Francisco Montez and Genaro Rivera Indicted for Capital Murder in 2023 TX Slaying of 52-Year-Old David Ruback

2 arrests made in deadly shooting of Dallas security guard

    By Fox 4 News Staff

DALLAS - Police say they have arrested two men accused of shooting and killing a security guard in Old East Dallas.

24-year-old Francisco Montez and 21-year-old Genaro Rivera have been charged with capital murder in the shooting of David Ruback on Sept. 1.

Montez's arrest was announced Wednesday morning. Rivera's was announced hours later on Wednesday afternoon.

Surveillance footage released by Dallas police last month shows a white sedan with two masked suspects inside pull up outside Big Jim's Check Cashing Store on Carroll Avenue.

Ruback, 52, was standing at the back of a van getting ready to deliver cash to the store.

The video shows both suspects dressed in all black hop out of the car, the passenger has a rifle.

The shooting happens outside of the camera's view, but it does show a gunman running off with a bag of cash.

Ruback worked as a security guard at Gardaworld for more than 20 years.

Ruback's girlfriend Terry Ball spoke with FOX 4 after the arrest.

"Every day has been a struggle since he died. I've cried every day," she said.

Ball says she is "so glad" that an arrest has been made.

She was worried that as time passed there would never be an arrest.

"There's some relief there hope that maybe we'll have justice in this, but it still doesn't bring him back," Ball said. "That's the hard part. That he doesn't get to come home when this is over."

Ball said there is something she'd like to say the suspects.

"Why would you think that it is okay to take a life over a bag of money?" she said. "It's not just his life that you took. You took a life away from me. You took my future. You took a life away from his friends, from his family. You took that from all of us."

Police are asking anymore with information about the case to give them a call.

Suspect cased Dallas check-cashing business before fatal armored-car heist, per affidavit

Francisco Montez, 24, and Genaro Rivera, 21, each face a capital murder charge in connection with the deadly Sept. 1 robbery

    Dallas Morning News

An arrest-warrant affidavit for the man accused of being the getaway driver in the deadly armored-car heist last month revealed how surveillance footage, mobile phone data and a traffic stop led authorities to the suspects.

On the morning of Sept. 1, David Ruback, a 52-year-old guard, was gunned down while making a cash delivery at a check cashing business in the 100 block of South Carroll Avenue, according to police. He later died at a hospital, police said.

Surveillance-camera images released by police showed two armed men, each wearing gloves, black clothing and masks, arriving in a white Chevrolet Impala. The fatal robbery lasted less than a minute, according to video shared by authorities.

Last week, Dallas police announced they had arrested the gunman and the getaway driver involved in the heist — Francisco Montez, 24, and Genaro Rivera, 21. Both face a capital murder charge in connection with the deadly robbery.

On Sept. 27, a car that matched the suspect vehicle description from the robbery was spotted in a city-operated surveillance camera, the affidavit stated. The license plate of the vehicle matched that of Montez, who had reported to The Colony police in April that a gun was stolen out of his Impala.

Authorities started to watch the address associated with the white Impala, and also found a white Nissan Sentra at the location, the affidavit stated.

About three weeks ago, police obtained warrants for data on mobile phones believed to have been used by Montez, according to the affidavit.

Investigators believe the data obtained showed that Montez was ”in close proximity” to where the heist occurred about a week before the incident.

Surveillance footage from Aug. 25 showed Montez, in a white Nissan believed to belong to his girlfriend, stopped in a parking lot near a business owned by a family member, police said in the affidavit. The car was “positioned directly across the street from Big Jim’s Check Cashing during the GardaWorld delivery and departs shortly after the delivery is completed.”

Police say that timeline was nearly identical to the heist one week later.

Rivera, whom police believe was the driver in the heist, was arrested Oct. 12 following a traffic stop in Rowlett for an expired temporary license plate, the affidavit stated.

The officer who conducted the stop learned that Rivera had an outstanding warrant on an unrelated crime and arrested him, according to the affidavit. Inside the vehicle, officers found a stolen gun, two phones, a ski mask, gloves, ammunition and about $20,000 in cash, the document stated.

Data collected from one of the phones confiscated following Rivera’s arrest showed that he and Montez communicated about ”hitting a lick,” meaning committing a robbery, the affidavit stated. Investigators also confirmed that some of the bills found in Montez’ vehicle matched money stolen during the Sept. 1 robbery, according to the affidavit.

Two men indicted for Capital Murder in September shooting death of armored car guard

    By NewsRadio 1080 KRLD

Two Capital Murder indictments have been handed down in the September shooting death of an armored car guard.

On September 1, a Garda armored car was making a delivery to the Big Jim's check cashing shop in the 100 block of South Carroll.

As 52-year-old guard David Ruback was about to go in the back door of the business with a cash delivery, the guard was ambushed.

Police say 24-year-old Francisco Montez and 24-year-old Genaro Rivera had staked out the store. Security video shows one man armed with a rifle attacking Ruback, then running to a waiting car with a bag of cash.

Ruback did not survive the attack.

Both Rivera and Montez face possible death penalty trials. Both are being held on more than $2 million bonds.
