Death Penalty Pursued for Daylon Delon Gamble in 2019 GA Mass Murder

Suspect identified in Georgia shootings that killed 4

    News4Jax

ROCKMART, Ga. - Authorities in Georgia are on the lookout for a gunman they say killed four people and wounded a man in a pair of shootings.

The Georgia Bureau of Investigation tweeted early Friday that 27-year-old Daylon Delon Gamble is armed and dangerous and wanted on four charges of murder for the shootings Thursday night in Rockmart, about 45 miles northwest of Atlanta.

A GBI news release said 48-year-old Helen Rose Mitchell and 19-year-old Jaequnn Davis died at one home, and 24-year-old Arkeyla Perry and 26-year-old Dadrian Cummings died at another home several blocks away.

The GBI says 24-year-old Peerless Brown was injured at the home where Mitchell and Davis were killed. He was flown to an Atlanta hospital. His condition was unknown.

"They were targeted, but I don't know why. I have no idea why," Rockmart Police Chief Keith Sorrells told WAGA-TV.

WXIA-TV reported investigators believe the incident was related to drugs.

State police say Gamble fled in a stolen truck that has since been recovered.

Authorities initially said six people had been shot but later corrected that information.

DA to seek death penalty in Polk County quadruple homicide

By Chelsea Prince and Zachary Hansen
    Atlanta Journal-Constitution

Polk County’s top prosecutor on Monday announced his intent to seek the death penalty against Daylon Delon Gamble, who is accused in two separate double homicides in Rockmart.

Gamble is facing four counts of murder in the January deaths of his aunt, Helen Rose Mitchell, 48, a cousin, Jaequnn Davis, 19, and two others, 24-year-old Arkeyla Perry and 26-year-old Dadrian Cummings.

Documents obtained by AJC.com show District Attorney Jack Browning filed a notice of intent to pursue the death penalty against Gamble. The documents cite his charges and claimed the homicides were “outrageously or wantonly vile, horrible or inhuman, in that (they) involved depravity of mind.”

The bodies of Mitchell and Davis were found in a home on Williamson Street, and Perry and Cummings were found about 300 yards away at a home on Rome Street. A fifth person, 24-year-old Peerless Brown, was shot in the face at the Williamson Street home but survived.

Brown previously told Channel 2 Action News that Gamble was his cousin, and the family had not seen or heard from him in several years before he turned up on their doorstep that night. Brown had just pulled into the driveway when he spotted him.

“When I got out of the car, I asked him what he was doing, and he said nothing,” Gamble said in an interview with the news station. “He shot me — didn’t say nothing.”

At the time, Gamble was paroled on a 2011 attempted armed robbery and burglary conviction out of Bartow County. He was released from state prison in June 2016, records show.

He was on the run for three days after the shootings until being arrested in Indianapolis by U.S. marshals, according to the GBI.
Gamble was initially scheduled for an arraignment hearing Monday in Polk County Superior Court until Browning told the court he would seek capital punishment, the Polk County Standard Journal reported.

As a result, the proceedings stalled until Gamble’s attorney could be present, the newspaper reported. No date has been set.

Rockmart quadruple murder case remains in limbo, hearing scheduled for January

A hearing is scheduled for early 2022 for a man facing the death penalty for the deaths of 4 people on Jan. 24, 2019, in Rockmart.

Daylon Delon Gamble is charged with murder in the deaths of Helen Rose Mitchell, Jaequnn Davis, Arkeyla Perry and Dadrian Cummings. The shootings took place on the same night at two different nearby locations.

A status hearing in the case is scheduled for Jan. 10, 2022, at the Polk County Courthouse at 10 Prior St.

That hearing will largely address pretrial preparations concerning the case.

During a short status conference in July, Jerilyn Bell with the Georgia Capital Defender’s office told the court that her office was working to get qualified attorneys assigned to the case. Bell told Tallapoosa Circuit Court Judge Meng Lim that Perisha Dixon from her office would be one of the attorneys representing Gamble.

