    Floyd William Damren - Florida Death Row




    Summary of Offense:

    Floyd Damren entered the grounds of R.G.C. Mineral Sands and stole equipment, telling a friend that “There [is] … some more good stuff down there I’d like to get.” Several weeks later, on May 1, 1994, after drinking beer with friends, Damren returned with an accomplice, Jeff Chittam, to steal more equipment. The two burglarized the electrical shop in the maintenance barn. Chittam was discovered by an employee, Don Miller, but Damren sneaked up behind Miller and struck him with a steel pipe. Miller and Chittam both pleaded for Damren to spare Miller’s life, but after pacing the floor, Damren bludgeoned Miller to death with the steel pipe, striking him seven times on the head and four times on the body. As Damren was dragging Miller’s body across the floor, Michael Knight, the shift supervisor, entered the building and yelled at Damren. Knight was acquainted with Damren due to the fact that he had lived in Knight’s neighborhood since childhood. Damren threatened Knight with the pipe, and Knight ran yelling from the building. Knight identified Damren to the police and Damren was arrested. Further evidence linking Damren to the crime included testimony from several witnesses that Damren made incriminating statements to them about the murder. Also, blood stains on Damren’s pants matched Miller’s blood.

    Damren was sentenced to death in Clay County on June 2, 1995.

    Co-defendant information:
    Chittam was not charged and did not testify at trial. He was the victim of a separate homicide, for which Damren was also charged, convicted, and sentenced to a term of life imprisonment.

    On July 8, 2010, the Eleventh Circuit vacated an order dismissing Damren's petition and remanded the case back to district court.

    On September 24, 2013, Damren's habeas petition was DENIED on remand in Federal District Court.

    This guy looks pretty old...they should schedule him for execution quickly or he's going to be another one who dies of natural causes in jail.

    On October 29, 2013, Damren filed an appeal before the US Court of Appeals for the Eleventh Circuit.

    Court: 11th Circuit Court of Appeals

    Petitioner, convicted of murder and sentenced to death, appealed the dismissal of his 28 U.S.C. 2254 petition for a writ of habeas corpus, arguing that the limitations period equitably tolled because his untimely filing was due to his attorney's failure to ascertain the deadline by which his petition was due. The court concluded that petitioner's attorney's incomplete and inadequate attempts to ascertain the deadline constituted negligence, but did not rise to the level of "extraordinary circumstances" as to merit equitable tolling. Accordingly, the court affirmed the district court's dismissal of the petition as time-barred.

    What are the chances this getting bounced back since SCOTUS is seemingly more liberal and less strict in letting cases end due to missed filing deadlines?

    Not that it really matters......this guy has to be at least 70+ anyway........

    In today's orders, the United States Supreme Court declined to review Damren petition for certiorari.

    Appeals exhausted decision could result in an execution date.
