    HARRIS COUNTY, Texas – The Harris County Sheriff's Office says a man has surrendered after five kids and three adults were found dead at a home late Saturday evening.

    Around 9 p.m. deputies were called to a home at 2211 Falling Oaks, not far from Veterans Memorial and Fallbrook Drive, to perform a welfare check.

    HCSO Spokesman Thomas Gilliland says when deputies arrived, no one responded at the front door. They then received more information that indicated a man in the home was wanted on a warrant for aggravated assault on a family member.

    The sergeant on the scene called for a High Risk Operations Unit, similar to SWAT, to help make entry and investigate. While the call was being placed, deputies surrounded the home, and they spotted the body of a juvenile through a window.

    At that point, the sergeant and three deputies forced their way in, and the 49-year-old male suspect inside began shooting, the sheriff's office says. Deputies pulled back and waited for the HROU and a negotiator to arrive.

    Authorities established contact with the suspect, and after more than an hour he came outside and surrendered without further incident.

    The bodies of eight people were found in the home, Gilliland said.

    "At this time we have what appears to be five children and three adults," said Gilliland. "Ages and genders we do not have, and cause of death we do not have. The medical examiner will have to determine a cause of death."

    It's not yet clear what the relationship was between the suspect and the victims, and a motive for the crime has not been determined.

    "Homicide detectives have taken over the operation along with our crime scene unit. Due to the amount of victims and the proximity to the people in the house, it'll be a scene that's going on for a while."

    "It's a hard job being a patrolman in this town, and our deputies do a yeoman's job every day, but when they're forced to see some of the most horrific things along this nature, especially of children, and someone so callous could do something like this to children - we have our family assistance coming out to talk to our deputies and help them decompress," said Gilliland.

    Suspect charged with capital murder in death of 6 children, 2 adults

    A 49-year-old man with a history of violence has been charged with multiple counts of capital murder in the deaths of five children and three adults whose bodies were found at a northwest Harris County home Saturday night.

    Deputy Thomas Gilliland, spokesman for the Harris County Sheriff's Office, identified David R. Conley III as the suspect in the case. Gilliland said the relationship between Conley and victims is unclear. Investigators are also still trying to determine how they were killed.

    Deputies responded to a welfare call around 9 p.m. in the 2100 block of Falling Oaks, near Veterans Memorial and Fallbrook Drive. Gilliland said deputies made repeated attempts to see if anyone would come to the door.

    They then learned that a male in the home had a warrant for an aggravated assault of a family member.

    Members of the High Risk Operation Unit were called to the scene to enter the home. While that call was placed, deputies surrounded the residence and checked through windows when they spotted the body of a juvenile inside.

    At that point, a sergeant and three deputies entered the home, and the suspect began shooting a weapon inside.

    The deputies pulled back, formed a perimeter and waited for the HROU team and hostage negotiators to arrive.

    Gilliland said the negotiators began communicating with the suspect and convinced him to come out. He was taken into custody without incident. Deputies then entered the home and found the bodies of the eight victims.

    The bodies are currently being taken for autopsies.

    Gilliland said their ages or genders were not known. Investigators are trying to determine if any of the victims were family members of the suspect. He said there have been previous calls for service at the home located on a quiet residential street off of Fallingbrook lined with well-maintained brick houses.

    Conley was arrested earlier this month for allegedly slamming the head of a woman into a refrigerator at the same Falling Oaks Drive address as where the bodies were discovered. Court papers state that on July he intentionally harmed Valerie Jackson, who he was dating at the time.

    The July attack began after Jacksons' 10-year-old son came in from the park after dark. Conley allegedly told her, "that if she did not discipline her son, he was going to do it himself," court records state. He then allegedly grabbed a belt, but Jackson took it from his hands. In the resulting scuffle, Conley pushed her head into the refrigerator multiple times.

