    I will say that Judge Steve Duskie is on annual leave for a week. Returning to work Monday June 5 for the punishment phase of the trial. With Marks found guilty, the likelihood of Marks being sent to Texas' death row is most probable.

    BELL COUNTY, Texas — Convicted murderer Cedric Marks returned to the Bell County Justice Center on Monday for his sentencing hearing.

    The state is seeking the death penalty for his role in the deaths of his ex-girlfriend, Jenna Scott, and her friend, Michael Swearingin in Temple back in 2019.

    During Monday's hearing, the state focused on another ex-girlfriend of Marks, April Pease. Marks was charged with second-degree murder for her death after she went missing 2009.

    In court, her mother, Dorothy Pease, testified how she believes Marks killed her daughter. She said Marks choked her and that her daughter explained how she was afraid of him.

    Pease had three children and shared a son with Marks.

    Pease did tell the jury her daughter lost custody of her two children and temporary custody was given to Marks after she went missing.

    A video of marks dedicated to Pease's other two children and his son was played in court. In the video, Marks can be seen and heard apologizing to the three children for quote "What he was about to do."

    That video was taken just a few days before Pease went missing.

    Sentencing is expected to last until Wednesday.

    Marks’ ex-wife confirms murder confession

    BELTON, Texas (FOX44) – The sentencing phase of the Cedric Marks Capital Murder trial continues in Bell County’s 426th District Court on Tuesday, June 6.

    Charles Roberts testified on the morning of Tuesday, June 6 about how Marks broke his jaw at Fort Hood in 2001. Roberts was in an intimate relationship with Sharon Baxter at the time, after she broke up with Marks. Marks broke into Sharon’s home to attack Roberts.

    Sharon Baxter testified after Roberts to confirm Marks broke into her home on February 5, 2001. Sharon said she was fearful in her relationship with Marks. Sharon said Marks choked her in their relationship, and stalked her after they broke up.

    In cross examination, Marks asked Sharon whats she’s getting to lie in front of the jury. Sharon denied, and didn’t recall ever hitting Marks or Ginell or allowing Marks to stay at her home in Texas.

    Ginell McDonough came back to testify on the morning of Tuesday, June 6 regarding what she knew about April Pease. Ginell now confirmed in front of the jury Marks confessing to her he killed April. Marks confessed this a few years after April went missing in 2009. Ginell said she and Marks talked in between her last testimony for Marks wanting to remarry her. Ginell said she declined because she didn’t know fact from fiction with everything happening.

    In McDonough’s direct examination, District Attorney Henry Garza started to play the video Marks left saying he was going to save Adrian and to take care of the boys. Marks got mad for the video being played, saying the prosecution is trying to make him and Ginell squirm. Marks shouted to Judge Steve Duskie, “These are such disgusting people to make her stick to a lie she told and you’re helping them. Whether I’m put to death or not, this is a dirty system, dirty county, dirty people.” Judge Duskie immediately asked for Marks to be escorted outside.

    Marks came back into the courtroom to ask to be excused while the video is played. The judge denied this request, saying Marks is representing himself and needs to be in the courtroom for all phases to represent himself. Marks then demanded to be taken out the courtroom.

    In Marks’ cross examination, Ginell said she remembers Marks being a good dad – but is starting to see some manipulation. Ginell then confirmed she and Marks won’t get back together. Ginell’s former boss, Sgt. Warrix, testified next and heard Marks being verbally abusive to Ginell.

    Jonathan Scott delivered his impact statement, saying it caused dramatic changes in their family. Jonathan shared how Jenna’s daughter Emory struggles without having her mom being at games and award ceremonies. Johnathan said it also left a huge void in Jenna’s brother’s life.

    On Monday, June 5, the jury could then decide if they want to recommend Marks for life in prison or the death penalty.

    A Bloomington, Minnesota detective was the first witness to speak on the morning of June 5. Marks asked for a mistrial and wanted to deny evidence being admitted, but was overruled.

    The court heard both videos Marks recorded to his son Adrian, and his wife Ginell McDonough, in relation to the disappearance of April Pease. In Adrian’s tape, Marks said April is a terrible mother, and Marks was coming to save him. Marks said he’d be leaving to do something that can put him in prison for the rest of his life or kill him.

    Marks said he has been a bad person in the past, but admits he’s not a person to allow a child to get hurt. He said that if he failed, he at least succeeded in freeing Adrian.

