    Convicted trooper killer ruled incompetent

    The resentencing trial of a man convicted of killing a state trooper in 2003 has been put on hold after the man was determined to be incompetent.

    A Comanche County district judge on Tuesday ordered Ricky Ray Malone to be sent to the Oklahoma Forensic Center in Vinita for treatment until he is deemed competent to aid in his own defense.

    Malone, 34, was convicted and sentenced to death in 2005 for the Dec. 26, 2003, slaying of trooper Nikky Green on a rural Cotton County road.

    The death verdict was later overturned, and the penalty phase of the case was remanded for resentencing.

    Comanche County District Attorney Robert Schulte said it was in the state's best interest to stipulate to the conclusions made by a defense psychologist, who found that Malone presently is incompetent to stand trial.

    A report prepared by a state mental health expert was inconclusive, Schulte said. He said Dr. Shawn Roberson, who prepared the state report, said Malone is either incompetent or highly intelligent and pretending to be incompetent.

    A court order approved by Comanche County District Judge Mark R. Smith states that both reports indicate Malone can be treated and his competency restored.

    Attorneys for Malone filed an application in June to determine his mental competency, alleging that he suffers from a psychiatric illness, according to court records. Smith ordered Malone to undergo testing in July.

    Tuesday's order states the center in Vinita will provide the court with updates and notify the court in writing when Malone's competency is restored.

    Schulte said he is hopeful that Malone's stay at the center will give the state evidence that he is competent and criminal proceedings against him can be resumed soon. He added that if Malone is found competent by experts at Vinita he has a right to a jury trial on the matter.

    Malone Gets 2nd Death Sentence

    Convicted cop killer Ricky Ray Malone has received his 2nd death sentence for the slaying of Oklahoma Highway Patrol Trooper Nik Green in 2003.

    The judge announced his verdict on punishment this afternoon in Lawton after both sides rested Friday.

    Malone faced life is prison or the death penalty. Malone received his 1st death sentence in the case in 2005, but it was thrown out on appeals.

    District Judge Mark Smith heard arguments over the last 2 weeks from the prosecution, as to why Malone should receive the death penalty, as well as arguments from the defense, as to why Malone should get life without parole.

    Judge Smith also presided over Malone's 1st trial.

    The execution of an ex-firefighter convicted of killing an Oklahoma Highway Patrol trooper is being delayed.

    The Lawton Constitution reports the Oklahoma Court of Criminal Appeals issued an order Monday staying the Jan. 14 execution of Ricky Ray Malone. Malone's attorneys sought the delay after a Comanche County judge sentenced him to death following a non-jury trial.

    A jury initially convicted Malone of 1st-degree murder and sentenced him to die for the December 2003 killing of Trooper Nik Green. Authorities say Malone shot Green after the lawman found him in Cotton County in a car that had a mobile methamphetamine lab inside.

    The Court of Criminal Appeals overturned Malone's punishment and ordered his resentencing.

    Attorney General's office spokesman Charlie Price says the stay is routine.

    Another date hasn't been set.

    The Oklahoma Court of Criminal Appeals is slated to hear the appeal of a man who was convicted and sentenced to death in the fatal shooting of a state trooper almost nine years ago.

    Arguments are scheduled Tuesday in the appeal of Ricky Malone, who was convicted of first-degree murder in trooper Nik Green's 2003 shooting death. Investigators say Malone shot Green with the trooper's gun after Green found him in a car that contained a mobile methamphetamine lab.

    The court wants prosecutors to argue whether Malone's death sentence was imposed under the influence of passion, prejudice or any other arbitrary factor.

    The appeals court previously overturned the death sentence and ordered a new sentencing trial. A Comanche County judge re-sentenced Malone to death in 2010.

    Oklahoma appeals court upholds death sentence for Ricky Ray Malone in trooper's killing

    A state appeals court has upheld the death sentence of a man accused of gunning down a state highway patrolman in 2003.

    The Oklahoma Court of Criminal Appeals on Friday affirmed the death sentence of 38-year-old Ricky Ray Malone. Malone was convicted of shooting trooper Nikky “Nik” Green twice in the back of the head after wresting Green's gun from him during a struggle on a Cotton County road. Green was trying to arrest Malone for allegedly operating a mobile methamphetamine lab out of the car he was driving, and some of the attack was captured on Green's vehicle's dashboard camera.

    Malone's attorney had urged the court to instead give Malone a life term, arguing that a judge didn't account for mitigating circumstances when re-sentencing Malone to death.

    Oklahoma court denies hearing for death row inmate

    An Oklahoma appeals court has denied a death row inmate's request for a hearing to present evidence in his appeal.

    The state Court of Criminal Appeals handed down the decision Tuesday in the case of 38-year-old Ricky Ray Malone.

    A jury in Comanche County convicted Malone of first-degree murder and sentenced him to death for the December 2003 killing of Oklahoma Highway Patrol Trooper Nikky "Nik" Green.

    Green was shot to death with his own gun while trying to arrest Malone for allegedly operating a mobile methamphetamine lab out of Malone's sister's car. Some of the attack was captured on Green's vehicle's dash-cam.

    Among other things, Malone asked the state appeals court for a hearing to produce evidence that his defense attorneys have been ineffective during his trial and appeal.
