    Huntsville shooting suspect confesses, charged with capital murder

    Police on Monday gave more details into the Friday shooting death of a Huntsville woman and said that the suspect, captured Sunday in Tennessee, will be charged with capital murder.

    Warren Hardy, 27, is in custody in Marion County in Tennessee awaiting extradition to Huntsville. During an interview with Huntsville police investigators on Sunday, Hardy confessed to the crime spree, police said.

    According to police, the shooting death of Kathleen Lundy, 72, occurred as Hardy stole her car to pursue his ex-girlfriend.

    When Hardy was confronted by police in Tennessee, he pulled a handgun. But the magazine in the gun apparently fell out in the car and the gun was not loaded.

    Here is the account provided by Huntsville police:

    "The shooting happened after a series of events that started on Bailey Cove Road (in southeast Huntsville). Hardy kidnapped his ex-girlfriend's daughter and stepfather from her Bailey Cove Road apartment and forced them to drive to a home on Morland Pointe in an effort to locate the ex-girlfriend. Once at the Morland Pointe home, Hardy forced the ex-girlfriend into the car at gunpoint, but before Hardy could get back in the car, the stepfather was able to drive away.

    "Hardy began walking down the street where he encountered 72-year-old Kathleen Lundy, who was exiting the front door of her residence. Hardy demanded her car keys and shot her before driving away in her car. Hardy was able to catch up to the car carrying his ex-girlfriend as well as her daughter and step-father. He fired multiple shots into the vehicle before they were able to get away uninjured.

    "Later that evening Mrs. Lundy's vehicle was found abandoned in an area close to the ex-girlfriend's apartment. It is believed that (Hardy) got back into his own vehicle and fled the area. Investigators knew that the ex-girlfriend had family members in the area of Jasper, Tennessee, and alerted local law enforcement in that area. A neighbor of the family member in Tennessee spotted Hardy and police. After a short vehicle pursuit Hardy was taken into custody. Huntsville Police investigators traveled to the Marion County, Tennessee jail on Sunday afternoon and interviewed Hardy who confessed to his involvement in the crime spree."

    Six death penalty cases pending in Madison County

    HUNTSVILLE, Ala. -- Six potential death penalty cases await their day in court in Madison County.

    At least half of them are to go before a judge in the next 12 months, but prosecutors say the time needed to prepare for those will push other death penalty cases down the road.

    The first death penalty case on the 2020 calendar involves Warren Hardy. He is charged with killing 72-year-old Kathleen Lundy, of Huntsville, during a crime spree.

    The Huntsville Police Department said the crime spree included an attempted kidnapping and a carjacking before Hardy approached Lundy outside her home.

    “He walks up and asks for the keys and then shot her and killed her before taking off in her car,” Huntsville Police Department Lt. Michael Johnson said in August 2016.

    Hardy is set to go on trial on April 6, 2020.

    Madison County postpones all capital murder trials scheduled in 2020

    MADISON COUNTY, Ala. — Jury trials will resume in Madison County next month, but trials for some of the most heinous crimes charged, capital murder cases, will be on hold for the rest of the year.

    As officials at the Madison County Courthouse work to prevent the spread of COVID-19, limiting the number of people in the building and ensuring people are able to practice social distancing are top priorities, but it’s creating a challenge. There simply isn’t the space to conduct jury selection the way they could before.

    Jurors will now be legally qualified online instead of in-person. After that they will be randomly selected into a 30 person panel and notified when their panel needs to be at the courthouse.

    “I indicated to the judges that we simply could not try any capital murder cases this year, because you know, we have one courtroom we can get 30 people in for voir dire and jury selection. For capital murder you need three to four times that, minimum,” said presiding Judge Ruth Ann Hall.

    Because of that, Judge Hall says it could take four days to go through panels for a capital murder case.

    “The questions for the capital murder cases, it’s intense, and it takes a long time, and so you would have to bring 30 at a time. So, you’d have to bring four different panels,” the judge explained.

    According to District Attorney Rob Broussard at least three capital murder cases were set to be tried in 2020.

    The first death penalty case on the 2020 calendar involved Warren Hardy, charged with killing 72-year-old Kathleen Lundy, of Huntsville, during a crime spree in August 2016.

    Trials were also set for Rhonda Carlson and Christopher Henderson, a husband and wife accused of murdering a family in New Market and setting their house on fire.

    Judge Hall says she knows this decision means those defendants will continue to sit in jail and victims’ families will have a longer wait. But very little in 2020 has gone as planned.