    Marks told Ginell in the second video to take care of the boys in case he doesn’t return. He was open to Ginell finding another partner not like Marks – claiming it would be drama for Ginell, like Marks himself.

    Marks told Ginell to one day play the video for Adrian and said he didn’t mind if his sons hated him as long as they grew up to be good adults. When detectives spoke to Marks in 2019 about the videos, Marks said he shot the tapes because he was planning to do an armed robbery to get more money for his CPS lawyer in his custody battle for Adrian.

    Marks said he decided to not go through with the armed robbery to claim he signed up for a UFC match.

    In Marks’ line of questions with the Minnesota Detective, Garza made an objection for relevancy. Marks said to Garza’s objection, “I deserve to save my f***king life.” Marks then told Garza, “You look like you want to do something,” as deputies started to stand.

    When Ginell dropped the videos off to Bloomington PD, one of the cases had Pease’s SIM card attached to it for the last activity to be recorded on March 18, 2009. This is the same period Pease went missing with Marks and Kelly Sorenson in nearby states.

    Washington State Child Custody Investigator Kyle Barber was the next witness to speak. Barber was assigned to Marks and Pease custody case in October 2008, after Pease filed protective orders charges against Marks in September 2008.

    Barber believed Marks wasn’t truthful in his interview. He believed Marks was controlling what Ginell McDonough and Kelly Sorenson said in their interviews with Barber himself.

    Barber recommended for Adrian to stay with April until she went missing to then allow Marks to have custody.

    April Pease’s mother, Dottie (Dorothy), testified on the afternoon of Monday, June 5 on April’s state in 2008-2009 and April’s relationship with Marks. Dottie mentioned how April knew Marks would never leave her alone.

    Dottie said Marks discovered April went to a women’s shelter in Washington through Ginell and Kelly Sorenson, calling to find her location for Marks to show up at April’s shelter to be arrested in September 2008.

    In cross examination, Marks didn’t deny telling Ginell and Kelly to call airports to find April’s whereabouts while he was in jail for two months.

    Both Dottie and Barber testified that Pease was going to a confidential shelter in Minnesota for April to check out between March 17 and 18, 2009, to then disappear.

    In regards to Dottie’s relationship with Adrian, Dottie testified Adrian didn’t want to have a connection with her due to what Adrian was told. Dorothy went back on the stand this afternoon to show messages of Marks being difficult in Dorothy and Adrian’s meeting. Dottie said she also received a message from Marks needing her help to get his record expunged. From the message, Dottie claimed if she did this, Marks would send Adrian to see her in Washington.

    BELL COUNTY, Texas — Day three of the sentencing phase of trial was held on Wednesday, June 7 for Cedric Marks, the man found guilty of killing Jenna Scott and Michael Swearingin back in 2019. The State is seeking the death penalty.

    Marks called in three witnesses on his behalf. The jury knew Marks was going to call in three witnesses, but what people didn't expect was when Marks called himself as the last witness.

    Before Marks testified, he called in two women to speak about their previous relationships with him. One said Marks owed her $30,000. The other testified Marks lied and manipulated her in their relationship.

    Marks then said he was ready to testify on his own behalf. Judge Steve Duskie asked Marks' standby counsel whether or not Marks was ready to open the door to questioning from prosecutors and if he had asked questions about the process.

    Marks' counsel said he didn't ask any questions but was ready to testify.

    "It's time for me to speak after four and a half years," Marks said to begin his testimony. "I want you to hear the good, bad and ugly."

    Marks went over his prior bad acts which started at the age of seven when he was charged with arson.

    Marks tried to clear his name, saying he even remained friends with a person who once turned him over to police.

    Marks brought up Sharon Baxter, who testified the day before.

    "She was one of the most violent people I know," Marks said.

    Marks then spoke about his ex-girlfriend April Pease, whom Marks is also accused of killing in a different case. He said Pease was a recovering meth addict and was holding onto their child.

    While Marks spoke about Pease, Bell County District Attorney Henry Garza objected for hearsay and speculation.

    "Dude, stop being a cry baby," Marks said in response.

    Marks says he believed Pease wasn't a good mother. He didn't dive into her death or disappearance.

    Marks also claimed the confession tapes he filmed were about a planned robbery.

    Marks testified he "knocked the breath" out of another ex-girlfriend after she hit their child.

    Marks brought up Jenna Scott next. He said he met Scott in Aug. 2015, but then he paused. Marks started to cry, couldn't get any words out and asked for a break.

    After Marks took a break, he dove into how he and Scott met on Tinder and how their relationship started.