    In 2013 he was convicted of assaulting Jackson, and got nine months in jail. In that case, she received an emergency protective order prohibiting Conley from contacting her.

    Conley also has a prior conviction in 2002 for felony retaliation and in 1994 for possession of a controlled substance, among many other charges.

    Alan Cartagena, 19, said he was at a barbecue at his girlfriend's nearby house just as deputies swarmed the scene Saturday night. His girlfriend's cousin, who was a friend of one of the boys who lived at the home, sent the boy a text message, asking if everything was OK. There was no reply, Cartagena said. He said deputies burst into their house and screamed at them to "stay inside!" He said they spent hours inside.

    Cartagena said the police refused to say what happened. "Are the kids OK?" they begged an officer. He kept walking, but shook his head sadly, Cartagena said. "That's when we knew," he said. "We were devastated."

    Enis Elshani, who has lived in the neighborhood since 2001, said that two of the boys were recently over for their son's birthday party.

    "You could see that they had problems," he said. "They never wanted to go home. They would feel much safer and much better here at my house than at their house."

    His wife, Vesa Elshani, had tears in her eyes when she learned the children were dead.

    "It's so hard. It's hard to believe," he said.

    A teacher from Sammons Elementary, where the children attended, stopped by the home. She didn't give her name, but said all the teachers at the school are concerned.

    "Everybody's shocked and everybody's hurt," she said with tears in her eyes.

    "They're good kids, very good kids. And so helpful. Very helpful. They're always sweet kid," she said. "I don't have anything negative to say about that family."

    Dalila Mercado, who has lived in the neighborhood for six years, said the area has had a history of robberies. Mercado said she was the victim of an attempted break-in at her home two years ago.

    She said Child Protective Services has been previously called to the house, and at least once seized custody of children living there. Mercado and other neighbors said the children could often be seen running around outside without supervision, the toddlers without diapers.

    "They were always having problems," said Mercado, who got home around 10 p.m. Saturday when she heard gunshots.

    Patrick Crimmins, a spokesman for Texas Department of Family and Protective Services, said a preliminary review has found previous CPS involvement with the family, and an internal review by the Office of Child Safety is under way "to evaluate any prior contacts with the family to ensure they were handled appropriately."

    The incident rekindled memories of the fatal shooting in July 2014 of six members of a Spring family, including four children and two adults, after an apparent domestic dispute.

    "It brings to mind a little over a year ago of the Stay family, where we went through this, an absolute tragedy, and again it's played out for Harris County citizens to endure this again," Gilliland said.

    He said counselors from the sheriff's office were coming out to talk to deputies and help them decompress.

    "It's hard job being a patrolman in this town," Gilliland said. "Our deputies do yeoman's job everyday. But when they are forced to see some of the most horrific things along this nature, especially of children, and someone so callous to do something like this to children."

    HARRIS COUNTY, Texas – David Conley has been charged with three counts of capital murder after eight people were found dead in a northwest Harris County home.

    One capital murder count covers multiple deaths. Another is for a person under 6 years of age, according to court records. He was being held Sunday in Harris County Jail. Bond has not yet been set.

    Man who authorities say killed 8 members of a Texas family set for court appearance


    HOUSTON – A man with a violent criminal history entered a Houston home through an unlocked window and fatally shot a woman he'd previously dated, her husband and six children, including a boy believed to be his own son, authorities said.

    David Conley, 48, is charged with capital murder in the deaths and is set to make his first court appearance Monday morning before a trial judge. Conley, who is being held in the Harris County Jail and doesn't yet have an attorney, didn't appear at a court hearing Sunday at which he was denied bond.

    The dead, who all shot in the head, were identified as parents Dewayne Jackson, 50; his wife, Valerie Jackson, 40; and their children Dewayne, 10; Honesty, 11; Caleb, 9; Trinity, 7; and Jonah, 6. Also killed was a 13-year-old, Nathaniel, who was believed to be Conley's son from the relationship with Valerie Jackson.

