    INDIO, Calif. - A quadruple homicide suspect was in the car with three of his victims the night of their alleged murders, according to the suspect's defense attorney.

    19-year-old Jose Larin Garcia appeared in court at the Larson Justice Center in Indio today for a felony settlement conference. His attorney, John Patrick Dolan, spoke with News Channel 3's Jeremy Chen and provided more details about the night of the alleged quadruple homicide.

    Larin Garcia is charged with four counts of murder in connection with the shooting deaths of 19-year-old Jacob Montgomery of Cathedral City, 18-year-old Juan Duarte-Raya of Cathedral City, and 17-year-old Yuliana Garcia of Thousand Palms, and 25-year-old Carlos Campos Rivera of Desert Hot Springs.

    Larin-Garcia reportedly had a friendship with Jacob Montgomery, according to Dolan.

    Larin-Garcia was arrested on February 4 at 7:48 p.m. at the Greyhound station in Indio.

    “He was arrested the night of February 4th at the Greyhound station after we developed probable cause to believe he was in possession of a high capacity magazine and that’s what he was arrested for and sent to the Indio County Jail for,” said Sergeant Michael Casavan of the Palm Springs Police Department.

    Larin-Garcia pleaded not guilty to all charges last week. He is being held without bail and is set to appear in court Friday for a preliminary hearing.

    At 11:40 p.m on February 3, an accident was reported near the intersection of Sunny Dunes Road and El Placer Road in Palm Springs. The driver and two passengers died at the scene. Shortly after the accident was reported, PSPD received a call of a body in the road at 12:15 a.m on Canon Drive south of Theresa Drive.

    All victims suffered from gunshot wounds.

    Montgomery, Garcia, and Duarte-Raya died at the crash scene, and Campos-Rivera's body was found on Canon Drive.

    A 19-year-old man suspected in the fatal shooting of four people in Palm Springs was ordered Thursday to stand trial on murder charges, authorities said.

    Jose Larin-Garcia, of Cathedral City, was charged with four counts of murder Feb. 6, days after police found the bodies of the four victims, according to the Riverside County District Attorney’s Office. Larin-Garcia is also charged with a special circumstance allegation of lying in wait, which makes him eligible for the death penalty.

    Dist. Atty. Mike Hestrin will decide whether to pursue capital punishment in the case, said John Hall, a spokesman for the district attorney’s office.

    Palm Springs police responded to a report of a crash on the night of Feb. 2 near the intersection of Sunny Dunes Road and El Placer Road, authorities said. When officers arrived at the scene, they found three of the victims, Jacob Montgomery, 19, Duarte Raya, 18, and Juliana Garcia, 17, inside the car. All had been shot in the head.

    A short time later, police received another call of a man lying in the middle of the road about a mile from the first crime scene, police said. Carlos Campos Rivera, 25, also died of gunshot wounds.

    “We cannot recall the last time we had four homicide victims” in Palm Springs, Police Chief Bryan Reyes said at a news conference after the shootings.

    Larin-Garcia was arrested two days after the killings on unrelated charges at an Indio Greyhound bus station, according to inmate records. Past charges against Larin-Garcia include two misdemeanor DUI offenses.

    At a preliminary hearing, Palm Springs Police Det. Barron Lane testified that Larin-Garcia had a bus ticket to Tampa, Fla., when he was arrested at the bus station, according to the Desert Sun. Larin-Garcia had shaved his head and beard.

    Police have not determined a motive in the case.

    The suspect in last month's quadruple homicides in Palm Springs will undergo a psychiatric evaluation, a Riverside County judge ordered Thursday morning during a pre-trial appearance at the Larson Justice Center in Indio.

    Also, the judge set an Aug. 2 trial date for 19-year-old Jose Larin-Garcia, who has pleaded not guilty to multiple offenses including four counts of first-degree murder. He is being detained at the Cois M. Byrd Detention Facility in Murrieta.

    "Bail remains at no bail," Superior Court Judge Charles Stafford said.

    Larin-Garcia's appearance Thursday happened very quickly as it was an information arraignment, a procedural pre-trial proceeding that usually follows a preliminary hearing, once a judge has decided there is enough evidence in a case to send a suspect on to trial.

    Prosecutors and Larin-Garcia's defense attorney, John Patrick Dolan, could not comment Thursday because of a gag order.

    Larin-Garcia is accused of killing three teens and an adult male.

    Shortly after 11:30 p.m. Feb. 3, Palm Springs police found the bodies of the teens, who had been shot-to-death, inside a crashed Toyota Corolla at Sunny Dunes and El Placer roads. The fourth victim, who had also been fatally shot, was found a half-mile away outside his residence at Theresa and Canon drives.

