at work at the time.

    When first responders arrived, they began treating 1-year-old Patricia Ann Rader, who remained unresponsive. She was pronounced dead at the scene 30 minutes later. First responders noted the girl’s body was bruised along her torso, arms, legs, neck and head. According to Rockdale Police Department Chief Thomas Harris, an autopsy showed the girl had extensive internal injuries and broken bones throughout her body.

    Police questioned Shawn Vincent Boniello, a New Mexico resident who identifies as a woman. According to Harris, Boniello and the baby’s grandfather had met earlier this year over a dating website, and Boniello moved to Rockdale several months ago to live with Rader’s grandfather. On Monday, Boniello was babysitting the 1-year-old.

    Boniello confessed to punching, slapping, shaking and squeezing the child until the girl stopped moving, a police report notes. The report states Boniello mentioned feeling angry at the baby and squeezing her until Boniello felt the child’s bones move.

    Boniello is charged with child endangerment and capital murder and was being held in the Milam County Jail. Bond has not yet been set.

    Prosecutors: No decision on death penalty in murder of 20-month-old

    No decision has yet been made on whether to seek the death penalty against a (man?) charged with capital murder in the death of a 20-month-old Rockdale girl, the Milam County and District Attorney’s Office said in a press release Monday.

    Shawn Vincent Boniello, who’s also known as Shayla Angeline Boniello, is held in the Milam County Jail charged with capital murder in the death of Patricia Ann Rader, who died on the evening of Dec. 3 at her home in Rockdale.

    “The investigation into this horrible tragedy is still on-going, and our office has yet to see a report or any of the evidence against the defendant,” prosecutors said in the press release.

    “At the time of this press release, our office has received two probable cause affidavits, capital murder and endangering a child - nothing else. As such, no decision has been made on what punishment our office will seek at trial,” the press release said.

    “Cost is not a determining factor for this office whether to proceed with a death penalty trial. Once our office has received the final reports and evidence from Rockdale Police Department, (District Attorney Bill Torrey) will review the complete case. After review, and only after the review, DA Torrey will meet with the family of Patrician Ann Rader, to discuss the case and what options we will have for the trial. Only after that meeting will our office know if we are seeking the death penalty for this heinous act,” the office said.

    Officers, firefighters and paramedics responded to the girl’s home at around 5:45 p.m. Dec. 3 after receiving a report of an unresponsive child.

    Paramedics performed CPR at the scene, but were unable to revive the girl.

    Boniello was arrested that night and was initially charged with child abandonment/endangerment, but on Dec. 4 was also named in a complaint charging capital murder.
    An uninformed opponent is a dangerous opponent.

    Milam DA reverses earlier statements on not seeking death penalty; Decision to come after investigation complete

    CAMERON — On the same day of the funeral for a 20-month-old girl who was brutally killed Dec. 3, Milam County District Attorney Bill Torrey reversed earlier statements he made about not seeking the death penalty in the case.

    Patricia Ann Rader — known to those who loved her as Annie — was allegedly killed by 30-year-old Shawn Vincent Boniello, who is charged with capital murder.

    “Cost is not a determining factor for this office whether to proceed with a death penalty trial,” Torrey said Monday.

    Last week, Torrey told the Telegram that his office would not seek the death penalty because legal costs involved in a death penalty case would give Milam County a $1 million deficit in 2019. He cited the bad financial shape of Milam County and the difficulty of getting a unanimous jury vote for the death penalty.

    Thomas Bond, Annie’s uncle, told the Telegram that the family supports the death penalty against Boniello.

    “I told him (Torrey) that his initial decision ‘wouldn’t fly with the family or voters,’” Bond said. “It’s just not going to happen.”

    In a news release Monday, Torrey said a decision won’t be made until his office's investigation is complete.

    “The investigation into this horrible tragedy is still ongoing, and our office has yet to see a report or any of the evidence against the defendant,” Torrey said in the release. “As such, no decision has been made on what punishment our office will seek at trial.”

    Torrey plans to review the case after the final reports and evidence are received from the Rockdale Police Department.

    Girl’s death

    Boniello allegedly punched, slapped, shook and squeezed Annie until she didn’t move, a probable cause affidavit said.

    He was charged last week by the Rockdale Police Department with capital murder of a child under the age of 10 by “punching, shaking and picking up the victim and wrapping her arms around her and squeezing the victim until she stopped moving” and abandoning/endangering a child by criminal negligence.

    Boniello was interviewed by police and told in more detail what happened — after his rights were explained and he waived them. He said he was angry and frustrated when he squeezed the girl until he “felt her bones begin to pop and crush,” the affidavit said.