    According to Clopton, Jackson and Conley had a relationship, which ended, and "then (Dewayne Jackson) began a relationship with Valerie, which led to five children."

    That relationship ended and Conley and Valerie Jackson began another relationship, before breaking up again, Clopton said.

    Court records show Conley's criminal history dates back to at least 1988, with the most recent incident last month, when he was charged with assault after allegedly assaulting Valerie Jackson. The attack happened at the home where the bodies were found.

    Conley pushed Valerie Jackson's head against a refrigerator multiple times after she tried to stop him from disciplining her son with a belt, the documents alleged. The case was still pending.

    In 2013, Conley was charged with aggravated assault for threatening Jackson with a knife. He pleaded guilty and was sentenced to nine months in the county jail.

    In 2000, he was sentenced to five years in prison for retaliating against his then-girlfriend after she had filed an assault charge against him. It was unclear if that woman was Valerie Jackson.

    Authorities declined to comment on assault charges Conley had faced in the past or what prompted relatives to worry and request that deputies be sent to the home on Saturday.

    Loved ones mourn victims of deadly shooting in Harris County

    HARRIS COUNTY, Texas - A street that's usually filled with the sounds of children playing, is now painfully quiet.

    "They would play ball over here," said Kathy Sysongkim, a friend and neighbor. "They were good kids."

    The only sound that comes from 2211 Falling Oaks is gut wrenching sorrow and prayers to heal this community's shattered heart.

    "You killed the kids, why?" cried out Sysongkim. "Why? They didn't do anything."

    Eight innocent victims: Valerie Jackson, her husband Dwayne and six children, Nathaniel, 13, Honestly, 11, Dwayne Jr., 10, Caleb, 9, Trinity, 7, and Jonah, just six years old. Sysongkim says she's loved them all like they were her own.

    "It's not one or two, it's eight in the family," said Sysongkim. "It's terrible."

    It has been 24 hours since David Conley is accused of killing an entire family even his own son Nathaniel, and friends and complete strangers are turning the scene of a horrific crime into a beautiful memorial.

    Candles, stuffed animals and flowers, all tributes have been placed right next to the toys the victims played with not too long ago. Jaelen was friends with the oldest child victim, Nate.

    "He said his dad tried to beat him, sometimes he came home crying to us," Jaelen said.

    The neighborhood is now in tears and trying to understand why someone would do something like this to innocent children.

    "I don't know why it got so bad," said Sysongkim. "I cannot believe it."

    Man charged in killing of 8 appears in Houston courtroom

    HOUSTON – A mother held at gunpoint in her home northwest of Houston somehow managed to send her own mother a text message calling for help moments before her former boyfriend massacred her and her entire family, authorities said today.

    Valerie Jackson’s text message led sheriff’s deputies to drive to her house Saturday night, the district attorney revealed, but they apparently arrived too late to save the Jackson family.

    “My heart goes out to the mother who received the text from her daughter that she was in trouble,” said Devon Anderson, Harris County district attorney. “And the mother was many states away, but of course, did what any mother’s going to do, which is call 911.

    David Conley, the 50 year-old accused killer with a history of abusing the woman whose family he allegedly killed, stood stone-faced before a state district judge who outlined the charges that could send him to death row. Conley faces three capital murder charges in connection with the execution style killings of two adults and six children inside their northwest Harris County home.

    Conley used to live in the house where he allegedly killed his former girlfriend, her husband Dwayne Jackson, 50, Dwayne Jackson Jr., 10, Nathaniel Jackson, 13, Honesty Jackson, 11, Caleb Jackson, 9, Trinity Jackson, 7, and Jonah Jackson, 6.

    “He killed an entire family – a husband, a wife and their children,” said Alysia Harvey, the lead prosecutor in the case.

    In court, standing a short distance away from the accused killer, Harvey’s voice occasionally quavered as she described the crime and outlined the charges.