    Madison County jury summons were put in the mail last week. Judge Halls says she expects people will begin receiving them in their mail box in the next few days. Jury trials will begin October 19th.

    Madison County judge goes into quarantine, capital murder hearing postponed

    MADISON COUNTY, Ala. – Warren Hardy, a former Huntsville City Schools bus driver accused of carjacking and murdering a 72-year-old woman after kidnapping three other people, was set for a status conference Tuesday morning.

    The hearing was called to set trial date for Hardy after more than 4 years in the Madison County Jail.

    But now he will have to wait a little longer.

    Sunday a continuance was filed on behalf of Madison County Judge Chris Comer. The judge presiding over hardy’s case, citing he had been exposed to COVID-19.

    News 19 reached out to Madison County Presiding Judge Ruth Ann Hall to see if any other court staff or operations had been affected by the exposure.

    She mentioned the probate judge’s office closed last week and reopened Monday. But Judge Hall said no court staff have been affected, other than Judge Comer, so far.

    More commonly, Judge Hall said the courts have been dealing with lawyers who get exposed to the virus or become ill and have to reschedule.

    She says lawyers have been good about notifying her when they are sick or have been exposed well ahead of hearings.

    As for the future of Hardy’s status conference, the filing states in the event an emergency issue comes up Judge Comer will work remotely and conduct virtual hearings until his quarantine period ends.

    Hardy’s hearing is not considered an emergency issue by the court.

    Former Alabama school bus driver in court on murder charges

    MADISON COUNTY, Ala. (WHNT) – Warren Hardy, a former bus driver for the company who had been contracted with Huntsville City Schools, is set to appear in court on charges of carjacking and murdering a 72-year-old woman after kidnapping three other people.

    Madison County Circuit Judge Chris Comer called the hearing for Hardy, who has now been in the Madison County Jail for more than four years.

    Judge Comer advised both the District Attorney’s Office and Hardy’s attorneys to reach an agreement on a juror questionnaire before today’s meeting.

    Authorities say the shooting happened in the middle of what they called a “crime spree.” Court documents say the incident happened just days after Hardy’s ex-girlfriend filed a protection order against him.

    In the hours before the shooting, Hardy allegedly kidnapped his ex-girlfriend’s daughter and step-father. Police say he forced them to drive to another residence across town to look for Hardy’s ex-girlfriend.

    Authorities say when Hardy found her, he forced her into the car at gunpoint, but her stepfather was able to drive away before Hardy could get back into the car. That’s when he approached the victim, Kathleen Lundy.

    Police say she was leaving her house when Hardy demanded her car keys, shot her, then stole her car.

    They say he then caught up to the car his ex-girlfriend and her family were in and fired shots into it, but the three were able to get away.

    Hardy then fled to Tennessee where he was caught 2 days later.

    Judge Comer did deny the defense’s motion to prohibit the State from seeking the death penalty against Hardy.

    The capital murder trial for Hardy is set to begin in April.

    I wonder what the longest time is in custody awaiting trial. This guy has been locked up more than 5 years AND he confessed to the crimes! I realize COVID slowed everything to a crawl, but....
    For some crimes committed by some people, death is the only just punishment

    Lucky Ward spent 10 years waiting for trial before his death sentences. Ward was charged with two murders in 2010 but didn’t go trial til 2020

    Also in Ohio, a man named John Deloney has been waiting for his death penalty trial since 2013, and he was caught of CCTV committing the murder

    Man accused of killing 72-year-old, kidnapping 3 others set to go on trial Monday

    HUNTSVILLE, Ala. – Warren Hardy has remained in the custody of the Madison County Jail since his 2016 arrest. More than five years later he maintains his innocence as he heads to trial.

    Hardy’s defense team filed a number of motions ahead of a status hearing Wednesday afternoon.

    The defense filed a motion to dismiss one count of the indictment ahead of trial. The indictment alleges Hardy willfully violated a protection order. His attorneys argued Hardy hadn’t been served and did not know about a protection order therefore he could not have violated it.

    Judge Comer denied the motion.

    The defense filed a separate motion in an effort to prevent a 9-1-1 call from the victim’s husband from being played during the trial. Hardy’s attorneys said the victim’s husband relaying the information on the stand during the trial will suffice, and that playing the recording will only distract the jury from the facts of the case.

    Judge Comer said he will make a decision on that request Monday.

    There was a motion for pre-approval of extraordinary expenses for clothes for Hardy to wear to trial. Judge Comer approved $500 for clothing.