    The squeeze lasted for about three minutes before Boniello let the child go, he told officers.

    Initial decision

    Torrey, in an email response to the Telegram after Annie’s death, said he wouldn’t seek the death penalty if Boniello was convicted. Instead, he would ask for life without the possibility of parole.

    The reasons he gave for that decision were the bad financial shape of Milam County in 2019 and the difficulty of getting a unanimous jury vote for the death penalty.

    “Rule of thumb is that a DP (death penalty) case will cost the county about $1 million. Milam County anticipates, I’m told, a million dollar shortfall for 2019,” Torrey wrote the Telegram Wednesday.

    Torrey said the courts have held that a case’s facts can support a death verdict. However, he said most of the time an extensive and violent criminal history is needed to support a finding of “future dangerousness” and to affirm it on appeal.

    “My impression at this point is that the ‘future dangerous’ finding would be difficult to prove and/or sustain on appeal,” Torrey said Friday.

    Family’s point of view

    The Bonds — Rachel and Thomas — both talked to the Telegram Monday before and after the funeral about Annie’s death and Torrey’s statements.

    When they were told Torrey reversed his earlier statements, Rachel Bond said, “Good.”

    Thomas Bond said he told Torrey last week in a phone conversation that Milam County would seek capital murder charges and the death penalty if a police officer was killed. He said he told Torrey there shouldn’t be any difference in how an officer’s death and the death of his niece should be addressed.

    “Why should a police officer’s life be more valuable than Annie’s — especially considering how she died,” Bond said he asked Torrey.

    Milam County prosecutors will seek the death penalty in the trial of a man indicted Thursday for capital murder in the death of a 20-month-old Rockdale girl.

    Shawn Vincent Boniello, who’s also known as Shayla Angeline Boniello, 30, remains in the Milam County Jail.

    The Milam County Grand Jury handed up a capital murder indictment against him Wednesday morning in the death of Patricia Ann Rader, who died on the evening of Dec. 3 at her home in Rockdale.

    “Upon receipt of the draft of an offense report…from the Rockdale Police Department…the Milam County District Attorney’s office will seek the penalty of death for the defendant,” County/District Attorney Bill Torrey said in a press release early Thursday afternoon.

    "District Judge John W. Youngblood has requested the Texas Capital Defender’s Service in Austin, to represent the defendant," Torrey said.

    Capital murder suspect’s pretrial hearing set

    Although a pretrial date for a Milam County capital murder suspect was scheduled for June 21, a new date for the pretrial hearing was set for 1:30 p.m. on Dec. 12.

    Jury trial for Shawn Vincent Boniello was set for 9 a.m. on Jan. 21, according to court records.

    Trial date set in Rockdale child murder case

    A trial date has been set in January 2020 for a man accused of killing a 20-month-old Rockdale toddler.

    Shawn Vincent Boniello, also known as Shayla Angelina Boniello is charged with capital murder and is facing the death penalty.

    Boniello is accused in the death of Patricia Ann Rader, who was killed December 3, 2018 in a Rockdale home.

    A pre-trial hearing in the case has been set for December 12 with the trial set to begin January 21.

    The child was found unresponsive, with Rockdale Fire and EMS personnel unsuccessful in their attempts to revive her.

    Rader’s family said the little girl was allegedly beaten while under Boniello’s care in Rockdale.

    Shawn Vincent Boniello, who’s also known as Shayla Angeline Boniello, 30, remains in the Milam County Jail.

    Boniello identifies as a transgender woman, according to Rockdale police.

    Boniello is charged in the Dec. 3, 2018 death of Patricia Ann Rader.

    Officers, firefighters and paramedics responded to the girl’s home at around 5:45 p.m. Dec. 3 after receiving a report of an unresponsive child.

    Paramedics performed CPR at the scene, but were unable to revive the girl.

    CAMERON, Texas (KBTX) - The person police say killed a 20-month-old Milam County child pleaded guilty to capital murder charges and will not receive the death penalty, according to court officials.

    Shayla Angelina Boniello plead guilty to the killing 20-month-old Patricia Ann Rader on Dec. 3, 2018 at a home in Rockdale.

    She was sentenced to life in prison with no possibility of parole. The State was recently provided with evidence that Boniello suffers from a traumatic brain injury.

    Prosecutors had announced in 2018 they would seek the death penalty in this case. But, Boniello’s non-violent past and traumatic brain injury would render any death verdict insufficient and thus be reversed on appeal.

    Boniello, whose legal name is Shawn Vincent Boniello, is a transgender woman.