    “As a citizen of Harris County, as a mother, anytime you hear about anything that’s this heinous, anytime you hear about the death of this many children in a single event, it is hard,” she said. “And it’s, it’s hard.”

    Valerie Jackson’s text message to her mother and the subsequent 911 emergency call led deputies to the home in the 2200 block of Falling Oaks, authorities said. Conley was arrested after a standoff in which negotiators talked him into surrendering.

    Conley’s violent behavior apparently led the Jacksons to change the locks on their doors, investigators said, but they believe the accused killer crawled through a window on Saturday evening. At some point, the district attorney said, the mother of the house sent a text message calling for help. Authorities said Conley handcuffed the family and shot each of them execution style.

    Outside the Jackson family home, friends and neighbors have filled the porch with poignant tributes. Amid the flowers, cards, candles and stuffed animals sits a shoebox bearing a note that reads, “Here are the shoes you wanted, bro. I love and miss you.”

    Also sitting on the porch are two small bicycles, one of which was left at the makeshift memorial by a boy named Romello Broussard, a friend of 13-year-old Nathaniel Jackson.

    “Nate, he was a cool and fun guy to hang around,” Broussard said with tears in his eyes. “He never made no wrong decision.”

    Broussard remembered his friend walking away and going home when other boys tempted him to get into trouble.

    “And that’s the type he is,” Broussard said. “He’s a good student. He made good grades. He never got in trouble with the principal. The principal don’t even know his name.”

    The family’s trouble with the accused killer was no surprise, Broussard indicated, because Nathaniel often seemed upset.

    “He would come outside sad,” Broussard said. “I be asking him like, ‘Why are you sad?’ And he would be like, ‘Oh, my step daddy did this to my momma.’“

    Broussard said his family was out of town for the weekend when he started receiving text messages about the killings.

    “I got the text message this morning and I thought everybody was playing about him being dead,” he said. “That’s when everybody just start blowing up my phone, talking about he dead. And I just started crying right there.”

    A capital murder conviction in Texas calls for a sentence of either death or life in prison. Although prosecutors will probably spend months reaching a final decision on whether to pursue a death sentence, the district attorney bluntly told reporters outside the courtroom that “it seems like a no-brainer.”

    Murdered Houston Family Well Known to CPS

    The six children found murdered along with two adults in Houston over the weekend were no strangers to Texas Department of Family and Protective Services, which investigated at least four complaints about their care dating back 2011, and temporarily took the children into foster care two years later.

    "The Department believes that the children are in immediate danger," wrote agency caseworker Brittney James on Sept. 19, 2013 in an affidavit petitioning a Houston court for the removal of all six from their mother, Valerie Jackson.

    On Saturday, Harris County Sheriff's Office deputies discovered the children: Nathaniel Conley, 13; Dwayne Jackson Jr., 10; Honesty Jackson, 11; Caleb Jackson, 9; Jonah Jackson, 6; and Trinity Jackson, 7; along with their 40-year-old mother and father to all but the oldest, Dwayne Jackson, 50, fatally shot in their north Houston home.

    David Ray Conley, father of the oldest child, was charged Sunday with multiple counts of capital murder and held without bail.

    James' petition, obtained by The Texas Tribune, asked a court to remove the children stating that "reasonable efforts" had been made in the past to prevent the state from taking them into care. The final straw appears to be that Caleb, a child with brain damage, wandered from the home two months after Ms. Jackson signed an agreement with the state agency to keep the children safe.

    It was not the first agreement Ms. Jackson had signed with the agency as a promise to keep the children free from harm. And despite the four complete investigations into their care logged by the agency, caseworkers received "multiple complaints" about the children's care in addition to those four cases.

    The court approved James' request in the fall of 2013 and the children were taken into foster care but later returned home, apparently by March 2014, records show. It is not clear why.

