    State to seek death penalty in trio's trials

    HOT SPRINGS -- Prosecutors indicated Monday they plan to seek the death penalty for a man and two women charged with capital murder in the death of a 58-year-old Hot Springs woman Friday.

    Dillon Wayne Orrell, 31, April Nicole Osborne, 23, and Isabelle Marie Marcial, 18, all of Hot Springs, appeared Monday via video in Garland County District Court and pleaded innocent to capital murder in the death of Laura Ann Dickerson, who was found dead at her residence at 208 Linwood St.

    Capital murder is punishable by the death penalty or life in prison.

    All three also pleaded innocent to a felony charge of aggravated residential burglary, punishable by up to life in prison. Orrell and Osborne also pleaded innocent to a felony charge of theft by receiving more than $2,500, punishable by up to 10 years in prison, involving the theft of the victim's car. Marcial was not charged with the theft count.

    Judge Ralph Ohm set each of their bails at $500,000 during Monday's hearing. A felony review hearing is set for Nov. 25 to determine if the charges will be bound over to Garland County Circuit Court.

    Ohm also issued a gag order limiting pretrial publicity in the case. Prosecutors filed a motion to file the affidavit in the case under seal, which was granted, so no details of the homicide have been made public.

    In a news release Saturday, Hot Springs police said the victim's murder was "not a random act" and was related to the theft of the car. The release stated that officers who responded Friday to the Linwood Street residence in reference to a welfare check found Dickerson dead inside.

    Mental evaluations ordered for murder suspects

    Mental evaluations have been ordered for two of three suspects charged with capital murder and facing the death penalty for their role in the death of a Hot Springs woman last year.

    Chief Deputy Prosecutor Kara Petro filed a motion Monday in Garland County Circuit Court for a mental evaluation to be conducted on April Nicole Osborne, 23, of Hot Springs, who was allegedly involved in the murder of Laura Ann Dickerson, 58, who was found dead inside her residence on Oct. 18, 2019.

    Osborne was arrested the next day along with Isabelle Marcial-Talley, 18, and Dillon Wayne Orrell, 31, both of Hot Springs. Each was charged with capital murder, punishable by death or life in prison, and aggravated residential burglary, punishable by up to life in prison.

    Osborne and Orrell were also charged with a felony count of theft of property over $1,000, punishable by up to six years in prison, for allegedly stealing Dickerson's car during the incident. Marcial-Talley was not charged in the theft.

    On Oct. 21, the state indicated it would seek the death penalty against all three suspects in the case.

    Marcial-Talley's attorney, William James Jr., of Little Rock, had filed a motion for a mental evaluation on behalf of his client on Feb. 19. A hearing to determine fitness to proceed is set for Aug. 17 for Osborne and Aug. 18 for Marcial-Talley.

    Osborne and Orrell had each pleaded not guilty to the charges against them on Nov. 1 in circuit court while Marcial-Talley pleaded not guilty to her charges on Nov. 5. All three have remained in custody in lieu of $500,000 bond since their arrests.

    The cases against all three were ordered sealed, initially by Garland County District Court Judge Ralph Ohm on Oct. 21, and later by Garland County Circuit Court Judge Marcia Hearnsberger on Oct. 24 after the cases were bound over. A gag order was also issued in the case to limit pretrial publicity.

    In a news release issued Oct. 19, the day of the suspects' arrest, Hot Springs police said the victim's murder was "not a random act" and was related to the theft of the car. The release stated officers who responded Oct. 18 to the Linwood Street residence in reference to a welfare check found Dickerson dead inside.

    "It was also noted that Dickerson's car was missing," the release said. The investigation later determined Orrell, Osborne and Marcial were involved in the homicide.

    "It appears that the victim and suspects knew each other and that this was not a random act. The case is still under investigation," the release said.

    Woman pleads guilty to murder, robbery; gets 60-year sentence

    The second of three suspects charged in the 2019 murder and robbery of a Hot Springs woman was sentenced to a total of 60 years in prison Wednesday after pleading guilty in Garland County Circuit Court.

    April Nicole Osborne, 26, of Hot Springs, pleaded guilty to one count of first-degree murder, amended from an original charge of capital murder, and was sentenced to 40 years in prison. She was also sentenced to 20 years on one count of aggravated robbery.

    The two sentences will run consecutively, for a total of 60 years, for the Oct. 18, 2019, murder of Laura Ann Dickerson, 58, who was found dead in her home at 208 Linwood St.

    One accomplice, Isabelle Marcial-Talley, 2o, also of Hot Springs, had pleaded guilty to the same charges in April and was sentenced to 40 years for first-degree murder and 10 years for aggravated robbery, to run consecutively for a total of 50 years in prison.