    Marks said he never intended to smear or shame Scott in this trial but claimed she was violent with him.

    "I was never laying my hands on her," Marks said. "I was never threatening her life."

    Marks will continue to share his testimony on Thursday, June 8 at 9:15 a.m. in the Bell County Justice Center. Prosecutors will have the chance to cross examine him after.

    Cedric Marks sentenced to death following capital murder conviction

    Jurors gave the man convicted of double murder the death penalty Friday afternoon

    BELTON, Texas — After a week-long punishment phase, a jury has given marks the death penalty on Friday, June 9.

    Marks was convicted last month of killing Jenna Scott and Michael Swearingin in 2019.

    In a shocking turn the day before his sentence, Cedric Marks, who testified on his own behalf while representing himself, admitted to lying to the jury about his role in the deaths of both Scott and Swearingin.

    Earlier in the week, Marks had testified to the jury that he had never laid a hand on Scott or made any threat toward Swearingin. However, on June 8, Marks let the jury know this wasn't the case.

    Marks admitted to threatening Swearingin, saying he was going to cut his head off if he did not stop calling his phone.

    After a fight broke out between Marks and Scott, Marks testified that he put Scott in a chokehold. Afterwards, Marks says she screamed, saying he was trying to kill her.

    "I should've never touched her," Marks said.

    Marks called himself an abuser and got emotional. He says the next day he taught a women's self defense class.

    "I teach these women how to get out of a chokehold I just put my girlfriend in," Marks said.

    Marks presented evidence to the court afterwards, specifically two audio conversations between him and Scott in regards to the choke and their relationship.

    In the audio clips, Scott says Marks killed six people. She also asked Marks if he told everyone that he almost killed her.

    "I wanted to hurt her," Marks testified. "That was a horrendous mistake."

    Marks then described what happened on his trip to Texas in Jan. 2019, when Scott and Swearingin went missing.

    Marks confirmed he went to Austin, a Whataburger and Rebecca Adney's house. He claimed Maya Maxwell, his accomplice and former girlfriend, met a friend at a coffee shop and took Adney's vehicle on Jan. 3, 2019.

    Marks says he called Maxwell throughout the day but never heard back. On Jan. 4, 2019, Marks says Maxwell called him at 4:00 a.m. crying. He then shocked the courtroom with his statements.

    "I have not told the truth," Marks said. "I've been a liar. I feel that I am absolutely responsible for the deaths of Jenna Scott and Michael Swearingin."

    However, Marks denied any involvement with the killings, claiming Maxwell killed Scott and a stranger killed Swearingin.

    He also briefly talked about why he was representing himself in trial.

    "I didn't follow my lawyer's advice," Marks said. "I wanted to not tell the truth about what happened." Marks says what he wanted to do was cover up for Maxwell.

    When Marks said Maxwell attempted to lure Swearingin out of his home in Temple, Bell County District Attorney, Henry Garza, objected to his statements for hearsay and speculation.

    Marks made another outburst and looked at the victims' families, telling them he was not a murderer. He was then escorted out of the courtroom.

    When Marks was present again, he started to play the video of Swearingin interacting with someone outside of his home. With multiple objections from the State, Marks raised his voice at the judge.

    "They're so afraid," Marks said. "They made a deal with the devil."

    Marks went on to say he was just there to clean up the mess.

    Marks wrapped up his testimony in tears, saying he wanted the harshest punishment possible.

    "I'm ready to go anyway," Marks said. "I am completely responsible. Do it for the dog, my boys, Scott and Harrison. Let me go. Please help me go."

    Marks could hardly get any words out and was escorted out of the courtroom.

    Prosecutors cross examined Marks next. Garza looked at Marks and asked, "Are you ready?" According to testimony by Maxwell, these were the last words Marks said to Scott before he choked her to death.

    The courtroom was filled with tension, back and forth dialogue and interruptions between Garza and Marks.

    Garza asked Marks if he was the one who dug the hole and drug the bodies in the grave.

    "Yes," Marks told the jury with no hesitation.

    Garza asked Marks where he buried April Pease, who disappeared in 2009 and has never been found. However, Marks denied any involvement her disappearance.

    "You told Jenna you killed more people," Garza said.

    "You guys are so dirty," Marks said back to Garza. "You should be in prison."

    Garza then asked Marks if he realized the horror, pain and hurt he caused Scott when he sent videos of her assaulting him to her school and other places.