The office is part of the Georgia Public Defender Council dedicated to the defense of those in the state facing the death penalty.

Gamble was arrested in Indianapolis, Indiana, days after reportedly fleeing from Rockmart after the shootings. He was captured and brought back to Polk County.

Lim issued a gag order in the case. That type of order is typically issued to prevent those involved with the case from speaking about it. The idea is to limit prejudice or potential bias for prospective jurors as a result of pretrial publicity.

However, some of the details of the case have been presented in pretrial hearings.

During a April 2019 pretrial hearing, GBI Special Agent Amanda Carter testified that Gamble was hanging out with several of the victims until 7:44 p.m. She also testified that all five of the shooting victims, including the sole survivor, Peerless Brown, were shot in the head.

Brown identified Gamble, who used to babysit him, as the shooter.

Witnesses in the case said Gamble was believed to be under the influence of alcohol and drugs at the time of the crime, Carter told the court.

Rockmart quadruple murder case not likely to go to trial until 2024

    By Jeremy Stewart
    Northwest Georgia News

It will likely be more than five years since the shooting deaths of four people in Rockmart before the start of the trial of a man charged with their murders.

In his first status hearing presiding over the case Friday, Polk County Superior Court Chief Judge Mark Murphy consulted the defense team for Daylon Delon Gamble for a possible time frame for the trial.

Gamble is represented by the Georgia Capital Defender office, a division of the Georgia Public Defender Council that is assigned to those who face the death penalty.

Murphy suggested the first quarter of 2024, while Jerilyn Bell, the lead counsel on the defense and director of the Georgia Capital Defender office, noted that they would need to have a hearing to resolve a string of motions filed by her team before a trial can commence.

She added that the setbacks and backlog created by the pausing of trial hearings during the COVID-19 pandemic has caused long delays in several cases in which her office is involved, adding that it has cases from 2016 and 2017 that have trial dates in the next year.

Gamble faces four counts of murder in connection with two separate shootings that occurred in January 2019 in the area of Martin Luther King Junior Street west of downtown Rockmart. Another victim was shot but survived.

Gamble was arrested in Indianapolis, Indiana, days after reportedly fleeing from Rockmart after the shootings. He was captured and brought back to Polk County. Tallapoosa Circuit District Attorney Jack Browning has filed his intent to seek the death penalty in the case.

A small hearing room in the Polk County Courthouse was packed with members of the victims' families and other supporters Friday morning as the proceedings were held via Zoom video conferencing to help make sure all parties involved were able to participate.

Browning said his office had been made aware of 22 motions filed by the defense challenging several aspects of the trial and he felt a number of them could be ruled on without a hearing and based on written responses from his office.

“We stand ready to move forward on it and await any new motions in order to respond,” Browning said.

A firm date on a motion hearing was not settled on, however Murphy did consult with the defense team privately following the status hearing to discuss the motions.

Murphy, who serves as chief superior court judge for the Tallapoosa Judicial Circuit which also includes Haralson County, was placed over the case in September following a series of events that led to former chief superior court judge Meng Lim losing re-election and resigning last July.

Murphy spent a majority of the hearing reviewing the Unified Appeal Procedure as set forth by the Georgia Supreme Court to be applied in cases where the death penalty is sought, adding that while previous court records have Lim referring to it, it is not expressly presented as an exhibit.

Part of the first proceedings of the UAP include establishing the qualifications of the defense team in a death penalty case to ensure defendants are adequately represented.

Bell said she recalled a hearing in February 2022 where Lim put the qualifications of the current defense team on the record and discussed the UAP with Gamble while providing a copy of it at that time.

Browning said that a quick search of his email did not turn up a transcript of the February 2022 hearing. Murphy said finding it could be difficult, since Lim's court reporter at the time was no longer with the court.

Murphy proceeded to review the qualifications again and confirmed with Gamble that he approved of his defense team and how they were conducting his case.

The defense team has gone through different iterations since the early stages of the case, with Bell working to get qualified attorneys assigned to the case. The current team was set in January 2022.
