    An Ohio detective is on life support in “grave” condition after being shot while serving a drug-related warrant, authorities said on Tuesday.

    Dayton police Chief Richard Biehl told reporters that Jorge DelRio, a 30 year veteran of the department, was shot twice in the face on Monday while working with a Drug Enforcement Administration (DEA) task force.

    “DelRio is currently on advanced life support at the hospital and his condition is considered grave,” The Dayton Police Department tweeted on Tuesday.

    “Please keep Det. DelRio and his family in your prayers along with this department and this community,” Biehl said.

    Detectives knocked and announced themselves as law enforcement officers before entering a home on Ruskin Rd. just before 7 p.m. on Monday, Dayton police said, adding that DelRio was shot as he started to go down basement stairs. He was rushed to a local hospital by a fellow officer due to the severity of the injuries, police tweeted.

    No other injuries were reported.

    Police said four adults and one juvenile were “secured at the scene” and that the adults are being held on felony drug charges.

    Three weapons, each with 30-round magazines, were recovered at the scene, as well as a significant amount of cash, fentanyl and marijuana, investigators said.

    “The shooting of this officer is an assault on our community and will not be tolerated,” Montgomery County Prosecutor Mat Heck said.

    U.S. Attorney Dave DeVillers said the suspected shooter, Nathan Goddard, 39, was charged with felonious assault on an agent. Federal authorities said two other men have been charged with conspiring to distribute drugs including fentanyl.

    Cahke Cortner, 39, and Lionel Combs III, 40, were charged with conspiring to distribute drugs, Fox 19, reported, citing an affidavit. A fourth man, Courtney Allen, 34, was also in custody in relation to the shooting, the station reported.

    Between July and October, the DEA’s Dayton resident office reportedly conducted an investigation on a Dayton fentanyl operation leading them to believe that Goddard was a supplier. Police conducted a search warrant on the home on Monday night and that is when DelRio was shot.

    Why was a detective serving a warrant?
    Violence and death seem to be the only answers that some people understand.

    Dayton detective shot: Injuries ‘not survivable,’ organs will be donated

    DAYTON — Dayton Police Detective Jorge DelRio remains in grave condition; however, his injuries are “not survivable,” according to Dayton Police Chief Richard Biehl.

    “After a life of dedicated public service, Jorge will continue to give of himself to the greater community by being an organ donor upon his death,” Biehl said in an updated media release Wednesday afternoon.

    DelRio remains on advanced life-support at this time, Biehl said.

    DelRio was shot Monday night while executing a drug-related search warrant at a house on Ruskin Road in Dayton.

    Four people have been arrested on charges connected to the initial drug bust and the shooting of DelRio.

    Nathan S. Goddard Jr., 39, is accused of firing the shots that critically injured DelRio, according to police and federal investigators.

    An Ohio detective who was shot twice in the face while serving a drug-related warrant on Monday has died, police said Thursday.

    "We are heartbroken to announce the passing of Det. Jorge Del Rio who succumbed to a line of duty injury today," the Dayton Police Department tweeted.

    "Earlier today at Grandview Hospital, Det. Del Rio acted to save lives through the generous gift of organ donation."

    Del Rio, a 30-year veteran of the department, was shot while working with a Drug Enforcement Administration (DEA) task force, Police Chief Richard Biehl had said.

    3 men face death penalty in killing of Dayton detective

    A grand jury has indicted three men prosecutors say were involved in the killing of a Datyon police detective on charges that could lead to the death penalty.

    The indictments were handed down Thursday in federal court in Dayton, a day after a Butler County man was charged with lying on a federal firearms form so he could illegally buy the gun used to kill Detective Jorge DelRio.

    The man accused of shooting DelRio, 39-year-old Nathan Goddard Jr., faces nine counts, including: deliberately killing DelRio; discharging a gun resulting in death in relation to a drug-trafficking crime; and conspiracy to distribute fentanyl, marijuana and cocaine.

    Cahke Cortner, 39, and Lionel Combs III, 40, are each charged with five counts, including the same gun charge Goddard faces.

    Combs also is charged with maintaining a drug house and with carrying a firearm in relation to a drug-trafficking crime.

    All three men face the death penalty, if convicted.

    On Nov. 4, DelRio was working as part of a federal Drug Enforcement Agency task force when he was shot in the face after entering a home on Rustic Road Dayton. He died days later.

    DEA's Dayton office had identified Goddard as an alleged source of narcotics, officials said, which led to the raid.

    At about 6:50 p.m., officers announced themselves and entered the home. DelRio was going down the basement stairs when he was shot, officials said.

    According to investigators, three guns, including two FN pistols that were loaded with armor-piercing ammunition and equipped with laser sights, were inside the home. The FN Five-SeveN pistol was dubbed a “cop killer" more than a decade ago by the Brady Campaign. The third gun was an AR-15-style rifle.