    DFPS Spokesman Patrick Crimmins on Monday declined to elaborate on the family's history with the agency's Child Protective Services division, also known as CPS. Nor would he say the last time the children were seen alive by caseworkers.

    "It's confidential," he said.

    But a review of the 2013 petition by CPS to take the children into foster care paints a stormy home life in which Ms. Jackson was battling threats from both of her children's fathers.

    On Oct. 26, 2012, the agency was notified that Dwayne Jackson "threatened to kill" his girlfriend and all six children. CPS took "dispositions" on that complaint and others filed that month against the mother. "The mother would leave all the children at home alone multiple times," James' affidavit states. The agency caseworkers found they were "unable to determine" the validity of the complaints and referred the family to Family Based Safety Services, also known as FBSS, in January 2013.

    That division tries to work with families in trouble, getting them to sign agreements to keep children safe and submit to future monitoring by the agency. When FBSS takes over in January 2013, James entered as the family's caseworker.

    At the time, the family which included Conley, seemed amenable to working with the agency. "Valerie Jackson and David Conley were very cooperative at the assessment," James wrote. "Both stated they would comply with all recommendations given by the Department. "

    But three months later, there were serious problems. In April 2013, Jackson contacted James and told her that she called the police on Conley for "domestic abuse." She told her caseworker that Conley had "chased her with a knife and cut her finger." He was arrested.

    James' petition states that three of the children were considered by the agency to have "special needs." Jonah was diagnosed with a mild form of autism. Nathanial had attention deficit hyperactivity disorder, known as ADHD and was diagnosed with oppositional defiant disorder. Caleb, who had suffered brain damage, would wander from the family's home. One such disappearance prompted James to ask a state district court in Harris County to approve the removal of the children from Jackson.

    "Valerie Jackson searched the child on her own," the caseworker wrote. "But she eventually had to call law enforcement for assistance."

    Caleb was eventually found by police in a park across the family's subdivision.

    The petition was approved and the children taken into foster care.

    The previous complaints investigated by CPS included:

    On Dec. 23, 2011, DFPS received a report of possible physical abuse of three Jackson children: Caleb, Trinity and Jonah. The case was "ruled out with no significant factors found."

    On Oct. 17, 2012, DFPS received a report of possible physical abuse of Nathaniel Conley and his four stepsiblings: Dwayne, Jonah, Caleb and Trinity. DFPS ruled the case "unable to determine."

    On Oct. 22, 2012 — five days after DFPS was contacted about possible physical abuse of five of the children — the agency was contacted again about possible neglectful supervision with the same five children.

    On July 29, 2013, the agency received a report of possible neglectful supervision of Caleb Jackson. Neglect was "ruled out" by the agency.

    On July 30, 2013, James went to the Jackson home and wrote a new child safety agreement for the mother to sign. The plan anticipated problems because Conley was about to be released from the Harris County Jail after Jackson recanted her accusation she had been abused and the case was dismissed.

    Two months after Ms. Jackson signed the agreement, however, Caleb went missing again, prompting James to return to court and asked that the children be placed in foster care.

    David Conley charged with capital murder after 8 found dead inside home

    HARRIS COUNTY, Texas - Channel 2 Investigates has learned through police sources that the man accused of killing eight people over the weekend spent nearly 14 hours in the house.

    Much of that time was spent terrorizing the adults and children who later died, and many of the victims whom were bound by handcuffs, one source said.

    During much of the unimaginable ordeal, Valerie Jackson, mother to the children, was writing secret messages via text and Facebook begging for family members to get help, another police source told KPRC's Joel Eisenbaum.

    It is not yet clear why three visits to the northwest Harris County home, where the tragedy unfolded over the course of eight hours did not lead to a faster discovery of the situation.

    Channel 2 Investigates learned Monday that Harris County Sheriff's Office deputies visited the house around the following times: 12:30 p.m., 5 p.m. and 8:30 p.m.

    During the first two visits, there were no outward appearances of trouble, according to one source.