    The Madison County District Attorney’s Office is seeking the death penalty in this case. Hardy is accused of killing 72-year-old Kathleen Lundy.

    Court documents show Hardy’s ex-girlfriend filed for a protection order two days before the shooting. It was granted the same day, with a hearing set for the next week.

    Huntsville Police say Hardy kidnapped her daughter and stepfather from her apartment and forced them to drive to Morland Pointe, where the shooting happened. Police say Hardy forced his ex into the car at gunpoint when the stepfather managed to drive away.

    According to the police, Hardy then found Lundy leaving the residence, demanded her keys, and shot her to death before driving away in her car. He caught up to his ex-girlfriend’s car and fired multiple shots into it. He fled to Tennessee.

    Jury selection is scheduled to begin Monday morning. The jury deciding Hardy’s fate will ultimately consist of 12 jurors as well as four alternates.

    Murder trial underway for man accused of killing Huntsville woman

    HUNTSVILLE, Ala. (WAFF) - The trial for a man accused of killing a woman during a crime spree in 2016 is underway.

    It’s been almost six years since Warren Hardy allegedly killed a Huntsville woman, kidnapped two other people at gunpoint and tried to abduct a third. He was set to go to trial in 2020, but the pandemic put his trial on hold.

    Right before today’s jury selection, Hardy’s attorney’s filed several motions that upset Judge Chris Comer. He says they had plenty of time to submit requests, especially in a case of this magnitude. If found guilty, Hardy could face the death penalty.

    Today WAFF 48 learned Hardy’s attorneys do not want his domestic violence history to be brought up in this trial. They also don’t want all 12 minutes of the 911 recordings on the day in question to be played for the jury. Madison County District Attorney Tim Gann agreed to only use the first 38 seconds of the 911 call.

    “By addressing those issues in the beginning you certainly hope that will make the trial process go a little bit smoother for everyone involved and hopefully make it easier for the jury to follow along with all of the evidence that’s going to be presented to them,” said Larry Marsili.

    Jury selection started on March 4 at 10 a.m. Hardy came face to face with 80 potential jurors. The group will get smaller as the week goes on.

    “Just because of the magnitude of the case, and really COVID, it’s going to take us all week to get this jury. We should have a jury by Thursday night and start the actual case, start evidence on Friday,” said Tim Gann.

    According to Huntsville police, Hardy kidnapped his ex-girlfriend’s daughter and her stepfather at gunpoint. Police say he killed 72-year-old Kathy Lundy, stole her car, and chased the kidnapping victims, firing shots along the way.

    The judge and attorneys say a verdict could be reached by April 15. Tomorrow the attorneys who you heard from will meet and continue to narrow down the jury.

    Opening statements went into an emotional testimony in a high profile capital murder trial.

    Warren Hardy is accused of killing NASA retiree Kathleen Lunch during a violent chase of his ex-girlfriend in 2016.

    Right off the bat, before opening statements even got under way, the defense team stated a racial discrepancy in the selected jurors.

    Everyone in the panel is white, Warren Hardy, the defendant is black.

    Hardy's defense team, brought that point up to Judge Chris Comer.

    Judge Comer said he noted the motion and is aware, but overruled the challenge of the defense.

    During opening statements, the state outlined the day of August 26, 2016. A day where the state said NASA retiree, Kathleen Lundy, was heading out to a neighborhood cookout.

    The state walked through the course of the day. They said Lundy was shot and killed by Hardy.

    The state also dove into Hardy's relationship with a woman named Jessica.

    The couple dated from 2014 to 2016 before the state said Jessica started seeing behavioral changes in Hardy.

    Later on, the state said Jessica obtained a protection of abuse order.

    That didn't stop Hardy from getting to get. The state mapping out several attempts in which Hardy did everything he could to get to her.

    One of those scenarios ultimately lead Hardy to the Lundy's porch on August 26, 2016.

    Prosecutors said in rage, Hardy approached Kathleen Lundy's husband, Rusty, for car keys. While Rusty went to get Hardy the keys, his wife was shot and killed.

    Now the defense on the other hand spoke to the jury asking them to be mindful of conflicting testimonies during the trial.

    They referred to it as an "unusual case" and asked the jury to listen closely.

    The State want Hardy to be found guilty of all the charges against him.

    The Defense said the state will fail once all the evidence is in front of the jurors.

    After opening statements, the first witness took to the stand. Rusty Lundy, Kathleen Lundy's husband fought back tears as he gave his testimony.

    His story mirroring the states opening statements.

    The trial will resume on Monday.