    In a news release Thursday, U.S. Attorney David DeVillers said authorities also found 10 kilograms of suspected fentanyl, containers with 50 to 60 pounds of marijuana. About $11,000 in cash was spread out on a coffee table, and more than $40,000 was inside a duffel bag in a storage area, DeVillers said.

    Suspect in Dayton police detective’s death wants separate trial

    Cahke Cortner Sr. requested that he go before a jury by himself instead of with Nathan Goddard and Lionel Combs III. The three are accused of participating in a drug conspiracy that led to the shooting death of DEA Task Force Officer and Dayton Det. Del Rio.

    Federal prosecutors have filed a response asking the court to keep the co-defendants together during trial.

    “Each count of the indictment arises from the same set of factual circumstances discussed with respect to the conspiracy charge and will require substantial overlapping proof,” the prosecutor’s response says. “Further, the interconnectedness of the charges clearly appears on the face of the indictment.”

    Del Rio was shot in the face during a drug raid at a home on Ruskin Road in November. All 3 men could face the death penalty if convicted, however, in the motion filed by defense attorney Dennis Lieberman, he says it is believed that Goddard will be the only defendant who will face the possibility of the harshest penalty.

    Goddard is accused of pulling the trigger and shooting Del Rio.

    “If there is a trial in which all 3 defendants participate, and only defendant Goddard is charged with death, then defendant Cortner will be severely prejudiced,” the motion says.

    U.S. prosecutors said in their response that they haven’t made any decisions about who will or will not face the death penalty in the case.

    The motion says Cortner’s right to a speedy trial would be infringed because he will have to wait a long period of time to try his case because death penalty cases move slower through the justice system. Prosecutors rebutted by saying that the case has already been deemed complex by the judge, meaning both sides need an extended period of time to prepare for trial.

    The defense motion also argues that the jury itself wouldn’t be ideal for Cortner.

    “In death cases, a defense team’s primary concern is a jury that can accept mitigation,” the motion says. “An attorney representing defendant Cortner will be primarily concerned about a jury that can listen to arguments relating to culpability. The 2 theories sometimes choose the same juror but oftentimes conflict. The Government will be focused on finding jurors that can accept death. Such jurors are often more likely to convict which will impact Mr. Cortner.”

    Prosecutors disagreed, saying courts have held that defendant’s rights are not violated by having their case heard in front of a death penalty qualified jury.

    There was no timeline presented for when a decision will be made.

    Death penalty will not be sought in Dayton detective DelRio’s shooting death

    The man accused of shooting and killing Dayton Police Detective and DEA Task Force Officer Jorge DelRio will not face the death penalty in his federal criminal case, according to court documents filed Friday.

    U.S. Attorney General Merrick Garland wrote in a letter filed in the case that prosecutors “are authorized and directed not to seek the death penalty against Nathan Goddard.”

    “The United States hereby notifies the court and defendant Nathan Goddard that the United States will not seek a sentence of death against Nathan Goddard for the charges contained in the indictment,” the court document says.

    The decision not to seek the death penalty wasn’t explained in the court records. Goddard’s defense attorney, Donald Malarcik, released a statement Friday afternoon.

    “We are grateful that the attorney general decided not to pursue death. Mr. Goddard believed he was the victim of a home invasion and never intended to harm Detective DelRio,” Malarcik told the Dayton Daily News.

    Goddard, Cahke Cortner and Lionel Combs III are charged in connection with the death of DelRio. The three are accused of participating in a drug conspiracy that led to DelRio’s shooting death in a raid in November 2019.

    Prosecutors previously said they will not seek the death penalty against Cortner nor Combs.

    DelRio was shot twice while serving a drug-related warrant at a home on Ruskin Avenue on Nov. 4, 2019, as part of Drug Enforcement Administration ask force in Dayton. Police said DelRio was walking down steps when he was shot twice in the face. DelRio died on Nov. 7, 2019.

    The decision was supposed to be made earlier this year, but due to the coronavirus pandemic, it was pushed back. Defense attorneys noted they needed more time to gather mitigating evidence to present to the government as to why they should not seek the death penalty.

    That was finished and submitted in May, court records say. Friday was the court-ordered deadline for the government to decide whether to pursue the punishment.

    The decision not to seek the death penalty was also made on the same week that DelRio was honored for the first time at the Montgomery County Annual Law Enforcement Memorial Ceremony. The ceremony was held Monday and Del Rio’s name was read among 39 other Montgomery County Law Enforcement officers who have died in the line of duty.

    Also on Friday, the Ohio Narcotics Association Regional Coordinating Officers named its Valor Award after DelRio. DelRio was posthumously given the 2021 Valor Award.

    A next court date in Goddard’s, Combs’ and Cortner’s case wasn’t listed on the docket Friday afternoon. The three remain in custody.