    "They just didn't have enough to go inside. They made a decision," the source said.

    Another police source said that patrol deputies during one of the visits heard a deadbolt lock turn on the front door, but nobody would respond from inside.

    Channel 2 Investigates pieced together the following timeline from the two police sources with knowledge of the scene and the follow-up investigation:

    • Saturday, 10:15 a.m. -- Valerie Jackson sends 'Help!' text to mother in Minnesota.
    • Saturday, 12:30 p.m. -- HCSO visit No. 1.
    • Saturday, 5 p.m. -- HCSO visit No. 2.
    • Saturday, 8:30 p.m. -- HCSO visit No. 3. Deputies make entry, gunfire.
    • Sunday, 12:15 a.m. -- Suspect surrenders.

    Total = 14 hours

    A neighbor's surveillance cameras caught deputies with guns drawn entering the home.


    A police source said Conley bought the gun online within the last two weeks.

    Conley appeared in court Monday morning for the first time. He said nothing and showed no emotion.

    Despite the nature of the crimes, prosecutors said they are still unsure about the possibility of the death penalty.

    Houston mass killing suspect: My kids 'were growing up to be monsters'

    David Ray Conley gave his first jailhouse interview to a local TV station Tuesday. The 48-year-old man – who is accused of killing his ex-girlfriend, her husband and six children Saturday – said his kids “were growing up to be monsters.”

    Conley, who faces three counts of capital murder, spoke to local TV station KTRK on Tuesday. He said that he and former girlfriend Valerie Jackson had an on and off relationship over the course of 14 years. But when he saw how his kids were growing up, he began planning the family’s murder.

    "They were growing up to be monsters,” Conley told KTRK reporter Jessica Willey. “I'm not saying I killed them because of that. I'm not even saying I killed. They were growing up to be monsters."

    Nathaniel, Conley’s 13 year-old son, was one of the shooting victims. Conley said he loved his son to death, but that he didn’t like the way his son or the family treated him.

    “Nate didn’t give me any respect because of what his mother was doing to me,” Conley told the local ABC affiliate. “She ignored me.”

    The TV station said he cried as he spoke about "years of frustration" and living as an ex-felon. The suspect would not go into details about what occurred Saturday.

    Officials for the Department of Family Protective Services said Tuesday that the state in 2013 briefly took custody of the family's six children. But a family court judge ruled the kids should go back with their parents in Falling Oaks.

    DFPS officials had warned the children were in "immediate danger," according to an affidavit.

    Jailhouse interview: David Conley says 'I'm only human'

    HOUSTON – Cameras aren’t allowed inside the room where David Conley and I talked.

    For a man accused of killing eight people, including his own son, he seemed very calm—he was poised and polite. He kept saying, "I’m only human."

    His attorney advised him not to discuss the events of Aug. 8, the night police said he tied up his ex-girlfriend, her husband and six children and killed them all.

    Conley said he had been living with his ex-girlfriend Valerie Jackson in the 2200 block of Falling Oaks Drive in northwest Harris County for some time, and that her husband was out of the picture. But, he said, the two started having problems, so he moved out and that’s when her husband moved back in.

    When he found out, he said he was in shock.

    Conley added, too, that his son, Nathaniel, had become a problem child. Conley described his 13-year-old son as disrespectful, and said Valerie, whom was the boy’s mother, wouldn’t allow him to discipline the boy.

    He then admitted he was at a breaking point, and admits he was in the home the night of the murders.

    I asked if he had a gun. He said he wasn’t allowed to own any.

    I asked him if her murdered the eight people or if he thought his son was in a better place now.

    Without admitting anything, he made a chilling statement, altering a well-known scripture from the Bible.

    “Thou shall honor your mother and father or your days are short,” he said.

    Conley broke down crying at the end of the interview saying he prays constantly and is so sad so many people died.

    He's due back in court Sept. 15.