    The teens were identified as Yuliana Garcia, 17, Juan Duarte Raya, 18, and Jacob Montgomery, 19. The adult victim was Carlos Campos, 25. Each victim had been shot in the head.

    Prosecutors said the killings may have involved an attempted robbery at Campos' apartment building, which is where his body was discovered. But they conceded during last month's preliminary hearing that a motive for the killings hadn't been determined.

    Police found Larin-Garcia hiding under a pickup truck just a few blocks from the Toyota, which had collided with a Jeep at Sunny Dunes and El Placer roads. Paramedics took him to Desert Regional Medical Center in Palm Springs, but he left about 3:30 a.m.on Feb. 4 without telling anyone, according to court testimony.

    Investigators testified during the preliminary hearing that Larin-Garcia went to a Palm Springs home where he stayed on numerous occasions over the past two years.

    It's the home of Joseph Beaver, 51, who said he occasionally helps troubled youth get back on their feet and improve their lives.

    According to officers, Beaver retrieved Larin-Garcia's clothing from his home in Cathedral City and purchased bandages and a bus ticket to Tampa, Fla., for the suspect, who only told Beaver he was in trouble after getting in a traffic collision.

    Authorities later took Larin-Garcia into custody at the Indio Greyhound Station on Indio Boulevard the evening of Feb. 4. They never said how they tracked him to Indio.

    During the preliminary hearing, an official testified undercover officers interviewed Larin-Garcia while he was in custody at the Larry D. Smith Correctional Facility in Banning.

    "He told our agents that he was screwed and was concerned that his mother might be charged," Riverside County sheriff’s Investigator Jarred Bishop testified.

    Bishop added Larin-Garcia said there were potential witnesses who could identify him and he believed law enforcement had found a gun.

    Palm Springs police said no gun has been recovered.

    Prosecutors will seek the death penalty in the criminal case against Jose Larin-Garcia, 20, of Cathedral City who is charged with murder in connection with four killings in Palm Springs last February, officials say.

    Riverside County District Attorney Mike Hestrin decided to seek the death penalty for Larin-Garcia on Feb. 20, 2020, a department spokesperson said, weeks after the one-year anniversary of the shooting deaths.

    A representative from Larin-Garcia's defense attorney declined to comment on the announcement.

    John Hall, a spokesperson for the district attorney, said that Hestrin makes the decision to seek the death penalty after a meeting with the prosecutors assigned to the case, executive management from the office, and the detectives from the law enforcement agency investigating the case. Hestrin also invites the defense attorney to present to him their case for why the death penalty should not be sought. Hestrin also meets with the family of the victims to seek their input.

    Montgomery's mother, Dana Beauchemin, lives in Montana and said efforts to get her mind off her son's murder are futile even one year later.

    "It all goes back to Jacob," she said. "It hurts. It'll probably hurt forever."

    Beauchemin said the entire month of February haunts her, since it took about 20 days for her son to be laid to rest. She still wonders why the victims were killed and whatever happened to the gun used in the killings.

    "It's tormenting, then I just have to think it's not my job to figure out what happened," she said.

    Larin-Garcia had a trial readiness conference scheduled for Monday, but it was delayed to Thursday.

    The alleged shooter in last year's Palm Springs quadruple homicide made a brief appearance in court Thursday before discussions were continued to March 4 because a courtroom wasn't available.

    Jose Larin-Garcia, 20, requires his own judge and courtroom for all court appearances now that Riverside County District Attorney Mike Hestrin has decided to pursue the death penalty, Deputy District Attorney Josh Hill said Thursday.

    Until now, Larin-Garcia's hearings have taken place in Larson Justice Center courtrooms where there are other defendants awaiting proceedings in their unrelated cases. Several were present Thursday.

    Court records show trial in this case may begin as early as March 30, but specific details aren't available outside the courtroom because all parties are under a gag order, which was put in place soon after Larin-Garcia was charged last year.

    Thursday's trial readiness conference had originally been set for Monday at the Larson Justice Center in Indio, but was switched to Thursday. It wasn't clear if the delay was related to the prosecutor's decision to seek death if there is a guilty verdict.

    Representatives from Larin-Garcia's defense team declined to comment.

    Thursday's brief proceedings came 13 months after a Palm Springs neighborhood was rocked by four fatal shootings, authorities say occurred within moments of each other.