    "Would you agree you're a danger to people when you want to be?" Garza asked Marks.

    "No," Marks said back.

    Marks claimed there is still more to the story and evidence in this case. He says prosecutors have been hiding it this whole time.

    "You're flipping it on us," Garza said. "You've had four years to think about this case."

    Marks then confirmed he drove to Oklahoma with Swearingin and Scott's bodies in his car. He admitted to buying clothes and getting shoes from the Walmart just a few blocks down from where the bodies were found.

    Garza brought up how Marks buried the bodies right next to a cemetery where his family was, alluding to the fact that this was all strategically planned out by Marks and no one else.

    Marks testified to filling the grave but still did not admit to killing the two.

    "You're trying to tell the truth, tell the truth," Garza said.

    Garza looked at Marks and said he is still trying to control this narrative.

    "No, I just really hate you," Marks said in response.

    The families say justice has been served knowing that Marks won't be able to do this to anyone else

    BELL COUNTY, Texas — After two and a half hours of deliberation, a Bell County jury sentenced Cedric Marks to death on Friday, June 9 after he was found guilty of capital murder for killing his ex-girlfriend, Jenna Scott, and her friend, Michael Swearingin, back in 2019.

    Both families gave their victim impact statements directly to Marks following the jury's decision.

    "Jenna knew what your plan was all along," Jenna's brother, Talon Scott, told Marks.

    He repeatedly said to Marks that no one was safe.

    "If you couldn't have her, no one could," Talon said.

    Deborah Harrison, Swearingin's mother, says she forgives Marks as a person but not his horrible acts.

    "With God's help, I've come to the point that I can forgive him as a person," Harrison said. "I don't forgive the act of murder that he did and the pain that he inflicted on my baby, but I forgive him."

    She gave her final words to Marks with a piece from her son that he posted on Facebook.

    Love is not a noun. To love is to do, to feel, to become. Love is not passive, nor still. Love is always moving, changing, growing, and adapting to fit and make space in your heart for someone. Some think love is supposed to be simple, easy, or effortless and that couldn’t be further from the truth. Love is not a singular thought or feeling. It’s a continuous action, choice, and promise to another person. Love is the movement towards one another through the chaos that is life. Love is active, searching for ways to be closer, to understand, to meet halfway. Love is a verb.

    I Corinthians 13:13: And now these three remain: faith, hope, and love. But the greatest of these is love.

    This world so desperately needs more of it.

    After the trial finished, prosecution and family members spoke to media.

    "We know that the stories of Michael and Jenna were told and that the right decision was made and that we can move forward in a position that will keep our community safe," First Assistant District Attorney Stephanie Newell said.

    "What we were waiting for was the thunder that was given today within a short period of time," Bell County District Attorney Henry Garza said.

    The families expressed that justice was served and that their family bond is even stronger.

    "Today, we have victory," Harrison told the media. "We believe that this had to happen to Michael and Jenna, so that justice could be served because he had already killed so many other people."

    After nearly two months of trial, the families say they've gone through all the emotions.

    “It’s been a really long, hard, stressful, traumatizing journey,” Talon said. "From January 2019 all the way till now, the family has experienced so many different emotions, going through the whole grieving process, whether it be anger, sadness, denial. There’s been a lot of small senses of closure throughout this whole endeavor, but now today, we get a really good sense of closure.”

    They thank the power of prayer, prosecutors, law enforcement and all the support from the community along the way as this has been a complicated investigation covering multiple towns, cities and states.

    "It doesn't change what happened but knowing that justice was served, knowing that Cedric won't be able to do this to anyone else," Talon said.

    Some jurors believe Jenna Scott and Michael Swearingin's deaths aren't the only ones Marks is responsible for

    BELL COUNTY, Texas — Jurors are speaking out and giving insight on their decision-making process in the Cedric Marks trial. The former MMA fighter was sentenced to death after a Bell County jury found Marks guilty of capital murder for both Jenna Scott and Michael Swearingin back in 2019.

    6 News spoke with the foreperson, Zachary Gauthier, who explained how the jury members had to answer three special questions for the proposed punishments during deliberation.

    "One of them was, 'Do we believe he is a continued threat to society?'" Gauthier said. "In his own testimony, in his previous imprisonment, he admitted to getting in multiple fights and things of that nature. We determined very quickly, a 12-0 vote, right away that we all believe that he was a continued threat to society."

    Jurors also unanimously agreed Marks was directly involved in making the decision to travel from Michigan to Texas to commit the murders of Scott and Swearingin.

