    Gov. Greg Abbott accepted the resignation of District Attorney Yvonne Rosales on Friday, clearing the way for him to appoint a successor.

    “I hereby accept your letter of resignation as the District Attorney for the 34th Judicial District, Culberson, Hudspeth and El Paso Counties,” Abbott wrote.

    Rosales sent her resignation letter to Abbott on Thursday, the same day she invoked her Fifth Amendment rights against self-incrimination in a court hearing that was examining possible abuses by the district attorney and her associates.

    Her attorney, Richard Román, entered the letters of resignation and acceptance in the court record of the capital murder case of the gunman accused of murdering 23 people and wounding 22 others at an El Paso Walmart in 2019. Rosales’ handling of that case was at the heart of months of controversy, including a court petition to remove her from office.

    The filing by Román also quoted Psalm 34: “When the righteous cry out for help, the Lord hears, and he delivers them out of all their troubles. The Lord is near to those who have a broken heart and will save those with a crushed spirit. For many are the afflictions of the righteous, but the Lord will rescue the righteous, all of you, from those afflictions.”

    The statement concluded with this comment: “It is our sincere hope and prayer that the Lord has heard your cries for help, and your time for healing can finally begin.”

    Rosales announced her resignation on Monday, effective Dec. 14. That ended a court petition that could have led to her removal from office on grounds of incompetency and official misconduct.

    Abbott will appoint an attorney to finish the final two years of Rosales’ term.

    El Paso Walmart shooting case gets new district attorney

    EL PASO, Texas (AP) — Texas Gov. Greg Abbott on Wednesday named a new El Paso district attorney after the previous one resigned under mounting pressure over the handling of the 2019 Walmart attack that left 23 people dead and has yet to go to trial.

    Abbott said Bill Hicks, a former judge and prosecutor, would "restore confidence" in El Paso after county officials last month took the extraordinary step of seeking to remove their elected district attorney. The Walmart shooting has put the office under scrutiny as the suspected gunman, Patrick Crusius, faces the death penalty if convicted.

    Yvonne Rosales, a Democrat, resigned as her job came under jeopardy over accusations of incompetence involving hundreds of cases in El Paso and slowing down the case against Crusius, who has pleaded not guilty.

    El Paso County Attorney Jo Anne Bernal, whose office sought to remove Rosales, said prosecutors "could not even tell the court what work had been done" recently when it came to the Walmart shooting.

    Crusius was arrested soon after the Aug. 3, 2019, shooting. Police later said he confessed to driving to the border city from his home near Dallas to target Mexicans. Soon before the attack, he posted a racist screed online that railed against Hispanics coming to the U.S., according to prosecutors.

    Death Penalty Deadline: The U.S. Attorney’s Office has until Tuesday to decide if federal prosecutors will seek the death penalty for Patrick Crusius, the man charged with killing 23 people during the Aug. 3, 2019, mass shooting at an El Paso Walmart.

    By enforcing the Tuesday notice deadline for a decision, the federal judge said attorneys will still have sufficient time to prepare for the trial that is set to start Jan. 8, 2024.

    Within a week after the federal prosecutors make a decision on the death penalty, state prosecutors are expected to meet with the state judge to talk about deadlines and a possible trial date.

    That's actually better. A death sentence in Texas is far more likely to be carried out.

    As we've seen with Hanson feds definitely won't hand him over here if he's facing death. Won't ever get executed anyway.