    Shortly after 11:30 p.m. Feb. 3, 2019, Palm Springs police found the bodies of three teens inside a crashed Toyota Corolla at Sunny Dunes and El Placer roads.     "Law enforcement agents were placed inside the cell," Bishop testified. "He told our agents that he was screwed and was concerned that his mother might be charged."

    Palm Springs police said they have yet to find the gun used in the killings.

    Larin-Garcia has pleaded not guilty to multiple offenses including four counts of first-degree murder. He is detained without bail at the Riverside County Jail in Indio, according to jail records.

    Riverside County Superior Court Judge Burke Strunsky on Wednesday ordered Larin-Garcia to return to the new courtroom at the Larson Justice Center in Indio on April 3 for a trial-readiness conference, when a future trial start date could be announced.

    The trial must start on or before June 12, Strunsky said.

    The Riverside County District Attorney’s Office announced in late February that prosecutors would be seeking a death sentence. Larin-Garcia remains in custody at the Indio jail without bail.

    According to prosecutors, three of the victims were found inside a Toyota Corolla that crashed at Sunny Dunes and El Placer roads around 11:40 p.m. that night, while the fourth was found 30 minutes later lying in the street about a half-mile away.

    A trial date was tentatively set Wednesday for mid-September for a Cathedral City man facing a possible death sentence for allegedly fatally shooting four people in Palm Springs more than two years ago.

    Jose Larin-Garcia, 21, is charged with four counts of murder stemming from the February 2019 shootings in which the victims, ages 17 to 25, were found dead at two separate locations. He also faces a special-circumstance allegation of committing multiple murders, opening him to the possible death sentence if convicted.

    During a status conference scheduled last-minute at the Larson Justice Center in Indio, Riverside County Superior Court Judge Anthony Villalobos conferred with the prosecution and defense about scheduling in the trial, and all sides agreed to begin the jury selection process on Sept. 13.

    Villalobos said a total of 800 prospective jurors were expected to shuffle in and out of the courtroom for eight days.

    Both sides will appear again in court again on Aug. 12 where the trial timeline will be finalized.

    Larin-Garcia remains in custody at the John Benoit Detention Center in Indio without bail.

    Man Accused of 4 Deaths Requests to be Housed Closer to Riverside Superior Court During Trial

    Jose Larin-Garcia, 21, faces death penalty for the alleged murder of 4 victims in Palm Springs, and at his trial here in Riverside County Superior Court Friday, his defense counsel asked the court if Larin-Garcia could be housed in Indio so he does not have to wake up at 2 a.m. to go to court.

    In February of 2019, Palm Springs police found 3 of the victims shot in the head inside a crashed car. After a few hours, a man was also found dead with gunshot wounds about a mile from Larin-Garcia’s location.

    2 days after the fatal murders Larin-Garcia was arrested and charged with death penalty.

    Defense Counsel John Patrick Dolan argued that his client is being unfairly treated because Larin-Garcia has to travel so far to get to court.

    “There’s a danger he might fall asleep (in the trial),” the attorney said, because Larin-Garcia wakes up at 2 a.m. or 3 a.m. to be in court. Defense Counsel Dolan further said that being tired in court does not look good in front of the jury.

    But Deputy District Attorney Samantha Paixao said that Larin-Garcia can take a break if he is exhausted.

    The decision of his housing depends on his behavior both in court and in jail. But the DDA said Larin-Garcia has had three incidents with law enforcement, including alleged attacks on law enforcement officer, and escape attempts.

    Larin-Garcia also attempted to flee the state after the quadruple homicide, she said.

    DDA Paixao also pointed out 2 safety concerns, including having Larin-Garcia unshackled. She stated that it is not only important keep the attorneys safe, but the jurors and civilians as well. She requested more deputies in the courtroom.

    The judge responded that Larin-Garcia has had exemplary behavior in the courtroom, and there has been no issues with him being unshackled.

    The judge approved future hearings for Larin-Garcia to have a leg bracelet that prevents him from having full leg mobility, and the courtroom will have two deputies.

    The 2nd concern from DDA Paixao is the mother of Larin-Garcia in the courtroom. She claims she observed a note being passed from the mother to defense counsel and then to Larin-Garcia.

    “It is a direct violation of the code,” said DDA Paixao.

    The judge stated that he was aware of the note, which said, reportedly, “I love you.” The judge said, “as long as the counsel sees it, and it says I love you from his mom, I really don’t think that’s an issue at all…We are all humans here; it is not her fault that her son is here in quadruple homicide.”

    Moreover, Defense Counsel Dolan pointed out that “this is a death penalty, he [Larin-Garcia] is fighting for his life so I think is very important that we can find a resolution to this.”

    The next hearing will take place Tuesday Oct. 12.