    Lastly, the jury had to determine if there were any mitigating circumstances as to why Marks shouldn't get the death penalty.

    "The concern was there, the potential abandonment concerns or other issues that may have occurred in his youth or younger years," Gauthier said. "None of it raised to the level that we consider to be significantly mitigating."

    They ultimately decided there weren't any circumstances and gave him the harshest punishment.

    "All the way through the end he, you know, told the families that you know, they have a right to know well, they do have a right to know, but he's the only one that can tell them exactly what happened," Gauthier explained.
    "He made the decision to not do that.

    He can live with that decision for the rest of his life, and he can do it while he's sitting on death row."

    "The other thing is, we really had to look at the evidence," another juror said anonymously. "We had to detach any narrative from prosecution or from Marks."

    The jury also had to review more than 800 exhibits of evidence. They expressed the key pieces that stood out to them.

    "The timeline of the primary, compiling the phone records, the security system with the missing videos, the Hyundai Genesis report of the Blue Link report that was provided for turning the car on at the address of both Michael Swearingin's home and Rebecca Adney's home in Killeen, Texas," Gauthier said. "Once we see that and then the Google account when they match that up with phone records for Cedric Marks, Maya Maxwell, and then the final phone usages of Jenna and Michael's phone, I suspect that that was actually done by Cedric Marks."

    Throughout the trial, the jury saw many outbursts from Marks to the judge, prosecution and even witnesses. While members of the jury say they understood Marks was fighting for his life, they also say Marks lied to the jury.

    "I believe he's a psychopath, I believe he's narcissistic, and I believe he's manipulative," Gauthier said. "You saw that with Ginell McDonough when he called her back to the stand and his final question to her was, 'Tell the jury something about me.' She said, 'Well, you're a loving father, you care about your kids, and I have no doubt that that's true, but I'm starting to realize that some of it was probably manipulation.' His face said it all in that moment, that he finally lost his grip on all the women that he thought he had his grip on. He lost all his power in that moment. I think that was the moment he decided to testify for himself, and again, we did not allow him to manipulate us as the jurors."

    Another suspicion from the jury was Marks could be a serial killer. Gauthier dove into why he thought this was true after a recorded conversation was admitted between Marks and Scott.

    Jenna is yelling at Marks saying, 'You tried to kill me,' when Cedric put her in a chokehold intentionally or unintentionally. She said, 'You almost killed me,' and then his response was, 'Well, what are you talking about? I didn't almost try to kill you.' She's like, 'Well, you're a violent murderer.' Again, he goes, 'Well, what are you talking about' She responds with, 'You told me you've killed six or seven people.' That really kind of clicked with me. Cedric Marks introduced this piece of evidence. That's the key there.

    Investigator Powell now, and I actually have done a fair amount of research over the last couple of days now that I'm allowed to look up the news. I found that there was a testimony by Maya Maxwell that we were not allowed to be part of as a jurors in which she's named off multiple people that Cedric Marks claimed to have killed... kittens and cats, and there were some other things involved from the article that I read. I'm fairly confident that Cedric Marks is, in my opinion, probably a serial killer, and I'm thankful that he will not be able to hurt anybody else from this point forward. I hope that some of his other victims at some point, get some kind of justice or closure. Even if that only comes by way of knowing that he can't hurt anybody else, because of the verdict that we came to, in this case.

    Other members of the jury say they hope Marks regrets the decision he made and the actions he took against innocent people. They also touched on how this case will impact Scott's daughter and Marks' children.

    "I'm so sorry to the Scott and Swearingin family," one juror said anonymously. "I'm really sorry because Emory didn't have the chance to you know, grow up with her mother."

    "As far as the Marks family, that's their father," the juror further explained. "I feel very bad for those boys. They won't necessarily have their father in their life."

    As the jury continues to reflect after nearly two months of gut-wrenching testimony, they say they are confident with their decision and commend Scott for speaking up.

    "Her story is sad in the end, but because she spoke out you know, five years ago now because she did that, Marks will never hurt another woman, guy, child, whoever ever again," Gauthier said. "It's because Jenna Scott spoke out and fought."

    "And what an amazing guy Michael Swearingin was to not allow Jenna to push him away, to say, 'No, you are my friend. I will be here as your friend I will be a safe space for you,'" Gauthier continued. "He just seemed like a big old teddy bear that cared so much about the people in his life, and that included Jenna. I'm glad she was able to at least have a caring person with her even in her final moments."