    Chief Deputy Prosecutor Kara Petro said Thursday both will have to serve 70% of their sentences before they are eligible for parole, so Osborne will have to serve at least 42 years and Marcial-Talley will have to serve at least 35 years, so "it's effectively life" for them.

    Petro noted neither Osborne nor Marcial-Talley had any prior criminal history. She said the original charge of capital murder was amended because the circumstances didn't qualify it for the death penalty, so it would automatically be a penalty of life in prison, which neither Osborne nor Marcial-Talley would have agreed to in a plea.

    A third accomplice, Dillon Wayne Orrell, 33, of Hot Springs, is still facing trial on the original charges of capital murder and aggravated robbery. Petro noted a gag order limiting pretrial publicity previously issued in the case still remains in place until after the trial of Orrell, so she was limited in what she could say about the plea negotiations or the case itself.

    Osborne, Marcial-Talley and Orrell were all arrested on Oct. 19, 2019, the day after Dickerson was found, and each has remained in custody since then in lieu of a $500,000 bond.     Last suspect in 2019 homicide sentenced to 28 years

    The last of three suspects charged in the 2019 stabbing and beating death, and robbery, of a Hot Springs woman was sentenced to 28 years in prison after pleading guilty Thursday in Garland County Circuit Court.

    Dillon Wayne Orrell, 34, of Hot Springs, who has remained in custody since his arrest on Oct. 19, 2019, pleaded guilty to first-degree murder in the death of Laura Ann Dickinson, 58, who was found dead in her home at 208 Linwood St. on Oct. 18, 2019. An additional charge of aggravated robbery was withdrawn.

    Chief Deputy Prosecutor Kara Petro said Thursday Orrell will have to serve his 28-year sentence "day for day" because he was previously convicted of a felony count of residential burglary, which qualifies as a violent offense.

    One accomplice, April Nicole Osborne, 26, of Hot Springs, pleaded guilty on Oct. 5 to first-degree murder and was sentenced to 40 years in prison. She was also sentenced to 20 years on one count of aggravated robbery. The two sentences will run consecutively, for a total of 60 years and she will have to serve 70%, or 42 years, before she is eligible for parole.

    A second accomplice, Isabelle Marcial-Talley, 20, also of Hot Springs, had pleaded guilty to the same charges in April and was sentenced to 40 years for first-degree murder and 10 years for aggravated robbery, to run consecutively for a total of 50 years in prison and will have to serve at least 35 years before she's eligible for parole.

    Petro said neither Osborne nor Marcial-Talley had any prior criminal history. All three were originally charged with capital murder, but she amended the charge to first-degree murder for Osborne and Marcia-Talley because they didn't qualify under the law for the death penalty because mental evaluations determined they both had low IQs.

    She said Thursday she amended Orrell's charge as well because he was less involved in the actual attack on Dickinson and Marcial-Talley's sentence was less than Osborne's because she had agreed to testify against the others if they went to trial.

    Petro noted she consulted with the victim's family before each of the plea deals.

    Osborne, Marcial-Talley and Orrell were all arrested on Oct. 19, 2019, and each has remained in custody since then in lieu of a $500,000 bond. Mental evaluations were later ordered for both Osborne and Marcial-Talley, but both were found fit to proceed, leading to their eventual guilty pleas.

    The probable cause affidavit, which has been sealed by court order for over three years, was obtained by The Sentinel-Record on Thursday, providing the first details of Dickinson's death.

    On Oct. 18, 2019, Hot Springs police responded to 208 Linwood Ave. regarding a welfare check and found a white female, later identified as Dickinson, deceased on the bathroom floor with "numerous wounds" as the result of a battery and stabbing.

    It was later discovered the victim's vehicle, a silver 2009 Ford Fusion, valued at $3,646, was missing. Witnesses provided information that Orrell and Osborne had taken the car and were seen driving it in Hot Springs.

    Warrants for theft by receiving for Orrell and Osborne were issued and they were subsequently arrested. While at the police department, Osborne admitted she, Orrell and Marcial-Talley had gone to the Linwood residence "to confront" Dickinson, but she would not allow them inside.

    Osborne said they forced their way inside and then they "began physically battering her which eventually resulted in her death." She said they searched through Dickinson's residence "looking for her car keys and purse" after beating her and after locating the purse and keys they left in her vehicle.

    Orrell also admitted to being involved in the incident, the affidavit states. He told police Osborne and Marcial-Talley forced their way inside the residence and began beating Dickinson. He admitted to entering the residence and "observing the battery" and to looking for the keys and leaving in Dickinson's car.

    According to court records, Orrell was convicted of residential burglary in Garland County in 2009, and sentenced to six years' probation. He was convicted again in 2010 of possession of a firearm by certain persons and sentenced to five years in prison and again in 2013 of theft by receiving over $5,000 and sentenced to eight years in prison but was later paroled.
