Judge Siracusa's ruling on the matter will be on May 1st. If DeSantis will sign a death warrant for Dailey in the first half of May, we can see Dailey executed in mid July/August, and after that maybe Rogers in October and Jennings in December like Jimenez. We'll see.

This case has dragged on for far too long. Desantis should just sign a warrant for him and execute him now. At this point, its better to let Jennings die of old age. Hes been on death row for 40 years which is a joke.

Given that Jennings is only 61, he's still probably a far cry from croaking of old age
Violence and death seem to be the only answers that people understand.

Judge denies motion for James Dailey to avoid death penalty

He was convicted of the 1985 murder of Shelly Boggio in Pinellas County

    By 10 Tampa Bay News

PINELLAS COUNTY, Fla. The conviction and death penalty will stand in the case of James Dailey.

A judge has denied his motion to avoid the death penalty.

Back in September, Gov. Ron DeSantis signed a death warrant for the 73-year-old. The execution was originally set for Nov. 7 at Florida State Prison. But, it was delayed as the courts considered new motions.

Dailey was convicted of the 1985 murder of Shelly Boggio in Pinellas County. Investigators say Dailey and two other men met Boggio and her twin sister when the girls were hitchhiking near St. Petersburg. After a night of barhopping, Dailey and one of the other men, Jack Pearcy, 64, took Boggio to a deserted fishing area.

Boggio's nude body was later found in the water.

Dailey's defense teams have claimed he might be innocent of the murder.

Pearcy was also convicted of murder and sentenced to life in prison. He told detectives that Dailey stabbed Boggio and held her down in the water. Court documents say Boggio was beaten, choked, stabbed 31 times and held underwater until she drowned.

Dailey was convicted largely on testimony from three jailhouse informants, who claimed Dailey shared graphic details of the murder. No physical evidence of eyewitness testimony linked Dailey to the crime.

Dailey's legal teams have filed numerous appeals over the decades since, and the case has been tried twice with two different juries recommending the death penalty.

If Ruben Gutierrez is executed June 16 in Texas, this should be an eye-opener for Florida and Gov. DeSantis to reschedule an execution date for Dailey. The US Supreme Court is Dailey's last avenue to avoid his death sentence.

Pinellas-Pasco Circuit Judge Pat Siracusa concluded in an order issued Friday May 29, that there is no new admissible evidence to warrant a new trial. It is unclear what will happen next.

Dailey, 73, still has an appeal pending before the U.S. Supreme Court. No new execution date has been set.

This guy got literally another a whole year of wasted time with that ridiculous stay. That same judge that stayed Dailey back then literally rejected the claims that were brought to him.

Once he’s denied Cert then this will probably be the only execution under DeSantis this year. All the people who exhausted appeals and he chose this guy.

Welcome to the pointlessness of death penalty appeals.
